This third edition of Lawbyrinth brings forth a compendium of the activities and achievements of the School of Law, Bennett University from October 2018 to April 2019.

The Semester sprung into action with the ‘Cornell Week’ – Four eminent faculty members from the Cornell Law School conducted credit courses for all the law students of the School. The School of law proudly launched the BULEXCONVO series and successfully organized three national conferences thereunder on diverse themes, namely ‘The conundrum of theory and practice in legal education, ; ‘Law, development and social inclusion’ and a workshop on biological diversity. The semester also witnessed the First Bennett National Moot Court Competition which not only received participation from 24 teams from across the nation, but also garnered much praise and adulation from the several distinguished scholars, advocates and judges who graced the event.

The faculty members and students also benefitted immensely from the Socratic Club lectures, Post-Truth seminars and the numerous workshops on debating. advocacy skills and alternative dispute resolution. Students won accolades in several other competitions like debates, client counselling, mediation and other literary and cultural activities .

Most notably, it was a moment immense pride when the relentless work and talent of the students brought home the winning trophy from the coveted XV All Delhi (NCR) Moot Court Competition, 2019, conducted by the University of Delhi. In addition, the students zealously organized their first inter-college law fest-L’egalite, hosting events such as Debating, Client- Counseling, Law Quizzes etc. The legal-aid clinic of the law school also entered into an MoU with ‘International Bridges to Justice’ to initiate joint undertakings on legal aid training, awareness and capacity building of law students. The faculty members as well as the students participated in several national and international conferences and had their research published.

Lawbyrinth also takes this opportunity to welcome Prof. (Dr.) Sridhar Acharyulu, Former Central Information Commissioner who joined the School of Law, Bennett University as a faculty.

WHY CHOOSE LAW?

In many of the counseling sessions with parents desiring to enroll their wards, one often gets queried about the salary package they will get once they enter the profession. It is an understandable query and anxiety of any Indian parent.

How do we predict the economy in today’s world after five years to derive a salary package? What could be the caliber of their ward when they graduate to predict such figure? Even the top-ranking law schools have graduates at the bottom of the pecking order? One cannot even predict if the candidate at the end of five years will prefer a corporate job or working for an NGO or take up an academic career or move to judicial services? In short, the question is ‘Why Choose Law’?

An illustration about a decade ago is an apt one to convey this transformative process. When I served as a Dean of the only law school in an Indian IIT- the Director

of the IIT once complained to me that my students are provocative and rebellious, and I need to do something.

On further inquiry, I got to know of the arguments they had with the hostel room allocation committee on the process of allocation. The Director remarked that in his three decades of service there was no instance where students questioned the process and there was implicit trust! I explained that they wanted to know the due process, fairness and transparency of allocation. I remarked that I am hopeful that these students who are enquiring about the process are in the making of an effective lawyer. Interestingly, the law school only admits technology/science graduates for Law courses and they are transforming themselves into what they learn and what they are about to practice. Of course, the Director was not amused but went away musing about my response.

Coming back to the response for the anxious parents of their ward’s prospects – encouraging your ward to take up legal education is also about inventing the person herself. The journey is transformative. The quest of their sense of ‘justice’ and ‘achievement’ takes precedence over ‘financial returns’. Do take a call to admit your ward in a law school if you feel they have the ‘Quest’ in them and rest will take care of itself.

Epilogue:

For the petitioner:

“All students enter law school with a certain amount of idealism and desire to serve the public, but after three years of brutal competition we care for nothing but the right job with the right firm where we can make partner in seven years and earn big bucks.”

-John Grisham in “Rain Maker”

From the Defense:

“Law is at the intersection of the ideal and the real, of metaphysics and magic, of the actual and the possible, of ideas and power, of fact and value, of is and ought, of the past and the future, of the individual and the social, of economics and politics.”

-Margaret Thornton in “Portia Lost in the Groves of Academe Wondering What to do About Legal Education”

The news of the demise of Prof Menon on May 8th of 2019 indeed is an irreparable loss to the world of legal education and it kindled my memories of my interaction with him in the recent past. He spoke in the plenary session at the conference on Legal education at Bennett Law school on 15th February and those who heard his speech would not have imagined that he will leave us soon. After his speech, I interacted with him and explained how information relating to which set a precedent of denying information and even the DoPT of Government of India passed an official order to deny information based on the Judgement. Later on, researching, I found that the dismissal by SC was only the SLP and not a full-fledged hearing of writ appeal. SC denied special leave to file a petition. Further researching I found that the SC in RR Gopal v Tamil Nadu has enunciated about what constitutes privacy.

