1 Introduction

The purpose of this document is to ensure background support for the UEFA EURO 2012 Final Tournament in terms of logistics and customs regulations. It is aimed at all our providers, sponsors and suppliers that will have to organise deliveries during the tournament.

The instruction provides a short description of the approach which should be taken in case of cross-border transactions from Europe to Ukraine and from EU- or non-EU countries to Poland as well as establish a standard set of rules that will be applied in relation to the UEFA EURO 2012 Final Tournament deliveries.

Ukraine is not a member of the EU and in turn it has particular customs clearance import and export procedures, some specific requirements to packaging, invoices and proforma invoices, set of documents which should accompany shipment etc.

In addition, the customs procedures in Ukraine are different from the ones applicable in other European countries. For this reason the entire process requires strict compliance with the existing customs regulations and it is highly advised to follow the recommendations written in this document and given by local customs brokers.

Poland is a member of the European Union and applies the Common Commercial Policy which allows a free flow of goods between member countries. The Common Commercial Policy is based on the principle that goods legally produced, or released for free circulation in one of the member countries may be transferred between member countries without any further limitations.

Deliveries from the countries-non-EU-members are obliged to follow Common Customs Code and subsequent Commission Regulations (EEC) which contain specific customs requirements as well as the tariff and statistical nomenclature in the form of a Combined Nomenclature where each good has a specific code and customs duty rate (ad-valorem).

2 General Information

The UEFA EURO 2012 Final Tournament will take place in Poland and Ukraine from June 8th to July 1st 2012.

Set-up period starts from the 11th of May and dismantling last until MD +3 maximum. For further information, please follow instructions provided by the Project Leaders.

All cost of delivery handling, including transportation, insurance, customs clearance, unloading, loading are borne by the suppliers and not on UEFA side.

No heavy machinery will be available at the venue; if any machinery is needed, it should be ensured by suppliers or their forwarders directly to ensure fast delivery in the stadiums.

3 UEFA Designation

3.1. Purpose

UEFA Designation process refers to the authorization for the supplier by UEFA EURO 2012 to be entitled to simplifications in customs procedures, both in Poland and in Ukraine.

Authorization is granted through the below:

provision to the supplier of a scan-copy of signed UEFA Designation Letter for the company that should be collected with the cargo documents,

provision to the supplier of a personalised Truck Identification Pass;

and to be relayed to the authorities through:

provision of an original UEFA Designation Letter to the respective customs authorities to allow their database update,

provision of border crossing information to the customs authorities.

Designation process/Designation letters are necessary:

o For temporary import in Poland: for NON EU suppliers/ deliveries from non-EU countries to be cleared at Host Cities

o In Ukraine for all suppliers crossing the border of Ukraine, for all import (permanent as well as temporary), all modes of transport.

Truck Passes are needed to identify easily EURO 2012 Trucks and ease the border crossing. You can find samples of UEFA Designation Letter in Annex 1 and EURO 2012 Truck Pass

in Annex 2.

3.2. Process

1-Fill in the Excel Template (see Annex 3 ) to announce deliveries in Poland and/or in Ukraine

2-Send back filled Excel Template to [email protected] and UEFA Project Leader

3-Receive VDS supplier Manual and start registration in Venue Delivery System

4-Receive the copy of the UEFA Designation Letter and a personalized truck Pass

5-Prepare the email (see Annex 4) to provide information on the delivery border crossing and send it together with the copy of the UEFA Designation Letter to:

Please note you have to count at least on one week to receive the UEFA Designation Letter once you have registered.

4 Delivery Planning

Delivery Addresses 4.1

In Annex 5 you can find delivery addresses of venues and other destination points both for Poland and Ukraine.

Delivery Schedule 4.2

For delivery in the Stadium, it is mandatory to register through the Venue Delivery System – the Manual will be received once you have send the Excel Template to announce your deliveries and will allow you to register, request UEFA Designation Letter together with Truck Identification Pass and request a delivery Time Slot.

For other delivery, make sure the final receiver is well informed of the delivery and exact dates and timing before shipping the goods.

5 Transportation documents

Shipping Documents - UKRAINE 5.1

The documents in the list below must be attached to the shipment:

Waybill (CMR or AWB) – 4 original examples Invoice – 5 original examples Packing List – 3 original examples Certificates, if the cargo type requires Carnet TIR or Carnet ATA - if any UEFA designation letter – printed colour scan-copy

It is mandatory that all above-mentioned documents should be verified/checked and approved by supplier’s agent/ customs broker in Ukraine before the cargo dispatch. This guarantees that the shipment will cross Ukrainian border without unexpected troubles/ expenses and proceeds fast to the import customs clearance, thus resulting in on-time delivery to the venue.

5.2 Shipping Documents - POLAND

A. Intra Community Acquisition (ICA)

The documents in the list below must be attached to the shipment:

• Waybill (CMR or AWB)

• Commercial Invoice or Proforma Invoice (if shipped goods are free of charge)

• Packing List / Delivery Note

B. Import deliveries from non-EU countries

The documents in the list below must be attached to the shipment:

• Waybill (CMR or AWB or Bill of Lading)

• Commercial Invoice or Proforma Invoice (if shipped goods are free of charge)

• Packing List / Delivery Note

• Certificates, if the cargo type requires

• TIR Carnet or ATA Carnet - if any

• UEFA designation letter – printed colour scan-copy (only for temporary import as alternative option for ATA carnet)

It is mandatory that all above-mentioned documents should be verified/checked and

approved by supplier’s agent/customs broker in Poland before the cargo dispatch.

