Rs.1000/- (non-refundable) to be paid by way of Pay Order or Demand Draft or

EMD:

All the bidders have to deposit (refundable subject to conditions) EMD @ Rs.

2,00,000/- (Rupees Two Lakhs only) per flat subject to maximum of Rs. 1,00,00,000 (

Rupees one crore only) by way of Pay Order or Demand Draft or Banker’s Cheque of

any Nationalised Bank drawn in favour of “ZAO, CBDT, Mumbai” payable at Mumbai

along with the tender document. No interest is payable on the EMD of the tender

document.

Refund of EMD:

a. EMD of all unsuccessful bidders shall be refunded within one month’s time after

scrutiny & submission of Technical Assessment Report by the Tender Evaluation

Committee.

b. EMD of other bidders who qualified technical bid (except lowest bidder/s) shall be

refunded within one month’s time from the end of month in which financial bids will

be opened.

c. EMD of lowest bidder shall be refunded separately or adjusted along with the

payment towards cost of flats.

d. In case lowest bidder refuses to offer / sale the flats after issue of acceptance letter,

amount shall be forfeited without any further correspondence.

e. Department’s decision either to refund or to forfeit the EMD amount is final &

binding on the bidders.

A pre-bid meeting of all the intending Tenderers desirous of attending shall be held

NOTICE INVITING TENDER

PURCHASE OF READY BUILT RESIDENTIAL FLATS IN MUMBAI

1. Income Tax Department, Mumbai for and on behalf of Hon’ble President of

India intends to purchase / acquire properties on ownership basis, located at specified

locations of Mumbai to be used for residential purpose at various locations. The

applicant may submit application for the properties which are ready to occupy/or

under advanced stage of construction and for which guaranteed possession along with

all necessary, mandatory and statutory clearances/sanctions/permissions etc. will be

available on or before 12 month from the date of opening of Financial Bid. The

prescribed application form can be downloaded from Department’s website

www.incometaxindia.gov.in/www.incometaxmumbai.gov.in or collected from Room

No. 380, Aaykar Bhavan, 3rd Floor, M. K Road, Mumbai-400020. The details of total

requirement of properties to be purchased at Mumbai are as under:

Preferred Locations are: 1. Bandra, Kurla(W), Vashi, Andheri, Ghatkopar,

Borivali, Chembur, Powai, AntopHill, Goregaon, Malad, Nahur, Airoli, Mulund,

Ghansoli, Belapur, Kharghar, Mulund, Sion & Kandivali.

2. The bidders who are offering all the types i.e type III, II, I within the same

building/same campus/same society will be preferred subject to their qualification

based on Technical and Financial bid

3. Department will shortlist and finalize if the bidder satisfying the entire terms.

At least two bidders will be shortlisted for each location. The prospective

bidders fulfilling above requirements may collect the tender documents viz.

Technical Bid and Price Bid from the Room No. 380, Aaykar Bhavan, 3rd Floor,

M. K Road, Mumbai-400020, Mumbai as per the addresses mentioned. The

tender documents will be issued between 11.00 AM to 5.00 PM (on all working

days) from 02.05.2016 to 26.05.2016 till 04:00 PM.

4. The tender document can also be downloaded from Department’s website

5. If the owner / offerer has more than one projects / premises to be offered, at

different locations, separate tenders have to be submitted for each of the locations.

6. The tender documents complete in all respects, Technical Bid and Financial Bid in

Separate Sealed Envelopes For Each Location duly marked as “Technical Bid”

and “Financial Bid” are to be placed in a single sealed cover superscripted as “Tender

for Residential Flats at ___________Specify Location in Mumbai” along with

following set of documents in the same envelope:

a. Copy of IOD (Intimation of project approval)/ Town Planning (TP approved)/ Approval from local statutory authority. Copy of sanctioned plan and layout.

b. Copy of Commencement Certificate of the project.

c. Copy of Occupation Certification / Completion Certificate issued by local statutory

authority (if the project is ready to move in)

d. Set of approved plans for the entire project.

e. Clear title certificate or ownership document or development agreement.

f. Environmental Clearance Certificate

g. Approval from Fire Safety Department

h. Approval from NHAI for approach road to the project if applicable.

i. Brochure of the project clearly showing the location map and plans of the buildings

along with amenities / services to be provided in the project.

j. Latest Income tax returns for the A.Y. 2015-16 and audited balance sheet for the

same financial year (2014-15) of the offerer.

k. Any other statutory clearance which the norms demand/warrant.

l. Copy of title investigation and Search Report along with copy of Title Deed

documents.

m. Structural Stability Certificate from licensed structural engineer of Municipal

Corporation / Local authority.

n. Site plan copy and NOC from the Society, in case offered flat is in old building.

