The Board members present at this meeting included: John T.Daniel, Jr. , Secretary-Treasurer; Eben Alexander, Jr. , M. D. ;David S. Citron, M. D. ; Harold L. Godwin, M. D. ; Hector H. Henry,II, M. D. ; Simmons Patterson, Jr. , M. D. , and Mrs. Martha Walston.

COBBLE, CLARK ROBERT, M. D. - Danvi lie, Virginia

At 1:10 p. m. , January 23, 1987, the Board of Medical Examinersof the State of North Carolina held a Hearing on chargespreferred against Clark Robert Cobble, M. D. Dr. Cobble and hiscounsel appeared at this Hearing.

On January 23, 1987, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Alexander and seconded by Dr.Daniel that the Board finds Charge Number One to besubstantiated by the evidence. On this same date, the Board ofMedical Examiners unanimously adopted a motion made by Dr.Alexander and seconded by Dr. Daniel that the Board, based uponthe evidence presented on January 23, 1987, does not findCharge Number Two to be sustained by the evidence.

On this same date, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Alexander and seconded by Dr.Daniel that the Board issue an Order stipulating Dr. Cobbleabide by the probationary conditions placed on his license inthe state of Virginia; stipulating Dr. Cobble notify the Boardof Medical Examiners prior to entering the practice of medicinein North Carolina; stipulating Dr. Cobble meet with the Boardprior to engaging in medical practice in this state; andfurther stipulating, based on subsequent actions of theVirginia Board of Medical Examiners, the North Carolina Boardof Medical Examiners reserves the right to issue such furtherOrders as may be necessary.

On this same date, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Alexander and seconded by Dr.Daniel that the Board send the Virginia Board a copy of theFindings and Order of the Board of Medical Examiners of theState of North Carolina.

ROBBINS, THOMAS WATERS, JR. , M. D. - Hightstown, New Jersey

At 3:00 p. m. , January 23, 1987, the Board of Medical Examinersof the State of North Carolina held a Hearing on chargespreferred against Thomas Waters Robbins, Jr. , M. D. Dr. Robbinsdid not appear at this Hearing.

On January 23, 1987, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Godwin and seconded by Dr. Danielthat the Board enter an Order revoking Dr. Robbins' license topractice medicine in the state of North Carolina on the basisof N. C. Gen. Stat. 90-14 (a)(13).

DAY, PHILIP MARK, M. D. - Grover, North Carolina

On January 24, 1987, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Citron and seconded by Dr. Duckettthat the Board enter into a Consent Order with Dr. Dayembodying a reprimand, expressing the Board of MedicalExaminers' concern regarding his consumption of alcohol, theDriving While Impaired charges pending against him, and hisfailure to answer the controlled substance question honestlyboth on the written application and during a personalinterview, referring Dr. Day to the Physicians' Health andEffective Committee of the North Carolina Medical Society withinstructions that Dr. Day request Theodore Clark, M. D. , toprovide the Board of Medical Examiners with a progress reportwithin three months of the date Dr. Day signs the ConsentOrder, instructing Dr. Day to refrain from consuming anyalcohol or controlled substances unless prescribed by anotherphysician or dentist, and advising Dr. Day the Board of MedicalExaminers will request him to appear for future interviews.

SALEM PSYCHIATRIC ASSOCIATES, P.A.

On January 22, 1987, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Citron and seconded by Dr.Alexander that the Board inform this corporation the Board ofMedical Examiners believes it should use the corporate nameSalem Psychiatric Associates, P.A.

The Board members did not approve the proposedname, New Directions: A Treatment Center for Anxiety andDepression, A Division of Salem Psychiatric Associates, P.A.

DIRKERS, JEROME DAVID, M. D. - Asheville, North Carolina

The Board unanimously adopted a motion made by Dr. Duckett and

seconded by Dr. Alexander that the Board of Medical Examinersenter into a Consent Order with Dr. Dirkers in which thisphysician agrees to the following conditions: ( 1) to surrendervoluntarily his license to practice medicine in the state ofNorth Carolina; (2) to surrender voluntarily his DEA

prescribing privileges; (3) to complete a drug rehabilitationprogram; (4) to authorize, if necessary, the Board's providinginformation to the rehabilitation program; (5) to authorize Dr.Talbot's providing progress reports as may be requested by theBoard of Medical Examiners; and (6) to appear before the NorthCarolina Board of Medical Examiners upon successful completionof this rehabilitation program.

