Builders, Remodelers Support Aging-in-Place StrategiesDid you know that in America 10,000 Baby

Boomers turn 65 every single day?

Or that only four percent of the 65-and-older population goes into a nursing home?

Those statistics point to the importance ofbuilding new homes and remodeling existingones where the residents can safely andcomfortably “age in place.”

Members of the Tallahassee BuildersAssociation recognize the trend and areworking to serve the housing needs of ouraging population but at least one prominenthousing expert thinks we all need to be doingmore.

Henry Cisneros, who served four terms asthe mayor of San Antonio and is a formerSecretary of the U.S. Department of Housingand Urban Development (HUD), has recentlyco-edited a book entitled “Independent forLife: Homes andNeighborhoods for an AgingAmerica.”

The book draws on the thoughts of morethan a dozen experts in aging and housingand its findings were recently reported byKaiser Health News and published in theWashington Post.

It points out that seniors fear beingunable to communicate, and oftenfeel lonely and insecure. This isespecially true for people who havelived their lives around family andfriends and now go days withouthuman contact.

The solution comes in what theauthors call “lifelong homes,” whichthey believe should becomeanationalpriority, along the lines of the stepstaken to make homes more energy-efficient.

They suggest this could involve certifying apackage of age-related home improvements– the kinds of things we did for our parents– and coming up with public and privatestrategies for financial support.

Focusingonhomesalonedoesnot solve theproblem, according to the book. It suggeststhatwe accessorize communities for an agingpopulation with age-appropriate recreationfacilities and non-automobile transit options.Looking ahead, our new communities shouldbe “walkable,” extending a lifeline to seniorswho no longer drive but need easy accessto groceries and pharmacies.

Cisneros and the authors also believewe should ramp up federal, state and localprograms to produce affordable housing forthe elderly, drawing on housing tax creditsand HUD subsidies.

Whether from a personal or professionalperspective, none of us can ignore or under-estimate the impact of an aging population,especially here in a retirement state likeFlorida. As builders and remodelers, wewant to be a part of the solutions that keepour seniors safe, secure, and sheltered.

A reader asked for ad-vice about a frozen waterline in the door of his re-frigerator.

Reader Kim Jacob ofFeasterville, Pa., offeredthis:

“I had the same prob-lem with my GE refriger-ator. In my case, the linewas frozen after only ayear.

“This must be a designissue because the GEtechnician who came tomy house told me he seesit all the time. He hadsome expensive fixes for

me, but also suggestedthat I open the door forabout an hour or two anduse a hair dryer up anddown the door. It workedlike a charm.

“Healso toldmeto turnoff thewater supply to thefridge when we are awayfor more than a week.

“We have had no prob-lems since.”

Q: We had a regular,electric-powered fan inour previous home andthe idea of the solar fanappealed tome. However,all the solar fans I sawwere lacking a featurethat themanwho installedour electric fan said was

very important: a firestat,to detect unusually highheatandshutoff thefan incase of a fire.

That seems like a verynecessary safety featureand I was surprised that Icouldn’t find a solar fanthat offered it.

Q: I have a basement

foundation of fieldstone.The house dates to1835 orthereabouts. You men-tioned that this basementconstruction made use of“Irish” plaster. Can thisfieldstone wall be sealedwithDrylokorsomeothertreatment?

A: I wouldn’t do it.Someone once told methat the Irish plaster wasdesigned to allow air ex-change and preventing itwill cause the plaster andstone pointing to crumbleover time.

Q: I have a summerhome at the Jersey Shore.The home is about threeyears old and six feet offthe ground. The air-condi-tioning and heating ducts

run under the house andare not insulated.

This space under thehouse is coldwhen the ACis on andwarm in thewin-ter.Weweretoldwedonotneed to have this duct-work insulated.

A: Without insulation,you are wasting a lot ofmoney. Duct insulationcomes in 1- and 2-inchthicknesses. Get thethicker material, espe-cially if your ducts arerectangular; 2-inch wrapcuts losses by about one-thirdmorethan1-inchma-terial.

You’llalsoneedseveralrollsofduct tapetosealallduct joints before you in-sulate.

