6. Military personnel are looked upon by the civilian community to set anexample in courtesy and honors rendered the National Anthem and the Na-tional Color. Accordingly, the conduct of military personnel should at all timesreflect respect to both the National Anthem and the National Color. The specificcourtesies set forth in AR 600-25 should be rendered the National Flag andNational Anthem at public events, whether the serviceman is-off or on dutyand whether he is in or out of uniform. Intentional disrespect to the NationalColor or,Anthem is particularly inappropriate and conceivably constitutes con-duct prejudicial to good order and discipline or discrediting to the militaryservice.Page 13, paragraph 31. (1) It is the responsibility of commanders to see that military personnelpresent a neat and soldierly appearance. Commanders will establish policiesand standards in the area of personal appearance to insure that the membersof their command appear neat and soldierly. Degrading or depersonalizingactions, such as the practice of requiring heads of soldiers to be shaved, areforbidden. However, a soldier may voluntarily have his head shaved.

&. Conduct. Discipline is a function of command, hence, it is the responsi-bility of all leaders in the Army, whether they are on duty or in a leave status, tosee that all military personnel present a neat and soldierly appearance, and totake action in cases of conduct prejudicial to good order and military disciplineby any military personnel which may take place with their knowledge.

(1) The senior officer, warrant officer, or noncommissioned officer willact promptly, .using such means as are available, to restore order. One of hisinitial actions will'be to call for military police assistance if they are readilyavailable. ;

(2) On public conveyances, in the absence of military police, the personin charge of the conveyance may be requested to notify the nearest militarypolice and arrange to have them board the conveyance and take custody ofmilitary personnel guilty of misconduct. If the misconduct is sufficiently serious,the person in charge of the conveyance will be requested to stop the conveyanceat the first opportunity and turn the offender over to the local police. lu all

such cases, the local police will be advised to telephone collect to the nearestArmy post or Army headquarters so that the accused's commanding officermay be notified and the commander of the area of responsibility in which theoffense occurs may take appropriate action.

(3) When an offense which endangers the reputation of the Army iscommitted elsewhere than on a public conveyance, civilian police may be re-quested to take the offender into custody when no military police are available.

(4) When military police are not present, the senior commissioned officer,warrant officer, or noncommissioned officer present will obtain the name, grade,Social Security account number, organization, and station of the offender, andforward this information, together with a statement of the circumstances, tothe individual's commanding officer without a delay. When the offender isturned over to the civilian police, the above information will be given to thecivilian police for transmittal to the appropriate military authorities. ,

(2) Immunization required by AR 40-562 or other Department of theArmy directives (subject to any limitation stated in these directives).

(a) Forcible immunisation is authorised. This policy is intended toprotect the health and overall effectiveness of the command as well as the healthof the soldier himself. The individual does not have an option as to whetherhe will be immunized; this is a military obligation, an exception to which isgranted only for medical reasons in accordance with paragraphs 9a and e.t AE40-562. . . . ,

.(&} In performing this duty, medical personnel are expected to useonly that amount of force necessary to administer the immunization. Any.force necessary to overcome an individual's reluctance to immunization nor-mally will be provided by personnel acting under orders from the soldier'sunit commander. The commonly used expression "refusal to take shots" er-roneously suggests that the individual concerned lias an option between being,immunized or being punished for his refusal. This is incorrect. A soldier sched-uled for immunization will routinely be inoculated at his turn, unless he defiessuperior authority in which event the inoculation will be specially accomplished,

(c) Unless medically cont.raindicated, any required immunization willbe administered to .1 member with or without his consent. Every reasonableeffort should be made to avoid the necessity of disciplinary, action. However, amember should be advised that he may subject himself to disciplinary action

by resisting, and that he will be inoculated witli or without his consent in anyevent. Additionally, prior to any mandatory immunization, the member shouldbe counseled concerning the many other reasons why he should submit to therequired inoculation.

The individual does not have an option as to whetherhe will be immunized; this is a military obligation, an exception to which isgranted only for medical reasons in accordance with paragraphs 9aand e. AR40-562.

(&) In performing this duty, medical personnel are expected to useonly that amount of force necessary to administer the immunization. Anyforce necessary to overcome an individual's reluctance to immunization nor-mally will be provided by personnel acting under orders from the soldier'sunit commander. The commonly used expression "refusal to take shots" er-roneously suggests that the individual concerned has an option between beingimmunized or being punished for his refusal. This is incorrect. A soldier sched-uled for immunization will routinely be inoculated at his turn, unless he defiessuperior authority in which event the inoculation will be specially accomplished.

(c) Unless medically contraindicated, any required immunization willbe administered to a member with or without his consent. Every reasonableeffort should be made to avoid the necessity of disciplinary action. However, amember should be advised that he may subject himself to disciplinary actionby resisting, and that he will be inoculated with or without his consent in anyevent..Additionally, prior to any mandatory immunization, the member shouldbe counseled concerning the many other reasons why he should submit to therequired inoculation.

b. Conduct. Discipline is-a function of command, hence, it is the responsibil-ity of all leaders in the Army, whether they are on duty or in a leave status, tosee that all military personnel present a neat and soldierly appearance, and totake action in cases of conduct prejudicial to'goo'd order and military disciplineby any military, personnel which may take place with their knowledge.

(1) The senior officer, warrant officer, or noncommissioned officer will actpromptly, using such means as are available, to restore order. One of his initialactions will be to call for military police assistance if they, are readily available.