This guarantees that the shipment will cross Polish/EU border without unexpected

troubles/expenses and proceeds to the import customs clearance without any delay,

thus resulting in on-time delivery to the venue.

5.3. Shipment Registration

Company designated by UEFA should register in VDS-system as from March 19th and not later than 2 weeks prior to its first dispatch in view to receive UEFA Designation Letter and be added to Ukrainian/Polish customs database of UEFA EURO 2012 companies.

Thereafter each shipment of this company must be registered in VDS-system before the dispatch takes place. For road transport registration should be done at least 2 working days before the cargo dispatch; for air transport, it must be submitted 3 working days before.

6 Packaging and labelling requirements

The packaging should protect the shipment against unauthorised interference, theft, damage during storage and transportation.

The shipment should be properly marked, addressed and packed to ensure safe transportation with standard care in handling.

Please check if the information on label complies with packing list (weight and quantities); and that there are no other labels on cartons/pallets from other/previous shipments.

Please, when possible, use fast removable packing materials, which can be recycled. The limited storage space at the venue does not allow storing of any packing materials or pallets within or around the venue.

If there is a need for reusing the packaging materials, please make sure that your suppliers or forwarding agent/ partner will keep those packing materials until the dismantling phase.

All packaging materials for dismantling phase shall be organized by suppliers or forwarding agencies/ partners.

All wooden pallets/boxes/cartons etc. used for packaging should be marked according to the international standard ISPM15.

International Standards For Phytosanitary Measures No. 15 (ISPM 15) is an International Phytosanitary Measure developed by the International Plant Protection Convention (IPPC) that directly addresses the need to treat wood materials of a thickness greater than 6mm, used to ship products between countries. Its main purpose is to prevent the international transport and spread of disease and insects that could negatively affect plants or ecosystems. ISPM 15 affects all wood packaging material (pallets, crates, dunnages, etc.) requiring that they should be debarked and then heat treated or fumigated with methyl bromide and stamped or branded, with a mark of compliance. This mark of compliance is

colloquially known as the "wheat stamp". Products exempt from the ISPM 15 are made from alternative material, like paper, plastic or wood panel products (i.e. OSB, hardboard, and plywood).

7 Permissions for entrance into the city centre/ venue in UKRAINE.

In Ukraine permissions for entrance into the city centre/ venue is necessary only in Kyiv. Details are described below.

Ordering process 7.1

To enter Kyiv city centre and reach the venue, the vehicles with cargo capacity over 2,5t must have special city permissions.

Such permissions contain the following information:

Tariffs for permissions 7.2

The tariffs for the permissions are as follows:

24 hours (1 day) duration – 174.30 UAH incl. VAT 20% 1 month duration – 434.30 UAH incl. VAT 20%

In case of ordering through the authorized company the additional commission fee in the amount of 30.00 UAH net of VAT 20% will be charged.

Payment can be provided only as bank transfer.

Please be advised that the delivery of permissions to your drivers is your responsibility and it is not included into the price.

8 Permissions for entrance into the city centre/ venue in POLAND

Introduction 8.1

This Memo has been developed in order to explain the host cities road limitation and procedures on processing the trucks permits for the tournament needs. Moreover, it describes existing national traffic and driving limitations in Poland. Each city in Poland regulates the local truck flow on its own. Therefore, there is different situation in this field at each host city. On the other hand, national traffic and driving limitations are equal for whole Poland, including territories of host cities.

Traffic & Driving Limitations 8.2

Attention needs to be paid to driving restrictions as well as minimum rest periods and rest time for truck drivers in Poland. 8.2.1 Driving period & rest time

Drivers can drive a vehicle up to nine hours a day and it may be extended twice a week up to 10 driving hours. The driver cannot drive a vehicle longer than 4,5 hours. After this time, the driver must take a 45-minute break. Weekly working time, including overtime, should not exceed 48 hours but there is a possibility to extend the working week up to 60 hours, in case the weekly average working time does not exceed 48 hours in a 4 month period. Every day the drivers shall take at least 11 hours break for the uninterrupted rest. Given the above mentioned regulations, in some cases we should foresee 2 drivers per one truck.

There are parking lots located along the main national roads in Poland. You can gain some useful and updated information at Directory concerning parking lots for lorries

Due to many road investments in Poland at many places within the country you can find serious traffic problems and temporary road limitations. You can update you information on the national and voivodeship roads difficulties at General directorate of national roads and motorways (available in Polish only).

