Government vide Notification No. LLR-D(6)-19/20 16-Loose dated 27,] .2017e-gazette of Himachal Pradesh on 30.] .20] 7) has carried out amendments in theTown and Country Planning Act, '1977 vide which provision for regularization of

constructions has been made. The following officers vested with the powersshall be the competent authority to examine and decide the cases for the purpose or

the Himachal Pradesh Town and Country Planning (Amendment) Act, 2016(Act NO.1 of

"iote:- The :powers for deciding the cases of deviations and un-authorized constructions attractingprovisions of Chapter IX-A and IX-B of the Himachal Pradesh Town and Country Planniilg Act,1977 shall vest with the Director (TCP). '

.The :fub-section (6) of Section 30-B of the Himachal Pradesh Town and Country PlanningI i\tlll:ndlllen!). 2016 provides that, "the regularization fee shall be credited to the StateGovernment andconccrned Urban Local Bodies or Special Area Development Authorities (SADAs) and shall be depositedlhl'Ough TreasuryChallanor e-Challanin theGovernmentaccountandby wayof demanddraft or onlinep,lYll1ell( to thdJrban LocalBodiesor SpecialAreaDevelopmentAuthorities(SADAs)respectively."

There could be number of queries and doubts about the said amended Act. , ' -It is Juj,thcr intimated that the prov.isions of the Himachal Pradesh Town and Country Planning(/\mendri16it) Act, 20] 6 (Act No.1 of 2017) are applicable w.e.f 30.01.2017. In all the Planning Areas;11)d Special' Areas under the jurisdiction of TCP Department,applicant would apply online forn:gula!:izationof deviations and un-authorized constructions under the said amended Act. Similarly, thei1l,plicant would ,apply online in Urban Local Bodies. All the Officers are requested to start receiving the
