ABOUT

• The properties of the Trust whether movable immovable shall be vested in Board of Trustees.• The number of Executive members may be enhanced, if necessary, by the Board of Trustees

by simple majority of the Trustees, present, & voting in a meeting especially called for the purpose. In case of tie, the chairman will have casting vote.

• The executive Committee shall have the power to frame byelaws of the Trust in respect of nay institutions or committees set up by the Trust in respect of any matter within the Jurisdiction of the Trust.

• the Executive committee shall be competent to affiliate other organization/ institutions on such terms & conditions as approved by the Board of Trustees.

• the Executive of any meeting of the general Body, Executive Committee or any Committee or sub-committee shall be 1/3rd of member expect amendment. If the Quorum is not complete; the meeting shall be adjourned & reconvened by the chairman These shall be no quorum for the adjourned meeting.

Aims & Objects of the Trust • The Trust & its members will work for the Upliftment of poor & the weaker with particular reference to the

followings.• To promote social awareness, educational & cultural empowerment of the Weaker section & downtrodden

people in particular & other in general.• To open, arrange, establish & look-after nursery. Primary, secondary & Higher secondary schools for the

development & advancement of education Amongst the people in general• To establish technical job oriented courses (I T I'S), polytechnics & other Technical / professional

institutions.• To start teachers training & physical training colleges /institution• To start & run the courses of computer science courses. Information Technology courses & business

management courses.• To open, arrange & establish paramedical courses & pharmacy colleges• To establish adult education centres in different parts of the country Imparting minimum educational set

up to the adult / old people in order To see that they are able to say good-bye to illiteracy which is mother of All the evils.

• To establish book bank, libraries & reading rooms & to give loans, Scholar & other assistance to intelligent as well as poor students.

• To Start sports coaching academes, coaching centres of different Competitive, examination/ tests for poor students/ needy persons of society.

• To publish journals news letters, periodicals, magazine, booklet & Publication in art, culture, socio economic & other different areas, & to Arrange the distribution thereof.

• To promote welfare of children with respect to education, health & other Areas as enshrined in the united nation convection no right of the child.

Management of the Trust • Board of Trustees : All the trustees/life trustees shall collectively constitute the Board of trustees. The settler as

its chairman for life. The Board of trustees shall be the Custodian of all the properties & whether moveable or immoveable, of the trust & in Matters of properties & finance, it may veto the decision of the Executive Committee. The meeting / emergency meeting of the board of Trustees shall be called & presided Over by the chairman. The Board of Trustees shall meet at least twice in a year to review & supervise the functions/ works of the Executive Committee & shall have power to Recommend / change for the consideration of the Executive Committee.

1) The Board of trustees shall be the first chair person comprise of not less than tow & not more than nine trustees including the chairman. The above-mentioned life trustees shall Be the founder trustees & shall collectively constitute the Board of Trustees.

2) ......... shall be the first chairperson & shall hold office for life ..........................................shall be the trustees & shall hold office for life. All other trustees shall hold office for a period of five yrs. & shall be eligible for-appointment in the manner stated in

3) In the event of vacancy of life trustees caused by death, resignation or otherwise, the Remaining life trustees shall elect a person who is otherwise eligible to be enrolled as Member of the Trust as life trustee by simple majority of the life trustees present & voting in a meeting especially called for the purpose. 4) There are only four life trustees. However, if the chairman is of the view that services of Any person (s) is required or essential for better management is of trust, he/she can nominate such person (s) as life trustees / trustees after consultation from & the consent of the Board of trustees.

Executive Committee • Subject to the over all supervision & guidance of the Chairman

of the board of trustees, all the properties, finance & other administrative Affairs of the trust shall be controlled & managed by the Executive Committee. The First office bearers shall be elected at the first meeting of the board of trustees after the registration of the Trust Deed. The Executive committee shall consists of the following:

1. The chairman, 2. Vice chairman, 3. General secretary, 4. four Executive members (two of whom shall be nominate by the chairman with the consolation & consent of the life trustees & the remaining two shall be elected by the general body)

Chairman • The settler be the chairman of the board of the trustees as well as chairman of the

Executive Committee . In the event of vacancy of the chairman caused by death, resignation, or otherwise the remaining trustees shall elected a chairman from amongst themselves a candidate who gets the highest number of the votes of the trustees present & voting in a meeting especially called for this purpose. The chairman so elected, shall hold office for a period of five yrs. However, the chairman so elected, shall eligible for Re-election.The chairman shall be the head of the Trust & shall be competent to represent the Trust. He/ she shall be chief custodian & financial authority of the Trust & shall exercise overall supervision & control over the Trust.

• The chairman shall ensure that the aims & objectives & rules and regulations of the trust Are duly implemented, he / she shall have all powers necessary to ensure, observance of the staff who violate the aims and objectives & rule & regulations of the Trust.

• The chairman may, if he/ she is of the opinion that immediate action is necessary on any Matter, exercise any power conferred on any authority / officer of the Trust & shall report It to the Executive Committee & it shall seek the consent of the Executive Committee.

