speaking, now is a greattime to put your house on
the market because theinventory of homes forsale has declined, hereand other areas. Buyersdon’t have the choices
that they did a year ortwo ago.
That’s boosting pricesand helping sellers.
Contact a real estate
agent who has experi-ence in your specificneighborhood. He or shecan pull the data thatshow how many other
homes are for sale inyour area and give youan idea how long it mighttake for you to find abuyer.
I expect more bank-owned homes to hit themarket sometime afterLabor Day, so sellingnow, ahead of that extracompetition, could proveto be a smart move.
Q: I own an invest-ment house and alreadyrefinanced through thegovernment’s HomeAffordable RefinanceProgram.
Still, the house isworth much less thanwhat I owe on the mort-gage, and I’m not eligibleto refinance againthrough the governmentprogram.
The rent is justenough to cover themortgage and associationdues. I really have nohardship, but I feel stuck.Short of walking away,what are my options?
—JasonA: Investing in any-
thing carries risk. I haveseveral shares of Face-book that I probably willgrow old with.
In your case, it doesn’tsound as if you can es-cape without taking afinancial hit. But you dohave options that canhelp minimize your loss.
First, you can keeprenting the property. Bydoing this, your mort-gage is slowly gettingpaid off, and the house isless and less “underwa-ter” with every passingseason. Eventually, youwill regain equity in thehouse.
If you do not want totake the long-term viewon this, you can try tocomplete a short salewhile still making the
payments. This will bedifficult to do, especiallywith a tenant in place,but it may work out witha little luck.
Walking away is theworst option, in my opi-nion, because the lenderwill foreclose and likelychase you down for theamount you owe on themortgage.
Q: Is it possible for mywife to buy a house with-out involving me as longas she can qualify for theloan by herself?
—JamesA: Yes. But if this
house is going to be yourprimary residence, youmay need to sign some ofthe collateral documents,even if you are not on theloan.

On the owner’s side,there should be a desig-nated person that will bethe contact representa-tive. The contact repre-sentative should have thepower to make any deci-sions pertaining to thescope of work and budget.By having this dedicatedcontact, the builder will
be assured of a singlesource of communicationand avoid duplicated cor-respondence and confu-sion in the project.
As important as thissingle point of communi-cation is for the builder, itis equally important to theownertohaveaconsistentbuilder representative.Sometimes it’s the builderhimself who corresponds
with the owner or it maybe the superintendent.The key for success isconsistency by the dedi-cated representatives andtheir commitment to reg-ularly scheduled meet-ings or correspondence.You should receive a pro-gress report on a recur-ring schedule using thesame date and time eachweek. If you cannot follow
through on this commit-ment of time, your projectwill be at risk for potentialproblems.
Finding the best way tocommunicate varies byclient, but the most likelywill be email and not aphone conversation foryour weekly update. Ifyou must use a telephone,makesurethat thebuilderfollows up with a summa-ry for your review.
A fax is good as long asboth parties have a full-time fax line open. Noth-ing is more frustratingthan a one-way fax con-versation. If you decide tohave job site meetings,follow the same protocolas a phone conversationwith a summary of eachmeeting. The number ofjob site meetings will de-pend on the size and pro-gress of your project andare not needed everyweek.
A weekly progress re-port on the project’s de-velopment should havethe following subjects ad-dressed each week. Main-taining the same formateach week will help theproject stay on track andfacilitate followup on theprevious week’s report.
1. What was last week’sjob progress: Under thisheading, the builder listsall of the phases of con-struction that were com-pleted during the lastweek, such as, “The foot-ers were poured and theblock work completed.The floor trusses were or-dered. Received revisedwindow proposal.” Thissection could also containpictures to explain thejob’s progress.
2. Review of con-firmed items and ques-tions: This section of thereport addresses answersto the previous report andseeks answers for the up-coming week from theowner. An example mightbe, “Confirmed garagedoor has insulated panels.Window treatments willbe selected from ABCWindow Coverings. Con-
firmed that paint selec-tion in family room hasbeen changed to EastwindGreenwithA-1trim.”Thissection of the report is tokeep an open dialogue onboth sides and helps tokeep the project on trackby maintaining timely se-lections, and recordingchanges.