The transit of the city of Warsaw by goods vehicles of over 16t (with the exception of traffic serving communities surrounding Warsaw) is forbidden. Transit traffic should divert via roads No. 50, 62 and 60. Vehicles travelling with a C16 identity card on board are exempt from this restriction. This card is delivered to carriers by the consignor. For more details please see below. Restrictions are signposted.

for ships;

transport of transmission equipment for radio or TV stations;

transport of equipment intended for mass events;

vehicles transporting newspapers which constitute a considerable volume of the total

cargo or of the available loading space;

vehicles used for the carriage of drugs or medicines;

vehicles used for the carriage of mail which constitutes a considerable volume of the

total cargo or of the available loading space;

vehicles whose operation is strictly connected with the necessary maintenance of the

production cycle or with providing services to a company working around the clock;

vehicles transporting dangerous goods, as covered by separate regulations, in

quantities for which the orange plate is required;

vehicles carrying perishable goods or foodstuffs2 which constitute a considerable

volume of the total cargo or of the available loading space;

vehicles used for the carriage of concrete or equipment for pumping concrete;

vehicles used for transporting municipal waste;

vehicles engaged in the production cycle up to a distance of 50km from their home

base;

vehicles used in combined transport;

slow-moving agricultural vehicles and tractors;

vehicles returning from abroad to complete a road transport operation or travelling

to the consignee who has his registered office in Poland, provided that the driver has

a valid annual toll card for driving on domestic roads;

vehicles which entered Poland before the date or time of the restriction and which

may travel up to 50 km from the border crossing, and vehicles in the border zone

waiting to exit Poland.

No additional permits or certificates are necessary to fall under exemptions. If one of the exemptions applies to the certain truck, it can enter the roads. In case of Road Inspection or Police control, the officers verify the cargo and papers and the exemption must be proven in the transportation documents.

8.2.3 Limitations in entering the Host Cities & truck permits

Warsaw

Vehicles with a permissible total weight above 5 tons or above 10 tons

Vehicles with total weight above 5 tons or above 10 tons may move in indicated zones of vehicles limited movement only after obtaining an identification tag C-5 C-10. Obtaining of an identification tag for a defined zone for defined vehicles (indicated in the motion) allows moving within this zone without any limitations. In one motion two zones may be indicated and then the positive decision will result in obtaining identification tag C-5 C-10 for two zones. The motion may be also limited to one zone and then an identification tag C-5 C-10 will concern only one of the zones. Application for C5/C10 is available in Annex 14.

Vehicles with a permissible total weight above 16 tons

The movement of vehicles with total permissible value above 16 tons in Warsaw between 7:00 and 10:00 and between 16:00 and 20:00 is, in general, prohibited, unless the vehicle holds the identification tag C-16. C16 Regulations are available in Annex 15, and C 16 Application form is available in Annex 16.

The movement of vehicles with total permissible weight above 16 tons in Warsaw between 10:00 and 16:00 and between 20:00 and 7:00 is allowed without the necessity to obtain the identification tag C-16, provided that if the vehicles are moving in the zone of limited movement of vehicles with total permissible weight above 5 tons or the zone of limited movement of vehicles with total permissible weight above 10 tons, they have to hold the identification tag C- 5 C-10.

In order to obtain both mentioned above identification tags the appropriate motions have to be submitted to Municipal Roads Management in Warsaw. The motions should be considered within the period of 7 to 30 days.

There are permits dedicated to the certain truck (preferred by authorities) and permit tags to the bearer i.e. the company can apply for certain amount of tags, but must prove the necessity of entering the city during prohibited periods and inability for pointing certain trucks (to many subcontractors, high rotation of trucks etc.). The permits are issued in Warsaw free of charge.

Wroclaw

Vehicles with a permissible total weight above 3.5 tons and 9 tons

Wroclaw has restricted zone for the vehicles with maximum total weight (MTW) over 3.5 and 9 tons.

The 3.5 tons limitation concerns only the strict of the old town area.

The vehicles with MTW over 9 and below 12 tons are temporally allowed to enter the restricted zone only via 5 defined corridors. The trucks with the MTW above 12 tons are allowed to enter the restricted area using above mentioned corridors and within following timeframes only: 4.00 - 6.00, 9.00 - 13.00 and 19.00 - 22.00.

All the trucks with MTW above 9 tons entering restricted area must be able to prove with transportation documents the necessity for entering the zone e.g. destination of the cargo.

Exceptions to above mentioned restrictions are currently not allowed in Wroclaw. The stadium is located outside the 9t restricted area, so in general the problem might be avoided. In case of necessary exemptions it must be negotiated with the City Authorities.

Vehicles with a permissible total weight above 18 tons

The movement of vehicles with total permissible weight above 18 tons in Wroclaw is generally prohibited within following timeframes: 06.00-09.00, 13.00-19.00 and 22.00-04.00.

There is possibility to obtain permits for entering the zone within limited timeframes in justified cases. In order to obtain permits mentioned above the appropriate motions have to be submitted to City Administration in Wroclaw.

Wroclaw has just opened a bypass highway excluded from the 18 tons limitation. The stadium is located just next to it; therefore heavy transport has an access to the venue without any local limitation. See below map with all the restricted zones in Wroclaw:

Poznan

Poznan has restricted zone for the vehicles with maximum total weight over 3.5 and 16 tons.

The 3.5 tons limitation concerns only the strict old town area, around the central square.

The movement of vehicles with total permissible weight above 16 tons in restricted area is generally prohibited.

The stadium is located outside the restricted zones. For the trucks that will have to enter the restricted areas relevant procedure of issuing permits needs to be developed.

Be aware, that the EXCEPTIONS to the national restrictions DO NOT apply to the local (city) limitations. In all the Host Cities there are additional local weight limitations, usually connected with the strict city-centres deliveries e.g. old towns, central squares etc. Due to the location of the 4 venues in Poland, they do not apply to the transportation access to the stadiums.