Insulating the duct-work prevents it fromsweating in the summerwhen the cold air hits thehumid. I had that problemin the basement of myhouse until I insulated itand also installed a dehu-midifier.

Bathroom odor

More reader advice,from Dick McCormick,concerning the cause andresolution of a bathroomodor:

“I had a similar odorthat I traced to a cloggedbathroom vent pipe thatexits through the roofover the bathroom. Eachtime the toilet flushed, agurgling sound emittedfrom the tub drain.

“The clogged vent re-sulted in the water seal inthe trap being drawn outwith the flush (hence thegurgling sound), leavingan empty tub trap. The re-sulting loss of awater sealallowed sewer gas to en-ter the bathroom throughthe tub trap.

“In my case, the clogwas a collection of rustparticles and scale thathad accumulated overmany years having flakedoff from the inside of thetwo-inch steel vent pipewall.

“This eventuallyformed a solid plug in a90-degree ‘L’ under thebathroom floor. Clearingthis plug solved the prob-lem.

“Another cause for aclogged vent is the accu-mulation of nesting ma-terials in theventwhere itprotrudes above the roof.

“In any event, a clearand functioningvent is es-sential in plumbing sys-tems to provide properdrainage and flushing ofutilities.”

Dealing With The Chronic Late Payerby Harry Anthony Heist, Attorney at Law

It is inevitable that you will have a chronic late payer. Every excuse in the book is given by the tenant for the tardypayment, but the payment always comes, sometimes with the late fees, sometimes without. You may inherit a laterpayer from a self-managed property or a prior management company. Is a tenant always allowed to pay late? Can youevict a late payer? Is there any way to tell a tenant to shape up or ship out, or will you be destined to always acceptlate payments?

Is a tenant allowed to pay late?The short answer is “yes”. There is nothing in Florida law that allows you to evict tenants because they pay late. You canevict a tenant if she does not pay at all, but paying late is not prohibited. Regardless of what your lease may provide,if a tenant wishes to pay late, she may. There is a built in grace period under Florida law of three days, not includingSaturdays, Sundays or legal holidays. If a tenant fails to pay the rent according to the due date of your lease, you mustserve the tenant with a Three Day Notice which gives the tenant the opportunity to pay you within that period of threedays. This is in essence a “grace period”. Without serving the tenant that Three Day Notice, there is nothing you can doto terminate the tenancy for nonpayment of rent. No provision in your lease can override the fact that a tenant is entitledby law to receive a Three Day Notice from you, and is allowed by law to pay you the rent if the notice has not yet expired.

We want to get the chronic late payer out!My usual response to this request is to tell the landlord to be glad to have a tenant who pays, albeit somewhat late. Timesare tough right now, and anything a landlord can do to keep a tenant is advisable. However, there will be times when thelandlord does not want the uncertainty of getting the rent late, or is tired of having to serve a Three Day Notice on thetenant every single month, and wants the tenant out. If the tenant pays the rent within the Three Day Notice timeframe,no matter how angry or frustrated the landlord is, the tenant can stay and pay as long as the notice has not expired. Thelandlord’s only recourse is to non-renew the tenant at the end of the lease, or if the lease is currently month to month,non-renew the month to month tenancy.

The tenant does not pay within the Three Day Notice periodThis is a different story. If the tenant does not pay within the Three Day Notice time frame, Florida law allows the landlordto terminate the tenancy. This sounds easy enough. The tenant is given a Three Day Notice and fails to pay within thetime frame allotted. The landlord then files an eviction, and the tenant is evicted from the premises. It would seemperfectly legal. The tenant is chronically late, the landlord has had it, the tenant does not pay and therefore is evicted. Ifthe tenant is in “new territory” by finally failing to pay within the three-day notice period, the landlord will have a strongcase. However, it is often not that simple. The fact that the tenant has paid rent late so many times actually put the tenantin better standing in court, if the landlord has accepted rent after the expiration date of prior Three Day Notices. Thelandlord could also have problems in court if the Three Day Notice that finally “snares the tenant” is delivered earlier inthe month than normal.

