1.0 BACKGROUND INFORMATION
1.1 About BEE
The mission of Bureau of Energy Efficiency (BEE) is to develop policy and strategies with a
thrust on self-regulation and market principles, within the overall framework of the EnergyConservation Act (EC Act), 2001 with the primary objective of reducing energy intensity of the
Indian economy. This will be achieved with active participation of all stakeholders, resulting in
accelerated and sustained adoption of energy efficiency in all sectors.
The setting up of Bureau of Energy Efficiency (BEE) provides a legal framework for energy
efficiency initiatives in the country. The Act empowers the Central Government and in some
instances the State Governments to:
1. Notify energy intensive industries, other establishments, and commercial buildings as
designated consumers.
2. Establish and prescribe energy consumption norms and standards for designated
consumers.
3. Direct designated consumers to designate or appoint certified energy manager in charge
of activities for efficient use of energy and its conservation.
4. Get an energy audit conducted by an accredited energy auditor in the specified manner
and intervals of time.
5. Furnish information with regard to energy consumed and action taken on the
recommendation of the accredited energy auditor to the designated agency.
6. Comply with energy consumption norms and standards, and if not so, to prepare and
implement schemes for efficient use of energy and its conservation.
7. Prescribe energy conservation building codes for efficient use of energy and its
conservation in commercial buildings State Governments to amend the energy
conservation building codes to suit regional and local climatic conditions.
8. Direct owners or occupiers of commercial buildings to comply with the provisions of energy
conservation building codes.
9. Direct mandatory display of label on notified equipment and appliances.
10. Specify energy consumption standards for notified equipment and appliance.
11. Prohibit manufacture, sale, purchase and import of notified equipment and appliances not
conforming to standards.
The Energy Conservation Act, 2001 defines the powers of the State Government to facilitate
and enforce efficient use of energy and its conservation. The State Governments have to
designate State Designated Agencies in consultation with the Bureau of Energy Efficiency to
coordinate, regulate and enforce the provisions of the Act in the State. Thus the State
Designated Agencies are the strategic partners for promotion of energy efficiency and its
conservation in the country.

BEE is a multi disciplinary body with a sanctioned strength of 19 personnel. Under the
provisions of the Energy Conservation Act, 2001, Bureau of Energy Efficiency has been
established with effect from 1st March, 2002 by merging into it, the erstwhile Energy
Management Centre, being a society registered under the Societies Registration Act, 1860,
under the Ministry of Power.
The mission of the Bureau of Energy Efficiency is to assist in developing policies and
strategies with a thrust on self-regulation and market principles, within the overall framework
of the Energy Conservation Act, 2001 with the primary objective of reducing energy intensity
of the Indian economy.
1.3 Functions of BEE
BEE co-ordinates with designated consumers, designated agencies and other organization;
recognizes, identifies and utilizes the existing resources and infrastructure, in performing the
functions assigned to it under the E.C Act, 2001. The Act provides for regulatory and
promotional functions. The major functions of BEE include:
Develop and recommend to the Central Government the norms for processes and energy
consumption standards.
Develop and recommend to the Central Government minimum energy consumption
standards and labeling design for equipment and appliances.
Develop and recommend to the Central Govt. specific energy conservation building codes.
Recommend the Central Government for notifying any user or class of users of energy as
a designated consumer.
Take necessary measures to create awareness and disseminate information for efficientuse of energy and its conservation.
1.4 The Energy Conservation Act, 2001
The Energy Conservation Act, 2001 (ECA) forms the core of the legal framework put in place
by India to promote energy efficiency and conservation. ECA came into force with effect from

The Bureau of Energy efficiency (BEE) (hereinafter called the Employer) is intending to
appoint Agencies for the undertaking the impact assessment study on BEEs National
Programme foe energy efficiency in small and medium enterprises in 12 SME sectors (25
clusters) in India.
1. The Employer intends to start the impact assessment in 12 SME sectors (25 clusters)
spread across the country as a part of the scheme for improving Energy Efficiency in
SMEs.
2. The Request for Proposal applies to all Firms having a proven track record in the field of
energy efficiency and market research with required knowledge, expertise, capabilities and
sufficient resources to undertake such assignments. Detailed information regarding the
services required is given in the enclosed Terms of Reference (TOR).
3. The Executing Agency will be selected as per the procedure described in this RFP.4. The RFP includes the following documents

