The Sarr~iti considered the proposals of the following Colleges/ Institutes for finalization of fee structure for the students who joined the courses started during Acaderr~ic year 2012-13. After deliberations, the Sarr~iti decides to approve the final fee structure of the following Institutes/Colleges for the students who joined the course started during AY 2012-13. The students admitted in the AY 2012-13 and there after continuing their studies will pay an enhanced fee of 8% each successive year as per the norms for 2012-13 till completion of the course. For example if the fee approved is Rs. 1,00,000/- then 2nd year, 3rd year and 4th year's student will be Rs. 1,08,000/-. (assuming course is of 4 years).

Item No.4: (a) To consider and decide on letter dated 23rd July 2012 received from The Director of Education, ('W iqker Education), Pune resardinq fee fixation of Private unaided BmEd., MmEd., B.P. Ed. and M.P.Ed. Colleses.

Considered the letter dated 21st July 2012 by the I/c. Director of Higher

Education (Maharashtra State, Pune 411 001.) At the outset we may note that it

is not a letter from the State Government. -The order passed by the Division

Bench of the Bombay High Court in W.P. No. 2911/2010 dated 29th November

2011 in the matter of Shri Saibaba Gramin Vikas Sansthan vs. State of

Maharashtra is clear. The Para 8 thereof is as 1~nder:-

'We direct respondent No.1 to place the grievance of petitioners for its approprlbte consideration before the Committee constituted in accordance with the above mentioned guidelines dated 258.2010. The said Committee shall attempt to take fresh decision uninfluenced by earlier orders as early as possible and in any case within a period of four months from today, '

I f this Sarr~iti approves the fee structure of B.Ed., M.Ed., B.P.Ed, and

M.P.Ed, courses then i t will be discriminatory since in case of one institute it will

ibe done as per the Act dated 25th August 2010 - ' Guidelines for Regulation of

Tuition Fees and Other Fees Chargeable by Unaided Teacher Education

Institution as prescribed under Regulations No. F. No. 51-3/2009/P/NCTE(N&S)

dated 25/08/2010.' This is under National Council for Teacher Education

(Guidelines for Regulations Other Fees Chargeable by Un-aided Teacher

Educations Institutions) Amendment Regulations 2010. There is already

reference made by the Division Bench of the Bombay High Court in the said

order in Para 8. Therefore, prima facie it is not possible for this Samiti to

consider request 111ade in the said letter dated 21/7/2012 and 23/7/2012. I t may


be reconsidered and further it may be brought to the notice of the State

Government the order passed by the Division Bench of .the High Court.

(b) To consider and decide on letter dated 16th July 2012 received from Gharda Institute of Technolosy, Watnaqkri reqardinq recovew of fee from Reserved Cateqoiy Student admitted in the AY 2009-10.

Considered the letter dated 8th Julie 2012 and 16th July 2012.

The student by name Mast. Khanderao Maragu Shinde had taken

admission during the year 2009-10 under IVT - C Category. He could not get the

Caste Validity Certificate. He had taken admission in the reserved category and

without making any payment of fees. As he could not get the Caste Validity

Certificate, the Government obviously has refused to reimburse the fees in his

case. The student did not attend the course during 2010-11 and 2011-12. The

college is now asking the student to make payment of fees for the year 2009-10

in which he has taken admission and attended it. The demand made by the

college is quite correct. The rule in that respect reads as under:-

'2) **Caste Validity Certificate:-

Candlilates belonging to SC, S7; VJ/DT/NTO, NTO, NTO, SBC and OBC category are required to produce Caste validity certificate may produce the same on or before 30th November 2011/ such candidates will be admitted on provisional basis. If a candidate fails to submit the required Caste Validity Certificate upto 30th November 2011 then the admission of such candidate shall be automatically cancelled.

Candidates who are unable to produce Caste Validity Certificate are required to submit following documents at the time of filling of CAP Admission Form.

=>Undertaking in Proforma-H by the candidate stating that if the candidate fails to submit Caste Validity Certificate on or before 30th November 2011 then Government and Admission Authority shall not be held responsible for the consequences arising out of cancellation of the admission of the candidate.


Important: I n case the canddate fails to produce the Caste Validity Certificate then the admission secured by such candidate shall be cancelled, Such candidate will be required to pa.y the com,plete fees of one academic year to the respective colle_qe. In any case the admission secured b-y such candidate in the respective reserved cateqory will not be converted into Open Cateqory, '

Therefore, the student will have to make the payment of fees for 2009-10 and on the payment the college shall be bound to return all the original certificates submitted by him.

Extension of date for submitting Proposals for BY 2012-13.

The time to file the proposals is extended up to the end of September

2012 subject to payment of penalty of Rs. 50,000/- (For those proposals, which

are submitted beyond 31st August 2012). It is third time extension. Colleges

may note that i t is the last extension.

The Meeting of the Shikshan Shulka Samiti (Higher & Tect-~nical

Education) to be held on Wednesday the 4th September 2012 at 11.00 a.m. in