Then came Justice KS Puttaswamy (Retd) vs. Union of India where Supreme Court pronounced that Privacy as a fundamental right with exceptions and one such exception is that of transparency in public interest. A curious Prof Menon wanted a note on this issue and I explained to him this analysis is part of my LLD thesis and also part of my book ‘Privacy as Secrecy’. He was truly appreciative and took notes of the same.In an earlier interaction in 2013, I had the opportunity to present before him on an innovative ‘phone- in-live’ programme in a Telegu channel to help agriculturists on their land rights which created an effective impact. Hearing this he facilitated me to present the same to a World Bank team looking at effective ICT techniques on social development issues.

Another important connect with Prof Menon occurred based on my decision relating to providing information on expenditure on publicity. The order related to the direction of disclosing the expenditure relating to the advertisements in media about the politicians with their photos. Later base on a PIL, Supreme Court constituted a committee to study this issue under the chairmanship of Prof Madhava Menon. Prof Madhava Menon. Prof Menon Committee recommended that government advertisements in media must not have the photos of ministers / leaders of ruling party and if essential it should be restricted to photographs of President/PM or Governor/Chief Minister.

Later, I had invited Prof Menon to speak at the tenth Annual Convention of CIC in 2015 addressing issues of character and duties of the Commissioners. He touched upon important aspects emphasizing that CIC/SIC is adjudicatory quasi-judicial body, which needs to be adequately manned with best legal minds for better interpretation of RTI Act. He opined that the stumbling block in success of the Act is the mindset of the governance of the country which is not in tune with what the Act envisages. Referring to a key provision i.e., Section 8 of the RTI Act, Prof Menon said that this section reflects the object of the Act -to deny information only if it is counterproductive, and the CIC and SICs are the bodies to ensure this. He advocated that the Commissions are under responsibility to balance the conflicting interests of disclosure and privacy issues.

We were wishing to interact with him more in the days to come but nature had a different plan. His demise has deprived us of a towering personality with a strong advocacy, reformist outlook and outspoken views. The legal fraternity and the society at large will miss this great teacher, friend and philosopher – Padma Shree Prof. N.R.Madhava Menon and we all wish his soul rest in peace.

CORNELL WEEK (14TH-18TH JANUARY 2019)

Entering into the second year of Bennett Law School’s collaboration with Cornell Law School, four distinguished Law Professors from Cornell Law School visited the university to offer their specialised credit courses to law students. The Cornell Week was held during 14th-18th of January 2019 for both first year and second year law students. The sophomores attended two very stimulating courses- ‘Law and Psychology’ offered by Professor Valarie Hans and ‘International Human Rights in Theory and Practice’ by Prof. Elizabeth Brundige. Prof. Valerie Hans is the Charles F. Rechlin Professor of Law at Cornell Law School and Prof. Elizabeth Brundige is the Assistant Dean for International Programs, Associate Clinical Professor of Law and Jack G. Clarke Executive Director of International and Comparative Legal Studies at Cornell Law School. Both courses entailed informative learning and brain storming sessions to engaging group projects on momentous human rights problems prevailing in different countries.

The first-year students of both B.A.LL. B. (Hons) and BB.A.LLB. (Hons) were offered one credit courses on ‘Law Literature and Fiction’ and ‘Judicial Processes’ by the visiting faculty from Cornell, Professor Elizabeth Anker and

Professor Mitchel Lasser respectively. Prof. Elizabeth Anker is an Associate Member of the Law Faculty and Associate Professor, Department of English and visited the School of Law for the second time. Prof. Mitchel Lasser is the Jack G. Clarke Professor of Law, Director of Graduate Studies, and co-directs the Cornell Summer Institute of International and Comparative Law in Paris. Both courses were highly informative and major eye openers for the students. The courses worked around group discussions and were more of a conversation between the students and the professors rather than a series of lectures, which appealed to the interpretative skills of the students.‘Judicial Processes’

focused on careful understanding of the bridges and gaps between the common law and civil law traditions whereas ‘Law, Literature and Fiction’ took an analytical and focused stand on studying literary works with a legal perspective. The courses were extremely thought-provoking for the students and helped them broaden their perspectives. Overall, the whole week was a whirlwind of ideas, emotions, learning, discovery and communication for not only the students but also for the faculty of Bennett University.
