    RESERVATIONS AND PAYMENT: Operatoraccepts payment by credit and debit cards is-sued on the following networks: AMERICANEXPRESS, VISA, MASTERCARD, OR DIS-COVER. If payment is made by credit card to atravel agent a signed, fully completed univer-sal charge form (UCC) for full payment mustbe received to secure reservations. Any otherperson or entity (including a travel agent) whoreceives monies from participants does sostrictly as an agent of participants. Tender ofpayment to Operator constitutes acceptance

    of these terms of sale. Full payment is appliedto the credit card entered into the system atthe time of booking. Online bookings will beaccepted up to 4 days prior to scheduled de-parture. All reservations made 14 days or lessprior to departure will be charged a $25.00Special Handling Fee to cover costs associ-ated with expedited processing of the book-ing. After payment is made, all revisions aresubject to a $25.00 per booking fee, plus anysupplier fees.

    RESPONSIBILITY AND LIABILITY: Operatordoes not own or operate, nor is it responsiblefor, the acts or omissions any of the supplierswhich will provide goods and services in con-nection with the trip or for any option which

    may be available in connection with the trip(including optional side trips, car rentals, etc.)and Operator has not priced the trip or op-tions to allow Operator to guarantee againstfailure of any such suppliers. Accordingly,participant(s) agree to seek remedies directlywith the supplier and not to hold Operator,its parent, subsidiaries, affiliates and/or rep-resentatives (collectively Operator Parties)liable, in the absence of i ts or their gross neg-ligence or willful misconduct, for any loss, in-jury, delay, expense or damage which resultsdirectly or indirectly from any action or omis-sion, whether negligent, criminal or otherwise,of any entity providing goods or services inconnection with the trip or any available op-tion (for example, the quality of services,

    cleanliness of a hotel, hotel overbooking, can-cellation of services, cessation of operations,accidents, failure of equipment, changes infares, itineraries or schedules or any ightdelay). Participant(s) also agree not to holdthe Operator Parties liable for circumstancesbeyond its or their control (for example, acts ofGod such as res, earthquakes, hurricanes,oods, or climatic aberrations; acts of govern-mental authorities; civil unrest; strikes; riots;theft; disease; accidents or failures related tothe public internet, telecommunications linesor facilities, or third party technology systems;piracy or terrorism). Participant(s) acknowl-

    edge that the Operator Parties have not madeany representations or promises with respectto the trip except as expressly set forth in theOperators literature, unless such agreementis in writing and signed by an officer of Opera-tor. At any time, the Operator may decline, forany reason, any person as a participant on atrip (or option) whereupon the Operators onlyobligation shall be to refund such person thatportion of any prepayment allocable to the un-used services.

    INTERMEDIARY DISCLOSURE: No jointventure, partnership, employment, agency orduciary relationship exists between you andOperator or American Express as a result ofyour use of our travel services. In our role asa travel agent Operator acts as an indepen-dent contractor. Operator assists you in nd-ing travel suppliers and making arrangementsthat meet your individual needs. We considervarious factors in identifying travel suppliersto you and recommending specic itineraries.We want you to be aware that certain suppli-ers pay us commissions as well as incentivesfor reaching sales targets or other goals, andfrom time to time may also provide incentivesto our travel counselors. Certain suppliers may

    also provide compensation to us for variousmarketing and administrative services that weperform for them, such as granting them ac-cess to our marketing channels, participatingin marketing programs and supporting tech-nology initiatives. In addition, our parent com-pany, American Express, receives compensa-tion from suppliers when customers use theAmerican Express Card or other AmericanExpress products to pay for supplier productsand services. From time to time we may enterinto other business relationships with suppli-ers and these arrangements, including levelsand types of compensation and incentives wereceive, are subject to change. In identifyingsuppliers and recommending itineraries, wemay consider a number of factors, including

    supplier availability your preferences and anyagreements we have to book travel. The re-lationships we have with suppliers may alsoinuence the suppliers we identify and theitineraries we recommend.

    TERMS OF PURCHASE: Please note thatseparate terms and conditions dictated by theapplicable supplier will apply to your reserva-tion and purchase of products and services.You agree to abide by such terms and condi-tions, including payment of all amounts whendue and compliance with the applicable sup-pliers policies, rules and restrictions regard-ing availability and use of fares, products andservices. You understand that any violation ofany such suppliers terms, conditions, poli-

    cies, rules or restrictions may result in (a) yourforfeiting any monies paid for such reservationor purchase, (b) cancellation of your reserva-tion or purchase, (c) your being denied ac-cess to any ights, hotels or other productsor services, and (d) Operator debiting youraccount for any costs Operator incurs as aresult of such violation. You acknowledge thatyou will be responsible for all charges, fees,duties, taxes and assessments arising outof your purchase of the travel products fromOperator.

