debut, three Queens will uphold our finest traditions of quality and service together, an unprece-

dented event in Cunard’s long and illustrious history.

Our magnificent flagship operates the only scheduled Transatlantic service, rais-

ing the classic crossing to exceptional new heights. In January 2007, she reinter-

prets another grand Cunard tradition on her Maiden World Cruise, an inspirational 75-night odyssey. Her

2007-2008 Caribbean & New York Collection offers the opportunity of combining the laid- back charm of

the Caribbean with the buzz and excitement of the Big Apple. Summer brings European adventures and

autumn showcases the magical colours of the Canada and New England countryside.

QE2 sails roundtrip from Southampton to a host of European favourites, venturing too across

the Atlantic to North America and the Caribbean. In January 2007, she sets off on her historic

before marking the 40th anniversary of her launch with a celebratory voyage around home

shores in September 2007.

Evening Dress CodeOne of the great thrills of a Cunard voyage is the sheer glamour of the evenings. Evening attire for the ship’s main restaurants,effective from 1800hrs, will be specified in your ship’s Daily Programme. Please refer to the adjacent dress code descriptionsand the table below. Casual clothing is permitted each evening in the Lido on QUEEN ELIZABETH 2 and the Kings Court onQUEEN MARY 2. Booking ConditionsThese are the terms and conditions which will apply to yourholiday. Please read them carefully as you will be bound bythem.

DEFINITIONS

1. In these Conditions and unless the context requiresotherwise: “the Contract” means the contract made betweenCunard and the Guest relating to the holiday; “Cunard” meansCarnival plc trading as Cunard Line; “fare” means the fare forthe holiday (excluding shore excursions and any additionalcharges shown as such in the relevant Cunard brochure orotherwise advertised) applicable at the time of booking andpayable by the Guest under the Contract; “force majeure”means unusual and unforeseeable circumstances beyond thecontrol of Cunard that Cunard cannot, even with the exerciseof reasonable skill and care, provide the holiday, or partthereof, including any part of the itinerary, and includes(without limitation) war or threat of war, terrorist activity orthe threat of terrorist activity, riots, civil commotion, disaster,Act of God, natural and nuclear disaster, fire, closure of ports,strikes or other industrial action, medical problems on boardthe ship or at intended ports, including in each case incidentsof infectious or other diseases or illnesses, lawful deviation atsea in response to a distress call or other emergency andadverse weather conditions; “Guest” means each and everyperson named in the booking and/or a Cunard ticket;“holiday” means the cruise holiday as described in therelevant Cunard brochure or other documentation publishedby or on behalf of Cunard including any flights to and from theUK and any pre-cruise and/or post-cruise package, but notincluding shore excursions or shuttle services; “itinerary”means the proposed itinerary as described in the relevantCunard brochure or other documentation published by or onbehalf of Cunard; “shore excursion” means any excursionoffered for sale by Cunard in the “Voyage Information” guideapplicable to a holiday for which a separate charge is payableat the time outside the all-inclusive fare whether booked inthe UK prior to the commencement of the holiday or on boardthe ship; “shuttle service” means any transportation service(ferry, bus, coach or minibus) provided by a third party whichmay (without guarantee) be available to Cunard’s guests incertain ports; “a significant alteration” means major changesto your holiday; "Supplier(s)" means any company orindividual which provides any service forming part of theholiday.

THE CONTRACT

2. The Contract shall be between Cunard and the Guest on thebasis of these Conditions and the information contained in thebrochure, and shall be governed by English law and the non-exclusive jurisdiction of the English courts. By entering thecontract Cunard agrees to exercise reasonable skill and careto provide the holiday.

3. By making a booking, the Guest confirms that all personsnamed in the booking (and their personal representatives)have agreed to be bound by these Conditions and all otherterms of the Contract, and that he/she has their authority todo so on their behalf.

4. All holidays are subject to availability at the time of booking.No Contract shall be made until the deposit (or, whereappropriate, the full fare) has been paid, whether or not abooking confirmation has been issued but all money paid to atravel agent shall be treated as having been paid to Cunard.Failure to pay the balance by the due date shall entitle Cunardto cancel the booking and retain the deposit by way of acancellation charge. Failure to pay any other amount by thedue date shall entitle Cunard to cancel the booking and toretain an amount by way of a cancellation charge as set outin clause 25.

