Introduction

The 92nd session of the IMO Maritime Safety Committee (MSC) will be held from 12 to 21 June 2013, at the IMO

headquarters in London. This briefing summarises subjects under discussion which are relevant to the work of Lloyd's Register. This document addresses documents released as of 27 May 2013. Due attention should be made to the “Advice” sections given in each annex.

Overview of agenda items

MSC 92 will consider the following:

the report of the Correspondence Group on the finalization of the draft Guidelines for the approval of

alternatives and equivalents as provided for in various IMO instruments (MSC 92/5);

any comments submitted by Member Governments and international organizations on the elements for consideration in the development of interim guidelines for the safety level approach (SLA); and

any other documents submitted by Member Governments and international organizations under this agenda item

Passenger ship safety (Agenda item 6) Following the unfortunate capsize of the large cruise ship Costa Concordia in January 2012, the IMO Secretary-General pledged that lessons from the incident will be considered and appropriate actions taken in light of those findings. MSC 92 will review comments and proposals on passenger ship safety, and a working group will be formed. Italy has provided some preliminary recommendations in a submission paper, and the formal investigation report has subsequently been released so it may be possible for IMO to take this into account in its considerations during the meeting. Nevertheless, it is important to note that this agenda item covers all passenger ships, not just cruise ships. The following are envisaged as the main discussion points:

• Draft amendments to the International Convention on Standards of Training, Certification and Watchkeeping, 1978, as amended, and the Seafarers'' Training, Certification and Watchkeeping (STCW) Code, to make the Code for the implementation of mandatory IMO instruments (III Code) mandatory;

• STCW.7 circular on Interim Guidance on colour vision testing • Draft amendments to part A of the STCW Code related to Minimum in-service eyesight standards for

seafarers. For details, please refer to Annex 11 of this document. Formal safety assessment (agenda item 17)

Formal Safety Assessment (FSA) is a structured methodology which the IMO uses to enhance maritime safety through risk analysis and cost benefit assessment. MSC 92 will consider outcomes of MSC 91, FP 56 and STW 44. For details, please refer to Annex 12 of this document. Piracy and armed robbery against ships (agenda item 18)

MSC 92 will consider various reports on piracy incidents. General cargo ship safety (agenda item 19)

The Committee will be invited to consider the outcomes of FP 56, DE 57 and STW 44 and any submissions made by Member Governments and international organizations under this agenda item, and to take action as appropriate. Implementation of instruments and related matters (agenda item 20)

MSC 92 will consider the following issues:

Clarification on the definition of “new ship” on the 1966 LL Convention, as modified by its 1988 protocol (MSC 92/20)

BNWAS Auto Function (MSC 92/20/1) For details, please refer to Annex 13 of this document. Review and reform of the organisation, including application of the committees guidelines (agenda item 22)

MSC 92 will consider the proposed reform (reducing the number of the technical sub-committees from current nine to seven) of the organization. Work Programme (Agenda item 23)

MSC 92 will review the proposed new work programmes for approval. The following proposals are relevant to the work of Lloyd’s Register:

The above instruments have been approved at MSC 91 for adoption at MSC 92 except for the IMSBC Code and Amendments to regulation V/19.1 (MSC 92/3/7). A brief introduction was given in Lloyd’s Register’s report on these meeting which are available on the Lloyds Register website.

Lloyd’s Register’s position

In general, Lloyd’s Register supports the conclusion of these mandatory instruments at MSC 92. However, there seems to be minor editorial issues: 1. Amendments to the HSC Codes • In the amendment to Chapter 18 of the 1994 HSC Code, there is no existing paragraph 18.5.7.1 (there is

only a paragraph 18.5.7). I believe that amendment 3 should read “The renumbered paragraph 18.5.8 is amended to read:…” therefore

• In the amendment to Chapter 18 of the 2000 HSC Code, there is a paragraph 18.5.7.1 but this is not entitled “Records” – 18.5.7 is entitled Records. I believe that amendment 3 should read therefore “The renumbered paragraph 18.5.8.1 is amended to read:

• “18.5.8.1 The date when musters are held, details of abandon craft drills and fire drills, drills of other life-

saving appliances, enclosed space entry and rescue drills, and onboard training shall be recorded in such log-book as may be prescribed by the Administration."

