    Introduction

    Inter – Municipal Cooperation (IMC) refers to two or more neighboring municipalities

    working together to perform municipal administrative duties, provide public services

    to citizens and promote local development more efficiently and effectively than through

    their isolated action.  1

     The Association of Kosovo Municipalities (AKM) analyzed thecurrent situation of the Inter-municipal Cooperation (IMC) in Kosovo and its future

    prospect. This study sets out the needs and priorities regarding the formation of IMC-s,

    and challenges. The AKM aims to increase IMC ‘s between Kosovo’s municipalities.

    AKM’s study focuses on five areas of service delivery:

      Forestry

      Environment

      Waste Management

      Fire Department

      Inspection

    For the needs of this study, AKM analyzed the situation in 15 municipalities of Kosova

    by interviewing majors, and on some occasions the directors of public services.

    The parent municipalities such as Prishtina/Priština were chosen based on theirproximity to newly established municipalities, in this case, Graçanica/Gračanica . The

    municipality of Prizren/Prizren may have IMC with two newly established

    municipalities, Mamush /Mamuša and Dragash/Dragaš.

    Association of Kosovo Municipalities estimates that this report will assist the process of

    IMC-s in Kosovo at a level in which cooperation between municipalities should be seen

    as a real opportunity to provide better services to citizens and as well lower costs for

    municipal services.

    Executive Summary

    Previous practices in the field of inter-municipal cooperation in Kosovo have shown a

    slow growth trend. IMC's in Kosovo are few and dysfunctional in providing mutual

    services to citizens and reducing municipal costs. Mainly municipalities cooperate witheach other in specific cases, though such cooperation is not formal (contract, agreement

    of understanding).

    Inter-municipal cooperation in Kosovo has been developed within the Private Owned

    Enterprises, whose boards are composed of representatives appointed by the

    municipalities. Additional segments in which the municipalities cooperate among each

    other are the Regional Development Agencies in which municipalities work together in

    order to create better economic opportunities. 2 The role of RDA’s is that in cooperation

    with businesses and other relevant stakeholders to promote regional development.However, even in these agencies municipalities have compiled individual projects

    rather than projects that develop the region in general.

    In terms of IMC-s, between two or more municipalities outside these institutions

    mentioned above, the study has shown that initiatives lack and these initiatives are not

    in a satisfactory level (although there is a need and possibility for cooperation).

    Moreover, it is of particular importance the fact of several memorandums of

    understanding being signed amongst the parent municipalities and just created

    municipalities as a result of decentralization, in which case the parent municipalitieshave been obliged to offer their help in raising capacities of new municipalities (i.e.

    Prishtina/Priština-Graçanica, Prizren/Prizren-Mamush /Mamuša, etc.).

    Through these agreements, parent municipalities offered their experience in preparing

    the staff of new municipalities, but also have provided services to the newly created

    municipalities (cadastre services, fire services, etc.).

    Legal framework for the Establishment of IMC-s in Kosovo

    The legal framework applicable in Kosovo specifies explicitly the inter-municipal

    cooperation, referring to a real possibility of cooperation between municipalities in

    Kosovo. Consequently, Kosovo Constitution specifies the inter-municipal cooperation,

    stressing: "Municipalities have the right to inter-municipal cooperation and cross-border cooperation, in accordance with the law.”3  Clearly, the legal basis of the IMC

    formation is foreseen with the highest law of the Kosovo state, the constitution.

    Furthermore, the Law on Local Self-Government in Chapter V regarding Inter-

    municipal Cooperation and Inter-municipal Arrangements specifies the right of

    municipalities to cooperate emphasizing "municipalities shall be entitled to cooperate

    and form partnerships with other Kosovar municipalities to earn out functions of

    mutual interest, in accordance with the principles of the European Charter of Local Self

    Government and in accordance with the law.4 

    Basics of IMC-s are also cited in Ahtisaari's Comprehensive Proposal, stating that

    “Municipal responsibilities in the areas of their own and extended competencies may be

    exercised through municipal partnerships, with the exception of the exercise of

    fundamental municipal authorities, such as election of municipal organs and

    appointment of municipal officials, municipal budgeting, and the adoption of

    regulatory acts enforceable on citizens in general.5

    Assessment of Inter-Municipal Cooperation

    Prishtina/Priština - Graçanica/Gračanica

    Prishtina/Priština, as the capital city of Kosova, has all the prerequisites for being themunicipality with the largest capacity in the area of public services. For this reason,

    AKM has analyzed the situation of the municipality of Prishtina/Priština in relation to

    its cooperation with other municipalities. Based on the interview conducted with the

    Director of Public Services, Defense and Rescue in the municipality of

    Prishtina/Priština, municipality cooperates with several other municipalities; however

    there is no signed document that defines the cooperation. 

    Municipality of Prishtina/Priština collaborates with the municipality of Fushe Kosove/

    Kosovo Polje, Obiliq/Obilič  and Graçanica/Gračanica  in the sphere of organizing thetransport of passengers, since buses of the aforementioned municipalities operate

    simultaneously in the territory of these municipalities.6  In relations to

    Graçanica/Gračanica , Prishtina/Priština municipality had an active role in providing

    assistance for capacity building of the municipality, since based on an agreement

    Prishtina/Priština has transferred all cases to the newly created municipality.

