salary of SR .

4. The employer shall help the DSW to open a bank

account in KSA subject to applicable SAMA rules. The

wages shall be deposited regularly at the end of every

month in the said account. The employer shall help the

DSW to remit her/his salary through proper banking

channels.

5. DSWshall be provided with continuous and undisturbedrest of at least nine (9) hours per day.

6. DSWshall be entitled to one day rest per week. If sheworks on her holiday with mutual consent, he/she shall beprovided with another day rest.

7. The employer shall pay for the transportation of theDSW from the point of origin in Djibouti to the site ofemployment and back to such point of origin in Djiboutiupon expiry of the contract. He shall ensure that DSW isrepatriated in time.

8. The employer shall provide DSWsuitable and sanitaryliving quarters aswell as adequate food, clothing and dailyusable.

9. For acceptable medical reasons, the DSW shall beallowed to rest and shall continue to receive her/hisregular salary. The employer shall bear all expensesincurred in suchmedical treatment.

10. After two years of service, if the DSW and theemployer agree to extend employment contract, the DSWis entitled to return to Djibouti to spend his/her paidvacation leave of thirty (30) days for every two years ofservice with a round trip economy classticket provided bythe employer without charging the DSW.

11. In case of death, the employer and the SaudiRecruitment Agency should inform the Djibouti competentauthorities and the DSW's next of kin. The employer isresponsible for repatriation of the DSW's remains andpersonal belongings to Djibouti as soon as legally possibleand without undue delay. In case the repatriation ofremains is not possible, the employer should obtain theapproval of the DSW's family or the Djibouti Embassyforthe suitable form of burial. The employer through theSaudi Recruitment Agency is responsible for makingnecessaryprocedure in pursuing compensation (if any) for

the DSW's next of kin as per Saudi Arabia's Laws andregulations.

12. The parties to this contract shall endeavor to resolve

dispute, if any, arising out of this contract amicably o)j_,1 ~l:ill J-JI '-,-lJ""tS..o ~ ~..lJ "O.)~..lia..ll ucthrough the Ministry of Labor. However if the same cannot L>.!!.}:Jl j.Y.":1o)\.cl ~..)Jy tlj.ill J:...)~ Ij!J .J-JI

be resolved asabove, the contracting parties may refer the G,Ill JI /J c:LJl ~..l_,....J1wU:J....li tlj.ill ;iJb! 0:l..l!\..Li.J1dispute to the appropriate Saudi authorities for .~conciliation and/or resolution.

13. In case of unauthorized absence of the DSWfrom thesite of employment, the employer shall inform thecompetent Saudi authority and the Saudi recruitingagency. Suchagency shall be responsible for informing theaforementioned absenceto Embassyof Djibouti.

14. Termination of Contract(i) The employer may terminate the contract by servingupon DSW a written notice. Such termination shall beeffected only on the expiry of a period of 30 days from thedate of service of the notice on DSW. The DSWshall bepaid the wages for this period of 30 days. However, if thetermination is intended with immediate effect the noticeshall state the same and shall be accompanied by wages ofone month.In such case, the employer shall also pay for the expensesincurred on obtaining exit papers and air ticket to Djiboutito effect the departure.

(ii) The employee may also terminate the contract bygiving a written notice of 60 days to the employer andshall pay the employer an amount equivalent to 2 (two)months' wage before departure. However, if theemployee terminates the contract with immediate effect,he/she shall pay an amount equivalent to 3 (three) monthswage before departure.

The employer on payment of the amount mentionedhereinabove shall immediately provide necessary papersto effect exit of DSWfrom SaudiArabia.

lS.General Provisions:

a) The Saudi Recruitment Agency shall be responsible forinforming the departure and arrival plan of the DSWin theKingdom of SaudiArabia to the employer.b) The DSW shall work solely for the employer and hisimmediate household, unless the DSW is recruited by a~ega Recruitment Company.

c) The employer shall not deduct any amount from theregular salary of the OW. In case of deduction for lawfulreasons and with approval of the OW, such deductionsmust be reflected in the OW's pay slip.d) The employer shall pay the cost of the DSW'sresidencepermit (Iqama), exit/re-entry visa, and final exit visa,including the renewals and penalties resulting from delays.e) The passport and work permit (Iqama) of the DSWshallremain in her/his possession.f) The DSWshall be allowed to freely communicate withhis/her family and the Djibouti Embassy/Consulate onhis/her personal expensesor account.g) The employer shall explain to the members of her/hishousehold the provisions of this contract and ensure thatthese are observed and that DSW is well treated keepingin view in all his/her rights.h) The employer shall ensure the welfare and rights ofDSWs promoted and protected in accordance with theapplicable laws, rules and regulations of the KSA.

16. Any provision of this Standard Employment Contractmay be altered, amended or substituted through theSaudi- Djibouti Joint Technical Committee.

17. The DSW shall be repatriated at the employer'sexpense in the event of war, civil disturbance or majornatural calamity, or in case the DSWsuffers from seriousillness or work injury medically proven to render her/himincapable of completing the contract. The DSW shall bepaid the wagesdue till the date of departure from KSA.

18. If on the expiry of the contract, the DSW desires toreturn to Djibouti, the employer shall present the bankstatement or pay slip of the DSW to Saudi RecruitmentAgency. The employer and the DSWshall then sign a finalsettlement. Such bank statement or proof of settlementmay be submitted asevidence in Djibouti and in the KSA.
