GBI• Le condizioni di pagamento, costi di trasporto e installazione sono specificati nei documenti relativi all’ordine.

• I prezzi non contemplano imposte (es. I.V.A.) e sono modificabili in qualsiasi momento ad insindacabilie giudizio della Ditta venditrice.

• La Ditta venditrice si riserva la facoltà di apportare ai prodotti modifiche tecniche ed estetiche senza preavviso.

• Le proposte d'ordine sono subordinate all'accettazione della Ditta venditrice.

• I termini di consegna dichiarati sono sempre indicativi e non impegnano la Ditta venditrice.

• La mancata consegna dovuta a cause di forza maggiore o inadempimento da parte del cliente dei termini di pagamento e/o qualsiasi altro motivo non da' luogo ad alcuna forma di risarcimento o indennizzo.

• Eventuali difettosità o anomalie rilevate sul prodotto all’atto della consegna e rappresentate ad esempio da rotture, graffi e ammaccature devono essere contestate immediatamente attraverso annotazione sul documento di trasporto; qualora non fosse possibile un controllo immediato della merce allo scarico si ritiene accettabile l’annotazione sui documenti “CON RISERVA DI CONTROLLO”. L’eventuale contestazione deve avvenire comunque non oltre 7 (sette) gg solari dall’avvenuta consegna comprovata dai documenti di trasporto o vendita.

• Anche in caso di contestazione tempestiva i pagamenti non possono essere sospesi.

• Il ritardo di pagamento anche di una sola rata, da' diritto alla Ditta venditrice di richiedere l'integrale pagamento con addebito degli interessi di mora nella misura dell’EURIBOR maggiorato di 7 (sette) punti e di risolvere tutti i contratti in corso.

• Sono ritenuti validi tutti i pagamenti effettuati direttamente alla Ditta venditrice e/o ad un funzionario autorizzato dalla stessa.

• La merce rimane di proprietà della Ditta venditrice sino a che non sia interamente pagata (art. 1523 e seguenti del c.c. ).

• Non si accettano resi se non preventivamente autorizzati, i resi saranno valutati al prezzo pagato solo se in perfetto stato, diversamente verranno accreditati al valore riconosciuto ad insindacabile giudizio del personale tecnico incaricato dall’Azienda.

• I depliants in circolazione hanno carattere puramente illustrativo, pertanto si consiglia di interpellare la Ditta venditrice per maggiori informazioni.

• Ad ogni effetto legale e per qualsiasi controversia derivante dal rapporto, il foro esclusivamente competente e' quello di Pesaro.

• La Ditta garantisce i propri prodotti da difetti di materiale o di lavorazione per un periodo di 2 (due) anni dalla data di consegna con l’esclusione del deterioramento legato al normale utilizzo o difetti prodotti dal cliente o utilizzatore; in ogni caso tale garanzia è condizionata dai requisiti presenti nel documento “Condizioni Generali di garanzia” disponibile anche sul sito internet www.dellarovere.it.

• Non disperdere i prodotti ed i materiali per imballo nell’ambiente ma contattare l’azienda specializzata per lo smaltimento dei rifiuti.

• Payment conditions, shipping and installation costs are specified in the documentation relative to the order.

• The prices are exclusive of taxes and duties (ex. VAT) and may be modified at any time at the unquestionable judgement of the selling Company.

• The selling Company reserves the right to make technical and aesthetic modifications to the products without advance notice.

• The order proposals are subordinate to acceptance by the selling Company.

• The declared delivery conditions are always indicative and are not binding for the selling Company.

• The failure to deliver due to force majeure or breach of contract by the client as regards payment conditions and/or any other reason is not cause for any type of reimbursement or indemnity.

• Any defects or anomalies found in the product upon delivery, i.e. breaks, scratches and dents must be immediately notified by means of an annotation on the shipping documents; if it is not possible to immediately check the goods when unloaded, the annotation “SUBJECT TO CONTROL” on the shipping documents is acceptable. Notification of defects and/or anomalies must, in any case, be made within 7 (seven) calendar days of delivery backed by shipping or sales documents.

• Even in the case of timely notification, payments may not be suspended.