5. A booking may only be made by a person aged 18 or over. AllGuests who, at the time of departure, will be under 18 yearsof age must be accompanied by a Guest aged 21 or over whowill at all times during the holiday be responsible for theirwelfare, conduct and behaviour.

6. Children aged 6 months or less at the commencement of theholiday will be refused permission to board the ship andCunard shall have no liability whatsoever for anyconsequences of such refusal. Certain holidays also haveprohibitions on children aged 12 months or less, Guestsshould check with Cunard before booking.

7. Cunard does not have on board its ships adequate medicalfacilities for childbirth. Accordingly Cunard cannot accept abooking or subsequently carry any Guest who will be 28weeks or more pregnant by the end of the intended holiday

(whether or not a fly cruise). In the case of a booking by oron behalf of any such Guest made before it couldreasonably have been known that the Guest would not beable to take the holiday by reason of this clause andprovided that the Guest notifies Cunard of the pregnancywithin 14 days of this becoming apparent, Cunard willrefund in full the fare paid by or on behalf of that Guest andthe fare paid by any accompanying Guest but shallotherwise have no liability whatsoever. Cunard expresslyreserves the right to refuse passage on board to any Guestwho appears to be in any advanced state of pregnancy andCunard shall have no liability whatsoever in respect ofeither such refusal and/or the carriage of any such Guest.

8. Cunard reserves the right to require any Guest to producemedical evidence of fitness to travel on the holiday.

9. Guests with physical or mental disabilities or other handicapswhich may require special treatment or assistance (includingpersons confined to wheelchairs) must advise Cunard inwriting before a booking is made. Some hotels offer no or onlylimited facilities for disabled persons. Guests confined towheelchairs must furnish their own standard sizewheelchairs and must be accompanied by a travellingcompanion fit and able to assist them. Ships wheelchairs areavailable for emergency use only. Cunard reserves the right torefuse passage to any Guest who has failed to notify Cunardof such disabilities or need for assistance or who in theopinion of Cunard is unfit for travel or whose condition mayconstitute a danger to themselves or to others on board, andCunard shall have no liability for such refusal. Furtherinformation is contained in the brochure.

10. A Guest shall not have the right to exclusive occupancy of astateroom with two or more berths or a twin/double hotelroom unless the single person surcharge is paid. If acancellation results in a Guest becoming the sole occupant ofa stateroom with two or more berths or a twin/double hotelroom, he/she shall be liable to pay the single personsurcharge. If a cancellation reduces the number of Guestsoriginally booked in a stateroom or hotel room together, theremaining Guests shall each be liable to pay any increase inthe fare arising as the result of such reduction.

11. For fly cruises (and if not already confirmed at the time ofbooking), Cunard will issue an ATOL confirmation invoicegiving the details of the flight arrangements (including UKand destination airports) within a reasonable time aftersuch arrangements are known.

12. Shore Excursions are available for separate purchase onboard and are arranged by Cunard with local operators.They do not form part of the Contract. Other excursions notarranged by Cunard may also be available for purchase atthe hotel, but such excursions similarly do not form part ofthe Contract and Cunard has no responsibility for theirproper performance.

TRANSFERS OF THE CONTRACT

13. In clauses 13 and 14, “another person” means anotherperson who satisfies all conditions applicable to theholiday. A booking may be transferred to another personprovided that Cunard receives the transfer request morethan 56 days before the scheduled departure date.Between 56 and 14 days (inclusive) before the scheduleddeparture date, Cunard will normally agree to such atransfer only where the original Guest will be preventedfrom travelling by reason of an unavoidable event (such asillness, death of a close relative or jury service) and Cunardmay require satisfactory evidence before agreeing to thetransfer. All transfers of a booking to another person at anytime up to 14 days or more before the scheduled departuredate will be subject to an administration charge of €30.

14. Any request for a transfer of a booking to another personwhich is received by Cunard 13 days or less before thescheduled departure date shall be treated as a cancellationby the Guest of the original booking and a cancellationcharge under clause 25 shall become payable.