(2) On public conveyances, i» the absence of military police, the personin charge of the conveyance may be requested to notify the nearest militarypolice and arrange to have them board the conveyance and-'take custody ofmilitary personnel guilty of misconduct. If the misconduct is sufficiently serious,the person in charge of the conveyance will be requested to stop the conveyanceat the first opportunity and turn the offender over to the local police. In allsuch cases, the local police will be advised to telephone collect to the nearestArmy post or Army headquarters so that the accused's commanding officermay be, notified and the commander of the area of responsibility in which theoffense occurs may take appropriate action.

(3) When an offense which endangers the reputation of the Army is com-mitted elsewhere than on a public conveyance, civilian police may be'requestedto take the offender into custody when no military police are available.

Section I. GENERAL

The key factors ofcommand covered herein are command authorityand responsibility, rank and precedence, commandand other channels, enlisted aspects of command,and military discipline. Additional guidance onthese matters is covered by the various publica-tions listed in DA Pam 310-3.

3. Right to command. Command is exercisedby virtue of office and the special assignment ofmembers of the Armed Forces holding militaryrank who are eligible by law to exercise command.The right to command is not limited solely bybranch of service except as prescribed in this regu-lation. A civilian may not exercise "command.However, he may be designated to exercise generalsupervision over an Army installation or activityunder the command of a military superior.

4. Assignment and command. Members of theArmy are assigned to stations or commands wheretheir services are required, and are there assignedto appropriate duties by the commanding officer.Without orders from competent authority, a mem-ber of the Army can only assume command wheneligible in accordance with this regulation.

5. Military rank. Military rank is the relativeposition or degree of precedence bestowed on mili-tary persons which marks their station and con-

fers eligibility to exercise command or .authorityin the military service within the limits prescribedby law. It is divided into classes and grades asshown in paragraphs 7 and 8.

6. How rank held or conferred, a. Rank isgenerally held by virtue of office or grade in theArmy, but may be conferred independently ofeither, as in the case of retired officers, or withrespect to commissioned officers in the same gradeby special assignment as provided in title 10,United States Code, section 3578.

6. Conferring honorary titles of military rankupon civilians is prohibited. Honorary titlesheretofore conferred will not be withdrawn.

7. Grades of rank. The following are thegrades of- rank in the Army, in order of theirprecedence or relative rank. Also indicated arethe grouping of grades into classes, pay grades,and title of address. Procedures for determina-tion of precedence and date of rank are indicatedin section VI.

9. Precedence between personnel of Armyand personnel of other services serving withArmy. Personnel of other services serving withthe Army are on equal footing with personnel of

the Army of corresponding component, and prece-dence will be determined in the manner set forthin this regulation.

Section II. COMMAND AND OTHER CHANNELS

10. Chain of command. The chain of com-mand is the most fundamental and important or-ganizational technique used by the Army. It isthe succession of commanders, superior to sub-ordinate, through which command is exercised.This chain is also known as the command channel.It extends from the President, as Commander inChief, down through the various grades of rankto the enlisted persons leading the smallest Armyelements and to their men. Staff officers and ad-ministrative noncommissioned officers are not inthe chain of command. A simple and direct com-mand channel facilitates transmittal of ordersfrom the highest to the lowest levels in a minimumof time and with the least chance of misinterpreta-tion. As used in this regulation, no distinction ismade between the terms commander and leader asthe fundamental policies of command and leader-ship are applicable at all echelons of the chain ofcommand. The command channel extends upwardin the same manner for matters requiring officialcommunication from subordinate to superior. It

is Army policy, as indicated in paragraph 3, thateach individual.in the chain of command is dele-gated sufficient authority to accomplish assignedtasks and responsibilities. Every commander hastwo basic responsibilities in the following prior-ity: Accomplishment of his mission, and the careof his personnel and property. Normally, efficientaccomplishment of the mission will help to satisfythe responsibility for personnel welfare. A su-perior in the chain of command Holds his sub-ordinate commanders responsible for everythingtheir command does or fails to do. Thus, in rela-tion to his superior, a commander cannot delegateany of his responsibilities. However, in relationto his subordinates, he does subdivide his responsi-bility and authority and assigns portions of themto various commanders and staff members. In this•way an appropriate degree of responsibility be-comes inherent in each command echelon. Thenecessity of a commander or staff officer observingproper channels in issuing instructions or ordersto subordinates must be recognized. Constant

and continuous utilization of the chain of com-mand is vital to the combat effectiveness of anyArmy unit. Every effort must be made to acquaintall individuals with its existence and properfunction.

11. Staff or technical and noncommissionedofficer channels. Another important Army or-ganizational-technique for communication is thestaff or technical and noncommissioned officerchannels of communications. The term staff ortechnical channels is used to describe the verticalor horizontal channel between a staff section atone headquarters and a similar staff section at an-other echelon, or at a parallel headquarters. Thenoncommissioned officer channel originates withthe commander of a major unit or installation andextends from that commander's 'sergeant majordownward through subordinate organization ser-geant major to unit first sergeants and, thence, toother noncommissioned officer'arid enlisted person-

nel of the units. These informal channels are usedprimarily for1 the exchange of information anddo not supplant the normal chain of command.The staff or technical channel is sometimes used forrouting reports and instructions not involvingvariations from command policies and directives.The noncommissioned officer channel is often usedfor the accomplishment of certain routine, but im-portant tasks and responsibilities. These includetraining in basic skills and attributes of a soldier;establishment and maintenance of noncommis-sioned officer standards; proper wearing of theuniform; appearance; and military courtesy ofenlisted personnel; care of individual'arms andequipment of enlisted personnel,"care of livingquarters of enlisted personnel; area maintenancetasks; and operation of recreational and otherfacilities for the primary use of enlisted personnel.Each commander defines to his "staff and sub-ordinates his policies on the use of these channels.