TOPE, JOHN JEFFERY, M. D. - Greensboro, North Carolina

On January 24, 1987, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Patterson and seconded by Mrs.Malston that the Board and Dr. Tope enter into a Consent Ordercontaining the following conditions:

that the Board of Medical Examiners reprimands Dr. Tope;

that Dr. Tope provide a psychiatric evaluation for theBoard's review and that he furnish the Board of MedicalExaminers with psychiatric progress reports at six monthintervals;

that Dr. Tope undergo a complete physical examination byan Internist;

that the Internist who examines Dr. Tope provide the Boardwith an evaluation of Dr. Tope's medical condition;

that Dr. Tope continue under the care of a personalphysician for his medical problems;

that Dr. Tope not consume any controlled substances otherthan those prescribed by his personal physician or dentist;

that Dr. Tope submit to random drug screens upon request;

that Dr. Tope appear before the Board at its request;

that Dr. Tope refrain from prescribing medications forfamily members or for individuals residing at his home;

that Dr. Tope maintain adequate records on all individualswhom he treats and for who he prescribes medications;

that Dr. Tope advise the Board of Medical Examinerswithin ten days of all changes in practice sites;

that Dr. Tope obey all federal and state laws; and

that Dr. Tope be and remain of high moral character.

On January 24, 1987, Dr. Todd did not appear for an informalinterview as requested by the Board.

On January 27, 1987, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Alexander and seconded by Dr.Godwin that the Board write a letter to this physician stating:

On January 22, 1987, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Alexander and seconded by Dr.Godwin that the Board approve the Minutes of the December, 1986meeting.

JANUARY, 1988, MEETING

The President directed that the staff reserve sleeping andmeeting rooms at the North Raleigh Hilton for the January, 1988,meeting; that this meeting begin on Wednesday January 20, 1988,and continue through January 24, 1988; that, if after meeting atSheraton Imperial, the Board of Medical Examiners wishes toschedule the January, 1988, meeting at this hotel, it wi 11 soadvise the staff.

On January 22, 1987, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Citron and seconded by Dr. Godwinthat the Board accept Dr. Hanna's graduate medical education asmeeting its requirements; and that it advise Dr. Hanna, when hecompletes the credentialing process, he may appear for apersonal interview.

On January 22, 1987, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Citron and seconded by Dr. Godwinthat the Board advise Dr. Lidor, at the present time, he doesnot qualify for licensure in the state of North Carolina;however, if Dr. Lidor receives an appointment to a residencyprogram in a North Carolina teaching hospital, he will then beeligible to take FLEX'

LITHOTRIPSY, ATTORNEY'S RE(VEST FOR OPINION

On January 22, 1987, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Citron and seconded by Dr. Godwinthat the Board write a letter to Mr. Sollins stating the Boardof Medical Examiners of the State of North Carolina has reviewedthe practice arrangement described in his letter of December 17,1986, and has concerns that it may constitute a violation ofN. C. Gen. Stat. 90-18 or 90-14 (a)(12), although, not knowingall the details of this situation, the Board of MedicalExaminers cannot pre-judge or pre-determine an answer to thequestions raised in his letter.

On January 22, 1987, the Board of Medical Examiners unanimouslyadopted a further motion made by Dr. Citron and seconded by Dr.Patterson that the Board also include a statement in this letterto Mr. Sollins indicating the Board of Medical Examinersunderstands both the American College of Surgeons and theAmerican Urological Association have disapproved sucharrangements.

IMPAIRED PHYSICIANS PROGRAM

Dr. Godwin discussed the letter he received from John Foust,M. D. , regarding improving the impaired physicians program inthis state. He indicated that Dr. Foust is in favor ofcombining the efforts of the Medical Society, medical liabilityinsurance companies, and the Board of Medical Examiners toestablish a funded, rather than volunteer, rehabilitationprogram for impaired physicians in the state of North Carolina.

The Board members discussed funding for this program. Dr.Duckett acknowledged that raising registration fees to $100 is apossibility but that the Board should not consider this actionat the present time. Dr. Alexander suggested utilizing moneyobtained from alcohol tax and further stated that impairedphysicians should contribute financially to a rehabilitationprogram.

Dr. Citron suggested there is a need for a committee to study

this matter and raised several questions: (1) What kind oflegal entity will the administrative body of this program be?(2) How will it function? (3) Who will be the beneficiaries ofsuch a program?

The Board of Medical Examiners requested Dr. Duckett and Dr.Godwin to gather additional information on improving and fundingan impaired physicians program and to present another report onthis subject.

CITRON, JOSEPH, M. D. - Atlanta, Georgia

The Board unanimously adopted a motion that it deny licensure toJoseph Citron, M. D.