3.0 TERMS OF REFERENCE
3.1 Background
The target growth for industry sector was put at 10% during 10th Plan consistent with an
overall GDP growth of 8%.The rate of growth of industry sector as measured in IIP (Index of
Industrial Production) was 7.8% during AprilDecember 2005 compared to 8.6% in the
corresponding period of 2004-05 (Economic Survey, GoI, 2005-06). Manufacturing sector
grew at 8.9% during this period, contributing for the overall growth of the economy. Indian
industry sector accounted for nearly 43% of commercial energy consumption during 2003/04
(93 million tonnes of oil equivalent) with coal and lignite meeting nearly 1/3rd of the
consumption requirements Industry sector also offers maximum potential for energy
conservation. The Government of India has also recognized this when a number of energy
intensive industries were included as designated consumers in the Energy Conservation Act,
2001.
Under the provisions of the EC Act, the identified energy intensive industries (DesignatedConsumers) need to comply with the conduct of regular energy audits and implementation of
techno-economically viable recommendations and establishment of energy management
system through appointment of certified Energy Manager, and meeting of specific energy
consumption norms once developed.
To bridge the efficiency gaps in the various units within the same sub-sector, there is need to
identify general and specific energy saving measures to facilitate the industries in their faster
implementation in their respective plants.
However the need for developing information and projects in much more in the SME sector
which usually cannot obtain or source the information needed with regard to energy efficiency.
The large number of Small and Medium Enterprises (SMEs) like foundries, brass, textiles,
refractories, brick, ceramics, glass, utensils, rice mills, and other manufacturing units etc, are
said to have large potential for energy savings. Many of these units are in clusters located in
various states of the countries.
In quantitative terms, there is not much authentic information and data available with respect
to their energy consumption and energy saving opportunities. Majority of SMEs are typically
run by entrepreneurs who are leanly staffed with trained technical and managerial persons to
deploy and capture energy efficiency practice to reduce manufacturing cost and increase
competitive edge. Therefore, it will be useful to build their energy efficiency awareness byfunding/subsidizing need based studies in large number units in the SMEs and giving energy
conservation recommendations including technology up-gradation opportunities. It is
envisaged that such interventions supported by diagnostic studies and pilot projects at cluster
level focusing on energy/resource efficiency, energy conservation and technology up
gradation would help in addressing the cluster specific problems and enhancing energy
efficiency in SMEs.
BEE had initiated diagnostic studies in 25 clusters to prepare cluster specific energy efficiency
manuals covering Specific energy consumption norms, energy efficient process and
technologies, best practices, case studies, etc. These studies have provided the information
on technology status, best operating practices, gaps in skills and knowledge, energy
conservation opportunities, energy saving potential, etc for each of the sub-sector in SMEs.