Annex 2 - Goal-based new ship construction standards (Agenda item 5)

Overview

MSC 92 will consider the following:

.1 the report of the Correspondence Group on the finalization of the draft Guidelines for the approval of alternatives and equivalents as provided for in various IMO instruments (MSC 92/5);

.2 any comments submitted by Member Governments and international organizations on the elements for consideration in the development of interim guidelines for the safety level approach (SLA); and

.3 any other documents submitted by Member Governments and international organizations under this agenda item

Background

GBS has been under discussion at IMO since 2002. IMO will develop initial high-level standards which permit innovation in design while ensuring ships remain safe for their economic life. One of the first applications is to the hull structures of new oil tankers and bulk carriers. The required SOLAS amendments to apply GBS to these ship types were adopted at MSC 87 and will enter into force on 1 July 2016. IACS is developing harmonised common structural rules (CSR-H) to comply with this. The IMO is now looking to the ongoing development of GBS for wider application, MSC 90 and 91 started work on developing initial definitions of a safety level and the safety level approach. A correspondence group was formed at MSC 90 to develop guidelines for the approval of risk-based ship designs, intended to replace current guidelines for alternative design and arrangements (MSC.1/Circ. 1002 and MSC.1/Circ. 1212). Its latest report will be discussed at MSC 92. There will be debate over the applicability of the draft guidelines and some proposed substantive changes. In order to implement GBS, it is necessary to have a method of assessing how effective rules and regulations are at enabling an appropriate level of safety to be achieved. There are two principal methods for this verification: a prescriptive (or deterministic) approach, or a safety level (or risk-based) approach. IMO is still working to compare the relative merits of these two approaches and to define the final approach which is to be applied.

Lloyd’s Register’s position

Lloyd’s Register will closely monitor the discussions especially in relation to the impact of GBS on the development, application and assessment against classification rules. Lloyd’s Register considers that a holistic and coordinated approach to the overall development of regulations should be encouraged.

Advice to clients

No immediate impact on industry is expected from this MSC, but the expected progress on approval of alternatives and equivalents will be of interest to clients who are considering this option for compliance as well as the flag states which would be requested to approve submissions.

Applicability

The current focus of GBS and the agreed SOLAS amendments apply to oil tankers of 150m in length and above and to bulk carriers of 150 m in length and above, constructed with single deck, top-side tanks and hopper side tanks in cargo spaces, excluding ore carriers and combination carriers, which are contracted from 1 July 2016.

Annex 3 - Passenger ship safety (Agenda item 6)

Overview

Following the unfortunate capsize of the large cruise ship Costa Concordia in January 2012, the IMO Secretary-General pledged that lessons from the incident will be considered and appropriate actions taken in light of those findings. MSC 92 will review comments and proposals on passenger ship safety, and a working group will be formed. Italy has provided some preliminary recommendations in a submission paper, and the formal investigation report has subsequently been released so it may be possible for IMO to take this into account in its considerations during the meeting. Nevertheless, it is important to note that this agenda item covers all passenger ships, not just cruise ships. The following are envisaged as the main discussion points:

Background

In 2000 IMO initiated a comprehensive review of passenger ship safety. This led to a package of amendments to SOLAS being adopted at MSC 82 in 2006, which came into force on 1 July 2010. The aim of the review was to assess whether the regulations in force at the time were adequate, especially for the ever-larger passenger ships which were being built. The philosophy behind the work on passenger ship safety was that the regulatory framework should place more emphasis on the prevention of a casualty from occurring in the first place and that future passenger ships should be designed for improved survivability so that, in the event of a casualty, persons can stay safely on board as the ship proceeds to port. This concept is often described as “the ship is its own best lifeboat”. In January 2012 the 114,000gt cruise ship Costa Concordia capsized off the Italian coast after apparently striking a rock. It was carrying 3,206 passengers and 1,023 crew, and there were 32 fatalities and 157 injuries. This incident received intense international attention, which led to calls for a review of the regulations and practices which govern cruise shipping. The IMO Secretary-General quickly pledged that lessons from the incident will be considered and appropriate actions taken in light of those findings. MSC 90 and 91 issued guidance on operational safety matters relating to this item, but decided not to address structural matters until after the publication of the Italian government’s investigation into the incident. It should be noted that Costa Concordia was built in 2006 and therefore was not subject to the amendments to SOLAS Chapter II-1 on damage stability which came into force in 2009, nor the “safe return to port” requirements in SOLAS Chapter II-1 and II-2 which entered into force in 2010. Further work associated with these regulations, and other work which is relevant to the safety of large passenger ships, still continues in various sub-committees, including DE, FP, SLF, COMSAR, NAV and STW.

