TO THE HONORABLE ADMINISTRATIVE HEARIl'"G OFFICER:

NOW COMES the State of Louisiana. Department of Public Safety and Corrections,

Office of State Police (hereinafter. the "Division") and Graphic Controls LLC (hereinafter,

"Permittee"). who file this loint ~fotjon for Approval of Compromise and Settlement

Agreement. and in support thereof would respectively show unto the Hearing Officer as follows:

The Division and Permittee are de'iirous of compromising and settling all clisputes

between them relative to the referenced administrative proceeding. In connection therewith. the

parries have entered into a compromise and settlement agreement which by its terms will become

effective upon appro\-al by the Administrative Hearing Office and the Louisiana Gaming Control

Board.

1. The Permittee failed to submit the annua: affidavit fonn and permit fee b)'

April 1), 2007. the anni\'er~ar)' date ,)f Permittee's :'-Jon-Gaming Supplier Pennit in 'iJolation of

La. R.S 27:29(3)(F).

2, The Permittee did not send the correct form lind fee umil on or about July 6, 2007

TERMS AND CONDITIONS

I. Within fifteen (15) days of the approval of this settlement by the Louisiana

Gaming Control Board. the Permittee shall pay a civil penalty of Fi \'e Hundred Dollars ($500,00)

for the violation of La, R.S 27:29.3(F) and Sixty -Two Dollars and Fifty Cents (~62.50) pursuant

to La, R.S. 27:29.5 for a total of Fi\'e Hundred Sixty-Two Dollars and Fift)' Cents ($562.50)

The Division hereby <lgrees to accept the payment of Five Hundred Si.'<t;;-T\~o

DoJlar~ and Fifty Cents ($562,50) in full and final settlement of the Notice of Recommencation

of Administrative Action.

3. The Division resel\les the right to take into consideration these admitted

violations in connection'" ith any future investigation. \'ioJation or assessmenr of penalty, and in

connection with any future assessments of the Permittee's suitability.

4. The terms of this Compromise and Settlement Agreement shall be Interpreled

under the laws of the State of Louisiana.

5. This Compromise and Settlement Agreement constitutes the entire Jgreement

between the Division and the Permittee pertaining to the subject matter contained hereJn and

~uper~edes all prior snd contemporaneous agreements. representations and understandings of [he

7. If approved by the Louisiana Gaming Control Board, the PerrnJ1tee must pay Five
