SECTIONi1.iiSection 42.0421, Human Resources Code, is amended byamending Subsection (a) and adding Subsections (f) and (g) to read as follows:

(a)iiThe minimum training standards prescribed by the department underSection 42.042(p) for an employee, director, or operator of a day-care center, [or]group day-care home, or registered family home must include:

(1)ii24 [eight] hours of initial training that must be completed not laterthan the 90th day after the employee ’s first day of employment for an employeeof a day-care center who has no previous training or less than two years ofemployment experience in a regulated child-care facility, eight hours of whichmust [to] be completed before the employee is given responsibility for a group ofchildren;

(2)ii24 [15] hours of annual training for each employee of a day-carecenter or group day-care home, excluding the director, which must include atleast six hours of training in one or more of the following areas:

(A)iichild growth and development;(B)iiguidance and discipline;(C)iiage-appropriate curriculum; and(D)iiteacher-child interaction; and

(3)ii30i[20] hours of annual training for each director of a day-carecenter or group day-care home, or operator of a registered family home, whichmust include at least six hours of training in one or more of the following areas:

(A)iichild growth and development;(B)iiguidance and discipline;(C)iiage-appropriate curriculum; and(D)iiteacher-child interaction.

(f)iiIn adopting the minimum training standards under Section 42.042(p), thedepartment may not require more training hours than the number of hoursprescribed by Subsection (a) for a day-care center, group day-care home, or aregistered family home.

(g)iiThe executive commissioner by rule shall adopt minimum trainingstandards for before-school or after-school and school-age programs as requiredby Section 42.042(p). In adopting minimum training standards for before-schoolor after-school and school-age programs under this subsection, the executivecommissioner may not require more initial or annual training hours than thenumber of hours required by Subsection (a) immediately before September 1,2011.

SECTIONi2.iiSection 42.0426, Human Resources Code, is amended byadding Subsection (c) to read as follows:

(c)iiNot later than the seventh day after the date an employee beginsemployment at a day-care center, group day-care home, or registered familyhome, the employee must complete an orientation to the facility.

SECTIONi3.ii(a)iiSection 42.0421(a)(1), Human Resources Code, asamended by this Act, and Section 42.0426(c), Human Resources Code, as addedby this Act, apply only to an employee who is initially employed by a child-care

(b)iiSections 42.0421(a)(2) and (3), Human Resources Code, as amended bythis Act, apply to an employee or director of a child-care facility regardless of thedate the person began employment with or service as director of the child-carefacility.

SECTIONi4.iiThis Act takes effect September 1, 2011.

CSSB 329 - STATEMENT OF LEGISLATIVE INTENT

REPRESENTATIVE ALISEDA: Isn ’t it correct that this bill does not includecomputer equipment because the legislature previously enacted a computerequipment recycling program?

REPRESENTATIVE CHISUM: Yes.

ALISEDA: Although there are similarities between the computer equipmentrecycling program and the television recycling bill before us, isn ’t one of themore significant differences the establishment of the Recycling LeadershipProgram whereby members can participate and collectively report, as opposed toindividually report their recycling numbers to the TCEQ?

CHISUM: Yes.

ALISEDA: And this is different from computer equipment which is required toindividually report its recycling numbers to the TCEQ; there is no collective oraggregate reporting option?

CHISUM: That is correct.

ALISEDA: I think you have a good bill, but I urge this body to closely monitorthe implementation of this program because we may want to revisit this in thefuture to make sure we don ’t have just a few television manufacturers recyclingand reporting large numbers for the benefit of all manufacturers participating in aparticular Recycling Leadership Program.