15. Any transfer of a fly cruise will also be subject to anycharges imposed by the airline. Guests should note thatairlines may not allow transfers on scheduled flights andthat a flight booking may have to be cancelled andrebooked, in which event the re-booking will always besubject to flight availability and to payment of any chargesimposed by the airline which may, in some cases, be thefull cost of the ticket.

16. Subject always to availability and to payment of both anadministration charge of €150 and any expenses (such as

airline and/or hotel charges) incurred by Cunard as a result,a Guest may transfer to another holiday advertised in thebrochure at any time up to 56 days 90 days for WorldCruise, Liners and Exotic Voyages before the originalscheduled departure date. After that time, any suchtransfer will be treated as a cancellation by the Guest anda cancellation charge under clause 25 shall becomepayable.

17. All transfers to another holiday will be treated as a newbooking. Any discount applicable to the original bookingmay not apply to the new booking, in which case the Guestshall be required to pay any difference in fare.

18. After a holiday has been booked, Cunard will try toaccommodate any request for a change (such as a changeof stateroom), but such changes are always at Cunard’sdiscretion and are subject to an administration charge of€30.

INSURANCE

19. It is a condition of the Contract that every Guest must havetravel insurance in force for the entire duration of theholiday. Details of suitable insurance (which must as aminimum include medical and repatriation coverage for notless than €3 million) must be provided at the time ofbooking or as soon as practicable thereafter.

20. Wherever possible, Cunard will offer general assistance toany Guest who suffers illness, personal injury or deathduring the period of the holiday, whether or not arising froman activity forming part of the holiday and whether or notthe result of fault by any party.

21. Any cost or expense which is reasonably incurred byCunard for or on behalf of the Guest in respect of any formof medical, dental or similar treatment, hotel,transportation, repatriation or any other expense shall berepayable by the Guest to Cunard, whether or not such sumis covered by the Guest’s travel insurance.

FARES AND EXTRAS

22. All fares are based on costs and exchange rates as at July2006 and include all port and airport charges and taxes setout in the brochure.

23. The fare can be varied due to changes in transportationcosts such as fuel, scheduled air fares and other airline costchanges which are part of the contract between the airline(and their agents) and Cunard, government action such aschanges in VAT or any other government imposed changesand currency changes in relation to an exchange ratevariation. In the case of any small variation, an amountequivalent to 2 per cent of the fare of your travelarrangements, which excludes insurance premiums andany amendment charges, will be absorbed for increases butnot retained from refunds. In either case there will be anadministration charge of the Euro equivalent of £1 perGuest, together with an amount to cover agents'commission. If this means the Guest has to pay an increaseof more than 10 per cent of the fare, the Guest may cancelthe holiday and receive a full refund of all monies paidexcept for any amendment charges. Cunard will consider anappropriate refund of insurance premiums paid if the Guestcan show that he was unable to transfer or re-use thepolicy. Should the Guest decide to cancel for this reason,the Guest must exercise his right to do so within 14 daysfrom the issue date printed on the final invoice.Alternatively, the Guest can accept an offer of an alternativeholiday if Cunard is able to provide an alternative andtransfer payment made in respect of the original holiday tothe alternative holiday if the cost of the alternative holidayis less than the original holiday the difference in price will berefundable. Cunard will also pay compensation as set out inClause 27 below. Please note that travel arrangements arenot always purchased in local currency and some apparentchanges have no impact on the fare of your holiday due tocontractual and other protection in place.

24. All accounts for on-board services and goods and for shoreexcursions must be settled in full before the Guest leavesthe ship. In the event that a Guest fails to settle his on-boardaccount at or before the completion of the holiday, Cunardshall be entitled to make a reasonable administration chargefor the subsequent collection of such sum due in addition toany costs of legal process.

CANCELLATION BY THE GUEST

25. The Guest may cancel the Contract at any time prior to thecommencement of the holiday by giving notice in writing toReservations Department, Cunard, Richmond House,Terminus Terrace, Southampton SO14 3PN (fax number023 8065 7030), but in that event Cunard shall be entitledto levy a cancellation charge as a percentage of the farepaid in accordance with the following scales.