    With the same municipality, Prishtina/Priština has reached an agreement for the receipt

    of all normative acts and permits issued by the municipality of Prishtina/Priština on

    March 30, 2010. This allows for each procedure completed, recognition by the

    municipality of Graçanica/Gračanica, whereas all cases that are still proceeding are

    transferred to the municipality of Graçanica/Gračanica. In addition, this memorandum

    includes the transfer of competencies, specifically the cadastre services, property taxes,

    archive, and urban planning7.

    In the field of emergency, particularly fire units, municipality of Prishtina/Priština

    cooperates with Graçanica/Gračanica and Fushe Kosove/ Kosovo Polje, since the units

    of Prishtina/Priština operate in the mentioned municipalities, but the agreement is not

    official. In the same area, Prishtina/Priština municipality cooperates with the

    municipality of Podujeva in which case Prishtina/Priština municipality has donated atruck as a contribution to daily operations.

    municipalities together with the Ministry of Internal Affairs, Economy and Finance, Local Administration, and the

    Kosovo Cadastre Agency.

    Municipality of Prishtina/Priština also has inter-municipal cooperation in the field of

    waste management and water supply through public companies in which neighboring

    municipalities are part of. The municipality of Prishtina/Priština is also part of the

    Regional Development Agency, (all other regional municipalities are part of the RDA as

    well.)

    Based on the interview, there is a willingness of the municipality of Prishtina/Priština

    to provide assistance to support the municipality of Graçanica/Gračanica   in all areas

    where collaboration is seen necessary by the newly created municipality.

    Graçanica/Gračanica 

    Given that the municipality of Graçanica/Gračanica  is a newly created municipality

    and capacities of this municipality are able to sustain the needs of the citizens.

    Graçanica/Gračanica municipality has signed a memorandum with the municipality of

    Prishtina/Priština, Fushe Kosove and Lipjan. This memorandum serves to obtain the

    database for current citizens of Graçanica/Gračanica.  8  Graçanica/Gračanica  

    municipality has also signed the agreement to be part of the Regional Development

    Agency, in which seven other municipalities of the region of Prishtina/Priština are

    already part of. Areas, in which Graçanica/Gračanica  sees a real possibility for the

    creation of IMC-s, is the field of Tourism and Cultural Heritage, in which case strategy

    and its promotion would be created. Also at the current moment, the municipality of

    Graçanica/Gračanica   has problems in the area of the inspectorate, in particular

    construction inspectorate, which is seen as an opportunity for inter-municipal

    cooperation.

    During this study AKM has learnt that the directors of various departments in the

    municipality of Graçanica/Gračanica   have close cooperation with the directors of

    various departments of Prishtina/Priština, Lipjan/Lipljan and Fushe Kosove/Kosovo

    Polje for knowledge and assistance for new regulations, although that this cooperation

    is based on consensus rather than formal agreement.

    Gjilan/Gnjilane – Novobërda /Novo Brdo

    Gji lan/ Gnji lane

    Municipality of Gjilan/Gnjilane is located in the southeastern part of Kosovo andborders all the municipalities that are subject to this study: Viti/Vitina , Kamenicë/Kamenica, and Ranillug/Ranilug and Partesh/Parteš. With the process ofdecentralization from the municipality of Gjilan/Gnjilane two new municipalities haveemerged, Partesh/Parteš  and Ranillug/Ranilug. At the current stage, the role of themunicipality of Gjilan/Gnjilane providing assistance in these two municipalities hasbeen enormous in the technical aspect as well as in the process of transferring cases inthese municipalities.

    Considering that from the municipality of Gjilan/Gnjilane, a few villages have beentransferred to the municipality of Novobërda/Novo Brdo, Gjilan/Gnjilane municipalityfor a certain period of time has provided services to these citizens, whereas now theyare in mutual discussions on the transfer of materials and databases to the municipalityof Novobërda/Novo Brdo.9  However, considering that Gjilan/Gnjilane municipalitypossesses greater professional capacities, as such it was "obliged" to offer its expertise tothe newly created municipalities in some of the services provided to citizens.

    According to the deputy mayor of Gjilan/Gnjilane, in terms of environmentalprotection all regional municipalities lack human capacity. Therefore, in this area jointforces and creations of joint projects should be imperative. In regards to the Departmentof Urbanism and Environmental Protection, currently there is only one officer, while the

    municipality of Gjilan/Gnjilane is looking into the possibility of making it a sector of itsown so that the environmental protection becomes more efficient.

    Waste management in this region is done through the joint system of the regionalcompany. According to the deputy mayor in this segment, municipality doesn’t havemany complaints. Considering the level of payment to citizens, the company is doing agood job (meaning low rate of payments – frequent pick-ups of waste). In relation tonon-inclusion of Novobërda/Novo Brdo municipality in the waste managementsystem, the deputy mayor of the municipality of Gjilan/Gnjilane stated that he isunaware of this fact.

    Municipality of Gjilan/Gnjilane, respectively Department for Agriculture is analyzingthe situation of transferring responsibilities to protect the forests and it is expected thatafter the analysis a determination will be reached on how forests will be protected.Nevertheless, the deputy mayor considers important the fact that in this area

    municipality of Gjilan/Gnjilane is available to cooperate with other municipalities tobetter protect forests, evaluating forests as valuable municipal-wealth.