• Late payments, even of only one instalment, gives the right to the selling Company to request full payment with interest for late payments at the EURIBOR rate increased by 7 (seven) points, and to cancel all contracts in progress.

• All payments made directly to the selling Company and/or to an official authorised by the selling Company are valid.

• The goods remain the property of the selling Company until full payment has been made (art. 1523 and following of the C.C.).

• Returns are not accepted unless authorised in advance, returns shall be assessed at the price paid only if in perfect condition, otherwise the value established at the unquestionable judgement of the technical personnel appointed by the Company shall be accredited.

• The brochures in circulation are purely illustrative, therefore we suggest contacting the selling Company for further information.

• For all legal rights and purposes and for any disputes relative to the relationship, the Court of Pesaro has exclusive jurisdiction.

• The Company guarantees its products from defects in material and workmanship for a period of 2 (two) years from the delivery date with the exclusion of deterioration tied to normal wear and tear or defects produced by the client or user; in any case, this guarantee is conditioned by the requirements given in the “General Guarantee Conditions”, also available for consultation at www.dellarovere.it.

• Do not dispose of the products and packaging materials improperly; contact a company specialised in the waste disposal.

F- Les conditions de paiement, coûts de transport et d’installation sont précisées dans les documents relatifs à la commande.

- Les prix ne comprennent pas les taxes (ex. T.V.A.) et ils peuvent être modifiés à tout moment, selon le jugement sans appel du Vendeur.

- Le Vendeur se réserve la faculté d’apporter aux produits toute modification technique et esthétique, sans obligation de préavis.

- Les propositions de commandes sont subordonnées à l’acceptation du Vendeur.

- Les délais de livraison déclarés sont toujours à titre indicatif et ils n’engagent en aucun cas le Vendeur.

- La non livraison due à des causes de force majeure ou à la non observation de la part du client des délais de paiement et/ou à tout autre motif ne donne lieu à aucune forme d’indemnisation ou de dédommagement.

- Tout défaut ou anomalie relevés sur le produit au moment de la livraison et représentés, par exemple, par des ruptures, des rayures ou des coups doivent être contestés immédiatement à travers une note rédigée sur le document de transport ; si un contrôle immédiat ne peut pas être effectué sur la marchandise au moment de son déchargement, on retient acceptable sur les documents la note “AVEC RESERVE DE CONTROLE ”. La contestation éventuelle doit être effectuée dans tous les cas, dans les 7 (sept) jours solaires de la date de livraison résultant des documents de transport ou de vente.

- Même en cas de contestation immédiate, les paiements ne peuvent pas être interrompus.

- Le retard de paiement, même d’une seule échéance, donne droit au Vendeur de réclamer le paiement intégral avec les intérêts moratoires dans la mesure de l’EURIBOR augmenté de 7 (sept) points et de résoudre tous les contrats en cours.

- Sont considérés valables tous les paiements effectués directement au Vendeur et/ou au fonctionnaire autorisé par ce dernier.

- La marchandise demeure propriété du Vendeur jusqu’à son solde intégral (art. 1523 et suivants du c.c. ).

- Les rendus ne sont pas acceptés sauf sur autorisation préalable, les rendus seront évalués au prix payé seulement à condition qu’ils résultent en parfait état, autrement ils seront crédités à la valeur reconnue selon le jugement sans appel du personnel technique préposé par l’Entreprise.

- Les dépliants en circulation ont un caractère purement illustratif, par conséquent il est conseillé d’interpeler le Vendeur pour plus d’informations.

- A tout effet de loi et pour tout différend dérivant du rapport, le tribunal compétent est exclusivement celui de Pesaro.

- La Société garantit ses produits contre tout défaut de matériau ou de fabrication sur une période de 2 (deux) ans à compter de la date de livraison avec exclusion de la détérioration liée à l’usage normal ou des défauts produits par le client ou par l’utilisateur; dans tous les cas, cette garantie est conditionnée par les mesures contenues dans le document “Conditions Générales de garantie” disponible aussi sur le site internet www.dellarovere.it.

- Ne pas abandonner les produits et les matériaux pour l’emballage dans la nature, mais contacter l’organisme spécialisé dans la récupération des déchets.