3. Schedule look-ahead: This section dealswith the upcoming week’sprojected progress as re-ported by the builder. Abuilder who meets cus-tomer expectations haspainted a realistic pictureof what to expect. Itemsmay include, “Drywallwill be completed withdoors and interior trimbeing delivered by Thurs-day. Painting contractorwill complete the exteri-or.” The projection of theupcoming week’s pro-gress helps hold the build-er responsible while aid-ing the owner in under-standing the buildingprocess.
4. Items that requireattention: This section ad-dresses items that needimmediate attention in or-der to keep the projectmoving. This area of thereport keeps everyone ac-countable and will be ad-dressed in the followingweek’s report. If a selec-tion or question is notcompleted, it will remainunder Section 4 in the fol-lowing week’s report un-der“extremeattentionre-quired.”
As you can see, it takeseffort from both parties tomake your building expe-rience positive. A com-mitment to good commu-nication will not only re-sult in a quality finishedproduct but a satisfactorybuilding experience.

THE TENANT AND THE ELECTRIC BILLby Harry Anthony Heist, Attorney at Law
In most annual rentals, the tenant is responsible for paying the electric bill. In addition to beingresponsible for paying the bill, the tenant is often given instructions by the landlord and agrees inthe lease agreement to place the electric bill into their name upon move-in. This requires the tenantto make a call into the electric company and/or go to the electric company office to give the relevantinformation and pay a utility deposit, which varies by company providing the electric. In a perfectworld, the tenant does just that. Prior to move-in they get the electric placed into their name and paythe bill. What happens when they do not pay the bill? In many places, the electricity is simply shut offand the tenant is without electricity. This is the tenant’s problem, and no liability to the landlord occurs.The tenant may then pay the bill and have it reconnected, steal the electricity from an adjoining tenant,put jumper wires on the electric meter or completely live without electricity. In some areas of Floridaand in many apartment communities, the electric will revert back into to the name of the apartmentcommunity, and the apartment community will later be notified that this has occurred, sometimesweeks later. This is to prevent a unit from being without electricity. While we cannot control what thetenant is “supposed” to do, we can take action, but must be careful that we do not run afoul of the law.Florida Law and ElectricFlorida law specifically states that a landlord shall not directly or indirectly cause interruption in thetenant’s electric service.FS 83.67 Prohibited practices. (1) No landlord of any dwelling unit governed by this part shall cause,directly or indirectly, the termination or interruption of any utility service furnished the tenant, including,but not limited to, water, heat, light, electricity, gas, elevator, garbage collection, or refrigeration,whether or not the utility service is under the control of, or payment is made by, the landlord.Direct InterruptionDirect interruption would be when the landlord shuts the electric off by actually disconnecting it fromthe rental unit (this is rarely done but happens!), or more commonly instructs the electric company toshut the electric off. A landlord who discovers that the tenant has not placed the electric in the tenant’sname could easily feel that it is correct to tell the electric company that the electricity is not to be in thename of the landlord, but rather that it must be in the name of the tenant. However, this can lead to adirect shut off. Further, the landlord may have had the electric bill revert back into the landlord’s name,as is often the case in apartment communities; notifying the electric company that this is not properand that it should be in the tenant’s name will result in a direct shut off to the tenant. In the single familyhome setting, sometimes the property owner who lives out of state receives an electric bill, is furiousand calls the electric company for a shut off. Does it seem fair to the landlord who now is stuck payingthe bill? No, but we never said the law was always fair.Indirect InterruptionAn example of indirect interruption occurs if the landlord receives an electric bill on an account that