Vice Chairman • The vice chairman shall be nominated by the chairman with the

Consolations & consent of the life trustees for a period of five years from amongst the Life trustees.The vice chairman shall be eligible to be re-nominated after completion of his / her Term.

• The vice chairman shall be assist the chairman in the discharge of duties of the chairman & Person such duties & exercise, such power as delegated, by the chairman or authorized by the Executive Committee from time to time.

• The vice chairman, if so designated by the chairman shall officiate as the chairman in The absence of the chairman or if the chairman is unable to perform his / her duties owing to death, illness or otherwise.

General Secretary • The general secretary of the Trust shall be nominated by the

chairman with the consolation & consent of the life trustees for a period of five yrs from Amongst the life trustees.The General Secretary shall be eligible for re-nomination on completion of his / her term.

• The General Secretary of the trust shall be in charge of administration & office work & Shall maintain the records of the Trust.

• The General Secretary will be responsible to prepare the annual report of the Trust & Present it to the Executive Committee.

Treasurer• The treasurer shall be nominated by the chairman with the consolation &

Consent of the life trustees for a period of five yrs for amongst the life trustees.The treasure shall be eligible for re-nomination on completion of his / her term.

• The treasure shall manage the funds of the Trust & to ensure that expenditure is Incurred for approved purposes & money is granted or sanctioned by the competent Authority.

• The Treasure shall prepare the annual budget by consulting with the chairman & the General Secretary, which will require the approval of the Executive Committee & the Board of Trustees.

• The Treasure shall ensure that the Accounts of the trust are regularly audited & the Annual Audit Report is presented before the Executive Committee and the Board of Trustees.

Powers and Functions of The Executive Committee• The Executive Committee shall have the power to create various posts & appoints the

staff Of the Trust & decide the conditions, remuneration & mode of recruitment. • The Executive Committee shall have power to take all such action which are required to

Promote all or any of the aims & objectives of the Trust. • The Executive Committee shall have power to approve the budget. account & audit

Report of the Trust. • The ordinary meeting of Executive committee shall be held at least twice in one calendar

year. • The order nary and special meeting of the Executive Committee shall be convened or

caused To the convened by the chairman. • The Executive committee shall have the power to frame bye-lows for the trust or the its

institution. • The Executive Committee may delegate its power to any sub- committee, officer or

institution by a specific resolution.• The Quorum of the Executive Committee meeting shall be one third.• There shall be no quorum for an adjoined meeting of the executive committee.

Powers of Trustees • For the furtherance of the objects of the trust, the trustees shall have following powers • To accept any donation, contribution, grant or subscription in cash or in kind from any Person(s) body of persons or

trust without conditions. • To apply the whole or any part of the income of the trust or the Trust fund or Accumulation thereof, any one or more of

the objects of the trust, as the trustees may in their discretion deem fit from time to time.• To convert and deal with Trust property and/or any investments for the time being. • To invest the trust either the purpose of immovable property or in shares, stock or debentures of other securities and

investment, or in deposits with or loans to any company, bank or any other person, and the alter, vary transpose such investment, from time to time at the direction of trustees.

• To borrow or raise or secure payments or moneys and also to lend money either with or without security. • To sell, manage, transfer, exchange, mortgage, pledge, hypothecate, gift, lease, and dispose of or otherwise deal with

any property, whatsoever belonging to the Trust for the best interest of the Trust. • To adjust, settle, compromise, compound refer to arbitration, all actions, suits, claims Demands & proceedings

regarding the Trust fund. • To appoint constitute attorneys or agents & to delegate to such attorneys or agents all or Any the powers vested on

them under these present & from time to time remove such attorneys or agents & to appoint other or others in his/her or their place.

• To appoint or make provision for the appointment of any person including all or any of The trustees & committees or administrator or managing Trustees or otherwise for the trustee & committees or administrator or managing Trustees or other wise for the purpose of the administration of the trust in such manner & subject to such rules & regulations as the trustees to hold any fund or investment, subject to the provisions in this deed in such manner & subject to such rules & regulations as the trustees may from time to time think fit.

• To make, vary alter or modify, schemes rules & regulation & for carrying our the objects or the trust & for the management of the affairs thereof or running any Institution in furtherance of the objects of the trust & otherwise for giving effect to objects of the Trust.

Membership of The Trust • The membership of the trust be open to all persons irrespective of their faith, sex, Race, caste, colour & domicile,

who have attained the age of eighteen years or above & are not unsound mind & subscribe to the aims & objectives & rules & regulation of the Trust. There shall be following categories of the members

Life Members : All the aforementioned life trustees including the settler shall be the life members of the Trust. Any person who is eligible to the enrolled as a member may be enrolled as life members on payment a sum of Rs. 1,000/- (one thousand rupees only).

General Members : A person is eligible to enrolled as enrolled as member, may be admitted as general member by the Board of Trustees on payment of Rs. 100/- (one hundred rupees only) as admission fee a monthly.

Honorary Members : The board of the trustees may request a person to accept the honorary membership of the trust who has achieved eminence in the field of the education, legal practice, social work, public administration etc.