    In the sector of inspectorate, according to the deputy mayor, is one of the sectors wherecooperation with the municipality of Gjilan/Gnjilane should be done since the borderswith the municipality of Novobërda/Novo Brdo are already very close, while the

    capacity of the municipality of Novobërda/Novo Brdo based on construction inspectorsis not satisfactory. In this case, the municipalities of Gjilan/Gnjilane through itsconstruction inspectors it is monitoring the situation in these parts in order not to allowillegal constructions, which then would present problems.

    In the emergency sector, considering that it is not at a satisfactory level throughout allmunicipalities of the region, deputy mayor considers it a real opportunity forcooperation aiming to offer quicker emergency services. However, there were someinter-municipal cooperation in case of extinguishing fires, but this cooperation is notfunctional, as there is no formal chain of command and communication.

    Inter-municipal cooperation in the region was also conducted through the Regional

    Development Agency of the European Commission, where municipalities jointly have

    developed a regional strategy for economic development. From the interview

    conducted with the deputy major from the municipality of Gjilan/Gnjilane, AKM has

    estimated that this municipality is willing to cooperate in the proposed areas but also in

    other fields as culture, sport, education, etc.

    Municipality of Gjilan/Gnjilane besides commitments to the creation of inter-municipal

    partnerships it has also been active in the creation of trans-border cooperation or by

    signing partnerships with other municipalities (outside of Kosovo) Kukes (Albania),

    Luterbah (France) and Iper (Belgium).

    Novobërda / Novo Br do

    Municipality of Novobërda /Novo Brdo by the Ahtisaari package is extended from 92

    km² to 204 km². The decentralization process has given these municipality nine

    cadastral areas of the municipality of Gjilan/Gnjilane and 5 cadastral zones of the

    municipality of Kamenicë/Kamenica. According to the mayor, the municipality of

    Novobërda/Novo Brdo was not ready for such an expansion as it lacks the capacity to

    provide adequate services for the citizens of this city. 10 

    So far this municipality has not created any inter-municipal cooperation in the sphere of

    providing joint services with other municipalities, although the problems of the

    municipality are evident. One of the main problems in the municipality of

    Novobërda/Novo Brdo is the issue of waste management. This municipality is not a

    part of the regional company for waste management.  According to the Mayor of

    Novobërda/Novo Brdo, this municipality must realize IMC’s so that the waste issue is

    resolved.

    Another problem in which the municipality of Novobërda/Novo Brdo has expressed

    interest in establishing inter-municipal cooperation is for cadastre mapping. According

    to the mayor of Novobërda/Novo Brdo, a partnership with the municipality of

    Gjilan/Gnjilane should be established in order to create an office of professionals who

    would operate as required in the two municipalities.

    Also, another area in which it was noted that the municipality of Novobërda/Novo

    Brdo has problems is the issue of forest protection. With the signing of the

    memorandum of the municipality of Novobërda/Novo Brdo, protecting 10 thousand

    hectares of forests were transferred to this municipality. By this agreement the

    municipality has received some assets, two employees, a technician and a forestguard. Given the size of forestland, the number of existing guards presents a problem in

    itself. Therefore, the cooperation with the municipality of Gjilan/Gnjilane and

    Kamenicë/ Kamenica in this area is need.

    Given the surface growth of the municipality of Novobërda/Novo Brdo, another area

    that presents a problem is the issue of Inspectorate. Novobërda /Novo Brdo’s current

    capabilities are insufficient in this case; therefore this municipality is looking at the

    possibility of cooperating with the municipality of Gjilan/Gnjilane . Both municipalities

    have had meetings on this issue, but until now there has been nothing concrete.

    Novobërda /Novo Brdo, being a member of the Regional Development Agency-East, in

    collaboration with Ranillug/Ranilug and Kamenicë/ Kamenica, have applied for a joint

    project in the field of Tourism.

    Kaçanik/Kačanik – Han i Elezit

    Kaçanik/Kačanik

    Kaçanik/Kačanik municipality has had an active role during the creation of the new

    municipality of Hani i Elezit. An agreement was signed in order to build capacity for

    service provision to citizens. During this time, Kaçanik/Kačanik offered its assistance toall the requests that the municipality of Hani i Elezit/Elez Han had. Until recently,

    Kaçanik/Kačanik municipality has provided services for the municipality of Hani i

    Elezit/ Elez Han in the field of cadastre as well as emergency services, which continues

    to be delivered, but there is no formalized agreement.

    During this analysis, it was observed that the municipality of Kaçanik/Kačanik needs

    to create inter-municipal cooperation in the field of waste management and sewage, as

    waste water that flow into the river Nerodime in Ferizaj/Urosevac, passes through

    some villages of the municipality of Kaçanik/Kačanik . For sewage treatment, greatercooperation should be established between municipalities of Kaçanik/Kačanik, Ferizaj/

    Urosevac and Hani i Elezit/ Elez Han.

    Forest management became a problem in itself after the decentralization of powers in

    the sphere of forest protection, as the municipality will manage a large forest area

    (about 40 thousand hectare), with a very small number of workers (six guards and

    two technicians). In this segment cooperation with the municipality of Hani i Elezit/

    Elez Han is seen as a possible opportunity as it has a smaller forest area.

    Another segment in which an inter-municipal cooperation exists between themunicipality of Kaçanik/Kačanik and the municipality of Hani i Elezi is regarding the

    inspectorate service. Municipality of Hani i Elezit/ Elez Han has problems in

    organizing this type of service due to lack of capacity. Inspectors of the municipality of

    Kaçanik/Kačanik have offered their services (informal agreement) to the municipality

    of Hani i Elezit/ Elez Han in cases such as traffic inspector. 