The studies/projects were also being aimed to provide a direction for designing sub-sector
specific energy conservation programs in the SME sectors.
BEE has also undertaken the capacity building of local service providers and entrepreneurs/
managers of SMEs. The local service providers have been trained in order to be able to
provide the local services in the setting of energy efficiency projects in the clusters.
Under national programme for energy efficiency, BEE has conducted the more than 1250
preliminary and detailed energy audit in SME units of selected 25 SME clusters (12 Sector
type). Under the major activity of the programme, detailed project reports of 375 energy
efficiency projects in the 25 clusters also prepared and disseminated among the various
stakeholders. The energy conservation opportunities and technology up gradation options also
has been disseminated through various workshops in the clusters.
The global objective of the project is to improve the energy intensity of the Indian economy by
undertaking actions in the SME sector which produced 48% of the industrial production of the
country. The immediate objective of the project is to accelerate the adoption of EE
technologies and practices in 25 chosen clusters in the SME sector through knowledge
sharing, capacity building and development of innovative financing mechanisms.
The proposed programme is described below:
The main project activities are:
1. Energy Use and Technology Analysis
2. Capacity Building,
3. Implementation of EE measures, and
4. Facilitation of Innovative Financing Mechanisms
3.2 Scope of Work
The main objective of the study is to assess the impact of BEEs National Programme for
Energy Efficiency in SME Sectors. Besides assessing the overall impact of the field activities
on energy conservation in various sectors, the study would also aim to assess the role of the
specific activities and thereby identify the implementation of the energy conservation
measures as most impactful activities.
The main project activities are:
1. Survey of the SME units
2. Assessment of the survey results (Questionnaires)
3. Preparation of sector specific report
Activity 1: Survey of SME units
Objective:
The objective of the activity is to develop information data base on status of SME units
after the innervations of BEEs national programme on energy efficiency in the 12 SME
sector (25 SME clusters).
12 SME sectors comprising 25 SME clusters have been preliminarily chosen for
intervention in this project. Details of all the clusters are available with BEE. After
completion of energy efficiency interventions in 25 clusters, BEE is having theinformation about the total number of units in the clusters and the complete contact

details of the units in which BEE has conducted the preliminary of detailed energy audit
activity.
The study needs to focus only on the impact of field activities undertaken during the
implementation of the activities of BEEs National Programme in 25 SME clusters. In
addition, this study will also focus to assessing the sector wise quantum of energysavings because of BEEs Field activities. The study must address the minimum 30%
units (Maximum up to 75 or 30 units at the minimum in smaller clusters) of a cluster
under a SME sector, out of which 50% units to be covered in which BEE has
conducted preliminary/detailed energy audit (BEE will provide the name and contact
information of the units) and 50% units in which BEE did not conducted preliminary or
detailed energy audit. (Please refer the section 4.1 to estimate the number of units
to be undertaken for study; cluster wise and sector wise).
Output
The outcome of the activity will be filled questionnaire (Annexure - 1) containing
following information:
Information of the unit (as per section 1 of Annex 2)
Assessment of energy conservation project implemented by units, total energy
saving achieved, financial investment, type of finance (self or loan), etc, (as per
section 2 of Annex 2).
Barriers and Constrain for implementation of Energy Saving Projects (as per
section 3 of Annex 2).
General feedback on the deliverables of the national programme (as per
section 4 of Annex 2).
Units must sign and stamp the questionnaire. Unsigned or unstamped questionnaires
will not consider as result.
Activity 2: Assessment of the survey results (Questionnaires)
Objective:
The objective of the activity is to analyse the collected information from activity 1 in
term of the quantification of various type of energy saved (electrical, coal, natural gasand others), challenges and barriers, feedback on national programme etc.
The study needs to focus on unit specific quantification energy saving in a common
unit (i.e. tonnes of oil equivalent toe). Study also intend to identify the cluster specific
barriers for implementation of the energy conservation measures and view of the unit
entrepreneurs on the activities conducted previously during the implementation of
national programme for energy efficiency in 25 SME clusters.
Output
The outcome of the activity will be analysis of the unit wise questionnaire (from activity
- 1) and preparation of following:

Activity 3: Preparation of sector specific report
Objective:
The objective of the activity is to prepare a consolidated document covering the results
of the activity 2 (Assessment of the survey results).
BEE will provide the format of report which will be based on the results occurred from
the activity 1.
Output
The output of this activity will be report for each of the each sector which will give anoverview of the results occurred in activity - 2 in terms of energy saved, list of
technologies implemented barriers and constraints and how to overcome these
barriers, etc.
3.3 Eligibility Criteria
The agencies/ Lead Consortium agencies interested in being considered for this task must
fulfil the following criteria:
Must be a firm/company registered/incorporated in India.
The invitation is open to reputed agencies/organizations with credible backgroundengaged in the field of impact assessment of energy efficiency campaigns.
Must have the work experience of at least 3 years in the field of Energy Efficiency. Proof of
having this experience clearly mentioning the nature of work and the period during which
the work has been undertaken should be submitted along with the Proposal. The total
months / years of working in the area of energy efficiency should be clearly stated.
Should have a minimum annual turnover of INR 100 lakhs (INR or its equivalent in foreign
currency) from Consulting Fees in last two of the last three (3) years i.e. FY 2008-09,
2009-10 and 2010-11.
Should have been profitable for at least two (2) of the last three (3) years i.e. FY 2008-09,2009-10 and 2010-11.

