50INSURANCE MATTERS.Handling complex, multi-party cases in jurisdictions across the United States, we have defended thousands of complex cases for insureds of America’s leading carriers and self-insureds.

NOTABLE EXPERIENCE

We represent developers, general contractors, subcontractors, multiple parties in CCIP/

OCIP matters, material suppliers, product manufacturers, design professionals, and

sureties in some of the largest construction defect lawsuits in the Carolinas and across the

United States.

We defend numerous toxic tort claims, including a recent multi-plaintiff toxic tort claim

in federal court involving alleged inhalation injuries and claimed damages exceeding

$45,000,000.

We have served as National Counsel for EIFS manufacturers, and in that capacity, defended

hundreds of individual construction products liability cases in 19 states involving thousands

of houses, including five putative class actions, defeating class certification every time.

We defended four subsidiaries of a multi-billion dollar conglomerate, which owns

manufacturers and distributors of exterior claddings, in more than 100 separate suits

involving hundreds of single-family homes where the average indemnity payment was

less than $20,000 and the average attorney’s fee per case was less than $19,000.

PRODUCTS LIABILITYRogers Townsend’s Insurance Defense Team represents major national corporations, insurers, and individuals defending an array of products liability claims. As National Counsel for EIFS manufacturers, our attorneys defended hundreds of individual construction products liability cases in19 states involving thousands of houses, including putative class actions, defeating class certification each time.

Rogers Townsend has developed procedures for handling product liability claims in many areas of the country and through all levels of litigation in an efficient and timely manner consistent with the legal and business needs of both carriers and manufacturers.

CONSTRUCTION DEFECT LITIGATIONRogers Townsend represents general contractors, subcontractors, design professionals, developers, consultants, material suppliers, and manufacturers in hundreds of construction defect claims. We handle single-family residence cases, and have extensive experience with large multi-family suits brought by condominium associations, class-action litigation in those cases and in commercial and industrial cases. We also have experience representing numerous parties and projects covered by CCIPs and OCIPs.

Rogers Townsend has one of the largest teams of construction defect lawyers in South Carolina. Our attorneys have real-world experience, as many have held previous positions in the construction, manufacturing, and industrial fields.

Environmental issues arising under federal or state law, such as CERCLA, RCRA, the CAA, the CWA, and state analogues, can be both surprising and costly. The defense of claims involving violations of environmental law requires specific experience identifying the areas of critical concern, such as the preservation of evidence and the types of testing and experts necessary for an efficient and effective defense.

Rogers Townsend’s environmental defense team has extensive experience in this area, including attorneys who have worked in regulatory offices and in industries with high environmental risk.

Having defended lawyers, doctors, nurses, engineers, architects, accountants, veterinarians and other professionals, our attorneys have the experience to defend claims of professional malpractice.

Our health care attorneys understand the unique risks associated with providers and their employers, whether they are independent or work under the auspices of nursing homes, hospital systems, national pharmacies, or other health care entities.

PROFESSIONAL LIABILITY

Rogers Townsend has teams experienced not only to the specific practice areas as discussed herein, but also to the numerous and varied types of general liability claims such as premises liability, trucking and automobile claims, and just about any other claim of personal injury or property damage.

Our focus on insurance defense and dedication to efficient and effective results means we have the experience and flexibility to meet all carrier guidelines and adjuster-specific needs. Our internal “litigation best practices” allow us to meet all reporting guidelines, integrate with electronic billing systems, and provide the high-quality, professional legal services that carriers and clients deserve.

GENERAL LIABILITY

MASS TORTAllegations of large-scale exposure to toxic chemicals, construction products, and a host of other allegedly dangerous or defective products have implications beyond simply the merits of the claims. Quick, decisive actions are necessary to address the logistical and practical issues which could overwhelm the substantive defense of these claims.

Rogers Townsend has a team experienced and dedicated to efficiently addressing the myriad aspects of mass tort claims and to coordinate efforts amongst multiple counsel, the carriers and the insureds. We quickly identify the critical issues (including not only the merits of the claims but also business concerns) and ensure proper communication and the development of an efficient and effective strategy to address them.