9 Customs regulations in Ukraine

Representation in customs procedures 9.1

The goods for the UEFA EURO 2012 Final Tournament can be declared by UEFA, UEFA Designated Companies or customs brokers chosen by the designated companies.

Only company included into the EURO 2012 Register of Ukrainian Customs authorities are recognized by customs as UEFA Designated Company and is allowed to bring goods to Ukraine for the UEFA EURO 2012 Final Tournament. Companies are being added to this Register on the base of UEFA Designation Letters (sample – Annex 1, relevant process is described in point 3 of this Instruction).

Please keep in mind that Ukrainian companies which import goods to the territory of Ukraine for fulfilment of relevant Tournament needs and declare them to customs as ones for the UEFA EURO 2012 Final Tournament also should be included into the mentioned customs database.

The general rules for the customs clearance are:

the declarant is responsible for the accuracy of the information stated about the goods

the legal regulations of Ukraine allow carrying out certain formalities through authorized agents, also in case of customs procedures (authorized customs broker)

Normally, the authorized agent (customs broker) is the forwarding agency acting in the name of the Company on a contractual basis. Such contract must be prepared and signed by the Company through the persons entitled to its representation.

In Ukraine such agent is a legal entity under Ukrainian laws. The Company assigns the agent concluding a relevant contract with this legal entity. This contract outlines all required liabilities of the parties, service tariffs and terms of payments.

There are 4 customs brokerage companies which were selected on the basis of RFP and which are recommended by UEFA/ LOC EURO 2012 Ukraine as designated companies to provide customs brokerage services:

Please be aware that the payment of all customs clearance expenses will be addressed by customs brokers to the suppliers directly.

Place of customs clearance 9.2

The location for the customs clearance for goods designated for the UEFA EURO 2012 Final Tournament is related to the type of import:

for permanent import – customs offices in Host Cities for temporary import – at border checkpoints

In practice, Ukraine has complicated customs clearance procedures, therefore the entire process requires strict compliance with existing customs regulations and following all recommendations of Ukrainian customs brokers.

The obligatory rule to avoid that goods get stuck at the Ukrainian customs is: BEFORE THE DISPATCH, all documents and terms of delivery must be carefully checked and confirmed by Ukrainian customs broker and consignee.

9.3.1. Permanent import

The permanent import of goods means their entry into the territory of Ukraine for free circulation without customs control after the end of customs clearance. Goods will not get back to the country of dispatch, they will be used in the territory of Ukraine and left/ consumed there.

Before sending the goods to the consignee in Ukraine the European vendor should bear in mind that the consignee needs 3-5 days for the usual import customs procedure (in case no additional authorizing documents have to be provided and additional procedures and controls have to be performed).

Trucks with cargo firstly should go to the customs terminal for clearance.

After all documents for customs clearance are submitted, necessary payments are made and shipment/documents are inspected, then shipment can be released to consignee.

The consignee must be a legal person registered in Ukraine (e.g. a registered representative office of a foreign company) that has a customs accreditation. In order to obtain the accreditation, such legal person should contact the Customs Office in the relevant city.

It is obligatory to indicate goods receiver at the shipping documents in a right way, which should be Ukrainian entity.

If supplier has local partner/subcontractor- he can be stated as receiver. That’s mean that subcontractor will be involved at the customs clearance process, shall have customs accreditation and will have financial responsibilities in part of customs duties/VAT.

If supplier doesn’t have Ukrainian partner/subcontractor local customs Broker Company can act as receiver and take care about customs related obligations.

NEVER INDICATE STADIUM OR OTHER DESTINATION POINT AS RECEIVER, as it is only a delivery place!

Receiver must have customs accreditation and is responsible for customs formalities. Please, agree with your partners/subcontractors or designated customs brokers the nomination of Receiver.

The Cargo Customs Declaration, called CCD, is used for declaring goods (SAD form which is unified with the same form in EU).

Together with the CCD, the list of documents below must be submitted to the customs:

UEFA Designation letter (sample in Annex 1);

Invoice or other document determining the cost of goods (in case of free of charge delivery – proforma-invoice);

Shipping document (CMR, Air Waybill etc.);

Other specified documents (accreditation at customs, bank documents, specification of goods, any other additional documents ) - must be consulted with Ukrainian customs broker before the dispatch, could be also requested by customs as additional documents during customs clearance.

Please keep in mind that it is not enough to have copy of signed UEFA Designation letter for customs clearance. Appropriate Designated by UEFA company should be added to Customs database by higher Ukrainian customs authority to be used by local customs. This process in under ELOG UKR supervision and takes time.

Therefore please TAKE CARE ABOUT UEFA DESIGNATION LETTER ACQUISITION NOT LATER THAN 2 WEEKS PRIOR TO DISPATCH OF GOODS.

9.3.1.1. Recommendations for documents preparation

Invoice (proforma-invoice) You can find the completed invoice sample in Annex 7.