The bidder must have experience of at least 2 years in undertaking such impact
assessments and should have at least undertaken 2 assignments during the last 2 years
out of which 1 assignment should be of impact assessment of energy efficiency
awareness campaigns.
Consortium of not more than two companies / organizations / International firms may also
apply and will have to give a joint letter about the lead partner and MOU. International
firms can form the consortium with Indian firms, however in that case the lead partner
should be the Indian firm.
Bidders should not have been debarred/blacklisted by any of the Govt. Institution
The bidder should have a team of experienced professionals from the relevant fields like
energy efficiency project assessment and market research/surveys.
3.4 Deliverables
The agency will submit the following to the Bureau of Energy Efficiency

Field movement plan
Weekly progress report on the survey
Analysis plan
Board Plan
Report on top line findings
Power Point presentation of top line findings
Draft and Final reports. The report should clearly contain cluster wise and sector wise
impact of BEEs activities and quantification of energy saved, financial analysis, barriers
and suggestions to overcome these barriers and if any on reforming/modifying the
campaigns to attain its objective of spreading awareness on energy efficiency in SMEs.

4.0 PROPOSAL
4.1 Preparation of Proposal
The consultant is requested to submit technical and financial proposals in the language(s) as
specified in the data sheet.
Technical Proposal
The technical proposal prepared by the agencies shall comprise the following components:
RFP Form 1: RFP Letter Proforma (refer Para 7.1).
RFP Form 2: Eligibility & Other Details (refer Para 7.4).
RFP Form 3: Prior Experience (refer Para 7.5).
RFP Form 4: Approach and Methodology (refer Para 7.6).
RFP Form 5: Proposed Work Plan including the timelines (refer Para 7.7).
RFP Form 6: Resumes of the members in the proposed team (refer Para 7.8).
RFP Form 7: Declaration Letter (refer Para 7.9).
EMD of INR 10,000 (INR Ten Thousand only).
The agency shall submit only one technical proposal per sector. The limit of number ofsectors that one bidder can bid for is 3 (three). In the case of the executing agencies(EAs) under BEEs national programme for energy efficiency in SME, EAs cannotsubmit the bid for the sectors for which they are working as executing agency. If abidder submits more than one proposal in a sector or EAs submit proposal in same sector inwhich they are working as EA, such proposals shall be disqualified. The work plan shall betask specific; however the agency shall include a one page description on understanding forrespective cluster under the respective group sector for which the agency is submitting theproposal. The timelines shall indicate the delivery schedule for Interim Report, Midterm
Report, Draft final Report and Final Report as per the above mentioned scope of work. Biddershall mention the Form No. clearly over the respective enclosure of the technical proposal.
Financial Proposal
The agency shall submit the financial offer separately for respective SME sector for whichtechnical proposal is submitting. Following are the group sector of SME clusters (refer sec 3.2for detail list): Format for financial proposal is enclosed as Annexure-1.

The agency shall submit the financial proposal separately for each Sector. The envelope
shall be clearly super-scribed with the FINANCIAL PROPOSAL for SME Sector____.
Financial offer should only indicate price without any condition or qualification whatsoever and
should include all taxes, service tax, duties, fees, levies, and other charges levied by Central &State Government/ government bodies, as may be applicable in relation to activities proposed
to be carried out. If there would be any increase in the taxes, levies, duties, fee and other
charges during tenure of the contract, the financial burden of the same shall be borne by the
bidder. The Financial Offer in respect of the above assignment must be valid for 120 days
from the date of opening of the Financial Offer. Bidders should express the price of their
services in Indian currency only.
4.2 Submission of Proposal:
The proposal shall be typed and shall be signed by the head or a person duly authorized to
bid by bidder agency. All pages of the offer, except for un-amended printed literature, shall beinitialled by the person or persons signing the offer.