It may be possible for the Guest to re-claim these cancellationcharges (less any applicable excess) under the terms of theGuest's insurance policy. Claims should be submitted to theappropriate insurer. After departure if the Guest disembarkswhether by reason of sickness or any other reason the Guest willnot be entitled to a refund of a proportion of the holiday not used.

ALTERATION AND CANCELLATION BY CUNARD PRIOR TODEPARTURE

26 Whilst Cunard will do its best not to cancel or to make anysignificant alteration after a booking has been made, it shallnevertheless be entitled at any time prior to departure tocancel the Contract or to change the hotel or to changeand/or curtail the itinerary where this reasonably becomesnecessary on operational, commercial or other grounds.Cunard will inform the Guest of any such cancellation orchange of itinerary as quickly as possible (with, whereappropriate, written confirmation as soon as reasonablypossible thereafter). If Cunard makes a significantalteration to the holiday it will inform the Guest or his travelagent as soon as reasonably possible. The Guest will havethe choice of either accepting the alteration, accepting anoffer of an alternative holiday of comparable standard ifavailable (Cunard will refund any difference in fare if thealternative is of a lower value) or cancelling the holiday andreceiving a full refund of all monies paid. The Guestrecognises and agrees that it will not normally be possiblefor Cunard to offer an appropriate substitute holiday whichis available at about the same time as and/or with a similaritinerary to that originally booked, but Cunard will do itsbest to provide a suitable alternative holiday of similarduration and value. The Guest must notify Cunard of his/herdecision as soon as reasonably possible and in any eventnot later than 14 days of being informed of the significantalteration.

27. If there has been a significant alteration or Cunard cancelsthe holiday, the Guest shall also be entitled tocompensation as follows (except if the change orcancellation is due to force majeure, non-payment by theGuest or where the minimum number of Guests required fora holiday to proceed is not reached). The compensation setout below does not exclude the Guest from claiming moreif he/she is entitled to do so.

ALTERATION AND CANCELLATION BY CUNARD AFTERDEPARTURE

28. After departure, Cunard does not guarantee that the shipwill call at every port on the itinerary or follow every part ofthe advertised route or schedule or that every part of theholiday will be provided, although Cunard will exercisereasonable skill and care to provide the holiday. Cunardreserves the absolute right to decide whether or not to omitany such port(s) and/or to call at additional ports and/or tochange the advertised route or schedule. If Cunard isunable to provide a significant proportion of the holiday, itwill make suitable alternative arrangements, at no extracost to the Guest, for the continuation of the holiday. If theGuest does not accept them, for good reasons, or, if it isimpossible to make suitable alternative arrangementsCunard will where appropriate, provide the Guest withtransport back to the place of departure or to another placeto which Cunard and the Guest have agreed. In both casesCunard will, where appropriate, compensate the Guest.Please note that compensation will not be payable if analteration is minor or if Cunard is not able to provide asignificant proportion of the holiday due to force majeure.

29. Transit or part transit of straits, other sea areas controlledby vessel traffic schemes, canals, rivers and all othernavigable waterways may be subject to delay due tooperational circumstances and/or the requirements of thelocal authorities and Cunard shall have no liabilitywhatsoever in respect of any such delay.

SECURITY, SAFETY AND SUPPORT

30. Guests are expected at all times throughout the holiday toconduct themselves in a proper manner and with dueregard to the health, safety, comfort, enjoyment andgeneral well-being of all persons both on board the ship andinvolved in the provision of any service or facility formingpart of the holiday (at the hotel, on board ship andelsewhere) or any shore excursion, and the Guestexpressly agrees to this. If it appears that a Guest’sconduct, behaviour or health is such as to be a breach ofthis requirement or the Guest's behaviour, health orconduct is likely to endanger the Guest’s own health orsafety or that of any other Guest or crew or may make theGuest likely to be refused permission to go ashore at anyport or may make Cunard liable for the costs of any medicaltreatment and/or maintenance and support and/orrepatriation, then Cunard and/or the Master shall have theright according to the particular circumstances to take anyone or more of the following measures as may appear to bereasonable and appropriate • remove the Guest from the hotel;• repatriate the Guest to the UK;• refuse to embark or to disembark the Guest at any

particular port or other place of call;• disembark the Guest;• transfer the Guest to another stateroom;• confine the Guest to a particular stateroom or to the

ship’s medical centre;• through the ship’s doctor and/or his staff, administer any

drug, medicine or other substance of a similar nature, oradmit and/or confine the Guest to a hospital or anysimilar institution at any port as the ship’s doctor mayconsider necessary.