We support the IMO Secretary-General’s statement that consideration of resulting improvements should be based on the outcome of the official investigations into the Costa Concordia incident. We confirm our commitment to support the pragmatic development and implementation of any necessary changes to international safety regulation.

Advice to clients

We recommend monitoring the developments for indications of likely future changes. The outcomes of discussions under this agenda item will depend upon the findings of the official investigations into the Costa Concordia incident. There could be a potential impact for any or all of: passenger ship builders; owners or operators; and equipment manufacturers. Impacts on other sectors are also potentially possible if, for example, there are changes to the requirements for safety management systems under the ISM Code.

This document provides information reported by passenger ship operating companies identified whilst conducting a review of operational safety measures in accordance with the Passenger Ship Safety outcomes of MSC 90, MSC 91 and MSC.1/Circ.1446/Rev.1 (Recommended Interim Measures for Passenger Ship Companies to Enhance the safety of Passenger Ships). Findings from the reviews are summarized, best practices are identified and recommendations to enhance the safety of passenger ships are proposed. Lloyd’s Register’s position

In general, Lloyd’s Register appreciates and supports the outcome of the FP 56. However, the following may need to be addressed at MSC 92 prior to its approval/adoption:

Draft amendments to SOLAS regulation II-2/10 concerning fire protection requirements for on-deck

cargo areas for new ships - Proposed testing for “the mobile water monitor jet reaches top tier of containers with a capacity of a minimum of 60 m3/h each with all required monitors and water jets from fire hoses operated simultaneously." is considered not verifiable during onboard testing. Further, the draft SOLAS amendments in II-2/10.7.3.2.2.3 require that the inlet pressure of the mobile water monitors shall be sufficient to reach the top tier of containers. In our opinion, this is a clear a functional requirement instead of stipulating a certain minimum discharge pressure for the monitors. It seems that the co-sponsors have not realized the principal difference between fire hydrants for which SOLAS specifies minimum pressures in II-2/10.2.1.6 (prescriptive requirement) whereas for mobile water monitors these pressure values are not applicable. Actually, the minimum monitor operating pressure

depends on the type of monitor used and shall be verified by testing (II-2/10.7.3.2.4.2). In conclusion, we prefer to retain the performance-based requirement as stated in paragraph 3.5 of the draft MSC Circular.

Many of these draft instruments introduced above will bring significant impact on ship design and operation. Lloyd’s Register will introduce detailed analysis after the meeting.

.7 note that the proposed draft SOLAS amendments to regulation II-2/20 and the associated draft MSC circular are consistent with Recommendation 2 of the FSA study on safe transport of dangerous goods (DSC 16/INF.2, page 88), thus meaning compliance with that recommendation had been achieved, thus offering considerable improvement to safety

.8 note the progress made on review of the recommendations on evacuation analysis for new and existing passenger ships

.9 approve the draft amendments to SOLAS regulation II-2/13.4 concerning additional means of escape from machinery spaces for new passenger and cargo ships, with a view to adoption at MSC 93

.10 note the agreement of the Sub-Committee to discuss any proposed interpretations to SOLAS regulation II-2/13.4 regarding the insulation of escape trunks for machinery spaces of category A at FP 57, under "Any other business"

.11 approve the draft amendments to SOLAS regulations II-2/1 and II-2/3 and the proposed draft new regulation II-2/20-1 concerning requirements for ships carrying hydrogen and compressed natural gas vehicles for new ships, with a view to adoption at MSC 93

This document seeks a clarification on the arrangement of a continuous-fire shelter to a safe position outside the machinery space with respect to the draft amendments to SOLAS regulation II-2/13 and provides the Committee with further modifications on the draft regulation with a view to uniformly implementing the amendments in future. MSC 92/8/2 (Denmark and Norway) – Comments on the report of the fifty-sixth session of the Sub-Committee on the review of fire protection requirements for on-deck cargo areas

This document comments on document MSC 92/8 subparagraphs 2.5 and 2.6, on a draft amendments to SOLAS regulation II-2/10 and on the draft MSC circular on Guidelines for design, performance, testing and approval of mobile water monitors used for the protection of on-deck cargo areas of ships designed and constructed to carry five or more tiers of containers on or above the weather deck, and proposed amendments to these in order to clarify the requirements MSC 92/INF.10 (Bahamas) – Testing of automatic sprinkler system on passenger ships

This document contains information on findings from the testing of automatic sprinkler systems on passenger ships in light of the guidance contained in paragraph 7.5.17 of the Revised Guidelines for the maintenance and inspection of fire protection systems and appliances (MSC.1/Circ.1432). During annual testing of automatic sprinkler systems on several passenger ships the two selected sprinklers have failed to operate. Further testing has noted an elevated sprinkler failure rate which, in some instances has exceeded 50 per cent. The elevated failure rates suggest the scope of testing in MSC.1/Circ.1432 may not adequately assess the actual condition of automatic sprinkler systems. Readers are invited to note this aspect.