a) The EMD as indicated in the data sheet shall be placed in a sealed envelope clearly
marked EMD. The EMD shall be furnished in the form of DD drawn in favour of the
Bureau of Energy Efficiency, payable at New Delhi.
b) Proposals from Firms should be submitted in two distinct parts, technical & financial.
c) The original hard copy and soft copy of the complete set of Technical Proposal shall be
placed in a sealed envelope clearly super scribed TECHNICAL PROPOSAL for SME
Sector.".
d) The original hard copy of the Financial Proposal shall be placed in a sealed envelope
clearly marked as FINANCIAL PROPOSAL for SME Sector." and
warning "DO NOT OPEN WITH THE TECHNICAL PROPOSAL".
e) All the envelopes (EMD envelope, technical proposal envelope and single/multiple no. of
financial proposal envelopes) shall be placed into an outer envelope and sealed. This
outer envelope shall bear the submission address and should be super scribed with the
wordings Request for Proposal for Impact Assessment Study on BEEs National
Programme for Energy Efficiency in Small and Medium Enterprises in 12 SME Sectors
(25 Clusters) in India (Sector.) for applying and shall also be clearly
marked "DO NOT OPEN, EXCEPT IN PRESENCE OF THE EVALUATION
COMMITTEE.
f) The completed Technical and Financial Proposal must be delivered at the submission
address on or before the time and date stated in the data sheet. Any Proposal received
after the closing time for submission of proposals will not be considered for participation.
g) This envelope shall be sent to The Secretary, Bureau of Energy Efficiency, 4th Floor,
Sewa Bhawan, R.K. Puram, New Delhi-110066.
h) Non-compliance to the above process will be liable to rejection
4.3 Evaluation of the proposal:
Technical Proposal:
The Technical bids shall be opened as specified in the data sheet at BEE by the Evaluation
Committee. The qualification of the bidder shall be checked as per the eligibility criteria (Form
2). Technical evaluation will be done on the basis of the following criteria:

The minimum qualifying total score, for the technical bid shall be 70. The financial offers of
only those bidders shall be opened who scores 70 or above during evaluation of technical
offers. For those bidders whose proposals did not meet the minimum qualifying marks under
technical evaluation or were considered non responsive to the terms of reference, the financialproposals will be returned unopened after completion of the selection process. The list of

bidders who have successfully obtained the requisite marks under the technical evaluation
criteria will be informed about the opening of the financial offers. Such selected bidders shall
attend the opening of financial bids at the BEE office at the date and time notified by BEE.
Financial Proposal:
The financial proposals of the technically pre-qualified bidders will be opened by theevaluation committee at BEE. Evaluation will be done based on the total lumpsum prices
quoted by the bidder for the particular group of appliances.
Financial offer with the lowest evaluated cost will be given a financial score of 100 and other
proposals shall be given financial scores that are inversely proportional (percentile format).
Evaluation of financial offers will lead to selection of agency after adding of scores in
technical and financial proposals with respective weightages, which shall be 0.70 for
technical bid and 0.30 for financial bid. Highest scorer will be awarded with the
contract.
4.4 Selection of the bidder:
4.4.1 To assist in the scrutiny, evaluation and comparison of offers, the Bureau may, as its
discretion, ask some or all bidders for technical clarification/presentation of their offer.
To speed up the tender process, the Bureau, at its discretion, may ask for any
technical clarification to be submitted by the consultant. BEE reserves the right to
analyze and alter the evaluation/selection criteria.
4.4.2 On completion of the evaluation of the technical and financial offers, the Bureau shall
issue Letter of Intent to the selected bidder.
4.4.3 Within Ten days of receipt of the Letter of Intent, the selected bidder shall enter into acontract with the Bureau in the prescribed format. The selected bidder shall also
commence the assignment within ten days of receipt of Letter of Intent from the
Bureau.
4.4.4 If the bidder, upon selection, fails to enter into a contract, Bureau may invite the
technically qualifying consultant who has ranked second in the aggregate financial
offer for the award of the contract, and may also exclude the former from all future
assignments.
4.4.5 Maximum of 3 Nos. of sectors of SME (as mentioned in section 4.1) can be allotted to
any single agency or consortium of agencies. However, BEE reserves the right to alterthe condition without assigning any reason whatsoever.
4.4.6 BEE reserves the right to reject any or all of the bids without assigning any reason
whatsoever.
4.4.7 BEE reserves the right to cancel any of the sector or part of the sector (Para 4.1).
However, conditions of the whole group are binding on the agency.