7.1 The offerer has to get four envelopes and mark the envelopes as I, II, III & IV.

Usage of envelopes will be as under:

i) Envelope marked as I: Technical Bid, duly completed in all respects, be put in this

envelope and sealed. The envelope would be superscribed as Technical Bid. This

envelope will be opened only after opening envelope II. The bidders whose envelope II

does not contain tender fees and EMD will automatically be rejected and their

technical bid envelope will not be opened.

ii) Envelope marked as II: This envelope shall contain the pay order or Banker’s

Cheque or Demand Drafts towards Tender Fees (non-refundable) and EMD

(refundable under certain conditions).

iii) Envelope marked as III: Financial bid be put in this envelope and sealed. This

envelope would be superscripted as Financial Bid. The envelope will be opened if the

offer is found technically suitable fulfilling the requirements stipulated by the

Department.

iv) Envelope marked as IV: The above three sealed envelopes No. I, No. II and No. III be

placed in envelope No. IV and sealed (i.e. envelope marked as IV, will contain three

envelopes marked as I, II & III). This envelope marked as No. IV would be

superscripted as “Offer for Residential Flats at ---------------------Specifiy Location

in Mumbai”.

7.2 The duly filled in and sealed and superscripted tender envelopes must be dropped

in the sealed Tender Box placed at the Room No. 380, Aaykar Bhavan, 3rd Floor, M. K

Road, Mumbai-400020.

8. The Technical Bids will be opened on 27.05.2016 at 11:00 AM at Conference Room,

Aaykar Bhavan, 3rd Floor, M. K Road, Mumbai-400020 in presence of the bidders or

their Authorized representatives and Department officers. The bidders are advised in

their own interest to be present on the date at the specified time. No separate

communication will be made for opening of the bids to bidders to attend. Income Tax

Department may reserve the right to change the schedule if found so necessary for

contingencies which will be informed to bidders.

9. Offers from Brokers/Intermediaries will not be entertained.

10. Department reserves the right to reject any or all the tenders without assigning

any reason whatsoever at any point in the process of acquiring premises. Canvassing

in any form will disqualify the tenderer.

PURCHASE OF READY BUILT RESIDENTIAL FLATS AT MUMBAI

TERMS AND CONDITIONS:

1.1 The terms and conditions shall form part of the tender to be submitted by the bidder/offerer hereinafter termed as “bidder” to Income Tax Department, Mumbai hereinafter termed as “Department”.

1.2 Tender document received by the Department after due date and time i.e. after 4.00 PM on 26.05.2016 shall be rejected outright. No communication shall be entertained in this matter whatsoever.

1.3 All bidders are requested to submit the tender documents (TECHNICAL BID AND FINANCIAL BID) duly filled, supported by relevant documents at the Room No. 380, Aayakar Bhavan, 3rd Floor, M. K Road,

Mumbai-400020.

1.4 All columns in the tender document must be duly filled and no column should be left blank. “Nil” or “Not Applicable” should be marked where there is nothing to report. All the pages of the tender documents should be signed by the authorized signatory of the tenderer. Any over-writing or use of white ink should be duly authenticated by the tenderer. The Department reserves the right to reject incomplete tenders or in cases where information submitted is found incorrect.

1.5 In case the space in the tender document is found insufficient, the bidders may use separate sheets to provide full information.

1.6 The offer for price as well as for quantity of inventory offered shall remain valid at least for a period of 12 months from the date of opening of Financial bid. During the validity period of the offer, the bidder will not withdraw / modify the offer in terms of price, inventory and other terms and conditions quoted in the bid. In this regard, the undertaking is to be submitted by the bidder along with the Technical Bid as per the prescribed format (Annexure)

1.7 There should not be any deviation in the terms & conditions as have been stipulated in the tender document. However, in the event of imposition of any other condition, which may lead to deviation with respect of the terms & conditions as mentioned in the tender document, the bidder is required to attach a separate sheet marking “list of deviations”. Bidders are advised to bring this in the notice of Income Tax Department during pre-bid meeting.

1.8 Canvassing in any form will automatically disqualify the bidder.

1.9 Property should be situated in good & habitable locality in specified locations with congenial

surroundings and proximity to public utility services like, railway station, bus stop, market, hospitals, educational institutes, shopping centre etc. The property shall also be elevated and not prone to water logging. The locality shall have amenities of water supply, sewerage, rain water harvesting, uninterrupted power supply etc.