    Municipality of Kaçanik/Kačanik is in negotiations with the municipality of Hani i

    Elezit/ Elez Han in order to co-finance several infrastructure projects linking the

    villages of the municipality of Kaçanik/Kačanik and that of Hani i Elezit/ ElezHan. During the analysis of inter-municipal cooperation in this municipality, the

    association has estimated that Kaçanik/Kačanik municipality is ready to establish

    IMC’s in areas such as waste management, wastewater, forest management and

    inspectorate.

    Hani i Elezit / Elez Han

    Capacity building of the municipality of Hani i Elezit/ Elez Han is accompanied by a

    large contribution of the municipality of Kaçanik/Kačanik. This contribution has come

    as a result of an agreement whereby Kaçanik/Kačanik municipality has offered its

    cooperation in all fields for the municipality of Hani i Elezit/ Elez Han. In an interview

    with analysts of AKM, the Mayor of Hani i Elezit/ Elez Han, Mr. Refki Suma, hasemphasized that the level of inter-municipal cooperation with the municipality of

    Kaçanik/Kačanik is excellent.11 

    Although the municipality of Hani i Elezi was established two years ago, the cadastre

    service and issuance of documents in this field has been done by the municipality of

    Kaçanik/Kačanik until recently. Since the cadastre service is already offered by the

    municipality of Hani i Elezit/ Elez Han, officials of the cadastre directorate of the

    municipality of Kaçanik/Kačanik have trained officials of the municipality of Hani i

    Elezit/ Elez Han and continue to offer cooperation in this field.

    The Civil Registration Office is not established in the municipality of Hani i Elezit/ Elez

    Han yet. This service is performed in the office of civil registration in Kaçanik/Kačanik 

    without any formal document to support these activities, and according to the mayor

    Suma this appears to be a big problem for citizens.

    Waste management is one of the most worrying issues in the municipality of Hani i

    Elezit/ Elez Han. Although being there is a regional waste management company,

    mayor Suma stated his disappointment with this waste management system, proposing

    that municipalities should have the right by legislation to create local companies forwaste management. According to him, the municipality of Hani i Elezit/ Elez Han has

    nothing in common with other municipalities in this regard. The only possible inter-

    municipal cooperation in terms of waste, mayor Suma sees the possibility of creating a

     joint dumpsite and the possibility of joint waste recycling.

    With the establishment of IMC-s, the mayor of Hani i Elezit/ Elez Han believes this is

    necessary since all municipalities of the region have limited capacities and collaborative

    efforts can protect the forests in the region. In this regard, there is an inter-municipal

    cooperation between the municipality of Hani i Elezit/ Elez Han and Kaçanik/Kačanik,but this cooperation is not official.

    One area in which the municipality of Hani i Elezit/ Elez Han closely cooperates with

    the municipality of Kaçanik/Kačanik is for the Fire Department. Although the

    municipality of Hani i Elezit/ Elez Han has established a Fire Brigade comprised of

    seven persons, yet this entity does not have adequate equipment therefore it is often

    dysfunctional. In this regard, Kaçanik/Kačanik firefighters operate in the area of Hani i

    Elezit/ Elez Han although these municipalities do not have a joint agreement to provide

    this service.

    Environmental protection is one of the areas in which the municipality of Hani i Elezi is

    looking at the possibility of cooperating with the municipality of Kaçanik/Kačanik .

    Respectively, an area of possible cooperation would be cleaning the river, since Hani i

    Elezit/ Elez Han is planning on building a factory and the maintenance of the river

    cleanliness should be imperative by the town of Kaçanik/Kačanik .

    In the sphere of inspectorate, the municipality of Kaçanik/Kačanik has highlighted

    problems, and based on what mayor Suma said, this field should have a formal regional

    agreement in order of control cases to have a better co-operation between municipal

    inspectors from Hani i Elezit/ Elez Han, Kaçanik/Kačanik and Ferizaj/Urosevac.

    Municipality of Hani i Elezit/ Elez Han is a member the Regional DevelopmentAgency, but so far hasn’t managed to attain a joint inter-municipal project.

    Prizren/Prizren – Mamush /Mamuša– Dragash/Dragaš 

    Pr izren/ Pr izren

    The municipality of Prizren/Prizren is located in the district of the six municipalities

    that lack capacity when it comes to providing services for their citizens.12  Having the

    municipality of Mamush /Mamuša and Dragash/Dragaš in the border, Prizren/Prizren

    is the most favorable cooperating municipality for these two municipalities. As in other

    regions, the most important cooperation of these six municipalities of Prizren/Prizren

    region is implemented within the Regional Development Agency-South, founded by

    the European Commission. Through this agency, municipalities discuss mutual

    interests and create projects that will help in the regional development.

    Municipality of Prizren/Prizren is implementing a project for roads linking the villages

    of Gjakova/Dakovica and Prizren/Prizren, which is co-financed by the municipalities

    of Prizren/Prizren and Gjakova/ Dakovica. Municipality of Prizren/Prizren has alsodeveloped another project regarding the development of tourism within which project

    the municipality of Dragash/Dragašis included. According to the mayor of

    Prizren/Prizren, Ramadan Muja, cooperation with the surrounding municipalities is

    necessary considering that a part of these towns beauty is included in the

    Prizren/Prizren area; therefore it is necessary to cooperate with these municipalities,

    especially for tourism. 