Section III. COMMAND POLICIES AND PROCEDURES

12. Command of installations, activities, andunits, a. Responsibility. Command of an instal-lation, activity or unit of platoon size or largernormally is the responsibility of the senior regu-larly assigned officer present, provided he is1 notineligible under paragraph 22, subject to the fol-lowing limitations:

(1) Class I installations and activities andcomparable oversea installations normal-ly will be commanded by an officer of one

• of the following branches: Annor, Artil-lery, Infantry, Corps of Engineers, andSignal Corps. When the senior regularlyassigned officer is a member of anotherbranch, the " next higher headquartersshould be informed.

(2) Class-II installations and activities nor-mally will be commanded by an officerof that branch of the-Department of theArmy staff agency having command jur-isdiction. When the senior regularly as-signed officer is a member of anotherbranch, the next higher headquartersshould be informed. Command of an in-stallation or activity under the jurisdic-tion of a Department of the Army agencyhaving no specific branch affiliation willbo assumed by the senior regularly as-

signed officer present, provided he is oth-erwise eligible.

(3) Army commanders or general officerswith the rank of lieutenant general orabove are prohibited from assuming com-mand of Army installations. When aspecific situation appears to warrant anexception to this policy, prior approvalof Headquarters,. Department of theArmy will be obtained.

&. Announcement of assumption of command.ssumption of command will be announced by

orders citing this regulation as author-it.y. Oral orders will be used in the case ofplatoons and smaller units that do not publishwritten orders.

c. Installation responsibilities. When a majorcommander deems it advisable to relieve tacticalcommanders of installation responsibilities, he mayissue orders designating an officer of the permanentstation complement junior to the senior tacticalcommander as installation commander.

d. Optimum length of command tours. Theoptimum length of command tours must be basedon the needs of the Army, stability within units,the. needs for officers with command experience,and availability of personnel. Optimum com-mand tours are established as follows:

(1) For company 'grade, 18 months with aminimum of 12 months.

(2) For field grade, 24 mouths with aminimum of 18 months and a permissibleminimum of 12 months for Medical Corpsofficers.

(3) In oversea areas where the tour lengthprecludes such tenure of command, thecommand tour will coincide with theoversea tour.

13. Branch immaterial c o m m a n d s . Thesenior officer regularly assigned and present forduty with logistical commands (or communica-tions zone headquarters, sections, and areas), andsimilar branch immaterial commands will assumecommand of the organization to which assignedprovided he is not ineligible under paragraphs 22and 23.

14. Designation of junior in same grade tocommand, a. When two or more commissionedofficers of the same grade who are otherwiseeligible to command are on duty in the samecommand or organization thereof, the Presidentmay assign the command of the forces withoutregard to seniority of rank.

5. Commanders of major commands; Armygroups, armies, corps, divisions, and units compa-rable thereto; and chiefs of services and heads ofother Department of the Army staff agencies areauthorized to announce, by direction of the Presi-dent, the designation of one of several officers ofthe same grade within a command under theirjurisdiction as a commander thereof without re-gard to relative seniority (see para 23<z pertainingto general officei's). 15. Death, disability, or absence of cbln-mander. a. fre.iieral. In the event of the death.

disability or temporary absence of the commanderof any element of the Army, the next senior reg-ularly assigned commissioned officer, warrant of-ficer, cadet, noncommissioned officer, specialist, orprivate present for duty and not ineligible underparagraphs 22 and 23, will assume command unl.ilrelieved by proper authority except as providedfor iu c below for major commanders. Assump-tion of command under these conditions will beannounced as indicated in paragraph 12& exceptthat orders will indicate assumption as actingcommander unless proper authority has indicatedthat the command will be permanent.

&. Heads of Department of the Army staffagencies. In the event of the death, disability, ortemporary absence of a head of a staff agency ofthe Department'of the Army, except The SurgeonGeneral, and the Chief, National Guard Bureau,the next senior officer on duty in the office of suchhead will, except as otherwise ordered, or required,exercise the functions of such head until relievedby proper authority. In the case of The SurgeonGeneral, such functions will be exercised by thenext senior officer of the Medical Corps present andon duty in his office. In the case of the Chief, Na-tional Guard Bureau, such functions will be exer-cised by the senior officer of the National Guardof the United States on duty in the Bureau (10U.S.C. 3015).

c. Commanders of major commands. A com-mander of a major command may continue to dis-charge the functions of his command while absentfrom the limits thereof, provided such absence isfor a short period only, he has reasonable com-munication .with his headquarters, and his absenceis not occasioned by physical disability.

16. Absence or disability of all officers of aunit. In the event of the death, disability, orabsence of all officers of a unit normally com-manded by a commissioned officer, the appropriatecommander will assign an officer, preferably ofthe branch to which the unit belongs, to its com-mand. Pending assignment and arrival of tlienew commander, the senior warrant officer, cadet,noncommissioned oflicer, specialist, or privateregularly assigned to the unit will exercise tempo-rary command. Restrictions pertaining to as-sumption of command prescribed in paragraphs225 and c and 25d and g apply. Assumption ofcommand will be as indicated in paragraph 15(7.