31. In the event of Cunard and/or the Master acting inaccordance with clause 30 above, neither the Guest nor (atthe sole discretion of Cunard) any other person travellingwith the Guest (whether or not under the same booking)shall be entitled to make a claim against Cunard for anyloss or expense incurred as a result of such action, whetherfor a full or partial refund of the fare or for any other form ofcompensation or for the cost of returning to the UnitedKingdom or to any other place or for any other form of lossor expense whatsoever. Where the Guest is repatriatedpursuant to this clause at Cunard’s expense, Cunard shallhave the right to recover the cost of this.

32. If any Guest is denied the right to board an aircraft because,in the reasonable opinion of the Captain, the Guest is unfitto travel or represents a threat to the safety of the aircraftor its guests or crew or is abusive or disruptive, Cunard willnot be liable to complete the Guest's holiday arrangementsand will not be liable to pay any refunds or compensation.If an aircraft is formed to make an unscheduled landing asa result of the conduct of any Guest, Cunard shall have theright to recover the full cost thereof from the Guest.

33. For security reasons, it may be necessary at any time tosearch Guests and/or their luggage and goods and theGuest agrees to allow such search upon being sorequested by the Master or any other authorised person.

34. The Guest must not bring on board the ship any goods orarticles of an inflammable or dangerous nature, nor anycontrolled or prohibited substance. To do so shall be abreach of these Conditions and shall render the Gueststrictly liable to Cunard for any injury, loss, damage orexpense and the Guest shall compensate Cunard in full forany loss, damage or expense suffered by Cunard as a resultof such breach. The Guest may also be personally liable tostatutory penalties. The Master (or any other officerdelegated for the purpose) shall be entitled at all times toenter and search the stateroom and personal luggage(whether or not in the stateroom) of any Guest whom theMaster reasonably believes may be in breach of thisclause. Where the Guest is found to be in breach of thisclause, Cunard and/or the Master of the ship shall beentitled to exercise any of the powers conferred by clause30 and clause 31 shall apply.

35. Any crew member or other person authorised by Cunardshall be entitled to enter a Guest’s stateroom to carry outnecessary inspection, maintenance or repair work or forany purpose associated therewith.

COMPLAINTS

36. Any problem which arises during a holiday must be raisedby the Guest at the time with a representative of Cunard. Ifthe problem is not resolved to the full satisfaction of theGuest during the holiday, it is essential that to enable thecomplaint to be investigated properly, it must be notified inwriting to Cunard at the earliest opportunity thereafter andin any event no later than 28 days after the Guest’s returnfrom the holiday. Failure to report the complaint within thistime may adversely affect Cunard’s ability to investigateand deal with it and may prejudice any future claim.

LIABILITY

37. Cunard accepts responsibility for death, injury or illnesscaused by the negligent acts and/or omissions of it and itsSuppliers. Cunard limits its liability, where applicable by theconventions referred to in clauses 40 to 44 inclusive. In anyevent, Cunard is not responsible for any improper or non-performance which is wholly attributable to the fault of theGuest; the unforeseeable or unavoidable act or omission ofa third party unconnected with the provision of anyservices to be provided under the Contract; unusual andunforeseeable circumstances beyond the control of Cunardand/or the relevant Supplier the consequences of whichcould not have been avoided even if all due care had beenexercised including (but not limited to) an event of forcemajeure; or any event which Cunard and/or the relevantSupplier could not even with all due care have foreseen orforestalled.

38. For claims not involving personal injury, death or illness orwhich are not subject to the conventions referred to inclauses 40 to 44 inclusive, Cunard's liability for improperperformance of the Contract shall be limited to a maximumof twice the fare the Guest affected paid for the holiday (notincluding insurance premiums and amendment charges).

39. All carriage (by land, air and sea) is subject to the termsand conditions of carriage of the actual carrier. These maylimit or exclude liability. They are expressly incorporatedinto the Contract and they also form the terms andconditions of separate contracts between the Guest andthe particular carrier as contained in that carrier’s ticketwhich is provided to the Guest before the scheduleddeparture date. Copies of these terms and conditions areavailable on request from Cunard.