1.10 Offers, which are ready for possession/guaranteed possession within 6 months along with all

mandatory, statutory & necessary sanctions/permissions will be preferred. Further, preference will be given to the offer received providing all the flats within same building.

1.11 Offers where there is scope/provisions for extended construction in future over the offered existing building with external columns will not be considered. Also, where future creation or construction is a possibility or pending for approval may not be considered i.e. only those projects will be considered where after possession no further construction shall happen in the respective building / wing. However, the builder can undertake construction activity in different wing/ building in the overall project. If the builder wants to utilize the Transferable Developmental Rights (TDR) he may not do so in the building / wing offered to Department, but same can be done in same project. Also the buildings which are under construction and not yet completed for more than 3-4 years are most likely to be rejected for the reason of undue and unwanted delay for completion.

1.12 The payment will be made by Pay Order/ RTGS/ NEFT against the possession of property to the extent of 97% of the purchase cost. The balance 3% payment will be retained as Retention money towards rectification of defects / repairs that may arise during one year period after taking possession. The selected bidder should attend to the defects / repairs free of cost during the period of one year from the date of possession.

1.13 Normally payment is against possession of property. Any interim payments before execution of sale

deed / possession will be minimum and against a Department guarantee. The bidder availing advance payment should also agree to pay penalty @ 18% per annum on the token amount /part payment in case of delay beyond the committed date of possession. For Properties which are complete or ready for possession, the payment will be made as mentioned in point 1.12.

1.14 Where the Department is purchasing full building or entire property, the Sale Agreement and Conveyance Deed shall be signed together without any separate charges for doing conveyance deed, within 6 months of possession.

1.15 The particulars of amenities provided / proposed to be provided inside the flat, building, complex

should be furnished in the Technical Bid.

1.16 Plinth Area

Definition and clarification of plinth area is attached as Annexure to this tender document as a reference for measurement of flats. The annexure is taken from the site of CPWD “Plinth area rate 2012”

1.17 A pre-bid meeting of all the intending bidder desirous of attending shall be held on 09.05.2016 at 11.30 AM at Conference Room, Aaykar Bhavan, 3rd Floor, M. K Road, Mumbai-400020, where the intended bidder scan have detailed dialogue regarding the tender, procedure for filling Bid or any other matter / clarifications concerning the tender.

1.18 Technical Bids will be opened on 27.05.2016 at 11:00 AM in Conference Room, Aaykar Bhavan, 3rd Floor, M. K Road, Mumbai-400020 in the presence of the tenderer/ authorized representatives. Bidders or their authorized representatives are advised in their own interest to be present on the date at the specified time.

1.19 All properties complying with advertisement criteria will be visited by team of Department Officers/Officials primarily for scoring which will be followed subsequently by visit of officers/officials for assessing the valuation and to verify the quality of construction, materials used, etc. The bidder should provide the requisite truthful, correct and accurate information / documentary proof to the visiting teams for verification/inspection.

1.20 The particulars of flat numbers floor-wise, wing, building name, etc. should be furnished in the Technical Bid. Details of measurements of the proposed flat offered should invariably be furnished in the Technical Bid. The tenderer should clearly understand concept of

plinth area as explained above in Para 1.16 and the same only will be considered for payment.

1.21 The property offered should be unencumbered and have clear and marketable title. Adequate documentary evidence to this effect should be furnished along with the Technical Bid.

1.22 While furnishing the information in Technical Bid, full detailed specifications of the items / materials used including the brand name, size, quantity, quality, etc. should be furnished for each and every item in the respective columns. In case of flooring, windows, doors, door shutters, etc. full detailed specifications of quality of material used, thickness, size, brand name, etc. should be furnished. These details are subject to verification.

1.23 Plans duly approved by municipal authorities/competent authority should be submitted along with the Technical Bid. Particulars of TDR (Transfer of Development Right in Mumbai) used, if any, and the eligible FSI and FSI used, etc. are to be furnished in the respective columns along with the requisite certificates issued by the competent authorities. For old buildings, NOC from the Society should be enclosed.

1.24 All the legal documents required by the Department for verification of the title clearance of the property should be submitted before finalizing the offer. The title certificate issued by Department’s Solicitor / Advocate only shall be considered.

1.25 It is the policy of the Department to issue Public Notice in the leading newspapers inviting claims from the public, if any, before entering into conveyance deed / MOU for the offered property. The bidder should not have any objection in this regard.

1.26 The bidders, at their own cost, shall obtain all statutory clearances as and when required.

1.27 The following documents should be enclosed with the technical bid :

1.28 Any advance payment to the successful bidder before execution of sale deed and possession will be

made only against Department Guarantee.

