INTRODUCTION

India being a developing nation is currently facing many challenges and the reservation system being one of them.

Reservation introduced for the equal progress of all the sections of the society.

General category people have started to feel that they are being subjugated.

The candidate who is the most worthy based on the merit should get the opportunity irrespective of his caste and religion.

BACKGROUND

Reservations were introduced in the last decades of 19th century when the subcontinent was divided into British India and 600 princely states.

The princely states were determined in the advancement of the minorities and deprived section of the society and hence reservation policies came into existence.

Dr. Babasaheb Ambedkar made certain arrangements for the backward classes to allow them to enjoy a humane lifestyle and bring their upliftment in the political field.

The reservation system finds its origin in the age-old caste system of India. The caste system at its birth was meant to divide people on the basis of their occupation like teaching and preaching (Brahmins), kingship and war (Kshatriya) and lastly business(vaish) etc.

Today we stand divided widely into Hindu, Muslim, SC, ST & OBCs with newer reservations coming up for other different sections of the society like Christians, Kashmiris, Jats, Kashmiri Pandits, Tribals etc.

Article 46 of the Indian Constitution:-Educational and economic interests of the weaker sections of the people(SCsandSTs) should be preserved and shall protect them from social injustice and all forms of exploitation.

Article 15(4) of our constitution empowers the government to make special provisions for advancement of backward classes.

Similarly Article 16 provides for equality of opportunity in matters of employment or appointment to any post under the State.

Current Situation

In today’s time one of the major roadblocks to the equality is the Reservation system.

Reservation in India is given on the basis of caste, sub caste and religion, and political parties are using this method to get the votes.

Total reservation quota stands at 49.5% in many states of India and this includes the SCs(15%), STs(7.5%), and the OBCs(27%).

Since economic status is not a test used, undeserving people gain the advantages and the deserving ones are still without a significant change in their situations.

The Mandal commission was established in 1979 by the central government to identify the socially or educationally backward people.

Mandal Commission Report of 1991 was in favour of reservations in higher education and government services for the other backward classes of India.

The current slogan in India seems to be “abolish reservation because merit and efficiency are in danger.”

Types of Reservation

Caste Based: Caste is decided based on birth, and can never be changed. A person can change his religion, and his economic status can fluctuate, the caste is permanent.

Management Quota: It is a quota based on economic status irrespective of caste, race and religion; anybody who has money can buy his/her seat.

Gender Based: The Womens reservation Bill was passed by the Rajya Sabha on 9 March 2010 by a majority vote of 186 members in favor and 1 against.

Religion Based: Government says that this sub-quota is based on the backwardness of the religious communities and not on the religions themselves.

State of Domicile: Most of jobs under state government are reserved to those who are domiciles under that government.

Undergraduate Colleges: Institutes like JIPMER (Jawaharlal Institute of Postgraduate Medical Education & Research) have a policy of reserving postgraduate seats for those who completed their MBBS in JIPMER.

. Other Criteria: 1)Sons / Daughters / Grandsons / Grand

daughters of Freedom Fighters. 2)Physically handicapped. 3)Sports personalities. 4)Non-Resident Indians (NRIs) have a small

fraction of reserved seats in educational Institutions. They have to pay more fees and pay in foreign currency.

5)Seat reservation for Senior citizens/ PH/Women’s in Public Bus transport.

centuries of discrimination • Reservation is political necessity required for

peace keeping in India.• Reservation are means to increase

presentation of present under-presented caste group.

Non supporter of Reservation

Reservation is a tool to meet narrow political ends.

Allocating quotas is a form of discrimination which is contrary to the right to equality.

The 60% of India that is rural needs schools, health care and infrastructure in rural areas, not reservation in urban institutions

Consequences Protests by students all over India. Upliftment of deprived castes. Deterioration in economic condition of

some non-reserved class people. Division of society. Demand for reservation by some non-

reserved category. Misuse of reservation policy.

SOLUTIONS Reservation can be on the basis of collective

salary of family, that is salary of husband and wife, and incomes derived from all other sources or income from joint family property.

Limited the duration for which reservation will be applicable.

Government also now making some new decisions like divide OBC(one the basis of income) in two classes Non-creamy layer and Creamy layer, and benefits of reservation will only for the peoples comes in category of Non-creamy layer.

Close reservation and support some NGO’s and other organizations by government to open better schools and institutions for peoples who really need some support

Makes the limit of no. of members for a family to takes the benefit of the reservation like only 1 or 2 children of the family will get reservation.

Or reserve the seats for general peoples also in the appropriate proportion to the % of the population

Conclusion

Taking into considerations all the points we can conclude that reservations were introduced in the Indian Education system as a means for the over all development of the society.

Many people belonging to the reserved category are taking undue advantage of the reservation. But from another point of view those who are worthy based on merit are losing their value due to reservations

Complete elimination of reservations is not possible considering the current political scenario.

Hence, reservation should be provided to the people who really need it.