CLINICAL CLERKSHIP REGULATION

On January 22, 1987, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Duckett and seconded by Dr. Danielthat the Board accept as information a report indicating theearliest possible effective date for the Clinical ClerkshipRegulation is March 1, 1987.

On January 22, 1987, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Duckett and seconded by Dr. Citronthat the Board not approve this data request.

On January 22, 1987, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Daniel and seconded by Dr.Patterson that the Board send a letter to Pharmacist Webb with acopy to Wayne V. Boss, Executive Vice President of St. Joseph' sHospital, stating the Regulations of the Board of MedicalExaminers apply equally to in-patient and out-patient settings;and that the Board send a copy of its Regulations both to Mr.Webb and Mr. Boss.

On January 22, 1987, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Daniel and seconded by Dr.Patterson that the Board authorize a staff member to advise theChief Administrative Officer of Memorial Mission Hospital inAsheville it is the judgement of the Board of Medical Examinersthat a physician extender must have an order issued by asupervising physician prior to entering this order into apatient chart.

ANESTHESIA ASSISTANT PROGRAM

On January 22, 1987, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Citron and seconded by Dr. Godwinthat the Board of Medical Examiners write the following letterto Mr. Mollica:

At its January, 1987, meeting the Board of MedicalExaminers of the State of North Carolina reviewedinformation provided by Dr. Furgerson concerning theAnesthesia Assistant Program at Case Western ReserveUniversity.

A careful review of the information provided onthis program indicates that the curriculum is not ofsufficient breadth to satisfy the Board of MedicalExaminers' criteria for program approval. Specifically,there is insufficient documentation of training inthe principles of primary medical care, for example:general physical assessment, preventive medicine, andmanagement of clinical problems commonly encounteredin the primary care setting.

If there is additional information you wish to submit,the Board of Medical Examiners will be glad to reviewthis material.

REGULATION CHANGING FLEX DEADLINE FOR IN-STATE STUDENTS

On January 22, 1987, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Dr. Duckett and seconded by Dr.Alexander that the Board initiate the Hearing process, includingsetting an appropriate date, to change its Regulations to permitin-state medical students to take FLEX provided they meet thefollowing requirements: (1) Not less than seventy-five daysbefore the date of the examination, the Executive Secretary mustreceive a letter from the Dean of the Medical School of theapplicant stating that this applicant is expected to completeall requirements for graduation prior to the date of theexamination; and (2) Prior to the date of the examination, theExecutive Secretary must receive a letter from the Dean of theMedical School stating that the applicant has completed allrequirements for, and will receive, the M. D. degree from themedical school.

LUPRECHT, GERI LYN, M. D. - Winston-Salem, North Carolina

On January 22, the Board of Medical Examiners adopted a motionthat the Board issue Dr. Luprecht a dated license for a periodof one year; that she appear before the full Board prior to theexpiration of this dated license; and that Dr. Luprecht requestDr. Mattox to send progress reports to the Board of MedicalExaminers at four month intervals. Drs. Godwin, Patterson andHenry abstained from voting on this motion.

GUIDELINES FOR LICENSURE INTERVIEWS

The Board members discussed the following guidelines forconducting licensure interviews: (1) Consider scheduling anapplicant who graduated from medical school more than ten yearsprior to date of application for an interview with the fullBoard; (2) Consider requiring an applicant who has not passed acomprehensive medical examination within twenty years to take anexamination prior to approval for licensure.

When applicable, the Board requested the staff to note onapplications: "This physician graduated from medical schoolmore than ten years prior to date on application"; and/or, "Thisphysician has not passed a comprehensive medical examinationwithin twenty years of date on application. "

EMERGENCY MEDICAL SERVICES

On January 23, 1987, Mr. Ed Browning, Representative of theOffice of Emergency Medical Services, met with the Board ofMedical Examiners to discuss matters of mutual concern.

Mr. Browning provided the following information on Bee StingCertif ications.

He reported that, since the North Carolina Legislature approvedthe bi 11 on Bee Sting certifications, the Board of MedicalExaminers, through the Office of Emergency Medical Services, hasapproved 6, 829 certifications and recertifications.

Mr. Browning also reported that, during the summer months, therewere several unconfirmed reports of lives saved as a result ofthese certifications in Pender and Brunswick Counties. He

further stated that there were approximately three similarunconfirmed reports: one in Yadkin County and two in the westernpart of the state. Mr. Browning indicated that there were nofigures available on the number of deaths which have occurred asa result of bee stings since the enactment of Bee Stinglegislation; but that, according to Claude Frazier, M. D. , priorto this legislation, four to six people per year died of beestings in the state of North Carolina.