Lloyd’s Register’s position

Lloyd’s Register is concerned about “Draft MSC Circular on Guidance on the validity of radiocommunication equipment installed and used on ships”. While it illustrate the problem, it was not clear enough in identifying the responsible party and clarifying the role of the Recognized Organization during Safety Radio Survey.

Advice to clients

Revision to the IGC code is expected to be approved at MSC 92 for adoption at MSC 93 with entry into force date on 1 January 2016. 1. Matters in relation to the “cross flooding” - (MSC 92/11/2 and MSC 92/11/3) Owners / operators of ships which will have cross-flooding arrangements should note the changes to the resolution. The changes to the regression formulas for cross flooding through ducts will lead to increased time to cross flood and may result in a need for larger cross-flooding pipes/ducts.

ITF suggests that the FSI Sub-Committee should seek solutions to implementing compliance with those requirements, to facilitate the work of the casualty analysis working group and subsequent advice to seafarers. MSC92/12/4 (IACS & ITF) – Failure to submit maritime casualty reports

This document comments on the apparent failure of some flag states to submit maritime casualty reports to the Organisation as required by IMO Conventions. It is suggested that further consideration might be given to this issue in the Committees future work, including the adequacy of the current definition of what constitutes “a very serious casualty”, and extend to which flag states should have latitude to interpret this definition. Finally, it is suggested that lessons might be learned from the approach adopted by the aviation industry and ICAO. MSC 92/12/5 (IFSMA) – Investigation and report on serious casualties

This document comments on the issues raised in the report of FSI 21 and specifically, the requirements of states to investigate and report on serious casualties. IFSMA suggests that the FSI Sub-Committee should seek solutions to implement compliance with those requirements to facilitate the work of the casualty analysis working group so as to reduce the number of deaths at sea. MSC 92/12/6 (Antigua and Barbuda, Jamaica and St.Kitts and Nevis) – relationships between GlobalRegs and existing codes

This document addresses potential issues concerning the relationship between the development of the non-mandatory GlobalRegs standard for small vessels and existing regional standards applicable to the same vessels. Draft amendments to the International Convention on Standards of Training, Certification and

Watchkeeping, 1978, as amended, and the Seafarers'' Training, Certification and Watchkeeping (STCW) Code, to make the Code for the implementation of mandatory IMO instruments (III Code) mandatory;

STCW.7 circular on Interim Guidance on colour vision testing

Draft amendments to part A of the STCW Code related to Minimum in-service eyesight standards for seafarers.

Background

MSC and MEPC decided to hold the Joint Working Group on Human Element (JWGHE) as a one of the working group at the STW Sub Committee. This is the first session under this arrangement. Subsequently, significant discussion took place in relation to the ISM Code.

Overview

Formal Safety Assessment (FSA) is a structured methodology which the IMO uses to enhance maritime safety through risk analysis and cost benefit assessment. MSC 92 will consider outcomes of MSC 91, FP 56 and STW 44.

Background

Formal Safety Assessment (FSA) is a structured and systematic methodology which has been taken on by the IMO. It is aimed at enhancing maritime safety, including protection of life, health, marine environment and property, by using risk analysis and cost benefit assessment. FSA can be used as a tool to help in the evaluation of new regulations for maritime safety and protection of the marine environment or in making a comparison between existing and possibly improved regulations, with a view to achieving a balance between the various technical and operational issues, including the human element, and between maritime safety or protection of the marine environment and costs. FSA is intended to allow decisions to be made at IMO which take account of the effect of proposed regulatory changes in terms of benefits (e.g. expected reduction of lives lost or of pollution) and related costs incurred for the industry as a whole and for individual parties affected by the decision.

Lloyd’s Register’s position

As any outcome of the review of the FSA studies may affect various requirements developed by the IMO, Lloyd’s Register will closely monitor the developments.

Advice to clients

There will be no immediate direct impact on design or operation of ships. Depending on the outcome of the discussions, existing IMO instruments may be reviewed to improve their ability to secure safety or environmental benefits.

No direct applicability to ships, but regulations governing particular ship types may be amended in future.