The invoice (proforma-invoice) must be signed and stamped. The invoice (proforma-invoice) should contain the following data:

1. Number and date of invoice;

2. Name and address of the supplier (shipper) – as suppliers act on the basis of contracts with UEFA (or UEFA Events SA) please add into this field “On behalf of UEFA/UEFA Events SA”

Forwarder agent/logistics company should not act as a shipper. Only Designated company should be stated in invoice/proforma-invoice as a shipper

3. Name and address of the recipient (consignee),

LOC EURO 2012 Ukraine can be a consignee only in case of shipments where shipper is UEFA and LOC EURO 2012 Poland. Otherwise you should act through customs brokers or your own counterpart,

4. Details of the contact persons both on the supplier’s and the recipient’s side,

5. Address of delivery - should be verified by customs broker as it is crucially important to put those address which will be accepted by Ukrainian customs, and this address is not always the same as physical address of your point of destination,

6. Terms of delivery according to Incoterms - it is necessary to indicate the exact place of delivery e.g. DDP Kyiv. It is strongly recommended to organize all deliveries on DDP-Kyiv basis in view of avoiding delays because of time for payments required for transfer to customs authorities

7. Type of payment – if it is delivery without payments then “free of charge” should be stated in the invoice

8. Exact description of goods – Name, material, model, trade mark, serial number etc.

9. Country of origin separately for each type of goods – full name without abbreviation (for example “Poland”, not “PL”)

10. International HS-code (8-digits) for each position and origin of goods

11. Quantity of goods (separately for each type of goods e.g. pens, t-shirts, notebooks etc.),

12. Value of goods per unit (separately for each type of goods) including the currency (e.g. USD, EUR),

13. Total value of goods (per type) including the currency (e.g. USD, EUR)

14. Total value of all delivered goods including the currency (e.g. USD, EUR)

15. Total net and gross weight.

16. If goods are delivered free of charge, then “Not for sale. No commercial value, value for customs purpose only” should be set out in the invoice (while price per item should be indicated in the invoice). - The invoice should not contain “pallet” as an item if the pallet is used as packing material, otherwise you will be obliged to pay duties and taxes for this item.

17. The clause: “This invoice should be accepted as the specification for the goods”

18. The clause: “Purpose of import: Goods for UEFA EURO 2012”

Shipping (Transport) documents The description of goods and weight shall meet relevant description in the invoice.

Only Designated Company should be stated in transport document as a shipper (not forwarding agent/logistics company).

Certificate of origin (if any is requested) It must contain reference to invoice number.

The description of goods and weight shall meet relevant description in the invoice.

9.3.1.2. The customs payments in Ukraine

1. Import Duties – several types of duties:

rates from 0% to 40 % based on the customs value

2. Excise Tax – for spirits, tobacco products, vehicles

3. VAT - rate is 20% based on the sum of customs value, duty and excise tax.

4. Customs Processing Fee

Please be aware that NO EXEMPTIONS FROM CUSTOMS PAYMENTS will be applicable for the UEFA EURO 2012 Final Tournament.

9.3.1.3. Permanent import of goods via post / express-courier services

The total value of the delivery (goods invoice value + transportation costs) should be lower than 100 EUR. If not then full customs clearance as described above will be realized.

9.3.2. Temporary admission (temporary import)

Temporary admission (temporary import) of goods means that their entry into the territory of Ukraine is temporary and not meant to be consumed during the event. When the customs clearance is completed the goods will remain under customs control until re-exported.

Goods that are temporarily imported to Ukraine are exempted from customs duties and taxes. This is the general rule, applicable to all shipments intended for the UEFA EURO 2012 Final Tournament.

Goods temporarily imported for the UEFA EURO 2012 Final Tournament needs can be declared under below documents:

- ATA Carnet

- Special (simplified) customs declaration

The following customs documents must be submitted to customs:

UEFA Designation letter (sample in Annex 1 ); shipping document (CMR, Air Waybill, etc.); power of attorney in case if the authorized representative of ATA Carnet holder

shows the goods to the customs authorities.

GOODS MUST BE FULLY RETURNED TO COUNTRY OF DISPATCH.

If they are not re-exported, the exporter/importer will be accused by Ukrainian state authorities of breaking Ukrainian laws.

9.3.2.1. ATA Carnet - general description

The ATA Carnet is an international document for a temporary admission used for the temporary import of goods which is accepted as a customs declaration, allows identifying goods and contains international valid guarantee to cover import duties and taxes.

Carnet ATA is accepted for such categories of goods as:

goods designated for events professional equipment

The ATA Carnet can be used for a multiple passage of goods across the customs border. The number of entries/exits to/from the customs border is limited by the number of tear sheets in the ATA Carnet.

The ATA Carnet is issued by the organization providing guarantees (as a rule, the Chamber of Commerce) in the country of dispatch. The detailed information on the execution of the ATA Carnet in a particular country of shipment can be found in such organization.

The customs clearance of goods with the use of the ATA Carnet is carried out by the customs authority at a customs border checkpoint.

Subject to the availability of blue transit sheets in the ATA Carnet, the customs clearance of goods intended for events and temporarily imported to the customs territory of Ukraine can be carried out by customs authorities whose area of activity covers the site of relevant event (Host Cities – Donetsk, Kharkiv, Kyiv, Lviv).

Please be aware that above statement does not cover temporary import of professional equipment.

The illustrative lists of goods intended for events as well as of professional equipment are set out in the Istanbul Convention of Temporary Admission.

The validity period of the ATA Carnet is 1 year. The ATA Carnet has to be completed in English or Ukrainian/Russian. Otherwise, it has to be translated into Ukrainian.

ATA Carnet should not be issued for the name of your forwarder agent/logistics company, but on the name of UEFA designated company.