Mr. Browning reported to the Board that East Carolina Universityhas trained quite a few individuals; but that physicians inBuncombe County have trained the 1arqest number of individualsfor Bee Sting certification. He indicated that Dr. Frazier has

not personally trained many individuals; that ten to fifteenphysicians train most of the applicants; and that there is nofee involved. Mr. Browning reported to the Board that theEMT-P's, EMT-AI's, , and EMT-I's administer most of the Bee Stingtreatment in North Carolina.

Dr. Citron stated that it is time to re-evaluate this program.He recommended referring the matter to the North CarolinaMedical Society with the suggestion that this organizationappoint a Committee of Allergists, Immunologists, etc. ; that theBoard request the Medical Society's Committee to recommendanswers to the following questions: ( 1) Should the program becontinued? (2) Should it be modified? Dr. Alexander suggestedto the Office of Emergency Medical Services that it review deathcertificates to obtain statistics on the number of deathsresulting from bee stings.

At the conclusion of the discussion of Bee Sting Certifications,Ed Browning updated the Board of Medical Examiners on the EastCarolina University Study Project. He indicated that the Officeof Emergency Medical Servicves should receive a report on thisproject in March. Mr. Browning reminded the Board members thatthe purpose of the study project is to determine whether theadministration of nitrous oxide in a pre-hospital setting byEMT-AI's can be effective.

Mr. Browning told the Board that five counties in the state:Dare, Currituck, Union, New Hanover, and Pitt, are now

functioning at the Advanced Intermediate level of life supportand that, to date, the medical directors involved are quitepleased with the results.

He then reviewed various categories in the EMS system for thebenefit of the new Board members. He stated that the NorthCarolina Medical Care Commission approves EMT's to provide basiclife support. He indicated that approximately forty-threecounties in the far eastern and western parts of North Carolinaare still functioning at this level. Mr. Browning stated thatEMT-I's can start IV fluids and utilize an esophageal airway.Dr. Alexander commented that the term "esophageal obduratorairway" is preferable to referring to an "esophageal airway. "

In explaining how EMT-AI's differ from EMT-I' s, Mr. Browningindicated that EMT-AI's have one-hundred hours of training abovethe educational level of EMT-I' s. This group of individuals candefibrillate and administer four cardiac drugs. Moreover, Mr.Browning informed the Board that EMT-P's spend two to threehundred more hours in training than do EMT-AI's. They canperform all functions of EMT-AI's plus EMT-P's may utilize amuch more extensive drug formulary approved by the Board ofMedical Examiners and the various physicians at sponsorhospitals.

Dr. Patterson stated, "It is not recommended to administerSodium Bicarbonate in cardiac arrest. In fact, use of thissubstance can be contraindicated. " Ed Browning commented, "EMS

wi 11 have to go through some regulatory changes to remove theadministration of this drug from the EMT-AI skills; however, thepresent policy is to discourage use of Sodium Bicarbonate. " EdBrowning further informed the Board of Medical Examiners thatboth EMT-AI's and EMT-P's can intubate.

Ed Browning next discussed the Mobile Intensive Care Nurses;they may issue orders to all EMT personnel. He indicated thatreapproval requirements for MICN's include ten callssupervised by the medical director of the program, continuingeducation, experience on a field ambulance, ALS certification orpassing an examination administered by the Office of EmergencyMedical Services. Mr. Browning stated that the requirement tocomplete ten calls supervised by a physician is difficult toachieve. He mentioned the example of an MICN's going to work ata sponsor hospital, working at the site for six months, becomingdisabled, or deciding to change employment. During this MobileIntensive Care Nurse's first six months of employment, he or shemay have only completed three or four calls. At a later date,if this nurse decides to return to work, he or she may not havecompleted the required ten calls supervised by a medicaldirector; therefore, the nurse cannot be reapproved as an MICN.Ed Browning told the Board that, in cases such as the one hedescribed, it is the recommendation of EMS to allow the medicaldirector/physician to develop ten simulated scenarios approvedby the Office of Emergency Medical Services, supervise the MICN

during these simulated calls, and offer the nurse an opportunityfor reapproval without the necessity of repeating the entiretraining program.

Ed Browning also reported that the number of MICN's isdecreasing in North Carolina.

On January 23, 1987, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Citron and seconded by Dr.Patterson that the Board refer the matter of Bee StingCertifications to the North Carolina Medical Society; that theBoard ask this group's advice on the subject; that the Boardsend the Medical Society all available statistics on the numberof both Bee Sting Certifications and Recertifications since theprogram's inception; that the Board request the North CarolinaMedical Society's opinion on the validity of this program,taking into consideration the number of deaths, if any, per yearfrom bee stings, the dangers involved in administration ofEpinephrine by non-physicians, as well as the question oftime elapsing between the bee stings and the administration ofEpinephrine; and that the Board of Medical Examiners request theNorth Carolina Medical Society to provide the Board with areport on Bee Sting Certifications.