Institutional Members : The executive Committee may admit Govt./semi Govt., private Institutions / NGOs as institutional members on payment of Rs. 10,000/- (Ten thousand rupees only) as admission fee & annual subscription of Rs.1,000/- Committee is satisfied that such institutions subscribe to the aims & objective & in the implementation of its Programmes in accordance with the rules & regulation of the trust. The Executive Committee may change The annual subscription of institutional members From time to time.

Enrolment Members : All applications for enrolment as member of the Trust shall be addressed to the general Secretary. Who after being satisfied thereof, shall submit application to the Chairman. The Chairman, thereafter, will recommend & place the application in the meeting of Executive Committee for its consideration. After approval of the Executive Committee, the person/ institution shall become member of the Trust.

Termination of Membership • A member ceases to be a member of the Trust.

on his/her death. • Non-payment of subscription fee continuously for more than three months. • upon acceptance in writing of his/her registration by the Executive Committee.• If, he/she does not atted three consecutive meeting of the General Body

without Any prior information/ intimation. • If,he/she is found working against the objective of the Trust.• If/he/she is declared bankrupt or punished by the court of law for offence

involving Moral turpitude. • The Decision of the Executive Committee in respect of termination of

membership shall be final. However, the members whose membership is sought to be terminate shall be given an opportunity explain his/ her case.

• Provide, the Board of trustees shall have power to restore the membership after being Satisfied with the explanation given by the member.

General Body Meeting : Functions & Meetings • The general body of the trust shall consist of life members, general members and

institutional members of the trust. • The general Body shall normally meet once in year to discuss and approve the annual

report and audit Report of the Trust. • The general Body may give such directions or guidance to the executive committee,

which may be necessary in the furtherance of the aims and objectives of the trust. • The chairman of the general secretary of the trust shall be the chairman and General

secretary of the General Body respectively. • The meeting of the General Body shall be the called by the general secretary, which shall

be presided over by the chairman. • An Extraordinary meeting of the general body may be convened by atleast one fourth of

the members enrolled of whom atleast two should be life trustees by circulating a notice in writing alonwith the agenda.

• One-Third of the members enrolled shall constitute quorum of the general body meeting however, there shall be no quorum for an adjourned meeting of the general Body.

• The general body shall appoint auditor in its annual general meeting for ensuring year. • The decision of the general Body shall be taken by a simple majority. The chairman shall

have the casting vote, in case of the tie. The decision of the general Body shall be final.

Election • The election of the office bearers and executive members

shall be held sufficiently in advance of the expire of their terms by a returning officer duly appointed by the executive committee.

• The returning officer, shall conduct election in accordance with the procedure approved by the Executive committee.

• A member eligible to vote can contest lection & a member who is in areas of monthly yearly subscription as the case may be shall no be eligible to vote or contest election.

Funds & Properties of The Trust • The corpus fund of the trust shall consist of donation of the trustees general contribution. Any Govt.

Dept. as per desire like minded institution and individual and Endowments to support scholarship and stipend, Govt. aid.

• Annual contribution received from affiliate association & organizations. • Subscriptions & donation collected from public, loans from banks & Financial Institutions. • Donations & grants collected from the state & central Govt. & other social organizations or corporate

bodies in India & aboard. • All income rents, service charges fees, donations & other funds & moneys collected from public & all

institution under the control & management of the Trust. • Movable & immovable properties acquired by the Trust. • All funds, properties rights, claims & demands belonging to or pertaining to the trust now or

hereafter that will be acquired from time to time & shall vest in the Trust. • The trust & the funds will be irrevocable for all times. • The settler trustee declares that the said funds & all further funds, donations, contribution, Income

from investments etc. received in any shape or form to the said fund, shall be held upon Trust for the objective & purposes; & will be subject to the powers & provisions hereafter mentioned.

• All money forming part of the Trust fund & requiring investment shall be invested by & in the name of the Trust for the time being in any of the forms & modes authorized by law For investment of Trust funds or in deposits with any scheduled Bank or Bans in India & The Trust Shall be invested only in immovable or movable property as authorized by law Applicable to Trust.

Banking

• Bank Accounts : The Trust shall open & maintain bank accounts in scheduled banks / Nationalized banks etc. & the bank account shall be operated by the joint Signatures of the chairman & Treasurer & to determine its or Their mode of operations.

Accounts and Audit : The Executive committee of Trust shall keep at the registered office of the Trust or at such other places as the Executive Committee may think fit & proper books accounts should be maintained.

• The Accounts of the Trust shall be audited annually be the chartered Accountant duly Appointed in the General Body meeting.

• The Account year of the Trust shall be from 1st April to 31st March.

The resignation so tendered shall become effective from the date it is accepted by the Executive Committee.

• All deeds and other documents to be executed by or on behalf of the Trust shall done by The chairman & the Trust may sue or be sued in the name of the chairman. All pleading Including plaints, written statements, counter affidavit, applications, petitions, affidavits Etc. in all the proceedings by or against the trust shall be signed & verified by the Chairman.
