court reporting fees as you know are extremely hiqh, those

of us who are lawyers huve to pay the dorn things every

once in a while and they're murder. I talked to the Chair-

man about the possibility and the sub-committee of Approp-

riaticns, the Full Appropriations Ccmmittee, which approved

this bill, also, discussed this matter with them . Isn 't

there some way that you can sit down and hire somebody to

take over the full time court reporting as an employee for

the agency. Ah, the agency did try that route and it turn-

ed out that they made an offer of $17,500.00,, I believe it

was for a full time court reporter and could not get anybod

at a1l tc accept the offer, and they figured that the total

cost if they had someone on their staff would be approx-

imately the same as they are if they hire outside court

reporters. Another problem is that they have many more

t ting requirements that 'one employee could han-cour repor

dle, they'd huve to have a number of full time court re-

porters. and they simply aren't available. It's kind of

like the situation with doctors, it's a seller's market and

the problem is that we just don't have the people available

for the job and those that are availsble are locked up inthe outside court reporting firm'and I believe the sub-com-

mittee and the full appropriations committee and I know I

am convinced that this is the most economical way fcr them

to go, but you can be sure that the Chairman and the member

of the board are well aWare of the problem &nd they're doin

their best to cut down the problem .''

we requested that maybe the Department of Personnel would

incorporBte a training program so we could hire a person in

this cBpaeity. Last week , Thursday, in Environment Com-

mittee, the Director Curry stated that they just o/ened upa bid for a cour't reporting service for the coming yeur

and in turn. I guess the dollar amount was quite favorable,

but as far as the House Bill 4130, the amendment that has

b een proposed was fairly discussed in ccmmittee, the reduc-

tion based upon fact and I concvr with the movement of the

the shape that its in, wouldn't we' be much better off with

this money being able to be used by people to feed their

families rather than sitting in the Treasury of khe State

of Illinois?''

Edward R. Madigan: ''Well: basically what we're trying to do

is to get the money out of the Treasury of the State of

Illinois, out of the General Revenue fund and into the

Appropriation for the Department of Revenue so that We 'can

have an a'dequate amount of money to pay the refunds to the

taxpayers and to pay them promptly. I don't believe: if I

may continue, Representative Shee, I don't believe that the

. fault lies with the Department of Revenue or with the State

of Illinois. I think it's been evident each year since

we've had the State income tax that the employers respon-

sible for computing the withholding for their emplcyees ccn

kinue to make errors in th'e amount that âs to be withhelde

then continue to cause those problems on the tail end of th

tax year for the Department of Revenue. It is just not

fai l/ng with the state income tax, but exists also with the$federal income tax and if you've been following that pro-

blem in the newspaper oh the federal income tax, then you

kncw that it amounts to about up to a sum of about $10

tion is isn't the 7% tax credit recently enacted by. the

Executive Order of the President? Isn't that accounting

down as to what they want it for and pn accurate amount and

then the Bureau of the Budget goes over these things and

cuts down those amounts that they choose to cut down. The

budget that you see presented to the legisleture by this

department or any other department reflects a prior judg-

ment having been made by the Bureau of the Budget as to

what these amounts should be. Klen the Bureau of the Bud-

qet is in error, then the Department of Revenue or whatever

agency is involved, must come back and ask for additicnal

money and basically that is what has cccurred here.''

John Hirschfeld: ''Thank ycu, Mr. Speaker. House Bill

4282 is my personal opinion is legislation which could

mean millions of dollars to Illinois Small Businesses.each

year. What this bill does is extend the concept of the

federal small business administrettion to purchases made by

the State of Illinois, by authorizing the Department of

General services to designate as small business specifize

certain specified commodities, equipments or services. In

the cases of purchases designated as small business set

aside, invitations to bid would be confined to small bus-

inesses énd bids from other businesaes would be refused.

However, in order to protect the State of Illinois, if the

total number of small businesses responding to the invita-

tion to bid was less than three or if the Department deter-

mined that acceptance of the best bid would result in the

pending of an unreasonable price, the Department could re-

ject a11 bids and withdraw the set aside designation. Upde

the bill, the small businéss is defined as a business which

is independently owned and operaied and it is not dominant

in its field of operation. Dollar volumes are also estab-

lished, so that no wholesale business would be a small bus-

iness if its annual sales for the most recently completed

fiscal year were to excêed $5 million and no retail busines

or business selling services as small business if its

is clear and has now been twice manifested, the form of

Hcuse Bill 206 as enacted inadverEantly repeals the languag

of our Dram Shop Law permitting local authorities to re-

strict the hours for the sale of alcoholic liquors on any

occasion. (See Maywocd Proviso state Bank v. City of Oak-

brook Terrace, 67 111. App. 2d 280, 214 N.E. 2d. 582, (1966 ).- The striking of this authority, particularly as it would

apply to our non-home rule units of local government, is

neither necessary nor consistent with the legislative in-

tent of permitting the sale of liquor on election days.