Please indicate “Any authorized representative”. May also indicate any person name or company name responsible for ATA Carnet clearance but “Any authorized representative” should be obligatory. Example: Mr. John Smith, “Atlantis GmbH” or any authorized representative.

You should also issue Power of Attorney for ATA. Please make sure you have several POA along with ATA Carnet.

Section (C) Intend of use

Should be: “Professional Equipment for UEFA EURO 2012” or “Goods for UEFA EURO 2012”

Section (c) Valid until

Please make sure the ATA Carnet is valid for the Tournament period plus at least several weeks for dismantling phase and return transportation.

Section (P) List of Countries

Please make sure that Ukraine is indicated in the country list. The wording “Other Countries” is not acceptable and ATA Carnet will not be accepted by Ukrainian Customs Authorities

In order to avoid delays during the customs clearance and ATA Carnet rejections please do not send shipments under ATA Carnets without preliminary customs broker confirmation.

9.3.2.3. Special (simplified) customs declaration.

Special (simplified) customs declaration was specially created by Ukrainian government for the UEFA EURO 2012 Final Tournament and can be used by Designated UEFA companies, including HB companies and teams-participants, in case of temporary admission of goods on the same terms as usually ATA Carnets is used based on provisions of the Istanbul Convention of Temporary Admission.

Form of the Special (simplified) customs declaration is in Annex 9.

Such declaration is to be filled in Ukrainian or English, taped or manually in duplicate: - 1st copy is for customs, - 2nd for declarant. 2nd copy must be returned to the customs on the way back during re-exportation.

Special (simplified) customs declaration can be used starting from 15th of April 2012.

As there are no experience of such declaration usage it is recommended to use the help of Ukrainian customs broker for declaring of goods under this type of declaration

10 Customs regulations in Poland

Representation in customs procedures 10.1

The legal regulations allow carrying out certain formalities through authorized agents, also in case of customs procedures.

UEFA Designated Company can be represented before the customs authorities in order to fulfill all formal requirements by such external agents. The Company does not declare goods for customs purposes by itself. Normally the authorized agent is the customs agency which acts in the name of the Company based on a direct authorization (power of attorney). Such authorization must be prepared and signed by the Company by persons entitled to its representation. In addition, such authorization requires payment of stamp duty in amount of PLN 17.

There are two types of authorization

Direct authorization – where the agent acts in the name and on behalf of the entity,

Indirect authorization – where the agent acts in his own name however on behalf of the entity.

The Company issues direct authorizations to customs agencies.

There are 4 customs brokerage companies, which were selected on the basis of RFP and which are recommended by UEFA/LOC EURO 2012 Poland to provide customs brokerage services:

1. JAS-FBG – present in all 4 Host Cities (Gdansk, Poznan, Warsaw, Wroclaw), Krakow, all 3 border crossings and 1 airport (Warsaw);

2. DB Schenker – present in all 4 Host Cities (Gdansk, Poznan, Warsaw, Wroclaw), Krakow and 2 airports (Warsaw, Wroclaw); concept of mobile customs agents will be available (especially for airport in Gdansk and/or 3 border crossings)

3. OmegAir Cargo – present only in Poznan (HC + airport);

4. Cargo-Partner Spedycja - present in HC Warsaw and 4 airports (Krakow, Warsaw, Poznan, Wroclaw).

The locations for the customs clearance of goods designated for the UEFA EURO 2012 Final Tournament are generally customs offices in Host Cities but it is not mandatory – customs clearance in the other customs offices located in Poland will be possible, also with some simplifications and priority for UEFA Designated Companies after notification in advance. It will be related especially to customs offices located not far from POL/UKR border or Host Cities.

Additionally customs clearance could be done not in customs office’s terminal but also in so called approved customs place – the place of the owner of customs agency, approved by local customs office. To use of this kind of approved customs places, customs agency should possess the authorization for customs simplified procedure and/or AEO (Authorized

Economic Operator) status. All of the above recommended customs agencies possess this status. For details please contact with them directly.

Customs procedures 10.3

10.3.1 Deliveries of goods into/from Poland from/to EU member states (Intra Community Acquisition – ICA and Intra Community Supply - ICS)

Poland is a member of the European Union and belongs to the EU customs union which allows a free flow of goods between member countries. Goods delivered into and sent from Poland within the territory of the EU are free from customs duties.

10.3.2 Import of goods into Poland from non-EU members states

For non-EU-member countries, however, common customs duty rates apply. The import of goods is related to the declaration of goods to the customs authorities and payment of customs duties and VAT (generally at the rate of 23%). To declare imported goods the Consignee/ Importer should have EORI (Economic Operators’ Registration and Identification) number – used to identify entrepreneurs (legal entities except individuals) in all matters involving the customs authorities of the EU. Companies from the EU countries obtain their EORI number from the customs authorities of their respective country according to applicable procedures. Companies from non-EU countries, if not in possession of an EORI number, apply for its issue personally or via mail to the customs authority relevant in relation to the location where the first activity requiring the EORI number is planned, or in relation to the location where the first activity requiring the EORI number is made.

NEVER INDICATE STADIUM OR OTHER DESTINATION POINT AS CONSIGNEE/RECEIVER, as it is only a delivery place!