The tenant beats an eviction because he has always paid late?While some judges are extremely strict and will evict a tenant if the tenant fails to pay within the Three Day Notice periodno matter what the tenant’s excuse may be or the tenant’s past payment history, be it prompt or tardy, if a tenant canprove to a judge that he has been paying the rent late, after the expiration of the Three Day Notice, and the landlord hasbeen accepting the rent late, the tenant may be able to prevail in court. This seems to go against logic. A tenant whopays the rent late is certainly not a good tenant. That tenant has blatantly violated the lease terms and caused extrawork and worry for the landlord. The issue here is waiver. The landlord, by accepting the rent late time and time againhas potentially waived his rights to enforce the terms of the lease. By his own actions, the landlord has modified theterms of the lease.

What is waiver?If you know that a tenant has a pet in violation of your no pet policy, but you do absolutely nothing about it for months, youwill have possibly “waived” your rights. The same would apply if there were unauthorized occupants in the unit and thelandlord did nothing. Any noncompliance that the landlord ignores or “tolerates” for some time can result in the landlordwaiving his rights. The exact same waiver can occur with late rent payment. The landlord thinks his case is better becausethe tenant looks “bad” in court, but actually it will be the landlord who will be at a disadvantage in court.

Can “waiver” be overcome?If the tenant has been chronically late, does this mean you can never evict or must tolerate this late payment forever?Probably not, but you must notify the tenant that late payments, although accepted in the past, will not be tolerated in thefuture, and the tenant can be subject to eviction if the payments are not made within the Three Day Notice time period.Essentially it is a “shape up or ship out” type of notification. We recommend this type of notification is done in writing, byregular mail and certified mail, and at least 30 days before the next monthly rent payment is due.

It is imperative that you pay your rent according to the lease terms from this point on.

Will this “shape up or ship out” letter work?There is a good chance that this type of letter can overcome a waiver defense by a tenant. There is no solid guarantee,but it is better than nothing. Remember that in order for the tenant to raise a defense of waiver, the tenant first must knowthat he has this defense, and in most cases must place the rent into the court registry. This minimizes the risk you have,but if you are managing property for others, you will often be inheriting tenants with inconsistent and late rent payments.

LOS ANGELES — WhenJoe Borst bought a run-down 1952 house in Mari-na del Rey, Calif., he andgirlfriend Maria Torreshoped to transform the1,200-square-foot cookie-cutter plan into some-thing that felt larger,more open and modern—a tall order given the lim-ited budget.

The couple could af-ford to renovate thehousebut not to expand it, so themission became to re-think the floor plan — toleave the perimeter of thehouse intact, adjust howthe existing space wasused and make the mostof the house’s backyard.

Borst called on hisclose friendRobert Sweetof the design-build studioRas-a in Redondo Beach(www.ras-a.com) to han-dle the makeover.

“I gave him free rein,”Borst said. “I had seen alot of his work, and heknew what I wanted: lotsof light and open space.”

The house came withlow ceilings and a compli-cated series of rooms.One bedroom was sealedoff from the rest of thehouse as a separate rental

unit. In the backyard,Borst said, marijuanaplantsweregrowingamidthe rebar remnants of apartially completed ga-rage.

Sweet took the housedown to the studs. Work-ing with a reconstructionbudget of about $150 persquare foot, he started byopening up the home’sthree-bedroom, two-bath-room layout, which hadmade the interiors feeldark and cramped.

“Everything was com-partmentalized, and therewas no open space,”Sweet said. “That was notthe way Joe wanted tolive.”

Going against prevail-ing wisdom about resalevalue, Borst went alongwith Sweet’s proposal toreconfigure the homewith two bedrooms in-stead of three. The kitch-en was moved from thefront of the house to theback, so it connected to arelocated and enlargedliving area that flowedon-to a new deck.

“We decided to use the

backyard deck as our din-ing roomand thegiantbarin the kitchen as informaldining,” Borst said. “InSouthern California, itworks perfectly.”

Sweet improved natu-ral light and cross ventila-tion by deleting partitionwalls, adding a cathedralceiling in the living areaand installing operableskylights to each quad-rant of the house. Hemade the master bed-room larger by forgoing acloset and building a longwardrobe instead. Clere-story windows above thecabinetry and the bath-room vanity allow light topass through and makeboth spaces feel bigger.