    Waste management is functional in the context of regional company, which includes all

    the municipalities of Prizren/Prizren region except the municipality of

    Dragash/Dragaš. Through the delegation of powers from central to local level

    forestland has been transferred, for which area the municipality of Prizren/Prizren sees

    no problem and is willing to cooperate with other municipalities in order to mobilize

    the forces and protect forests.

    Noting that the municipality of Mamush /Mamuša was created from the process of

    decentralization, the municipality of Prizren/Prizren has given its contribution towards

    management capacity building of the municipality of Mamush. It is also important to

    mention that the municipality of Prizren/Prizren has donated two fire trucks and has

    raised the capacity of workers in this sector.

    Municipality of Prizren/Prizren and municipality of Mamush /Mamuša collaborated in

    the area of cadastral service as well. Municipality of Prizren/Prizren has provided

    assistance within different measurements and requirements of the municipality of

    Mamush /Mamuša. In addition, an understanding cooperation was carried out, with no

    formal agreement.

    Within the capacity development of the field of inspectorate, municipality of

    Prizren/Prizren has offered its assistance to the new municipality of Mamush. Now

    officials of Prizren/Prizren municipality confirm that municipality of

    Mamush/Mamuša already has a functional service. Also there was interference of inter-

    municipal inspectors to stop using the gravel of the river Drin. Another important area

    of cooperation was organization of cultural and sport activities, since during different

    holidays municipalities organize joint activities.

    Municipality of Prizren/Prizren, seeing the capacity of other municipalities around is

    convinced that collaborations besides the above mentioned sectors may occur mostly in

    the sphere of co-financing infrastructure, roads connecting villages of Prizren/Prizren

    with other surrounding villages.

    In the context of European integration, the municipality of Prizren/Prizren is in the

    procedure of creating an office for EU integration. This office will be concentrated on

    adopting and harmonizing EU acts and will create activities which will contribute to the

    European integration.

    In the area of cross-border cooperation, the municipality of Prizren/Prizren

    collaborated with the municipality of Kukës. Through this cooperation municipalities

    provide and receive advices on joint work. Young people of Kukës study in the

    University of Education in Prizren/Prizren municipality because of its proximity to

    these two municipalities. It is expected from the University of Prizren/Prizren this year

    to have a greater number of students from the district of Kukës. Apart from thisinformal cooperation, the municipality of Prizren/Prizren is ‘twinned’ with the

    municipality of Ankara, Turkey, which has helped the municipality of Prizren/Prizren

    with a donation to build the city park. Also, this municipality is ‘twinned’ with a

    municipality of Istanbul and one from Bulgaria, and it expects in the near future to be

    ‘twinned’ with the municipality of Osijek in Croatia.

    Dragash/ Dragaš(Sha r r )

    Geographical position of Dragash/Dragaš municipality located in the south of

    Prizren/Prizren, disables inter-municipal cooperation on a variety ofservices. According to the mayor of Dragash/Dragaš, there is a natural division of

    Dragash/Dragaš municipality with other municipalities. In fact, this makes the inter-

    municipal cooperation difficult as mutual interests of the municipality of

    Dragash/Dragaš and other municipalities are slim.

    Waste management in this municipality is done through the regional company while,

    the waste landfill is the property of municipality in which only the wastes of the

    municipality of Dragash/Dragaš can be thrown. Dragash/Dragaš municipality has its

    own assets in the regional company and it is represented by one member on the board

    of the company.

    In terms of forest protection, Dragash/Dragaš municipality claims that they have a

    tradition in the protection of forests and does not think there is a need for inter-

    municipal cooperation in this field. Inter-municipal cooperation is already operating in

    the sphere of inspectorate, in which veterinary inspectors from the municipality of

    Prizren/Prizren provide services to the municipality of Dragash/Dragaš.

    Moreover, for emergency services, cooperation between the municipality of

    Prizren/Prizren and Dragash/Dragaš exists for (illegal) forest burning. However themunicipality has established the Fire Unit, even though equipment is outdated. Again,

    there is no formal agreement for this cooperation.

    One area in which Dragash/Dragaš municipality has greater potential compared to

    other small municipalities (like Mamush/Mamusa) is cadastral services, and according

    to the mayor of Dragash/Dragaš the workers are ready to offer their knowledge to their

    colleagues in Mamush/Mamusa.

    From the analysis of the situation in Dragash/Dragaš, AKM estimates that there is a

    willingness of the municipality to cooperate in areas where mutual interests can be

    seen. While in terms of the municipality of Dragash/Dragaš and its capacity for

    integration, AKM has learnt that this municipality has an official for European

    integration, but this is his secondary activity since the same person holds the position of

    the legal officer. The monitoring and project implementation component of this

    municipality is part of the Department of Urbanism.