17. Emergency command. In the event ofemergency, the senior commissioned officer, war-rant officer, cadet, noncommissioned officer, spe-cialist, or private among troops at the scene of theemergency will exercise control or command of themilitary personnel present. These provisions arcftlso applicable to (roops separated from theirparent units under ba t t l e f i e ld conditions or inprisom-r of war status. 18. Functions of individual in temporarycommand. A member in temporary commandwil l not, except- in urgent cases, alter or annul thestand ing orders of the permanent- commanderwithout , au thor i ty from t h e next higher com-mander. Temporary command is de.fined to in-clude command assumed under conditions out l inedin paragraphs 15. 1(1, and 17. Such commanderswi l l ho considered temporary commanders u n t i lthey are designated as permanent or u n t i l they lirereplaced by the appropriate senior commander.

19. Responsibility of successor. A memlie.r\\-hct succeeds to any command or du ty stands. MIregard to his dudes, in the same s i tuat ion as didhis predecessor. The. successor will assume re-sponsibi l i ty for all orders in force and all thep u l > l i c property and f u n d s pe r ta in ing to thecommand.

20. Separate commands of the U.S. Armyserving together, n. (2)" A student at a service school or civilianinstitution, or undergoing individualtraining, instruction, or intransit process-ing at an installation where lie is not apart of the command complement.

(3) Not permanently assigned, and his unitis not permanently assigned to the instal-lation.

(4) Assigned primarily as a permanent mem-ber of a board.

(5) Prohibited by statute or by Army regu-lations (para 23 and AR 600-31) fromassuming command.

(C) Assigned specific duty aboard a militaryvessel or aircraft where his particularduty and military occupational specialtydo not technically qualify him to assumethe duty of ship's master or aircraft com-mander.

1>. Suspension from rank, command, or duty.A commissioned officer may be suspended fromrank or command by sentence of a court-martial.Suspension from rank includes suspension fromcommand. An officer thus suspended may not ex-ercise military command of any kind or performany duty involving the exercise of command. Acommissioned officer may also be suspended fromduty. Such suspension, is analogous to suspensionfrom command and is particularly appropriatein the case of an officer assigned to a purely ad-ministrative .duty not involving the exercise ofmilitary command. While suspended from rank,command, or duty, an officer is ineligible to sit asa member of a court-martial, court of inquiry, ormilitary board,-and he is deprived of .privileges,,depending on rank, such as any.priority depend-ent on. rank in the selection of quarters. For re-ports required to be submitted in certain cases in-volving changes in status of officers resulting fromcourts-martial actions, see paragraph 96, Manual.for Courts-Martial, 1951.

c. In arrest, A person in arrest is ineligible toexercise command of any kind.

23. Restrictions, a. Announcement of appoint-ment. With the exception of the CommandingGeneral, U.S. Continental Army Command, com-manders referred to in paragraph 14 will not exer-cise their authority in the assignment of general

officers without prior approval of Headquarters,Department of the Army, in each instance. TheCommanding General, U.S. Continental 'ArmyCommand, is authorized, during the temporaryabsence of the regularly assigned commander con-cerned, to assign general officers under his com-mand to positions of command in accordance withparagraph 14. The authority contained in para-graph 14 will not be exercised to assign commandfunctions to chaplains, or, unless authorized by theSecretary.of the Army or his appointee (d below),to officers of the Army Medical Service when suchassignment involves troops other than those of theArmy Medical Service.

b. General Staff officers. An officer assigned toduty on or detailed to duty with the Army GeneralStaff will not assume command of troops otherthan personnel on duty with the'Army GeneralStaff unless specifically directed to do'so by anauthority named in paragraph. 14. An officerdesignated general staff with troops may assumecommand when he is the senior regularly assignedofficer of the command present for duty and notineligible under the provisions of this -paragraphand paragraph 22.

c. Officers on duty in Department of the Armystaff agencies. Officers on duty in any of the staffagencies, services, and bureaus of the Departmentof the Army, including heads thereof and officersdetailed to duty therein, will not assume commandof troops other than those of the service, staff, orbureau in which they are on duty unless specifi-cally directed to do so by competent authority.

d. Officers of tlie Army Medical Service. Of-ficers of the Army Nurse Corps and the ArmyMedical Specialists Corps may exercise commandonly within their respective branches, and overpersons placed under their charge. Other officersof the Army Medical Service may exercise com-mand only within the Army Medical service. Asan. exception, to this general rule, officers of theMedical Service Corps may exercise command, oftroops that are not part of the Army Medical Serv-ice whenever authorized by the Secretary of theArmy, by the commanders of major commands,army groups, armies, corps, divisions, and unitscomparable thereto, the chiefs of services, or headsof other Department of the Army staff agencies.

e. Chaplains. A chaplain has rank withoutcommand (10 U.S.C. 3581). Although a chaplainmay not exercise command, he has authority to

Commanding officer of troops on transports.All military personnel embarking on MSTS ves-sels are available for command duty, unless other-wise indicated in their travel orders or by reason oftheir branch of service they are not eligible tocommand troops. General officers will be ex-cluded from this requirement and the designationof colonels will be at the discretion of the terminalcommander. See AR 55-325.

g. Women's Army Corps officers, warrant of-ficers, and noncommissioned officers. Commis-sioned officers," warrant officers, and noncommis-sioned officers of the Women's Army Corps mayexercise command over, "Women's 'Army' Corpspersonnel only. They may exercise such militaryauthority over other military personnel as is neces-sary to carry out the duties pertaining to theirassigned tasks.

h. V.S. Army Reserve unit commanders. Theauthority delegated under paragraph 14 will apply"in the following cases when it is determined im-practicable to assign the senior officer to command:

(1) When the Reserve oflicer selected to com-mand a-U.S. Army Reserve unit, while

. in Reserve duty training status, is juniorin date of rank, as computed under sectionVI, to other officers of the same gradeassigned to that unit.

