Finishing the year on a high is definitely what current clients of

1 - Use an independent mortgage broker

Finding the right mortgage involves lots of work as

there are so many different deals available from

scores of lenders. Finding the most competitive deal

is a time-consuming task unless you use a

mortgage broker.

Not just any broker will do. Always use an

independent broker, such as Savills Private Finance

(SPF), with access to all the mortgages on the

market. The likelihood is that those restricted to a

panel of lenders will not be able to find the best deal.

A good broker will be able to talk through what

sort of loan suits your circumstances and help you

choose the best deal. SPF also offers exclusive rates

and products, saving you even more money.

2 - Figure out what type of mortgageyou need

There is no single best mortgage deal - the right

one for you will be the one that best suits your

circumstances.

If you need the certainty of guaranteed monthly

repayments because you are on a tight budget, you

need a fixed-rate mortgage. These also suit those

who believe interest rates are going to rise because

they protect you from such fluctuations.

Borrowers typically fix for two, three or five years

although shorter and much longer fixes are

available. The shorter the fix, the better the rate,

with two-year fixes starting from 4.15 per cent;

three-year fixes from 4.24 per cent; and five-year

fixes from 4.39 per cent.

Make sure you don’t fix for longer than you are

comfortable with i.e. a ten-year fix if there is a

chance you will want to move next year, for example.

Fixed-rate mortgages can have hefty early repayment

penalties so stick with a period that you are happy

with. And remember, the downside with fixed rates

is that if interest rates fall, you won’t benefit.

3 - Consider a tracker

Borrowers who don’t need the certainty of fixed

monthly repayments and who can afford to be

wrong – i.e. if rates move up rather than down they

can still afford their mortgage – may find a tracker

mortgage to be more suitable. This tracks the base

rate so any cut made by the Bank of England is

passed onto borrowers in full soon afterwards. So if

rates move downwards over the next few months,

these borrowers will benefit from lower monthly

repayments.

Tracker rates start from 0.11 per cent under base

for two years, giving a current pay rate of 4.39 per

cent. They tend to be better value in the long run

than discounted mortgages, even if the latter are

cheaper at least initially (starting from 4.24 per

cent).

This is because a discounted rate is a few

percentage points below the lender’s SVR rather

than the base rate, so while lenders are obliged to

pass on a cut in the base rate in full to customers

with base-rate trackers, they aren’t obliged to

adjust their SVR accordingly. Thus a borrower on a

discounted rate may miss out on the full scale of

any rate cut.

4 - Think about fees

While the rate of interest on a mortgage is

undeniably important, so too are the fees. These

have been rising in recent months and are

consequently far higher than in the past.

Arrangement fees are typically around £300 to

£400, although they can be as high as £600. Most

lenders will let you add this onto the mortgage so

you don’t have to pay upfront.

As a general rule, if you are taking out a fairly small

mortgage you should opt for a smaller fee and

higher rate, whereas if you want a bigger loan, a

higher fee and lower rate are more cost-effective.

5 - Avoid a higher lending charge

Some lenders impose a higher lending charge (HLC)

if you have no deposit or a very small one. This is a

percentage of the loan and can be as much as a

few thousand pounds. It is used to purchase an

insurance policy protecting the lender against the

borrower defaulting on their mortgage: if the

property has to be repossessed and sold, it ensures

the lender doesn’t lose any money.

Many lenders don’t impose a HLC so it’s worth

shopping around for one that doesn’t.

6 - Beware marketing gimmicks

A free car, iPod or £250 cash are all various

incentives offered by lenders recently to encourage

borrowers to take out a mortgage with them. But

before being dazzled by the freebies it is important

to work out the true cost: often the mortgage will

have a higher rate of interest than the best deals on

the market and a sizeable arrangement fee. Try to

be guided by the interest rate and fees rather than

gimmicks.

7 - Consider protection

If you have dependants you must consider what

will happen to them if anything happens to you. It

is worth taking out life cover if you haven’t already

got it to ensure your mortgage is paid off if you die.