    Mamush

    Mamush/Mamuša is the newly created municipality as a result of the decentralization

    process. The municipality has initially started as a pilot unit and later has been

    functionalized as a municipality in itself. Mamush /Mamuša municipality, though it is

    newly created, at the beginning of its operation has encountered some problems, which

    in fact have made its indispensable cooperation with several municipalities of

    Prizren/Prizren region. Its collaborations are:

      The agreement of understanding with the municipality of Rahovec : geodeticmeasurements

      The agreement of understanding with the municipality of Suhareke: geodeticmeasurements• Agreement of Understanding with the municipality of Prizren/Prizren in thedepartment of Emergency regarding Emergency inspections and prevention,Nr.52/2010 since 21/06/2010

      Collaboration with the municipality of Suhareke/Suva Reka to fix the Trnje-Mamush /Mamuša road

      Collaboration with the municipality of Suhareke/Suva Reka to fix the Suhareka-Mamush /Mamuša road

    Therefore, as seen by the agreements of understanding made by this municipality,cadastre and geodesy services are areas in which the municipality of Mamush/Mamušafaces the most problems.

    As regards to the protection of forests, the mayor of Mamush/Mamuša stressed that theissue of forests is a problem in itself. The municipality of Mamush/Mamuša even nowhasn’t engaged any person for this particular issue due to lack of sufficient budgetaryresources and inability to increase the number of municipal staff members that comes as

    a result of the decision made by the government and the ministries to not increase thenumber of workers in municipalities. 13 

    In regard with the inspectorate sector, the municipality of Mamush/Mamuša has

    established the unit in which three inspectors are employed: trade inspector, sanitary

    and environmental protection inspector and municipal and construction

    inspector. Difficulties arise in the absence of staff and inspectors on other profiles due tothe lack budget resources. In this area, the municipality of Mamush/Mamuša is

    interested to cooperate with municipalities located in the region of Prizren/Prizren.

    Within the Directorate of Public Services municipality of Mamush /Mamuša has

    formed the Emergency Sector where the fire unit operates, which has one coordinator

    and six firefighters. Difficulties in this area appear due to the lack of necessary resources

    respectively the lack of water truck. In this sector there was collaboration with the

    municipality of Prizren/Prizren, where this municipality has helped the municipality of

    Mamush /Mamuša with a donation of two vehicles for the Fire Unit.

    Mamush /Mamuša municipality has managed to establish cooperation with other

    municipalities outside the country concretely Turkey, which has benefited from several

    projects in infrastructure.

    Viti/Vitina – Kllokoti/ Klokot

    Vit i / Vi t inaThe Director of Public Services, Agim Haziri was interviewed to replace the mayor. Mr.

    Haziri said that currently there is no formal contract between the municipality of

    Kllokoti/ Klokot and Viti/Vitina, but it is understood that whatever needs Kllokoti/

    Klokot has, Viti/Vitina will dedicate the available resources. However, if future

    cooperation requires formal contract, Viti/Vitina is prepared to outline all points of

    cooperation in a formal document which both parties can agreed.

    Viti/Vitina does not have any concrete plans for IMC because the requests come from

    Kllokoti/ Klokot. The Director was eager to emphasize that Viti/Vitina is an established

    and experienced municipality and does not require the assistance of the new

    municipalities such as Kllokoti/ Klokot.

    Regarding project coordination, those directors whose sector is involved, for example,

    for health, the Director of Health Services is the person responsible for project

    coordination and monitoring. Although the director says that at times it is difficult for

    the directors to fulfill their contractual obligations and take on other duties and that in

    the future they would like to employ someone specifically for project coordination and

    monitoring.

    Mr. Haziri expressed his willingness on behalf of the municipality of Viti/Vitina to

    collaborate on future initiatives not only with Kllokoti/Klokot but also with other

    Kosovo municipalities.

    As far as the strengths of the municipality, Mr. Haziri believes that Viti/Vitina is

    competent and able to provide all services to its citizens. However, when Mr. Haziri

    was asked about specific services, it was understood that even an experienced

    municipality faces difficulty; specifically for forestry protection, the inspectorate and

    fire services. Forestry protection is an issue because there is a vast amount of forestland

    that is unprotected because there are not enough guards and the municipality budget

    does not allow for more guards. In addition, those guards out on patrol are unarmedand at times face “criminals” and are forced to walk away. The director recommends

    that there should be collaborative effort between the police and Kosovo Security Force,

    since forests are a national resource. In addition, a local campaign would be essential to

    increase the awareness of citizens for protecting national forestland.

    For the inspectorate, the director emphasizes that this is a national issue not only a local

    issue. All municipalities, parent and small, have issues because of lack of staff, penalties

    are not enforced and other issues. And lastly the fire department of Viti/Vitina is

    equipped with old machinery and a small number of fire fighters given the size ofViti/Vitina. For this, when needed, other municipalities such as Gjilan/Gnjilane and

    Ferizaj/Urosevac also provided assistance.

    Kl lokot i / Klokot

    The mayor of Kllokoti/ Klokot is largely dependent on the municipality of Viti/Vitina

    in order to offer municipal services to citizens. The mayor is very experienced in inter-

    municipal cooperation and has deemed this as a very important element for the

    functionality new municipalities. He also said that it is very important not only to work

    with neighboring municipalities but with other municipalities of Kosovo.

    Momentarily, Kllokoti/ Klokot has a contract to transfer competencies from Viti/Vitina

    to Kllokoti/ Klokot. All municipal services are offered in Viti/Vitina because they do

    have neither the space nor the staff to offer any services. Currently, the mayor and other

    directors do the management and coordination of this understanding. An individual

    would be needed to handle the activities connected with IMC.