(2) When a Reserve unit is ordered to activeduty, and the assigned unit commander isjunior in date of rank, as computed undersection VI, to other assigned officers ofthe same grade.

i. Warrant officers. When assigned duties asstation, unit, or detachment commander, warrantofficers are vested with all powers usually exer-cised by commissioned officers except as indicatedin AH 611-112. ' .

j. Partially disabled officers. Partially disabledofficers contin^edLon,active duty under the pro- ~ fvisions of AR 4it£-4-r will be assigned to positions ^~ *Tin which their special qualifications make them ofparticular value to the service. Such officers willnot be assigned to command positions unless posi-tive determination is made by the assigning au-thority that the individual concerned has the medi-cal (physical) and career potential to serve incombat situations and until the age for mandatoryretirement.

Section IV. ENLISTED ASPECTS OF COMMAND

24: General policies, a. Except as specificallyindicated, all of the policies of this regulationapply equally to all classes of military personnelas listed in paragraph 7. This section is devotedto emphasizing policies of command that are pri-marily or exclusively related to the enlisted grades.At all echelons of command, commanders and theirstaffs are charged specifically with the responsi-bility of insuring equitable delegation of authorityand responsibility, as guided by this regulation, tononcommissioned officers by their superiors,whether officer, warrant officer, or other noncom-missioned officers.

6. This regulation is applicable to-enlistedpersonnel of all components of the Army. Per-sonnel retired and members of USAR ControlGroups prior to.l July 1955 are exempted fromthis regulation while in that status.

25. Noncommissioned officers. The guidancein this paragraph is amplified in AR 611-201which describes in detail the command function ofall noncommissioned officer MOS.

a. Sergeant major of the Army. This is thesenior sergeant major grade of rank as indicatedin paragraph 7. It is also the position title thatdesignates the senior enlisted position of the Army.The sergeant major occupying this position servesas the senior enlisted advisor and consultant tothe Chief of Staff of the Army on problems af-fecting enlisted personnel and their solutions; onprofessional education,'growth and advancementof noncommissioned-officers; and on morale, train-ing, pay, promotions and other matters concerningenlisted personnel. He is also available to pre-sent the enlisted viewpoint on Department of theArmy boards and committees. Other functions ofthis position include meeting with military andcivilian organizations to discuss enlisted personnelaffairs, receiving enlisted personnel who visitHeadquarters, Department of the Army, and rep-resenting all Army enlisted personnel at appropri-ate ceremonies.

staffs of various commanders. In keeping with thetrust, confidence, responsibility, and authoritybestowed upon this function, the sergeant majorshould be considered as a key staff member. Asindicated in paragraph 11, it is from the sergeantmajor of a major unit or installation that the ac-tivities of the local N"CO channel ;emanate. Thischannel functions orally through the sergeantmajor's and first sergeant's call and does notnormally involve written directives.

G. First sergeant. This position title is secondto the sergeant major in importance, responsibil-ity, and prestige. In the sense that first sergeantsare in direct and daily contact with sizeable num-bers of other enlisted men, this position is. onerequiring outstanding leadership and professionalcompetence. The first sergeant is the senior en-listed assistant to commanders of companies, bat-ieries, and troops. It is normal for companycommandcrs to use the noncommissioned oflicerchannel (para 11)'for the conduct of many routineactivities, particularly in garrison. Thus, in theseactivities, the first sergeant occupies an intermedi-ary position between the other enlisted personneland the officers of the.company. He conductsroutine company administration and .companyoperations as directed by the company commander.He drafts company orders, reports, and .otherdocuments requiring the signature of the companycommander. The functions of the first sergeantdo not include responsibilities which cannot'bedelegated by the company commander or whichproperly belong to the executive officer or platoonleaders. , . •

d. Platoon sergeant. This position title is alsoone of the key ones in the command structure ofthe Army. It is normal for platoon sergeants tobecome vital members'of1 the chain of commandunder the provisions of paragraph 16. When theofficer platoon leader is present, the platoonsergeant is his key assistant and advisor.

e. Section, squad, and team leaders. < The im-portance of these positions stems from the factthat the responsibilities of these echelons of thechain of command (para 11) are habitually exer-cised by noncommissioned officers. Platoon lead-ers hold their subordinate leaders responsible—

(1) For personal appearance and cleanlinessof their soldiers.

.(2) That all Government property issued.tomembers of their units is properly main-

tained and accounted for at all times andthat discrepancies are reported promptly,

(o) That, while in a duty status, they be readyat' all times to report the' location andactivity of all individuals of the unit.Thus as the basic reporting unit in for-mations, the squad is either present, orindividuals absent are reported by name

:'and not merely accounted for.(4) That'the unit is prepared to function in

its primary mission role./. Acting noncommissioned officers. Company,

troop, battery, and separate detachment com-manders may 'appoint acting corporals and ser-geants in accordance with AR 600-200 for thepurpose of filling p'osition vacancies. Addition-ally, AR 600-200 provides1 for acting corporals,sergeants, and staff sergeants for casual groups.While so acting they'will wear the insignia andhave the responsibilities, authority and privilegesof the position to which appointed, except thatthey will not be entitled to the pay and allowancesof such higher grades, and such service will notbe credited as time in a higher grade for appoint-ment or date of rank purposes.

g. Noncommissioned officer disciplinary policies.The purpose of this subparagraph is to emphasizethe important' status of noncommissioned officersin the maintenance of discipline in the Army.These policies should be considered together withthe provisions of section V and MCM 1951.