If you are remortgaging you may want to review

existing cover to ensure it will pay out enough.

Autumn is a good time to buy a new home. With summer holidays out of the way

and the Christmas festivities still some way off, it can be the perfect opportunity to

consider upping sticks and moving to a new property.

However, getting the financing right is crucial. Despite a reduction in interest rates to 4.5 per

cent in August, this came on the back of four increases in 2004 so affordability is likely to be

more of an issue than in the past.

There are plenty of excellent deals out there but picking the best one can be daunting. Below,

I run through the golden rules you should follow to help you get the right mortgage.

SIPPS: FACT OR FICTION?What is a SIPP and why is it receiving somuch publicity in the property world?

A SIPP is a Self Invested Personal Pension plan which

enables the policyholder to direct the investments in

the fund. Typically personal pension funds are invested

by insurance companies whose performance over

recent years have been somewhat disappointing.

These SIPP plans are approved by HM Revenue &

Customs (HMRC) and premiums to a SIPP attract tax

relief at an individual’s highest rate, subject to

prescribed limits

Where does property fit in?

Under the current rules, a SIPP can only invest in

commercial property (i.e. a shop, office or factory).

Over the years commercial property has proved a very

good hedge against inflation but has not seen the same

huge increases in value experienced by residential

property in the South East.

Against this, rental income can provide a good rate of

return which, locked in a pension, is tax-free.

This form of investment has proved very popular with

the owner managed business, enabling the owner to

acquire business premises in a very tax efficient vehicle.

As well as no Income Tax (IT) being paid on rental

income, no Capital Gains Tax (CGT) is payable on the

eventual sale of the business property

What’s changed?

The Government has introduced new rules to simplify

the pensions tax regime as from 6th April 2006.

Presently there are a confusing number of different

types of pension funds, all with different tax rules and

regulations. From 6th April 2006, officially named A-

Day for reasons known only to the Government, all

pension funds will operate under one set of rules as

summarised in the table.

The new rules have been issued on a piece-meal basis

over the last 12 months and, whilst there are still some

uncertainties over detailed provisions, the main rules are

clear.

The rule that is causing all the interest is the one that

allows pension funds to invest in residential property for

the very first time.

This is where the SIPP comes in.

What does all this mean for me? ShouldI transfer my own house into a SIPP?

It depends on the circumstances but probably not. This

is because:

- You no longer own it, the SIPP does

- It is already free of capital gains tax (CGT)

- The trustees of the SIPP will be very strict with

how the property is maintained

- You will have to pay rent to the SIPP at a market

value or suffer a tax charge at your highest rate

- The property may have to be sold to provide your

retirement benefit.

Can I transfer my existing buy-to-letinvestments into a SIPP?

Possibly! It is technically possible to transfer all or part

of a buy-to-let property into a SIPP subject to the

contribution limits of 100% of earnings up to a

maximum of £215,000.

The main problem here is that CGT is due on the

transfer into the fund. The CGT is based on the

difference between the market value at the date of

transfer less the original cost adjusted for indexation up

to 5th April 1998. The Capital Gain is then taxed at

your highest marginal rate, which in many cases will be

40% and don’t forget Stamp Duty Land Tax on the

transfer.

Is there another way?

One alternative may be to re-mortgage the buy-to-let

property up to its original cost and then use the money

generated to pay into a SIPP, with a view to using these

funds to acquire a new buy-to-let property.

In this way no CGT is payable and if this is done

correctly full tax relief is available on the re-mortgage.

But you will need expert advice to do it properly!

Another simple alternative exists if you have an existing

SIPP, which hold sufficient investments. These

investments can be encashed to provide the funds to

purchase existing buy-to-let property. The property is

then owned by the pension fund and you then have

cash to invest, possibly in another property.