5.0 TERMS OF PAYMENT
a) Payment authority will be Bureau of Energy Efficiency.
b) The selected firm shall raise the invoice in favour of The Secretary, Bureau of Energy
Efficiency, 4th Floor, Sewa Bhawan, Sector 1, R. K. Puram, New Delhi.
c) The payment breakdown is as follows:

6.0 GENERAL TERMS AND CONDITION
6.1 Cost of RFP
The agency shall bear all costs associated with the preparation and submission of its RFP,
including cost of presentation for the purposes of clarification of the bid, if so desired by the
purchaser. BEE will in no case be responsible or liable for those costs, regardless of theconduct or outcome of the tendering process.
6.2 Contents of the RFP
The agency is expected to examine all instructions, forms, terms & conditions and Statement
of Work in the RFP document. Failure to furnish all information required or submission of an
RFP document not substantially responsive to the RFP in every respect will be at the
Consultants risk and may result in the rejection of the proposal.
6.3 Conflict of Interest
The agency/agencies that are selected for the work will have to maintain the confidentiality of
the information compiled. In no case the agency/agencies would be allowed to use the data or
share the information with anyone else, except for the BEE.
BEE shall hold the copyrights over any of the data collected or compiled during the course of
the awards.
6.4 Language of Bids
The Bids prepared by the agency and all correspondence and documents relating to the bids
exchanged by the agency and the Purchaser, shall be written in the English language,
provided that any printed literature furnished by the agency may be written in another
language so long the same is accompanied by an English translation in which case, for
purposes of interpretation of the bid, the English translation shall govern.
6.5 Confidentiality
BEE require that recipients of this document to maintain its contents in the same confidence
as their own confidential information and refrain from any public disclosure whatsoever.
6.6 Disclaimer
BEE and/or its officers, employees disclaim all liability from any loss or damage, whether
foreseeable or not, suffered by any person acting on or refraining from acting because of any
information including statements, information, forecasts, estimates or projections contained in
this document or conduct ancillary to it whether or not the loss or damage arises in connectionwith any omission, negligence, default, lack of care or misrepresentation on the part of BEE
and/or any of its officers, employees.
6.7 Authorized Signatory (agency/bidder)
The "agency/bidder" as used in the RFP shall mean the one who has signed the RFP
document forms.
The agency should be the duly Authorized Representative of the agency, for which a
certificate of authority shall be submitted. All certificates and documents (including any
clarifications sought and any subsequent correspondences) received hereby, shall, as far as
possible, be furnished and signed by the Authorized Representative. The power orauthorization, or any other document consisting of adequate proof of the ability of the