(1) NCO authority to apprehend, see para-graph 32, this regulation; article 7(c)UCMJ; and paragraph 19, MCM 1951.

(2) Noncommissioned officers may be author-ized by their commanding officers, in ac-

- cordance with article. 9(b), UCMJ, toorder enlisted persons into arrest or con-finement. Also see paragraph 21a, MCM1951. This authority is frequently con-fined by commanding officers to first ser-geants, charge of quarters, or other dutypositions.

(3) Noncommissioned officers do not haveany authority to impose nonjudicial pun-ishment upon other enlisted personnelunder article 15, UCMJ. However, therecommendations of noncommissioned of-ficers may be sought and considered byunit commanders. - -

(4) As enlisted commanders of troops certainnoncommissioned officers play an ex-tremely important role in furthering theefficiency of the company, battery, ortroops. This function includes the pre-vention of incidents which, if they oc-curred, would make it necessary ,to resortto trial by courts-martial or imposition ofnonjudicial p u n i s h m e n t.. Thus,, theNCO is a key assistant to the com-

• mander in administering the minor non-punitive (not to be confused with non-judicial p u n i s h m e n t ) disciplinaryresponsibilities prescribed in paragraph33, and in paragraph 128c, MCM 1951.See also paragraph 35&, this regulation.

(5) In taking corrective action with regardto subordinates, noncommissioned officerswill be guided by, and observe, the prin-ciples set forth in paragraph 34e.

NCO recommendations have tradi-tionally been of immeasurable assistanceto their commanding officer on such mat-ters as assignment, reassignment, promo-tion, privileges, discipline, training, unitfunds, community affairs, and supply.

(4) Be utilized only in supervisory roles onfatigue duty, and only as noncommis-sioned officers of the guard on guard duty,

. except in temporary situations whereother grades are critically short.

(5) Be granted such privileges as organiza-tion and installation commanders arecapable of granting and consider properto enhance the prestige of these vital en-listed troop commanders.

(6) Be considered for assignment of quarters(noncommissioned officers with bona fidedependents) by installation commandersupon the basis of several pertinent factorsunder the provisions of AR 210-14. De-termination of the seniority factor of ap-plicants under AR 210-14 will be on thebasis of date of rank within pay grade forall enlisted personnel under considera-

special skill. Specialists must have acquiredproficiency in the technical or administrativeaspects of their MOS field. Specialists, by virtueof their technical skill, are often called upon toexercise leadership with respect to matters relatedto their specialty. Normally,.their duties do notrequire the exercise of enlisted command of troops.Thus, while leadership proficiency is not a pri-mary prerequisite for advancement to or withinthe specialist'grades, qualities of leadership shouldbo encouraged and recognized..

b. Although the duty positions of specialists arenot enlisted command positions, and do not nor-mally require" exercise of leadership functions,there are exceptions. In particular, the moresenior specialists will occasionally be called uponto assume command under the provisions of para-graphs 10, 17, or 31a of this regulation. Addi-tionally, senior specialists are tusually soldierswith long service "and outstanding ability whocontribute in considerable degree to maintenanceof the high appearance and conduct standards ofenlisted personnel of lesser rank.

27. Privates. This class of enlisted men is, asindicated in paragraph 7<2(3) , the basic manpowerstrength and grade of the Army. While commandfunctions do not normally pertain to privates,they should be indoctrinated in their responsibili-ties and in their potential for enlisted commandduties. Special emphasis should be made of theguidance in paragraphs 16, 17, 18, 19, section V,and paragraph 25:

Section V. MILITARY DISCIPLINE

28. Explanation of term. a. Military disci-pline is a state of individual and group trainingthat creates a mental attitude resulting in correctconduct and automatic obedience to military lawunder all conditions. It is founded upon respectfor and loyalty to properly constituted authority.

6. While military discipline is enhanced bymilitary training, every feature of military lifelias its effect on military discipline. It generallyis indicated in an individual or unit by smartness

of appearance and action; by cleanliness and neat-ness of dress, equipment, and quarters; by respectfor seniors; and by the prompt and cheerful ex-ecution by subordinates of both the letter and thespirit of the legal orders of their lawful superiors.

29. Obedience to orders. All persons in themilitary service are required to obey strictly andto execute promptly the lawful orders of theirsuperiors, .