Capital Gains Tax and Stamp Duty Land Tax will also need

to be considered but it may be possible to mitigate this if

the funds were used to make further pension

contributions into the SIPP. Subject to the limits of course.

What about a holiday home abroad?

Probably not a good idea! Because a SIPP is really a trust

and trusts are not recognised in many foreign countries,

it may be better to buy your holiday home personally.

Although the SIPP is a tax-free fund in the UK, income

and capital gains generated abroad will be taxable at

possibly higher rates than here. This especially applies

to Spain.

For a SIPP to be tax-efficient, the overseas property

would have to be in a very low tax area otherwise you

may not get the tax break you bargained for. However

at the moment SIPP providers are very wary of overseas

investments.

A further problem with overseas property is that the

policyholder would need to pay the SIPP market rent for

personal use or suffer a tax charge.

It is possible that HMRC may seek to tax policyholders

for periods when the property is not let, but we will not

know the outcome of this for some time.

A holiday home in the UK then?

As the UK recognises trusts the problem of paying IT

and CGT disappears. Not so for personal use! The

same rules apply and the policyholder could face a tax

charge for personal use and unoccupied periods.

Commercially, a furnished holiday home let in the UK

already enjoys favourable tax treatment so the benefits

of ownership in a SIPP could easily be outweighed by

tax charges for personal use.

What then is an ideal investment for a SIPP?

Easy! A UK buy-to-let residential property, but not one

already in the ownership of the policyholder. And don’t

forget commercial property. This is still as good as it

always was but don’t forget the Lifetime Allowance of

£1.5 million.

Good, but I don’t have the money. It islocked in my company and to draw itout would cost me lots of tax.

No problem! Even if you are receiving a very low salary

and taking dividends instead, after the 6th April 2006

your company can pay up to £215,000 into your SIPP.

Another of those uncertainties that we still don’t know

the answer to is whether HMRC will seek to spread the

tax relief on these employer contributions over more

than one accounting year. Even so this is likely to be a

minor problem against the main advantage of

extracting funds locked into a Company in a very tax

efficient way.

But what happens when I retire? I hearthat annuity rates are low and may not bea good time to sell investment properties.

Again, no problem! The new regulations have relaxed

the rules on annuities. So, instead of selling your entire

portfolio of investments, pension benefits can, within

limits, be withdrawn from those investments.

For example, if a SIPP only contains UK buy-to-let

properties, the tax-free rental income from these properties

can be used to fund the pension to the policyholder.

On death the fund assets can be passed to other

members of the scheme, for example the policyholder’s

children. It now appears that this won’t escape

Inheritance Tax as was originally thought, but the final

details have still to be decided.

Hopefully this clarifies the considerable amount of

speculation that exists on the subject of SIPP’s. There will

be many changes to the rules on 6th April 2006. We

recommend that anyone with an existing pension fund,

especially if you are approaching or exceeding the

Lifetime Allowance of £1.5 million, should have their

circumstances reviewed by an expert.

NEW PENSION REGIME FROM6th APRIL 2006

• One set of rules will apply to all pension schemes.

• A Lifetime Allowance limiting the value of tax-free

pension funds is introduced. For 2006/07 this is

£1.5m.

• Complicated transitional rules exist to protect those

whose funds at 6th April 2006 already exceed £1.5m.

• A lifetime tax charge will exist if benefits exceed the

£1.5 million Lifetime Allowance.

• A maximum annual pension contribution of

£215,000. Tax at 40% is charged on the excess.

• Annual maximum contribution of £3,600 or 100%

of earnings, whichever is greater.

• 25% of the fund value can be taken as a tax-free

lump sum.

• Benefits can be taken from age 50 (55 from 6th

April 2010).

• Benefits can be taken without having to cease

employment.

• Available investments will include residential

property. The fund can borrow up to 50% of the

capital value of the fund.

• No need to ever purchase an annuity or sell assets

as pension income can be taken direct from the

fund.

• A pension fund will be able to acquire assets from

the policyholder.