signatory to bind the agency shall be annexed to the bid. BEE may reject outright any
proposal not supported by adequate proof of the signatorys authority.
6.8 Consortium Partners related conditions
The agency has the option to submit the proposal either alone or along with other consortium
partners including the parent company/firm.Consortium of not more than two companies / organizations / International firms may apply
and will have to submit a joint letter about the lead partner and MOU. International firms can
form the consortium with Indian firms, however in that case the lead partner should be the
Indian firm
The consortium partners should not be involved in any major litigation that may have an
impact of affecting or compromising the delivery of services as required under this contract.
The consortium partners should not have been black-listed by any Central / State Government
or Public Sector Undertakings. If at any stage of Tendering process or during the currency of
the Contract, any suppression / falsification of such information is brought to the knowledge,
BEE shall have the right to reject the proposal or terminate the contract, as the case may be,
without any compensation to the Tenderer.
6.9 Amendment of RFP
At any time prior to the last date for receipt of bids, BEE, may, for any reason, whether at its
own initiative or in response to a clarification requested by a prospective agency, modify the
RFP Document by an amendment. In order to provide prospective agency reasonable time in
which to take the amendment into account in preparing their bids, BEE may, at their
discretion, extend the last date for the receipt of Bids and/or make other changes in the
requirements set out in the Invitation for Proposals.
6.10 Earnest Money Deposit (EMD)
All bids must be accompanied by a EMD of INR 10,000 (INR Ten Thousand only) in the form
of a crossed demand draft drawn on any nationalized/ scheduled bank payable at par in New
Delhi, in favour of Bureau of Energy Efficiency, New Delhi for applying for the task..
Proposals not accompanied by EMD shall be rejected as non-responsive.
No interest shall be payable by the Employer for the sum deposited as earnest money
deposit.
No bank guarantee will be accepted in lieu of the earnest money deposit.
The EMD of the unsuccessful bidders for a sector would be returned back within two
months of signing of the contract for the cluster.
6.11 Power of Attorney
Registered Power of Attorney executed by the agency in favour of the Principal Officer or the
duly Authorized Representative, certifying him/her as an authorized signatory for the purpose
of this RFP. BEE shall not be responsible for non-receipt / non-delivery of the RFP due to any
reason whatsoever.
Consultants are advised to study the RFP document carefully. Submission of proposal shall
be deemed to have been done after careful study and examination of the RFP document withfull understanding of its implications

6.12 Force Majeure
Shall mean and be limited to the following:
a) War/hostilitiesb) Riot or Civil commotionc) Earthquake, flood, tempest, lightening or other natural physical disaster.
d) Restrictions imposed by the Government or other statutory bodies which prevents ordelays the execution of the Contract by Consultant.
In the event of any force majeure cause, agency or the BEE shall not be liable for delays in
performing their obligations under this order and the completion dates may be extended, for a
period not exceeding the period of delay attributable to the causes of Force Majeure. Neither
BEE nor agency shall be liable to pay extra costs provided it is mutually established that Force
Majeure Conditions did actually exist.
The agency shall at all times, Indemnify and keep indemnified, the BEE and its officers
servants and agents, from and against all/any claims whatsoever, arising as a consequence
of, or in the course of execution of the work (including but not limited to property loss anddamage, personal accident, injury or death of or to property or person, of the agency or any
JV partner or sub-contractor, and / or the servants or agents of the consultant, or any other JV
partner or any sub contractor and / or of the BEE).
6.13 Disclaimer
BEE and/or its officers, employees disclaim all liability from any loss or damage, whether
foreseeable or not, suffered by any person acting on or refraining from acting because of any
information including statements, information, forecasts, estimates or projections contained in
this document or conduct ancillary to it whether or not the loss or damage arises in connection
with any omission, negligence, default, lack of care or misrepresentation on the part of BEE
and/or any of its officers, employees.
Except where otherwise specified in the contract, the decision of BEE shall be final,
conclusive and binding on all agencies to the contract upon all questions relating to the
meaning of the RFP specifications, scope of work, terms & conditions etc. here in before
mentioned and as to the trustworthiness of measurement & suggestions, or as to any other
question, claim, right, matter, or thing whatsoever in any way arising or relating to the contract,
specifications, terms & conditions, orders, or otherwise concerning the works or the execution
or failure to execute the same, whether arising, during the progress of the work or after the
completion or abandonment thereof.
6.14 Disqualification
Bureau may in its sole discretion and at any time during the process if bidding, disqualify any
bidder from the tender process if the bidder has
Submitted the tender after the schedule date and time.
Firms not meeting eligibility criteria.
Made misleading or false representations in the forms, statements and attachments
submitted in proof of the eligibility requirements.
If found to have a record of poor performance such as abandoning works, not properly
completing the contract, inordinately delaying completion, being involved in litigation or
financial failures, etc.