In the kitchen, Sweetinstalled white IKEA cab-inets along with some up-grades: a custompeninsu-la, a Blanco sink and Em-tek hardware. Sweet saidhe saved about $15,000 byusing IKEA’s Applad cab-inets, leaving money forother premium touchessuch as theMiele cooktopand counter made of Pri-ma Decora, a Corian-like

surface by Basix Interna-tional.

In the minimalist liv-ing area, Sweet created aTV and desk console us-ing a prefab system byRakks (commonly used instores), which he com-bined with custom cab-inets. The desk acts as ascreen, further separat-ing the master bedroomand living area.

Three outdoor roomsextend the indoor floorplan. The garage waspushed toward the alleybehind the house, creat-ing an L-shaped court-yard in back. Because thegarage was so prominent,Sweet designed it to looklike a modern shed with asloped roof.He also paint-ed the James Hardie fi-ber-cement plank fencealong the alley in alternat-ing tones of gray.

After five months ofconstruction, Borst gotwhat he wanted: a low-maintenance house thatfeels brighter and moreopen without growing insize. Small-space livingisn’t for everyone, he

said, but it works for himand Torres.

“We do a lot of enter-taining,” Borst said. “Wekeep the doors open to thepatio and fire pit and caneasily host a lot of people.Rob made sure every lit-tle thing had a functionalpurpose.”

Sweet said he prefers

working on smallerhomes. “Americans areused to excess,” he said,noting how dense livinghas led to creative designin places such as HongKong and Tokyo. “We arenow starting to rethinkliving,” Sweet said, “andgo for quality of spaceover quantity.”

LOSANGELES – Somepeople are happy collect-ing fast cars or nicewatches, but the ultimatevanity purchase may bethe private island.

Billionaire RichardBranson owns several.Magician David Copper-field has a dozen. SingerCeline Dion is trying tosell hers. And tech titanLarry Ellison is closing adeal to buy nearly all oftheHawaiian island of La-nai.

Although private is-lands are often associatedwith the very rich, theyaren’t always that exclu-sive or even all that ex-pensive.

Private Islands Inc., aToronto-basedislandmar-keting firm, lists about500 islands worldwidefrom less than $50,000 tomore than $100 million,CEO Chris Krolow said.

U.S., Canadian andBritish buyers make upabout 80 percent of themarket; far-flung localessuch as the Caribbeanhave amore internationalbuyer base, he said. TheBahamas and Belize arehot, as is Panama. In theMediterranean, Greek is-lands are popular.

“Before the recession,a lot of islands werepricedbyownerswhohadwhat we call Coke-bottleglasses,” Krolow said.“They put crazy pricetags on their islands.”

Price drops in suchareas as the Bahamas anda sense that values havebottomed out havebrought increased inter-est in island ownership.

“It has opened the door

to people looking,” Kro-low said. “They are morecomfortable now.”

Ego, extravagance andidentityplayroles insomehigh-profile trophy pur-chases, experts say, butothers are motivated byprivacy and security.

Celebrities have longpopulated the ranks of is-land owners, includingMarlon Brando, NicolasCage and Johnny Depp.Eventhosenotpursuedbypaparazzi can understandthe desire for seclusionthese days, said clinicalpsychologist StephenGoldbart, co-founder ofthe San Francisco-basedMoney, Meaning &Choices Institute.

“We are all living in aworld where there isn’tmuch privacy,” saidGold-bart.Oneofhis clientshasbought an island, and sev-eral others are interestedin making their own pur-chases. “The need forfeeling safe and securehas increased radicallysince the economic down-turn.”

Island buyers tend tofall into two groups: peo-ple who are making life-style choices and entre-preneurs developing re-sorts.

Oracle Corp. CEO Elli-son’s recent deal to buy 98percent of Lanai could beconsidered an example ofa trophy purchase, sinceownership has been amoney-losing propositionfor sellerDavidMurdock,the Los Angeles billion-aire who controls DoleFood Co.

The estimated $500million deal makes littlesense from a financialstandpoint, said Paul Ha-bibi, who teaches real es-

tate at the University ofCalifornia-Los Angeles’Anderson School of Man-agement. Among the rea-sons he cites are a lack ofresort potential becauseof a mostly rocky beach-front and scant infra-structure.

