Jason Lemons, PE Program Director, Highway/Roadways Parsons Jason Lemons, PE is a transportation Program Director for Parsons in Southern California. Jason has a unique background in design and construction over the last 20 years. Jason’s career spanned geotechnical engineering, working as an estimator/project manager for Granite Construction, and the bulk of his career developing transportation projects through their lifecycle. Jason has a

passion for finding innovative technical and process solutions to maximize value for his clients. Jason’s pre-construction transportation experience spans all aspects of surface transportation from active (multi-use paths), bus rapid transit, rail, and roadway with substantial Caltrans experience. Jason is a proud father of 3 young boys and enjoys life with his wife Sarita.

Michael Boraks, PE, Program Director, Rail Parsons Mike Boraks, PE is the Program Director for Rail for Parsons in Southern California with more than 30 years of experience in the design and management of multi-disciplinary public works projects with an emphasis on transportation projects and specific expertise in the design and delivery of rail and transit projects here in Southern California. Michael also has both broad and in-depth

understanding and experience in all aspects of multi-disciplinary rail projects including areas critical to project success such as right of way and at-grade crossings. Michael’s expertise spans the complete project life cycle from project planning and programming to preliminary engineering and environmental clearance, construction document preparation, construction assistance, start-up and testing and project closeout. Best Practices for Delivering Right of Way in a Design Build World

Jeff Mathews Acting Director Real Property California High Speed Rail Authority Jeffrey Mathews is currently serving as the Acting Director of Real Property for the California High-Speed Rail Authority, where he oversees an experienced staff of right of way agents, real property appraisers, relocation specialists, contract managers and regional consultants who support the

Authority’s mission to acquire property rights for the high-speed rail program. He has over 25 years of experience in the field of land appraisal, acquisition, utility relocation and project management for public transportation projects, including acquisition of habitat values needed prior to the issuance of regulatory permits. Prior to joining the Authority in 2015, Mathews worked as a consultant for two, national environmental mitigation firms. His extensive knowledge of land use planning and transportation planning, including over eight years as a city and county planning commissioner, served as a guide to the strategic development of environmental mitigation projects to serve a variety of client needs. He is past co-chair of the Sacramento Metro Chamber of Commerce Cap-to-Cap Transportation team and lead annual missions to Washington, D.C., advocating for federal support of federal transportation projects in the Sacramento region. Mathews served as a Senior Right of Way Agent for the California Department of Transportation (Caltrans). He was responsible for the delivery of all property rights necessary to construct a wide variety of transportation facilities across Northern California. During his tenure with Caltrans, Mathews was also responsible for the development and management of the right of way capital budget, operating expense budget and personal service dollar allocation for North Region Right of Way. At the statewide level, Mathews served as a subject matter expert (budgeting and project management) and instructor at the Right of Way Planning and Management Academy. He is also a recognized team facilitator and instructor-promoting teamwork, empowerment and process improvements as instructor and guest speaker. Mathews holds a Bachelor of Arts degree in Social Science from California State University, Chico. He also earned a Master of Public Administration at CSU Chico.

Don Grebe Deputy Director Real Property California High Speed Rail Authority Don is responsible for all aspects of property acquisition and the right-of-way process, which includes appraising, acquiring and relocating businesses and residences impacted by the Authority’s high-speed rail project. He oversees a staff of experienced Right-of-Way agents, Real Property reviewers and contract managers that work for the State of California. Don also

supervises over 200 right-of-way consultants working in the field. Prior to joining the Authority, he spent more than 30 years at California Department of Transportation (Caltrans) doing right-of-way work in both metropolitan and rural districts. Most recently, he was the Right-of-Way Headquarters Office Chief at Caltrans overseeing policy and procedures in the areas of acquisition, condemnation, relocation assistance, railroad agreements, federal and state land transfers, hardship and protection and certification. He also served as an Appraiser and Acquisition agent, and a Senior Right-of-Way agent in the areas of right-of-way planning and management as well as project delivery and coordination. He is also an ex officio member of the Caltrans Real Property Law Committee.

Appraisal Best Practices for Federally Funded Projects

Mike Lahodny, R/W Planner / Project Manager / IRWA Instructor Bender Rosenthal Mike Lahodny is a Right of Way specialist with over 45 years of experience. Prior to joining BRI, Mike worked for the California Department of Transportation (Caltrans) for 35 years in the Right of Way Division. He served as the Caltrans Assistant Right of Way Chief for North and Central Regions overseeing Right of Way delivery for Districts 1, 2, 3, 9 and 10.