Consignee/Receiver must have EORI number and signed direct/indirect power of attorney for customs agency’s representation in relation to all customs formalities. Please, agree with your partners/subcontractors or designated customs agencies the nomination of Consignee/Receiver.

10.3.2.1 Standard procedure – release of goods for free circulation

In order to allow quick and effective release of goods for free circulation in Poland, it is necessary to fulfil certain formal obligations. This essentially requires from the exporter completing the documents in appropriate form, as well as attaching of statements and certificates required by law. It must be stressed that in practice the customs procedure may take many days depending on the requirements of the customs authorities. The customs authorities may i.e. demand presentation of goods for inspection, opening of the parcels, providing samples for testing etc. It should also be noted that the goods may be released for free circulation after payment, or securing of the customs duty and VAT. Therefore it is recommended to cooperate strictly with one of the above designated customs agencies or chosen by your own in Poland.

The basic document necessary to properly complete the SAD document3 and, as a consequence, to release the goods for free circulation, is the commercial invoice, or a proforma invoice issued by the exporter. In case of free of charge deliveries ), the proper document shall be the proforma invoice.

Apart from the invoice the customs authorities may also require additional documents such as statements and certificates of origin. It should be noted that it is impossible to describe in a concise form all possible cases where additional documents will be required by the customs authorities. It is also not possible to define all types of certificates and additional

requirements of the customs authorities. E.g. in case of food of animal origin (other than samples), it may turn out necessary to obtain a veterinary certificate and goods should be produced in a manufacturing plant and country approved by the EU. Some goods may also be subjected to obligatory quarantine before being entered into free circulation etc.

The basic documents attached to the proforma invoice include:

a) In case of ICT (Information and Communication Technologies) goods – statement that the product does not contain asbestos,

b) In case of goods made of leather – statement that they were not produced of cat and dog skin,

c) In case of goods made of leather - statement that the goods are not subject to restrictions of the Washington Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES),

d) Certificate of origin of goods (for certain goods such as textiles if customs authorities will have doubt concerning declared origin of goods).

The statements indicated in letters a) – c) above may be made in the form of one document. They should state the types of goods concerned and the delivery number.

The example of such statement constitutes Annex 11 to this Instruction.

Certificates of origin of goods, referred to in point d), may be required in relation to certain types of goods e.g. textiles under section XI of the Combined Nomenclature. Following Regulation (EU) No. 955/2011 of the European Parliament and of the Council of 14 September 2011 certificates of origin for the above goods will be not obligatory. Customs authorities are able to require additional information, notably in the event of doubt concerning the origin of the imported goods. The certificates of origin are issued by the relevant certification authority in the country from which the goods originate.

There are two types of certificates:

Standard – these do not allow for any reductions in the customs duty rates.

Special – these allow for application of reduced customs duty rates (e.g. Form A).

It should be noted that in Poland certificates of origin are issued by the local customs offices or Polish Chamber of Commerce (KIG). The customs office may require proof where the product was made. The certificates are usually issued without delay.

It should be noted that some deliveries may be exempt from both customs duty, as well as VAT. Normally this concerns deliveries of value not exceeding EUR 22,-.

10.3.2.1.1 Recommendations for documents preparation

The commercial/proforma invoice should contain the following data:

3. Details of the contact persons both at the supplier’s and the recipient’s side,

4. Date of delivery,

5. Number of packaging,

6. Net and gross weight of goods,

7. Description of goods and their quantity (separately for each type of goods),

8. Value of goods per unit (separately for each type of goods) including the currency (e.g. USD, EUR),

9. Total value of goods (per type) including the currency (e.g. USD, EUR),

10. Terms of delivery according to Incoterms 2010 - it is necessary to state the exact place of delivery e.g. DDP Warsaw and indicate whether the terms of delivery include VAT e.g. DDP Warsaw, including VAT,

11. Total value of all delivered goods including the currency (e.g. USD, EUR),

12. Information on the origin of goods (e.g. „produced in China” or „Country of origin - China”) separately for each type of goods,

13. Statement on the preferential origin of goods (if applicable) exactly as indicated below:

The exporter/supplier of the products covered by this invoice/document declares that, except where otherwise clearly indicated, the products are of …….. preferential origin, in accordance with the provisions of the EU.

10.3.2.2 Temporary import (admission) into Poland

Temporary import means that goods may be used in the EU without payment of duty or VAT under certain conditions and re-exported afterwards outside the EU customs territory or they will be assigned a new customs-approved procedure. The fundamental condition for temporary import is that goods are intended for re-export without having undergone any change except for normal depreciation.

The following customs documents can be submitted to customs:

UEFA Designation letter (sample in Annex 1 ); Temporary admission – document attached to the oral customs declaration (draft

Annex 13) shipping document (CMR, Air Waybill, etc.); power of attorney in case if the authorized representative of ATA Carnet holder

shows the goods to the customs authorities.

GOODS MUST BE FULLY RETURNED OUTSIDE THE EU CUSTOMS TERRITORY.

If they are not re-exported, goods will be assigned a new customs-approved procedure and payment of customs duties and taxes will be obligatory.

10.3.2.2.1 ATA Carnet in Poland

General description of ATA Carnet procedure in Poland is similar as above in Ukraine. ATA carnets are used for most temporary imports (commercial samples and specimens, goods for fairs and exhibitions, professional and other equipment). They allow goods to be imported from 71 countries (including Ukraine and Switzerland) with full exemption from VAT and duty payments.

