Material & Deadlines1. All advertising reservations and materials must be received on or before 17th day of the

month for publication the following month. Exceptions can only be made with the written permission of The Publisher.

2. Customers with long term contracts wishing to update artwork (when allowed by their contract) must send new artwork to Fast Media Ltd by the 17th of each month, for publication in the following month’s issue. In the absence of written notification by the 17th of each month Fast Media Ltd will re-run the ad unchanged in the next issue.

Payment3. Frequency discounts apply to ads run in a continuous period. No alternating issues or other

schedules are allowed. Frequency must be ordered with the first insertion.

4. Payment must be received (not postmarked) on or before 17th of the month before publication. Any invoice not paid within 30 days of invoice will be subject to interest and penalty charges.

5. In the event of a customer failing to pay an invoice Fast Media Ltd reserves the right to cancel publication of any ads under contract to that customer.

6. There will be a HK$200.00 charge for any check not honored by the bank. Returned checks must be replaced with certified/cashier/wire transfer funds within 48 hours of notification. Fast Media Ltd reserves the right to withhold further advertising pending receipt of replacement funds.

7. In the event an account is referred to a third party for collection, advertiser agrees to pay collection and/or attorney fees, as well as court costs incurred to effect collection.

8. Extension of credit to advertising agencies is based on the agency’s acceptance of sole liability for all advertising placed by it and billed to its account. No endorsement, statement or disclaimer on any insertion order, check or letter shall act as an accord or satisfaction, or as a waiver of this condition unless and until it is accepted by Fast Media Ltd by a separate written agreement signed by a duly authorized representative of Fast Media Ltd. In the event of nonpayment of any agency account, prior to referring said account for third party collections, Fast Media Ltd reserves the right to contact the agency’s client(s), as disclosed principal(s), for payment. If the outstanding balance is still not satisfied, Fast Media Ltd may proceed with collections against both the agency and its client(s). No such action on the part of Fast Media Ltd shall relieve the agency of liability for the debt.

Refunds9. No refunds will be given for failure to publish an ad. Instead, the ad will be published in the

next available issue. The only exception is for time-sensitive ads (such as event ads).

10. Fast Media Ltd is not responsible for misspellings or other errors in advertisements. Proofs are not provided.

11. It is the Customer’s responsibility to find an issue of the magazine in which their ad appears to check if the ad is correct. If there is a mistake, one free insertion of the ad will be given regardless of the number of issues in which the mistake has appeared. A refund for the incorrect ad will be given only if i) the ad was time sensitive and no free insertion can be given and ii) the error was a material one which would prevent a reader from reaching the advertiser (for example a wrong telephone number).

Cancellations12. The Customer may cancel an ad only before the first insertion of the ad. The request

for cancellation must be made in writing via registered mail to The Publisher, and must be received on or before the 17th of the month before publication. No telephone cancellations are accepted. For administrative reasons, no refunds are allowed after the first insertion.

13. Fast Media Ltd will not be liable for any loss or damage incurred by a Customer arising from any failure to publish Advertising in accordance with a Customer’s request.

Content of Ads14. Any advertising copy that might be mistaken as an article, commentary or other non-

advertising material must be clearly marked “advertisement”. In the event such copy is not clearly marked, the “advertisement” notation will be added by Fast Media Ltd.

15. The Customer certifies that it has all necessary rights and permissions to offer, sell and/or license advertised products and services and that their advertisement does not and will not violate any applicable laws or regulations or any third-party rights (including, without limitation, intellectual property rights), or contain any libelous or defamatory materials. The advertiser and advertising agency assume liability for all ad content (regardless of who designed the ad) and any claims arising therefrom made against Fast Media Ltd, including costs associated with defending against such a claim.

16. In the event that the ad was designed by a third party (including Fast Media Ltd) the content of the ad and liability for the ad still rests with the advertiser.

Ad Placement17. Fast Media Ltd does not guarantee any given level of circulation or readership for an

advertisement. Fast Media Ltd reserves the right to vary the placement of Advertising or to change the format of Advertising (including changing colour to black and white) without notice to Customer or any change to rates. Fast Media reserves the right to change the title or name of the magazine publication without notice or any change to rates. If the press configuration is changed, Fast Media reserves the right to shrink or enlarge the Advertising by up to 10%.

18. All positions are at the option of Fast Media Ltd. In no event will adjustments, reinstatements or refunds be made because of the position and/or section in which an advertisement has been published. Fast Media Ltd will seek to comply with position requests and other stipulations that appear on insertion orders, but cannot guarantee that they will be followed. Payment of a premium position fee does not guarantee positioning. In the event that Fast Media Ltd is unable to provide the requested positioning, the premium position fee will be refunded. Customer service representatives and Account Managers are not authorized to modify this provision or to guarantee positioning on behalf of Fast Media Ltd.

general19. Advertiser (and agency) may not resell any advertising or advertising space.

20. Fast Media Ltd shall be under no liability for its failure for any cause to insert an advertisement.

21. Fast Media Ltd reserves the right to edit, revise or reject any advertising.
