Greetings Wainaina, How are things with you. we would iike to inform you that the witness namely: MESHACK YEBEI has been a sly and troublesome witness to PEV case. we came to this conclusion as he never testified to Waki nor the Kenya National Human Rights Commission. he only appeared on a 10 minutes video documentary which was conducted initially by the American Human Rights watch AHRW in the year 2008 with 6 others. AHRW report was then publicized in the media and my then ED Koros received threats and he was assisted by the coalition on human rights defenders protection desk.

lmmediately afier Koros had received the protection Meshack and 6 others ganged up and started ailedging that Koros has used their evidence for Monetary gains. They never h e w that he was mder protection hence accusing him of being the traitor. we persevered and come 1 year later, we secured funds eom USAID and SWSS EMBASSY in order to protect more wiinesses who had reported their fears ,threats and infimidation in our office like them.

Because the list was so long, and the USAID wanted 4 people and the SWSS EMBASSY S people, we chose not to accommodate them because of their conduct and suspicion. Meshack and the rest continued to express their fears but Koros would not support these claims.

In Mid last year Koros was absorbed by the 1CC and since 1 was lefi alone in the ofice 1 chose to assist them on Humanitaian gromds. little did 1 laow that they will again tum against me. Now 1 took initiative of fowarding their names to USAiD in September and the process reached at an advanced stage. Later everythmg was scuttled by 2 men, BARAZA and RON0 who surbotaged everything. Now due to this, the USAID cancelled the p r o p m and fowarded the same names to the coalition of Human rights defender, Meshack was interviewed by Ignatius Ambasa in November last year (2010); He was advised to be patient as his issues are being processed.

Now Meshack was not convinced by hun of events and what 1 told him about the USAID winding the program. He immediately ganged up with Rono and Sammy Koech and a series of meetings were held with inclusion of Rutos Advocate, Advocate Katwa. and the personal assistant to Ruto Mr. Keitany. The strategy was on how to convince other witnesses lefi by the ICC to Join their camp and how best they can tackle the 1CC wiinesses. A h a l meeting was later held at AMACO oflices in Nairobi where Meshack, Rono, Sammy and Seven Others were invited to discuss the issue with Honourable Ruto. This was on 17th-19th January 201 1. Meshack led prayers in the oflice (he is regarded as pastor at home) and also issued opening remarks.The 7 others were drawn h m various counties in rift Valley. They were told to recant their statements which were taken by Advocate Katwa and each signed his statement. They were rewarded with some amount and Hon Ruto advised them to look for others and that he will arrange for a major meeting at his home in Surgoi to cement their relationships and tell people to accept these people back to the community. We are yet to see.

These details were unveiled to my office by HELLEN CHEBET who was one of the people whose views were also documented by the AHRW and somebody by the name Caleb, whom Meshack had contacted advising them to foilow his suit. Upon Meshack realizing that 1 have gotten the details they started waging war to me and the office, to the extent of threatening to close it down in a few months time. he was alleging that we are not here to assist, but to com people and use their statements to source

money, reason being that he was not given protection. So far the office has assisted Hellen to secure protection ftom the coalition of human nghts defenders. Caleb on is part has since pulled out and he does not waut to be associated with PEV issues any longer. He is living a quiet life.

Owing to the above, 1 do request that his fate be sealed completely once and for all. He is a dangerous chalacter.

Hi SS , Long time,many things have happened,Have attended numerous ICC meetings both in Nairobi and Eldoret including having a one how WEB based Training on judicial proceedings with ICC based at Hague. Situation not bad at the moment,initially tension was high in Rwai areas whereby immediately after the announcement people started to assemble in smaii groupings discussing the issue on smaii tones but they couldn't make any move due to heavy presence of p a r a - d t a q police who were onpakol. The local community is in a state of sorrow,confused and panic .The= anger and perception is now shifted to Hon Raila whom they accuse of conspiring with ICC to silence there leader 60m ascending to power. They do also rely on politicians as their sowce of infomation and as such we are yet to see many issues gradually unfolding. Otherwise we have shifted ow offices to a more secwe building, still keep watching carefidly since we are at a criticai moment.Personally still yet to receive assistance. Will keep updating you.

Due to our work on the ground especially in pmtecting victims of post elections violence and human nghts defenders, our office was attacked in 19th November 2010 ... we lost most of our valuable documents and office eq~ipinents; our computer, photocopy machine and other valuable documents linked with the Kenya violence of 200718 were stolen. We had to close the office for one week as investigations were being carried. All in all we got matenal support 6om the USAID and we are now able to continue with our work. 2. The Oak grant was very insbumental in irnplementing the inuch needed activities according to our pnonty areas as a Centre that fights Torture and Impunity in the Westem Part of Kenya and we really appreciate and thank you so rnuch for the support. 3. The ICC officials were f?om the Situation Analysis Section.We inet at Hotel Sandton.The ineeting started at 6pm and ended at9pm.We did focused around three issues nainely a)Judicial and non judicial issues limited to ICC and VictimsIWitness protection b)State CO-operation c)Kenyans views on Ocampo's awaited visit. They me set to come to ELDORET with effect as f?om today 18 and tomoi-row 19. My org. has been selected as the one to take them around in our area with focus on hotspots areas,and mobilise victimskey witnesses for a discussion with thein. Greetings Joseph, How is Nigeria? We hope life has been treating you well. we are also working hard on our side and the CAT project has made quite a milestone. We have been engaged with various donors on different program with main focus being North Rift Kenya. So far we have implemented programs on Legal awareness for torture victims ( By USAID KTI), rehabilitabon for Victims of Post Election violence ( by Oak Foundation), Pmtection of witnesses of Post Election Violence ( this was one nsky and sensitive progmn in our program- the funding came £mm Swiss Embassy), there was also a national cohesion pmgmn funded by the USAID OTI in Kenya. During the campaign for the enactment of the new constitution we were greatly involved with Maina Kiai where we secured a one month funding £mm InformAction. Asa at the moment God has blessed us with a 12 month project which will be funded by the UN Office of High Commissioner for Human Rightc- UNVFVT program.

So far 1 can say that we have successfully implemented these programs and gained confidence with donors. Except to say that we are still in need of more funding capacity as these programs only allocated moneys for implementation ... we are working on ways to employ more staff, increase the office capacity and also be able to Open more satellite centres around western kenya.

At this point Joseph 1 wish to inform you that Advocate Machio of Machio and Company Advocates ( as you remember he is the one who represented the 2 officers accused of torturing one Isaac Mwaniki Gitari) died a natural death at his home in Elgon View on 27th February 201 1. he will be bunied on 12th march 201 1.

Joseph we thank you for your continued support and shall be sending you consecutive reports of our activities soonest.