The ATA carnet has to be filled in by applicant (Holder of ATA carnet or his representative, e.g. customs agency) for his release. It must be completed legibly (computer or on the machine) in a foreign language, provided the importing country (English is advisable). Customs authorities in Poland may require to present General List with description of goods in Polish language.

The other necessities for the process of filling in of ATA carnet in Poland are the same as in Ukraine (see chapter 9.3.2.2).

10.3.2.2.2 UEFA Designation Letter for temporary imported goods

UEFA Designation letter’s process, which was described in chapter 3., is dedicated for temporary imported goods into Poland as an alternative to ATA Carnet procedure. The results of this process for Exporter/Shipper of goods are:

no need to give security for payment of customs duties and taxes and

verbal (not written) customs declaration with required list of goods (template in Annex 10) or as a list of goods without following the template, but containing at least information on the quantity and value of the goods, a suggested date of re-export of the goods, as well as the applicant name and address (indicating the person responsible for customs matters in the company including their e-mail address and telephone number) and such data of a representative (if appointed) or a proxy for notification in Poland).

12.15 Annex 15. C 16 Regulations

Appendix to regulation No. 4013/2006 of the President of Warsaw of 31st of October 2006

REGULATIONS OF ISSUING C16 ID’s

§ 1. SCOPE

These Regulations set out the rules and procedures regarding the issuing of C16 ID tags as described in the regulation No. 4013/2006 of the President of Warsaw of 31st of October 2006 regarding the restrictions in movement of vehicles with total permissible weight above 16 tons.

§ 2. DEFINITIONS

Whenever the following is mentioned in these Regulations: 1) Road Management – it shall mean the Urban Road Management in Warsaw, with

its seat in Warsaw at 120 Chmielna st; 2) C16 ID – it shall mean a document prepared according to the template set out in

Appendix 1 to these Regulations, in the form of a card containing: a) a hologram, b) the registration number of the vehicle to which the C16 ID applies (in the

case as set out in § 4 cl. 2 pt. 1), c) the permitted route based on the C16 ID, d) the hours of validity of the C16 ID, e) the validity period of the C16 ID, f) the C16 ID owner;

3) Vehicle Owner – shall mean the party which owns the vehicle on the basis of any legal title.

§ 3. GENERAL PRINCIPLES

1. The C16 ID owner is permitted to enter and move within the City of Warsaw with a vehicle with total permissible weight above 16 tons, along the routes as set out on the C16 ID, within the period of traffic restrictions for these vehicles, as indicated by the relevant traffic signs located in the City of Warsaw and outside its limits.

2. The C16 ID' shall be placed inside the windshield in the lower left corner. 3. The appropriate use of a C16 ID is subject to control by the relevant services authorized

to perform traffic control. 4.

§ 4. C16 ID ISSUE REGULATIONS

1. The C16 ID is issued at the request of the Vehicle Owner wishing to obtain permission for his vehicle to enter and move within the City of Warsaw along a pre-determined route within the period of traffic restrictions for these vehicles.

2. The C 16 ID's are issued:

1) for a specific vehicle with total permissible weight above 16 tons, identified by its registration number;

2) without the indication of a specific vehicle with total permissible weight above 16 tons to which the C16 ID would apply, if the requestor indicates in the C16 ID application that he possesses more than 50 vehicles and is unable at the moment of submitting the application to indicate the specific vehicle to which the C16 ID will apply.

3. The C16 ID application form, as per template in Appendix 2 of these Regulations, is issued at the seat of the Road Management and is also available at www.zdm.waw.pl.

4. The C16 ID application form must be submitted, with a tax stamp to the value of PLN 5 attached, in the Road Management Chancellery located at its seat.

5. The C16 ID's are issued on the basis of the submitted applications, in cases justified by the necessity for:

1) continuous operation of public institutions, including emergency services such as emergency units, hospitals, clinics and shelters;

2) the maintenance of technological processes, meaning processes that due to their nature may lead to:

a) the termination or the impossibility to commence of investments in the City of Warsaw, or

b) interruption of the functioning of the City of Warsaw, or c) large-scale damage to the City of Warsaw or the requestor, who – due to

his mode of operations or inability to offload the cargo to vehicles with total permissible weight below 16 tons – cannot conform to the traffic restrictions.

6. The decision to issue a C16 ID is made by an authorized employee of the Road Management, following a positive opinion from another Road Management employee, who is tasked with drafting opinions regarding the issue of C16 ID's.

7. The opinion regarding the issue of a C16 ID is drafted on the basis of documents submitted by the requestor, evidencing the criteria set out in cl. 5.

8. C16 ID's are issued free of charge.

§ 5. VALIDITY OF ISSUED C16 ID's

1. A C16 ID is valid for the period indicated on the C16 ID. 2. A C16 ID loses its validity when its validity period ends, or if any data described in § 2 pt

previous C16 ID. 4. In case a C16 ID is lost or damaged to the extent which prevents its further use, a new

C16 ID shall only be issued after the requestor has submitted a relevant declaration of loss or damage of the previous C16 ID.

§ 6. FINAL PROVISION

A C16 ID does not permit entry into the restricted traffic zone for vehicles with total permissible weight above 5 or 10 tons.