40. Carriage of Guests and their luggage by air is governed byvarious international conventions (hereinafter “theinternational air conventions”), including the WarsawConvention 1929 (whether as amended by the Hague Protocol1955 or the Montreal Protocol 1999 or otherwise) or theMontreal Convention 1999. Flights between the UK and anymember state of the European Union are currently governedby EC Regulation 889/2002 which gives legal effect to theMontreal Convention 1999. To the extent that Cunard may beliable as a non-performing air carrier to Guests in respect ofcarriage by air, the terms of the international air conventions(including with any subsequent amendments and any newconvention which may be applicable to a Contract for a flycruise between Cunard and a Guest) are expresslyincorporated into these Conditions. The international airconventions may permit the carrier to limit its liability fordeath and personal injury, loss of and damage to luggage anddelay. Insofar as Cunard may have any liability to the Guestin respect of carriage by air, it shall be determinedaccordingly. Copies of these conventions are available fromCunard on request.


Booking Conditions

Booking Conditions41. Carriage of Guests and their luggage by sea is governed by

the Athens Convention 1974 (whether as subsequentlyamended or otherwise “the Athens Convention”). A copy isavailable on request. The Athens Convention is expresslyincorporated into these Conditions and any liability of Cunardfor death or personal injury or for loss of or damage toluggage arising out of carriage by sea shall be determinedaccordingly. In most cases, the Athens Convention limits thecarrier’s liability for death or personal injury or loss of ordamage to luggage and makes special provision forvaluables. It presumes that luggage has been deliveredundamaged to the Guest unless written notice is given toCunard (as carrier):

(a) in the case of apparent damage, before or at the time ofdisembarkation or redelivery;

(b) in the case of damage which is not apparent or of loss,within 15 days from the date of disembarkation or redeliveryor from the time when such redelivery should have takenplace.

Any damages payable by Cunard up to the Athens Conventionlimits shall be reduced in proportion to any contributory negligenceby the Guest and by the maximum deductible specified in Article 8(4) of the Athens Convention.

42. Insofar as Cunard may be liable to a Guest in respect ofclaims arising out of carriage by air or carriage by sea,Cunard shall be entitled to all the rights, defences,immunities and limitations available, respectively, to theactual air carrier (including its own terms and conditions ofcarriage) and under the Athens Convention, and nothing inthese Conditions shall be deemed a surrender thereof. To theextent that any provision in these Conditions is made nulland void by the Warsaw Convention, the MontrealConvention or the Athens Convention or any legislationcompulsorily applicable or is otherwise unenforceable, itshall be void to that extent but no further.

43. Insofar as the holiday may be performed on a ship not ownedby Cunard, it is agreed that Cunard shall at all timesnevertheless be deemed a ship owner for the purposes of theConvention on Limitation of Liability for Maritime Claims1976, whether as amended by the Protocol of 1996 orotherwise and as in force in any relevant jurisdiction fromtime to time, and so entitled to limit liability thereunder.

44. Except for claims arising out of carriage by air (as providedby clause 40), any liability in respect of death and personalinjury and loss of and damage to luggage which Cunard mayincur to the Guest, whether under the Contract inaccordance with these Conditions or otherwise, shall alwaysbe subject to the limits of liability contained in the AthensConvention.

45. Hotels, shore excursions and shuttle services are arrangedby Cunard with local operators who may themselves engagethe services of local suppliers. Standards of hygiene,accommodation and transport in many countries whereexcursions take place are often lower than comparablestandards in the UK. Cunard will at all times endeavour toappoint reputable and competent local operators whocomply with all prevailing local rules regulations andstandards. Cunard will apply the local laws and regulationsof the relevant country to assess performance of theContract in the event of a complaint by a Guest. The Contractwill be regarded as having been performed if local laws andregulations have been satisfied even if the laws of Englandand Wales have not been met unless the absence of aparticular safety feature would lead a reasonable Guest notto enter into the Contract. Cunard is not responsible for anyimproper or non-performance which is wholly attributable tothe fault of the Guest; the unforeseeable or unavoidable actor omission of a third party unconnected with the provisionof any services to be provided; unusual and unforeseeablecircumstances beyond the control of Cunard and/or therelevant Supplier the consequences of which could not havebeen avoided even if all due care had been exercised,including (but not limited to) an event of force majeure; orany event which Cunard and/or the relevant Supplier couldnot even with all due care have foreseen or forestalled.

