What is a DBFOM?

Overview• DBFOM: Design Build Finance Operate and Maintain • CDOT maintains ownership of the Project

• All aspects of procurement are transferred to the private sector

• During Construction, the Developer is paid milestone payments for a portion of construction costs

• Over the remaining life of the Project, the Developer is paid performance payments (i.e. fixed yearly fee)

services from local businesses and provides hundreds of jobs over the 30 year term

• Cost Certainty: The Developer has increased responsibilities for design, construction, maintenance, and rehabilitation limiting the risk of cost overrun

Mark Roles KMP forms an SPV (Special Purpose Vehicle) to arrange financing and manage the Design Build and Operate and Maintain Contracts (the contract is between the SPV and the Department; there is no contract between DB and CDOT) CDOT ensure Developer remains in compliance with all contract requirements (financing, construction, operations, maintenance, etc.) Kiewit and Parsons Brinckerhoff will serve in traditional roles of a design build contract Jorgensen and Kiewit will take over the responsibilities typically associated with the Department for routine maintenance, operations, and renewal work for a 30 year period