' IV, AH 000-25.31. Appearance and conduct, a. Discipline is

a function of command; hence, it is the responsi-bility of all leaders in the Army, whether they areon duty or in a leave status, to see that all militarypersonnel present! a neat and soldierly appearance,and to take action in cases of conduct prejudicialto good order and military discipline by any mili-tary personnel wpich may.take place with theirknowledge.

b. The senior officer, warrant officer,.or noncom-missioned officer (will act promptly, using suchmeans as are available, to restore order. One ofhis initial actions will be to call for MilitaryPolice assistance if they are .readily available.

c. On public conveyances, in the absence ofmilitary police, tlie person in charge of the con-veyance may be requested to notify the nearestmilitary police and!arrange to have them board theconveyance and taloe custody of military personnelguilty of misconduct. If the misconduct is suffi-ciently serious, thel person in charge of the con-veyance will be requested to stop the conveyanceat the first opportunity and turn the offender overto the local police.! In all such cases, the localpolice will be advised to telephone collect to thenearest Army post or Army headquarters so that.the accused's commanding officer may be notifiedand the commander of the area of responsibilityin which the offense occurs may take appropriateaction.

d. When an offense Which endangers the repu-tation of the Army is\committed elsewhere thanon a public conveyance! civilian police'may be re-quested to take the offender into custody whenno military police are' available.

e. When military police are not present, thesenior commissioned officer^ warrant officer, ornoncommissioned officer vpresent will, obtain thename, grade, service number, organization, andstation of the offender, and forward this informa-tion, together with a statement of .the circum-stances, to the individual's commanding officerwithout delay. When the'offender is turned overto the civilian police, the above information willbe given to the civilian police for transmittal tothe appropriate military authorities.

32. Maintenance of order.. Military" policej air

police, and'meinbers of the Navy, Marine Corps,and Coast Guard shore patrols are authorized anddirected to apprehend Armed Forces, personnelwho commit an offense punishable under the Uni-form Code of Military Justice. Commissioned of-ficers, warrant officers, noncommissioned officers,and petty officers of the Armed Forces are au-thorized and directed to quell all quarrels, frays,and disorders among persons subject to militarylaw and to apprehend participants. Those exer-cising authority hereunder are enjoined to do sowith judgment and tact. ' Personnel so appre-hended will be returned to the jurisdiction of theirrespective services as soon as practicable. 33. Military authority, how exercised. Mili-tary authority will be exercised with promptness,firmness, courtesy, and justice. Resort to trial by .court-martial or to nonjudicial punishment underthe Uniform Code of Military Justice, article 15,will not be made for trivial offenses, except whenless drastic methods of administering disciplinehave been tried (see para 128c, MCM, 1951) inthe case of the individual concerned without re-suit. A private E-l, for example, who is late forformation, appears in improper uniform, or hasunclean equipment may be censured, required toclean his equipment, or to .take extra training ormakeup training in subject(s) directly related tothe training deficiency. Such action is in the na-ture of instruction, not punishment. Care willbe exercised at all levels of command to insurethat subordinate commanders understand and ad-here to the principle that training will not be usedas punishment. Trivial offenses which'have beencorrected after being brought to the attention ofthe .individuals concerned need not be noted ontheir records, and will be considered as closed in-cidents (paras 25^ (4) and 356).

34. Relationship of superiors toward subordi-nates, a. .The commander will encourage amonghis. subordinates harmonious relations coupledwith a friendly spirit of competition in the per-formance of duty.

b. The commander's timely intervention to pre-vent disputes, give advice to the inexperienced, andcensure conduct liable to produce dissension in thecommand, or to reflect discredit upon it, is of greatimportance in securing and maintaining efficiency.

c. Commanders exercise command through theirsubordinate" commanders. The commander in-spires confidence in his subordinates by example,by sound' and "decisive1 action, and by his' abilityto overcome obstacles. He encourages strengthen-ing of the chain of command .and "development ofinitiative, ingenuity, and boldness of executionthroughout all echelons of his command. Heestablishes policies, prescribes missions, and setsstandards for his command. By personal visitsto his units and by formal or informal inspectionsand reports, he insures adherence to his policies,compliance with his orders, and maintenance ofliis standards. He employs his staff to acquireinformation, to prepare detailed plans, and tootherwise relieve him of details so that he mayhave maximum freedom of action. The degree towhich he delegates responsibility and authority toliis staff will vary with the 'commander and theleveV of the command. He must take care^ how-ever, that the staff does' not isolate him from hissubordinate commanders ' and that the uniquerelationship between himself and his" subordinatecommanders is preserved. The commander m'ain-

-t.ains a close, direct, and personal'relationship withhis-subordinate commanders and with his staff.He insures that a feeling of mutual respect andconfidence exists between his headquarters andsubordinate commands.- '

• d. Commanders'will assist in the professionaldevelopment of their subordinates by such meansas encouraging self-study, periodically rotatingtheir duties, and frequently counseling them upontlieir* performance. Normally, enlisted personnelwill not be rotated to duty 'outside their primaryMOS particularly in the case of those receivingproficiency pay.

e. Authority will impose its weight by theprofessional competence of leaders at all echelonsrather than by the arbitrary or despotic methodsof martinets. Second only to the accomplishmentof tlieir military mission,' leaders are responsiblefor the welfare' of their troops. Commissionedofficers,' warrant officers, and' noncommissionedofficers will enhance the will to fight for theircountry in'their subordinates by instilling in thema sense of responsibility as citizens of the UnitedStates, a sense of responsibility in conduct andbehavior as service members, and a spirit ofloyalty to the democratic principles oh which theAmerican way of life is based. Leaders at all

echelons will impart to "troops, on a continuingbasis, constructive information oh the necessity forand purpose of military discipline.. In complyingwith the Uniform "Code of Military Justice,article 137, the articles required to be explainedwill be presented in such a manner as to insurethat enlisted personnel will be fully cognizantof the controls and obligations imposed on them by-virtue of their military service. Commissionedofficers, warrant officers, and noncommissionedofficers will keep in close touch with personnelwithin their command, will take an interest intheir organization life, will hear their complaints,and will endeavor on all occasions to remove thosecauses which make for dissatisfaction. Leaderswill strive to maintain such relations of confi-dence and sympathy as will insure that personnelof their command will feel free to approach themfor counsel and assistance, not only with regard tomilitary and organizational .matters, but withmatters which may bo contributing to personal orfamily distress or perplexity. This relationshipmay be gained and maintained without relaxationof the bonds,of discipline and.with great benefitto the service.as a whole.' 35. .Disciplinary powers of commanding of-

punitive measures, as explained, in paragraph12Sc, MCM 1951, if the individual to be adminis-tratively admonished or administratively repri-manded is.no longer a member of his command,the commander concerned will forward such ad-ministrative admonition or administrative repri-mand direct to the individual at his current dutystation (paras 25</(4) and 33).