Mike has an in-depth knowledge of the legal aspects, development and administration of the Uniform Act and Right of Way process and procedures. He was directly involved in delivery of Right of Way appraisals, appraisal review, and acquisitions; and understands the pressing issues facing the delivery of small and large Right of Way intensive projects. Visualization Techniques for Eminent Domain Trials

Jason Fries, Forensic Expert/ CEO 3D-Forensic A leading proponent of the use of forensic animations, Jason Fries also helped create the first forensic animation developed using laser scanning data in trials in California and Hawaii. He helped write articles on accident and crime reconstruction and simulation for Forensic Magazine, Claims Magazine, the California District Attorneys Association Quarterly Journal and Right of Way

Magazine. Mr. Fries has given lectures to, and trained members of, many organizations including the Highway Safety Transportation Board, CAARS, CLE International, National Association of Professional Engineers, Forensic Expert Witness Association, Society of Forensic Engineers and Scientists, International Right of Way Association, UC Hastings School of Law and the Transportation Research Board Human Factors Workshop. Mr. Fries has maintained a 100% admissibility record for courtroom submissions throughout the country and all over the world, working on over 1,000 cases with more than 20 years of experience at the highest levels of accuracy and forensic analysis. He has been qualified as an expert in court in the field of forensic animation, line of sight analysis, video reconstruction, ballistic analysis, photogrammetry, night-time video analysis and human factors. Rick Rayl, Esq. Partner Nossaman, LLP Rick Rayl is an experienced litigator on a broad range of complex civil litigation issues. His practice is concentrated primarily on eminent domain, inverse condemnation, and other real-estate-valuation disputes. Andrew P. Nierenberg, Deputy District Director of Right Way, District 7, Caltrans As the Deputy District Director of Right of Way, Mr. Nierenberg is serves as the single focal point for Right of Way activities in Los Angeles and Ventura Counties. He is responsible for the appraisal and acquisition of real property for transportation projects, as well as the relocation of households and business from properties required in conjunction with freeway improvements. Right of Way oversees relocation of public utilities, railroads, and Local Agency right of way efforts. Right of Way is also responsible for the disposal of excess lands, leasing of airspace (air rights) and cellular sites near

freeway facilities, and the management of property held for transportation improvement purposes. The District Right of Way Division works closely with the Department's public and private partners to effectively deliver quality transportation projects while ensuring equitable treatment of persons affected by transportation improvement efforts. Before being promoted to Deputy District Director of Right of Way, Mr. Nierenberg served as District Right of Way Manager from November 2007 to April 2009. He served as Right of Way Project Delivery Manager beginning June 2003. Between November 1998 and May 2003, Nierenberg served as southern Right of Way Region Special Projects Manager and Condemnation Appraisal Specialist and as Chief of the southern Right of Way Region Special Appraisals Branch, managing a regional appraisal team responsible for delivering the appraisals of the properties required for the Route 60/91/I-215 Interchange Project in Riverside County. Mr. Root’s career in the Right-of-Way industry spans over 25 years with both public and private entities. Darryl specializes in large business relocation cases. He has managed Right-of-Way delivery for projects throughout the nation, including design-build projects. Among other projects, he is managing a number of Non-Residential relocation cases for the California High Speed Rail Project. Some of the cases he manages are among the most complex in the country. He has served on the International Relocation

Assistance Committee and later Chaired the International Relocation Community of Practice, where he remains an active contributor. He is also a Past President of IRWA Chapter 1, a certified IRWA instructor and is a frequent author for the Right-of-Way Magazine.

Rich Hodges, ASA, Partner, Hodges Lacey & Associates Mr. Hodges has been actively appraising machinery, fixtures and equipment for 26 years; predominantly for property acquisition by public agencies. He has worked directly with numerous relocation consultants, acquisition agents, public agencies, real property appraisers, goodwill appraisers, attorneys, and business owners throughout California as well as Nevada and Oregon. William Busch, SR/WA, R/W Consultant & Educator Mr. Busch is a recognized expert in right of way acquisition and management with professional contacts in the United States, Canada and Europe. He has worked in Northern and Southern California, Alaska, Eastern and Western Oregon, Michigan and Kentucky. Acquisitions have facilitated Water Transmission, Electric Transmission, Highway, and Cellular projects, including complex agreements for mitigation land. He has successfully concluded negotiations with multiple utilities; federal, state, and local government

agencies, environmental and corporate organizations. He has helped bring together parties having diverse interests to resolve challenging conflicts.

Mr. Busch currently resides in Kentucky where he works as a right of way consultant. He is an IRWA CLIMB certified Instructor – instructing multiple right of way topics, and has taught in 18 states. He has spoken at seminars across the country, often presenting one of his favorite topics Resolving Conflicts Between Public Agencies. Although proficient in Eminent Domain processes having been involved in many condemnation cases and mediations, and serving as an expert witness, his focus is providing tools to avoid the pitfalls that lead to court action.