46. All employees, agents, contractors and their sub-contractors(including Suppliers as defined in clause 1), as well as allinsurers of both Cunard and its Suppliers shall have thebenefit of the same rights, defences, immunities andlimitations available to Cunard under these Conditions, and itis agreed for this purpose that Cunard contracts with theGuest as agent or trustee for all such persons.

ACTIONS, CLAIMS AND TIME LIMITS

47. Any action by a Guest arising out of carriage by air or seamust be commenced within the two year time limitprescribed by the Warsaw Convention, Montreal Conventionor Athens Convention as applicable.

48. If a court or tribunal applies any law other than English law,Cunard shall (in respect of all exclusions and limitations ofliability) be entitled to the maximum protection allowed bythat law including statutory protection of limitation as to theamount of damages recoverable.

49. Some disputes involving claims to a limited amount may, ifthe Guest so wishes, be referred to arbitration underschemes devised by the Chartered Institute of Arbitrators forthe Passenger Shipping Association and ABTA. Anapplication for arbitration must be made within nine monthsof disembarkation from the ship. In addition, the PassengerShipping Association offers a low cost conciliationprocedure where a non-binding review of correspondence isundertaken by an independent conciliator. Details of theseschemes are available on request.

CONSUMER PROTECTION

50. Cunard holds an Air Travel Organiser’s Licence granted bythe Civil Aviation Authority under number ATOL 6294 whichprotects all its fly cruises sold in the UK. In the unlikely eventof Cunard’s insolvency, the Civil Aviation Authority willensure that Guests are not stranded abroad and will arrangeto refund any money paid to Cunard for an advance booking.For further information, visit the ATOL website atwww.atol.org.uk.

51 All other holidays sold by Cunard in the UK are protectedunder the Passenger Shipping Association’s consumerprotection scheme. In the unlikely event of Cunard’sinsolvency, the Passenger Shipping Association will ensurethat Guests are not stranded abroad and will arrange torefund any money paid to Cunard for an advance booking.Holidays sold overseas may be covered by consumerprotection schemes in place in the country of sale or by aprotection scheme operated by ABTA, and Guests shouldcontact Cunard for further details.

DATA PROTECTION

52. In clauses 52 to 54, “you” means the Guest. In order toprocess your booking and to ensure that your travelarrangements run smoothly and meet your requirements,Cunard needs to use the personal information you providesuch as name, address, any special needs, health, medical,mobility or dietary requirements, etc. Cunard may passpersonal information on to other relevant suppliers of yourtravel arrangements such as travel agents, airlines, hotels,and transport companies. Your personal information mayalso be provided to security and/or credit checkingcompanies, credit and debit card companies, governmentand enforcement agencies, public authorities such ascustoms and immigration if required by them, or as requiredby law. This may involve sending your personal informationbetween different countries, including countries outside theEuropean Economic Area (EEA) where controls on dataprotection may not be as strong as the legal requirements inthis country. This may also apply to any sensitiveinformation that you give to us such as details of anydisabilities or dietary/religious requirements. If Cunardcannot pass your personal information on to the relevantsuppliers, whether in the EEA or not, Cunard cannot properlyeffect your booking.

53. The personal information you provide to Cunard, or which isobtained through your dealings with Cunard or other brandsof Carnival plc, will also be used by Carnival plc or byprocessors on its behalf: to review your dealings withCarnival plc brands including your purchasing preferences;to review, develop and improve the holidays and servicesCarnival plc offers; for market research purposes; and forstatistical analysis.

54. Carnival plc may wish to contact you by post, email and/ortelephone with news, information and offers on its holidaysand other services (including those offered by Cunard andother Carnival group brands such as P&O Cruises, PrincessCruises, Swan Hellenic, Seabourn Cruise Line and OceanVillage) and for market research purposes.