“It is probably more ofa quality-of-life invest-ment – a pride-of-owner-ship purchase,” Habibisaid. “Who wouldn’t wantto own a Hawaiian is-land?”

Murdock, though un-loading the 141-square-mile island, is keeping hisLanai home and some oth-er assets, including awoodworking shop and1,000 rare orchids.

Dion and her husband,Rene Angelil, put theirprivate island up for salein Quebec in late spring.Thecouple,whoalsoownsa home in Miami, couldseldom get to their islandmansion because ofDion’s touring schedule,so they listed it for sale atmore than $29 million.

Michael Caffey under-stands the downside ofowing a coastal island inCalifornia. The TV pro-ducer inherited a 1.3-acreparcel called White RockIsland off Santa CatalinaIslandandhasbeentryingto sell it for years.

Listed at $657,000, theland is virtually impossi-ble to develop “unless youare the governor,” Caffeysaid. “The problem is theCoastal Commission.”

Miami-based entrepre-neur Christian Jagodzin-ski bought his Fiji atollwhen he was flush with

funds from the sale of hisonline business to Ama-zon in the late ’90s.

“At the time you have alot of money, you look atwhat kinds of toys to buy,”said Jagodzinski, whosplits his time betweenFlorida and the south ofFrance. Houses and prop-erty seemed to be pur-chases he could both en-joy and make money on.

“WhenI lookedatFiji, Ithought the resort offer-ings there were sub-par,”he said. So he boughtsprawling Katafanga Is-land in Fiji’s Lau group in-tent on operating a top-notch, exclusive resort.

But his initial partner-ship floundered. Once thedevelopment money wasgone, constructionstalled. He has since list-ed the 225-acre isle at $20million in the hope of re-couping his investment.

To reach West Coastbuyers and tap intoHolly-woodA-listandbillionairebuyers, he hired TristaRullan, a listing agentwith Hilton & Hyland inBeverly Hills. Owners of

Fiji islands include actorMelGibsonandFijiWaterfounder David Gilmour.

Among the most strik-ing features of KatafangaIsland are its natural re-sources including a biolu-minescent lagoon, Rullansaid.

“It literally glows inthe dark,” Rullan said.“You can see fish swim-ming.”

White sand beachesring the pristine island,which has an infrastruc-ture for 20 villas. A breakin the surrounding natu-ral reef can allow yachtsas longas 200 feet to enterthe protected waters.

Ultimately, though, is-land ownership isn’t formost people.

Beyond the cash need-ed, hurdles may includegetting building permitsand environmental is-sues. Areas with politicalinstabilityareaharderre-sale.

“At end of the day,”Krolow said, “there areonly a handful of proper-ties and buyers that canbe aligned.”

V.P., Timberlane Appraisal…then just don’t. If I have heard it once, I have heard a thousand times, “Wedon’t really have to sell.” If you are not ready to jump into the real estatewater, your best bet is to stay dry.

So far in 2012, local REALTORS® have sold over 1,500 homes, townhomes,and condos in Leon County. Of those, 54% sold in less than 100 days undertheir most recent listing agreement. These are the sellers who are motivated;they are willing to get their homes in “ready to market” condition. In themarket today, there are the “haves” and the “have-nots” - those who have acompetitive listing and those who have not come to reality.

If you still believe in yesterday’s philosophy of “the new buyers can replacethe carpet and countertops; we are not doing anything,” then you need towatch some more HGTV. Very few buyers are willing to change a light bulb,much less replace flooring. The investors may come knocking, but they

need to buy at wholesale prices. To sell at retail, you need to be “all in,” put all your chips on thetable and do what needs to be done.

In the real estate euphoria of 2005 to 2008, everyone was an expert and nobody was losing. Today,if you really want to sell your house, then you have to play by today’s rules. Before our eyes, somesegments of the Leon County market have already stabilized, while others are still recovering. I won’tsay this too loudly, but I have even seen a few examples of increasing trends. Regardless, this is not amarket for the weak seller; the buyers still have the upper hand in most cases.

In summary, if “we really don’t have to sell” is another way of saying, “We are not ready to be realistic,do what needs to be done, and sell at market value,” then just wait until you are. Your REALTOR® willstill be there and be ready when you are.