should have been in the tenant’s name, and the landlord simply fails to pay it. Here the landlord has fullknowledge that the tenant failed to place the account in his or her name, and by the landlord not payingit, the account will get shut off. Again, this seems unfair to the landlord, but is the law.Steps to take if it is discovered that the tenant is not paying theelectricOnce it is discovered that the tenant is not paying the electric bill, the tenant needs to be notifiedimmediately by the use of a 7 Day Notice of Noncompliance with Opportunity to Cure. The notice maystate the following:You have failed to place the electric utility service account into your name as required by yourlease agreement, and you owe the landlord the sum of $__________ at this time for outstandingelectric bill(s).Steps the Landlord can takeWhile it is beyond the landlord’s immediate control if the tenant steals electric, or in the event ofreversion of the account back to the landlord, there is one thing that often occurs which is indeedcompletely in control of the landlord, but is often missed, because of the landlord’s forgetfulness ormisplaced trust that the tenant will do what the tenant is “supposed” to do. Due to the need for electricto operate pools and a/c units, most landlords do not wish to have a time period when the electric isoff. The result is that the electric is in the landlord’s name until such time as either the landlord directlyhas it shut off, OR the tenant directly has it placed in the tenant’s name. When a tenant moves into arental unit and the electric is on, they will often happily sit there until the electric is shut off. But wait.How can the landlord have it shut off? Did not we just say that was illegal? The answer lies in timing.If the tenant is notified in writing that the landlord will be taking the electric out of his or her name nolater than a fixed date, and the landlord does indeed do this, it is doubtful that a prohibited practice orindirect termination as envisioned by the statute will occur. We recommend the following wording in anotification to be given to the tenant prior to move-in. This can be placed directly on the INFO SHEETthat the tenant should receive from the landlord, stating the names, phone numbers and addresses ofthe utility company, garbage pick up days, etc. Here is some recommended wording:Tenant understands and agrees that the electric service is currently on in the Landlord’s name.Tenant agrees that the Landlord shall order the electric service be taken out of the name of theLandlord within 3 days, and Tenant shall place the electric service in Tenant’s name and pay allnecessary deposits.So you notified the tenant prior to move-in. There’s something fan-tastic about moving wa-ter, bubbling spas and thesight of a sparkling pool inthe heat of Tallahasseesummers.
When shopping for ahome in Tallahassee dur-ing the summer months,thoughts of purchasing aplace with a swimmingpool are often more ap-pealing than not.
Often, the warmweather makes people en-tertain the idea of owningapoolhomewhomightnototherwise have consid-ered this as an option.
In-ground pools are themost popular in our areaandoftenhavesuchaddedfeatures as elaboratefountains, spas, pool fin-ishes and borders.
Resistance swim-spasare popular as therapeu-tic alternatives for somehome owners.
Some buyers haveowned homes with pools,however, many consum-ers may have no experi-ence or knowledge relat-ed to maintenance issuesinvolved in owning such ahome.
Here are a few tips forthose new to pool owner-ship.
First, is the home buy-er purchasing a home us-ing a mortgage, and doesthe mortgage lender al-low financing of homeswith swimming pools?
Not all loans will allowthis type of purchase, soknowing ahead of time iscritical.
Second is the cost of in-surance. The added liabil-ity coverage in a home-owner’s policy, in mostcases $1 million, is oftenrequired.
It’s very important toreveal that the home has apool when you phone anagent for insurancequotes. Agents will askthe type of pool, andwhether it has a divingboard. Insurance on
homes with diving boardsor water slides is not pos-sible in most cases.
Fences surroundingthe pool area are also re-quirements both of insur-ance companies and LeonCounty building codes.
Third, maintenancecosts should be taken intoconsideration. Knowingthe type of pools, saline orchlorinated, heated ornon-heated are considera-tions for maintenancecosts because each re-quires different chemi-cals and pump systems.
Life expectancy ofpump and cleaning sys-tems is something thatshould be included inhousehold budgets aswell.
Fourth, knowingwhether a pool contrib-utes to a home’s value issomething a Realtor canhelp a home buyer deter-mine. These facts willvary from neighborhoodto neighborhood. Valuesof pools are sometimessubjective, and whatworks for one buyer maynot for another.