    The European Union has donated the majority of funds needed for the construction of

    the city hall. This will be completed in the beginning of 2011. The mayor also

    emphasized the fact that the government was not ready for decentralization to function

    they way that it is, meaning they did not expect that the minority population would

    hold local government positions and that the Kosovo Serbs would be equally

    represented in local government. The actual conditions of the temporary location of thecity hall are not suitable and it is impossible to provide citizens with passports or

    identification cards. He feels that cooperation, although it exists, it is not at a

    satisfactory level because the municipality of Viti/Vitina is hesitating to assist Kllokoti/

    Klokot as a municipality and its citizens.

    In actuality it is very difficult for Kllokoti/ Klokot to offer various services to the

    citizens. Regarding waste management, USAID has donated garbage containers and a

    collection truck. Kllokoti/Klokot is in need of 20 more garbage containers, which are to

    be donated soon. All payments for property tax or vehicle registration are done in

    Viti/Vitina, but the income generated is directly deposited to the municipality of Kllkot.

    Forestry is also another issue for the municipality. The citizens who cut wood illegally

    do so for sustenance and not for trade purposes. The mayor attributes this phenomenon

    to high unemployment rates but says they need to be aware of where they can cut wood

    rather them haphazardly cutting where they want.

    The Fire Department does not exist in Kllokoti/ Klokot and for all fires; Viti/Vitina or

    Gjilan/Gnjilane fire brigades are called to react. The mayor has requested funds from

    the Ministry of Internal Affairs to establish a fire brigade and the funds have beenpromised but they are unsure of when this will happen. An advantage that the

    Kllokoti/ Klokot municipality has is that there are local citizens who have been trained

    in fire rescue and so Kllokoti/Klokot needs the equipment and building associated with

    the fire department.

    The inspectorate is also another service that does not function. The positions have been

    advertised and they have received many qualified CV’s, but once again, they do not

    have the funds to support the positions. The Ministry of Internal Affairs has been

    contacted and once the funds are provided, Kllokoti/Klokot will be able to provide the

    various sectors of the inspectorate. Currently, inspectors from Viti/Vitina are called as

    needed.

    The mayor is ready to concretely establish IMC with any municipality that expresses

    interest and knowledge. Kllokoti/Klokot anxiously awaits any assistance that can be

    provided for IMC.

    Deçan/Dečane – Junik/Junik

    Deçan/Dečane

    The Director of Protection, Rescue and Public Services, Admir Hasanaj fully understood

    the concept of IMC and was eager to say that there have been IMC amongst other

    surrounding municipalities such as Gjakova/Dakovica and Peja/Pec. Cooperation has

    not been formally established by contracts but has been successful.

    Within Mr. Hasanaj’s department, there is an office for Project Management and that

    person is responsible for coordination, implementation and monitoring.

    All requests that have made for Deçan/Dečane’s assistance have been honored and

    resources have been allocated as needed. In Mr. Hasanaj’s opinion, water, infrastructure

    and acquiring documents are the strengths of the municipality. Over 90 percent of themunicipality has drinkable water and road infrastructure covers all but 5 km of

    municipal roads with asphalt. For documents, citizens receive requested documents

    within 30 minutes of their initial request.

    Unfortunately, the municipality of Deçan/Dečane has difficulty in satisfying the

    municipalities’ needs for all the services: forestry, environment, waste collection, and

    inspection and fire services. Regarding the environment and waste collection, Mr.

    Hasanaj was quick to say that the situation not only in Deçan/Dečane but also in other

    municipalities is chaotic. He refers to the low rate of payments amongst citizens,

    frequency of waste collection, locations and conditions of regional landfills, etc.

    Concerning forestry, Mr. Hasanaj says this is currently a huge problem, because

    traditionally the people of Deçan/Dečane have lived off the forests in the surrounding

    mountains. Therefore, cutting wood is a part of their culture and it is difficult to stop a

    long-standing tradition. And for the inspectorate, he says that the employees face

    limited resources, low salaries and have no incentives.

    Despite the difficulties that the municipality faces, Mr. Hasanaj ensured us that his

    municipality is interested in any type of IMC that will benefit his citizens as well as thecitizens of other municipalities.

    Juni k/ Juni k

    The mayor of Junik/Junik, Mr. Agron Kuqi is an experienced civil servant regarding

    inter-municipal cooperation. He currently has active agreements with

    Gjakova/Dakovica and Deçan/Dečane for forestry and fire rescue services, and has also

    had cooperation with the municipality of Tropoje, Albania.

    Regarding project management, Junik/Junik does not have the budget to support an

    employee specifically for this, but within the department of Finance and Economic

    Development, there is a Project Manager. They have recently given an employee (non-

    director) the responsibility to monitor EU development, integration, and grants in

    Kosovo.

    Mr. Kuqi was pleased to say that given the restrictions, they are able to provide citizens

    with the services they need and satisfactorily. However, two areas where they

    experience the most difficulty are the inspectorate and urban planning. Mr. Kuqi is

    dedicated to improving these two very important sectors of the municipality. Regarding

    fire rescue services, Junik/Junik does not have a fire department and is currently

    dependent on Deçan/Dečane and Gjakova/Dakovica for assistance in this area.

    Forestry is another area with some difficultly due to Junik/Junik only has one employee

    for protection of all forestland.

    My. Kuqi emphasized that he is very interested in participating in formal IMCs and that

    he would like to explore other possibilities in other areas of municipal services.