    CANCELLATION AND REFUND POLICY:

    The right to a refund is limited if a participantchanges plans prior to or after the trip is tak-en. All requests for refunds must be submit-ted (certied mail, return receipt requested)in writing through the booking agent to theOperator or directly with Operator if the book-ing was made directly with Operator except inthe case of pre-trip which can be done overthe phone. Operator shall then process yourrefund and may retain a $50 processing feeif a refund is given. All appropriate receipts/

    vouchers and documentation must accompa-ny the refund request. No refund will be madefor package features the participant opts notto use. No show penalties could be up to100% of the package or component costs.The rights and remedies made available here-in are in addition to any others available underapplicable law. However, Operator offers re-funds under this agreement with the expressunderstanding that endorsement of a refundby participant(s) constitutes a waiver of anysuch additional rights and remedies againstOperator. See Cancel for Any Reason TravelProtection Plan section below for details onour Cancel For Any Reason Waiver.

    CHOICE OF LAW; RESOLUTION OF DIS-

    PUTES: This Agreement is governed by thelaws of, and disputes shall be venued in, theState of New York, without reference to itschoice of law doctrine. All disputes, claims orcontroversies arising out of or related to theservices or this agreement shall be submit-ted to mediation and if the matter is not re-solved through mediation, it shall be submit-ted for arbitration. Unless we agree otherwisein writing, any mediation and/or arbitrationshall take place in the State of New York,New York County, and shall be administeredby, and pursuant to the rules of, the Ameri-can Arbitration Association. Disputes shall bearbitrated on an individual basis. There shallbe no right or authority for any disputes to bearbitrated on a class action basis or in a pur-

    ported representative capacity on behalf ofthe general public, other travel customers orother persons similarly situated. The arbitra-tors authority to resolve disputes and to makeawards is limited to disputes between you andus alone, and is subject to the limitations ofliability set forth above. Furthermore, disputesbrought by either party against the other maynot be joined or consolidated in arbitrationwith disputes brought by or against any thirdparty, unless agreed to in writing by all parties.No arbitration award or decision shall be givenpreclusive effect as to issues or claims in anydispute with anyone who is not a party to thearbitration. Should any portion of this sectionregarding the arbi trators authority to resolvedisputes between only you and us be stricken

    from this agreement or deemed otherwise un-enforceable, then this entire section shall bestricken from this agreement. The provisionsof this section may be enforced in a court ofcompetent jurisdiction and the party seekingenforcement shall be entitled to an award ofall costs, fees and expenses (including at-torney fees), to be paid by the party againstwhom enforcement is ordered. This arbitra-tion provision is made pursuant to a transac-tion involving interstate commerce, and shallbe governed by the Federal Arbitration Act, 9U.S.C. Sections 1-16, as it may be amended.

Operator has the rightto substitute services or accommodations insimilar categories for items listed in the litera-ture. PLEASE NOTE: Operator reserves theright to re-invoice participant(s) in case of anerror made in computing tour price, or in theevent that a change in tax or hotel rate, or ifa service fee or surcharge is imposed by thehotel or airline. Foreign government departuretaxes, fees and tourist cards may be collectedat the destination by the respective govern-ment authority.

    LUGGAGE: Many airlines are now chargingfees for your luggage. These fees are payabledirectly to the airline upon check-in. Pleasecontact your airline for specic details. Theselimitations on liability are subject to change.

    PROOF OF CITIZENSHIP AND ENTRY RE-QUIREMENTS: Participant(s) are responsiblefor determining and obtaining proper docu-mentation including any visas or other traveldocumentation that may be required. Failureto carry proper proof of citizenship may leadto denied entry to aircraft and/or foreign coun-try. All participants are required to check withthe appropriate consulate or embassy for therespective destination for entry requirementsthat apply to them and their travel compan-ions. No refunds will be made if incompleteor improper documentation results in deniedboarding or entry. A valid passport may be re-quired and should be valid for a minimum of 6months after your return date.

    CANCEL FOR ANY REASON AND TRAVELPROTECTION PLAN: To have a relaxing,worry-free trip, we recommend our CancelFor Any Reason and Travel Protection Plan(Plan), designed exclusively for our partici-pants. To enroll in the Plan, simply pay thePlan cost included on your travel invoice atthe time you make your trip deposit. The Can-cel For Any Reason and Travel Protection Plan(Plan) contains both non-insurance (SectionI) and insurance (Section II) components.Section I Cancel For Any Reason Waiver isan example of a non-insurance component,which reimburses you for any cancellationpenalties incurred if you cancel your trip FORANY REASON prior to your original sched-uled ight departure time.