Fifth, the location of apool is often a considera-tion in a home buyer’smind. Is the pool too closeto the home? Is thereenough room surroundingthe pool for a buyer’sneeds?
Lastly, running a poolpump and maintenancesystems can cost as muchas $240 a year. By using a
few energy-saving mea-sures, such as switchingto a smaller pump and re-ducing its hours of opera-tion, one could expect toreduce the cost of opera-tion by as much as 75 per-cent, according to the U.S.Department of Energy.
Heated pool costs aresignificantly higher andsometimes cost prohib-itive, especially when us-ing gas heating systems.In our area, solar blanketsor heating systems mayprolong the swimmingseason.
In any home purchase,home inspections are arecommendation. Typicalhome inspectors do nottest pool equipment. Li-censed pool inspectors
are of value to a home-owner to test not only thepool pumping systems,cleaning equipment, cop-ings and decking con-struction and materialsand any connected spaunits and their function,but predicting effectivelife spans of these sys-tems.
There are more than250 homes with pools forsale in the Tallahasseemarket. Many are gettinga lot of attention. Having apool already installed isattractive to some buyers.Others look for homessuitable for adding a poolin the future.
Consider the timespent at home with yourfamily, the personal en-
joyment of outdoor activ-ities and entertaining, orsimply the enjoyment andsolitude of your personalpool or swim spa. Sellers learned all thisby sorting through build-ing permits, tax records,city directories, maps, oldnewspapers on microfilmand more.
A retired software en-gineer and a member ofthe Twin Cities BungalowClub, he has chronicledthe history of the struc-ture, its environs and thepeople who lived in it. Heeven met that 6-year-olddaughter when she was inher late 80s.
“It’s fun to know thatother families have livedhere — children havegrown up and been nur-tured in this house,” saidSellers. “Each familymakes it theirownandhastheir own life and experi-ences here. It’s fun to getthat feeling of continuity.”
Many homeowners andapartment dwellersacross the country are do-ing the painstaking workof researching the historyof their home and neigh-borhood.
Some delve into thepast for practical reasons— perhaps they want tochange the exterior of anold house and need to doc-ument how it once looked,or they want to create (orprotest) a historic desig-
nation. Others are simplyfascinated by the testa-ment of time.
This research “feedsinto the notion of pride ofplace,” said KingstonHeath, professor and di-rector of the graduateHistoric PreservationProgram at the Univer-sity of Oregon. The histo-ry of a house and its peo-ple can also cast light onlarger historical changes.
“A house is like an arti-fact,” Heath said. “It rep-resents these collectivehuman values, and cultur-al and technologicalchange.”
Inside the New YorkPublic Library’s Beaux-Arts building on Fifth Av-enue, librarian Philip Sut-ton works amid ornategold shelves lined withbound genealogy periodi-cals, passenger lists, mil-itary records, social reg-isters, newspaper deathnotices and more.
Sutton teaches an hour-long class on house-histo-ry research once a month.It grew out of the enthusi-astic response to a blogpost he wrote last yearabout researching the his-tory of a Manhattan apart-ment building that hepicked at random.
He takes students stepby step through his detec-tive work, using land con-veyances, early maps,Census records, data-bases and more.
Expert house histori-ans advise novices to fo-cus on one question at atime and to keep notes onexactly where informa-tion was found.
To begin, figure outwhat you know from doc-uments you already have.
And talk to neighbors whohave lived on your blockfor a long time to collecttheir stories.
Be aware, however,that community storiesand legends often aren’taccurate, cautions EllenBaumler of the MontanaHistorical Society.
“That’s the greatestpitfall — perpetuating in-formation that is not cor-rect,” said Baumler.“Sometimes those storiesand legends are reallyhard to squash.”
Find out whether yourstreet name is the originalone, said Mary LouiseDays, a historian andboard member of the San-ta Barbara Trust for His-toric Preservation in Cali-fornia.