1.29 Department reserves the right to accept or reject any or all the tenders / offers without assigning any reason whatsoever at any point in the process.

1.30 The requirements of flats mentioned in the tender document are indicative. Depending on the availability/exigencies, the Department may enhance or reduce the requirement in a particular sector / centre/location or may readjust allocation within the same location.

1.31 The offer submitted shall confirm to area norms specified. The Department may consider offers to a maximum of 10% deviation of the area indicated, however the same is subject to approval of the CPWD.

1.32 No high tension wire shall pass through the plot of the offered flats.

1.33 The plot shall have good frontage and proper access. It should be free from encroachments

litigation & have clear title.

1.34 Any over writing or use of white ink is to be duly initialled by the tenderer. The Department reserves the right to reject the incomplete tenders.

1.35 Department is not bound to accept the lowest bid.

1.36 Department will evaluate the tenders received at each location separately even if given by same bidder on other location.

EVALUATION OF TECHNICAL BID

1. The Department has adopted system of Combined Quality cum Cost Based System (CQCCBS) for

evaluation of Technical bid received. The salient feature of evaluation system is mentioned as

under:

1.1 All the offers received will be screened and short listed by the Committee constituted by Pr. Chief

Commissioner of Income-Tax, Mumbai/Project Committee, based on the requirement specified and

the details submitted by the bidder by carrying out inspection of the offered sites. The offerer

should have flats in ready condition for the inspection of committee. Immediately after

opening of the Technical Bid (Photographs of flat should be attached with Technical bid),

all such short listed offers will be further inspected and examined by the Committee and

will be further evaluated on the qualitative aspects in various parameters. The detailed list

and marks assigned to each parameter is as under:

1.2 Minimum 70% marks are necessary for opening of the Financial Bid in each category (location).

1.3 Financial bids will be opened only if minimum two technically qualified bids for each

location are available.

1.4 Bidders are advised to note importantly that evaluation of offers will be under Combined

Quality cum Cost Based System (CQCCBS). The procedure which will be followed to arrive

at conclusion at each location under this system will be as under:

i) Preliminary evaluation of the documents submitted in the technical bids will be done to

ensure that the bidders fulfil the basic selection criteria as per detailed terms and

conditions specified in the tender documents.

ii) Thereafter, the site will be visited by Department Officials/ CPWD official to verify the suitability of

location and genuineness of facts stated in the technical bid submitted. The Shortlisting of bids will be

subjected to detailed evaluation by allotting marks on various parameters/criteria

prescribed in the bid document to arrive at the qualifying marks. The marks will be given

by the committee after due consideration of all parameters. Marks given will be final and

no communication to alter or increase the marks given shall be entertained by the Department.

iii) Bidder obtaining marks more than 70 % will be qualified, once qualified all the bidders who have

qualified will be at same platform and then final negotiation will be done with the bidder having lowest

financial bid among the qualified who will be designated as L1.

iv) The financial bids of only those bidders, who qualify technically by obtaining a minimum

qualifying mark of 70% in their technical evaluation, will be opened.

1.5 The negotiation will be done with L1 after assessing the reasonability of the rates.

It is observed from the above that bidder (A) is L1 bidder and order shall be placed to him.

In case the L1 bidder is unable to provide all the flats as per Department’s requirement, then

Department may purchase flats from L2 in its own discretion (Department is having full discretion) at a rate as per below formula As per above examples = (Rate of L1) x Technical mark of L2/ Technical mark of L1 Or the actual rate quoted by L2 in financial bid whichever is lower

Even after clubbing the total nos. of flats provided by L1 & L2, if total demand of Department is

not fulfilled. Department at its own discretion may purchase flat from L3 as per below formula. As per above examples = (Rate of L1) x Technical mark of L3/ Technical mark of L1 Or the actual rate quoted by L3 in financial bid whichever is lower 1.6 The same procedure will be followed for bids at different Locations and accordingly L1, L2, L3 will be determined separately for all locations. 1.7 EMD: All the bidders have to deposit EMD @ Rs.200,000/- (Rs Two lacs only) per flat subject to maximum of Rs. 1,00,00,000/- (Rs. One Crore only) towards all the flats offered for sale by the bidder by a crossed demand draft or Banker’s Cheque or payment order in favour of “ZAO, CBDT, Mumbai” payable at Mumbai while submitting the tender . 1.8 The price bid of the bidder who does not deposit such EMD shall not be opened and their offer shall stand automatically rejected.