On January 23, 1987, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Daniel and seconded by Dr. Henrythat, when MICN's who have not completed the tenphysician-supervised calls requirement for certification have abreak in employment, the Board of Medical Examiners approve anextension of one year during which time the MICN must complywith this ten physician-supervised calls requirement; but thatthe Board permit a Mobile Intensive Care Nurse to use thisextension only once.

On January 23, 1987, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Citron and seconded by Dr. Danielthat the Board accept the recommendations of the Office ofEmergency Medical Services and approve 114 initial ALSapplications, 106 ALS recertification applications, includingthree duplicates, and 223 Bee Sting Certifications.

On January 24, 1987, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Duckett and seconded by Dr. Citronthat the Board accept the training approved by the OB/Gyn Boardas meeting the requirements of the North Carolina Board ofMedical Examiners.

BEAVERS, CARL, M. D. - Apex, North Carolina

On January 24, 1987, the Board of Medical Examiners adopted amotion made by Dr. Patterson and seconded by Dr. Godwin thatthe Board enter into a Consent Order with Dr. Beaversstipulating that (1) the Board reprimands Dr. Beavers for hisprescribing practices; (2) for a period of six months from theeffective date of this Consent Order, Dr. Beavers shall notprescribe, dispense, or administer any controlled substances inSchedules 2 through 5 except in a hospital or emergency roomsetting; and (3) Dr. Beavers shall meet again informally withthe Board at its direction.

Dr. Alexander voted in opposition to this motion.

The President informed Dr. Beavers that the Board will requesthim to appear for another informal interview to discuss hisprogress in May or June, 1987.

CONFIRMATION OF CLINICAL CLERKSHIPS

After March, 1987, the Board of Medical Examiners directed thatthe Board obtain written confirmation from all hospitals wheregraduates of foreign medical schools have completed clinicalclerkships stating these institutions are teaching hospitals

with approved residency programs in the areas of theapplicants' clerkships; and that the licensure applicantsprovide written confirmation from such hospitals stating theseapplicants have successfully completed clinical clerkships inspecific specialty areas.

LANDAU, STEVEN EDWARD, M. D. - Smithfield, North Carolina

On January 24, 1987, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Citron and seconded by Dr. Godwinthat the Board approve Dr. Landau's request for full licensure.

ROBERTSON, LOGAN THOMSON, M. D. - Canton, North Carolina

On January 24, 1987, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Duckett and seconded by Dr. Danielthat the Board prefer charges against Dr. Robertson on thebasis of N. C.G. S. 90-14 (6): Unprofessional Conduct, Aidingand Abetting the Illegal Practice of Medicine, and any otherapplicable violations of North Carolina General Statutesexcluding the use of Chelation Therapy.

HAYES, ALBERT DRAKE, M. D. - Hendersonvi lie, North Carolina

On January 24, 1987, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Duckett and seconded by Dr. Godwinthat the Board enter into a Consent Order with Dr. Hayescontaining the following stipulations: (1) Dr. Hayes shallimmediately surrender to the Board his license to practicemedicine in North Carolina; (2) Upon receiving this license,the Board will issue Dr. Hayes a dated license to practicemedicine in North Carolina valid through March 30, 1987; (3)Dr. Hayes shall obtain, as soon as possible, comprehensivemedical and psychiatric evaluations from Board-certifiedspecialists in internal medicine and psychiatry of hischoosing, subject to approval by the Board; (4) Dr. Hayes shallarrange for his chosen internist and psychiatrist to providedirectly to the Board within thirty days complete evaluativereports regarding his current physical and mental condition,including their respective diagnoses, prognoses, andrecommended courses of treatment, if any; (5) Dr. Hayes shallauthorize the Board to provide to his physicians suchinformation concerning him as the Board, in its discretion,shall deem necessary and appropriate; (6) Dr. Hayes shallabstain completely from the consumption of alcohol andcontrolled substances, except such as may be prescribed for himby his regular physician or dentist; (7) Dr. Hayes shall be andremain of good moral character and shall violate no state orfederal laws; and (8) Dr. Hayes shall meet again informally

with the Board at its regular meeting in March, 1987.

ADJOURNMENT

As the Board of Medical Examiners had no further business toconduct at this meeting, Charles H. Duckett, M. D. , President ofthe Board, declared the meeting adjourned at 6:40 p. m. , January24, 1987.