    Kamenicë/ Kamenica – Ranillug/Ranilug

    Kameni cë/ Kameni ca

    Director of Administration, Enver Ajbazi, was keen to discuss his perception of IMC as

    any activity that involves an exchange of ideas, offering of assistance, cooperation,

    between two or more municipalities. Currently, the municipality of

    Kamenicë/Kamenica and Ranillug/Ranilug does have a Memorandum of

    Understanding (MOU) that involves three ministries (Finances, Local Governance and

    Internal Affairs) for the delegation and transfer of competencies from

    Kamenicë/Kamenica to Ranillug/Ranilug. This MOU is coordinated by the director

    himself as well as the Deputy Mayor of Ranillug/Ranilug. For other projects, within the

    Director of Urbanism and Development, there are officials who are involved. However,

    if in the future there is need for a specific person to undertake project coordination and

    monitoring, the municipality will provide the necessary elements (finances and staff)

    for the establishment of that office.

    Approximately 2 months ago, a female civil servant was hired to monitoring EU

    activities; assist in fulfilling EU standards, EU integration laws, etc.

    Mr. Ajbazi emphasized that Kamenicë/Kamenica is ready and willing to provide anyassistance need by other municipalities, based on their own available resources. In

    addition, the Kamenicë/Kamenica was in need of assistance, it would be in the

    municipality’s best interest to make those requests.

    Mr. Ajbazi was also very eager to say that Kamenicë/Kamenica is able to provide all

    municipal services at a very satisfactory level for the citizens. He mentioned a USAID

    project where a public opinion poll was conducted with local residents. The results

    showed that the citizens are very satisfied with the activities and work of the

    municipality officials. Mr. Ajbazi emphasized that administrative services, income

    generation and environment protection as well as waste collection are services that have

    strong performances. He said that like other municipalities, they face normal difficulties

    for forestland protection and fire services, but that they are able to fulfill the needs of

    the residents with their current resources.

    Ranil lug/ Rani lug

    This interview was not conducted face-to-face. The municipal officials (Deputy Mayor

    Nebojsa Kencic, Director of Public Services Jovan Sentic, and Municipality President

    Gradimir Mikic) responded by email to the questionnaire. The responses are presentedin bullet points corresponding to their written responses.

      Collaboration between municipalities on all levels, especially realization of

    mutual projects that are essential for municipalities, infrastructure, projects on

    the interest of economic development.

      We have a memo on the municipality of Ranillug/Ranilug’s accession within the

    EU project for Regional Economic Development in Kosovo, Agency for Regional

    Development East, Gjilan/Gnjilane i Region ARR (RDA)

      Lack of office/department that can coordinate/implement projects. We don’t

    have a specific office for project coordination, except for the office of

    procurement and the department of urban planning and cadastre.

      Lack of professional staff to employ in important departments. We cannot

    provide all services because we lack professional personnel in various areas.

      Most difficult services to offer are issuance of building permits, approvals,

    especially non-compliance of laws that the municipality serves. Department of

    Urban Planning (Building inspector), termination of work execution. The party

    tears down the document, keeps working, attacks physically the official person

    (Case, Taip Arifi, Ylli Commerce on constructing the Garin mill.)

     

    Currently we do not have any collaboration with municipalities outside of

    Kosovo. Considering that the municipality of Ranillug/Ranilug is a result of

    decentralization, which has been functioning for the last 7 months. In the future

    we plan on collaboration with municipalities outside of Kosovo.

      Difficult to offer all services listed (fire services, inspectorate, environment,

    waste, and forestry)

      Environment: Inability to control the sand exploitation on the lots that are close

    to the riverbed.

      Waste: Insufficient number of containers, thus this service is not done in the

    expected level.

      Forestry: Inability to control illegal cutting which happens during the night.

      Inspectorate: In some cases, the party does not comply with laws and solutions

    that the inspection gives them.

      Fire Services: The municipality does not have their own fire department service.

    The services are done by the main municipality of Kamenicë/ Kamenica. We are

    planning on forming the fire department.

      Yes, we are will to collaborate. With any and all municipalities that show

    interest.

      The future is on the inter-municipality cooperation. On the field of Culture,

    Education, Sports, Economy and Infrastructure Building, Reducing

    Unemployment, Providing better life conditions, and so on.

    Conclusion

    It is apparent that from the interview conducted with mayors and directors within the

    chosen municipality, the IMC has only reached a very basic level. There are several key

    points that should be outlined as follows:

      Many cooperative efforts are not written under formal contracts and are

    therefore loosely followed.

      Some municipalities have difficulty offering basic services to their citizens and

    are fully concentrated on improving these conditions.

      Small municipalities such as Junik/Junik, Ranillug/Ranilug and Kllokoti/

    Klokot are currently in temporary locations and do not have the neither the space

    nor human capacity and limited resources to support services.

      Every municipal official is interested in IMC however there is a lack of initiative

    to formalize cooperation.

      Parent municipalities do not need assistance from small municipalities but from

    other parent municipalities.

      EU integration and project monitoring is not a priority amongst municipalities

    and this is usually delegated to low-tier civil servants.

      The parent municipalities that offer services (documents, registrations, etc) for

    small municipalities are displeased that the fees generated are directly deposited

    to the small municipalities without any consideration for the resources (human

    and material) that are used to complete these transactions.

      Parent municipalities do not see an incentive or benefit for IMC for their

    municipality (small municipalities do not have the capacity to reciprocate).

      Small municipalities lack the human capacity initiate and delegate the

    responsibilities associated with IMC.