36. Private indebtedness and financial obli-gations, a. See AK 210-̂ 7.

b. Commanding officers will not tolerate actionsof irresponsibility, gross carelessness, neglect, dis-honesty, or evasiveness in the private indebtednessand. financial obligations of their, personnel.Normally, it is not difficult to distinguish betweenan honest denial of an obligation and a dishonest.• ' • ' . ' ' ' . •or irresponsible evasion thereof. A claim basedupon a judgment, order, or decree of a court whichappears valid- on its face, should ordinarily beaccepted by the commanding officer as prima facieevidence of the financial obligation establishedthereby. Such a judgment, however, may be re-butted by other evidence, such as a conflicting

37. Support of dependents, a. General. Sup-port of dependents by members of the Army in-volves a serious responsibility which is of directconcern to the Army. Failure on the part of aincmU-r to carry out this responsibility not onlyreflects adversely on the Anny as a whole but isentirely inconsistent with Army standards ofhonor. The Anny wi l l not t« a haven or refugefor personnel who disregard or evade their obli-gations to their families. Members of the Armyare expected to conduct their personal affairssatisfactorily. This includes the requirement thatthey provide adequate and continuous support fortheir legal dependents and comply with the termsof separation agreements and court orders. Fail-ure to do so in any manner which tends to castdiscredit on the Army is a proper subject of com-mand consideration for punit ive action or otherappropriate administrative act ion to includeelimination from the service or denial ofre-enlistment.

b. Entitlement to basic allowance for quarters.Since 1 January 1963, enlisted members in thegrade of E-4 with over 4 years' service and ingrades E-5 through E-9 have received the basicallowance for quarters wi th tlieir pny, rather thanthrough mandatory class Q, allotments to the.ir de-pendents. This procedure was instituted in thebelief that noncommissioned officers, together w i t hcommissioned and warrant officers, are responsible,individuals who wi l l fulf i l l their family support,obligations without coercion. Although the al-lowance is paid to the member, rather than to hisdependents, its purpose is to provide for (he sup-port of his dependents, and his unjust enrichmentby a refusal to support his dependents will not In*permitted. Cases involving alleged refusal of amemlwr to use the basic allowance- for quarters forthe. support of his dependents will be referred tothe, appropriate Finance and Accounting Oflicerfor init iat ion of action to determine whether themember is entitled to that allowance.

c. When considered necessary, take action underthe Uniform Code of Military Justice, articles 15,121, 123a, 133, or 134, when individuals under theircommands issue checks against an account withinsufficient ' funds therein or fail to clear theirpersonal accounts prior to departure from theirstations. When information of indebtedness isreceived subsequent to the departure from thestation of an individual, the commanding officerof the station at which personal accounts remainunsettled will take action outlined in paragraph3GcZ(3).

39. Civil status of members of .the Reservecomponents, a. A member of the Reserve compo-nents, not serving on active duty, is not held orconsidered to be an officer or employee of theUnited States solely by reason of his status as suchmember and is not prevented from accepting em-ployment in any civil branch of the public service,nor 'from receiving pay incident to such employ-ment in addition to any pay and allowances towhich he may be entitled under the laws 'relatingto the Reserve components. Except as specificallyprovided to the contrary in certain laws of theUnited States, a member of the Reserve compo-nents, not serving on active duty, is not prohibitedfrom practicing his civilian profession or occupa-tion before or in connection with any departmentof the Federal Government. There are a numberof laws which impose limitations on the activitiesin which persons may engage after terminationof active duty or employment by the United States.The underlying principle of these laws is that itis improper for an individual who has handled amatter for the Government to leave public serviceand thereafter represent the other side in connec-tion with the same or a closely related matter.(See, for example, 18 U.S.C. 284 and 22 U:S.C.1764.)

b. Members of tlie Reserve components who areofficers and employees of the United States or ofthe District of Columbia are entitled to a leave ofabsence from their respective civilian employmentwithout loss of pay, time, or efficiency rating on alldays during which they are ordered to duty with.troops or field exercises or for instruction forperiods not to exceed 15 days in any calendar year,

except that officers and employees of the UnitedStates or of the District of Columbia who aremembers of the Army National Guard of the Dis-trict of Columbia are authorized leave for all days(no limit) on which they are ordered to duty forparades or encampment under 25 Stat. 779, asamended by 35 Stat. 634.

c. Members of the Reserve components, subjectto the approval of the Secretary of the Army, mayaccept civil employment .with and compensationtherefor, from any foreign government or any conrcern which, is controlled in' whole or in part by aforeign government. __

40. Release of Rchurvu personnel rosters out-.side the Military Establishment, a. Rosters ofReserve component personnel will not be releasedto Reserve associations, other agencies, and indi-viduals outside the Solitary Establishment. Thisshould not be construed as preventing reasonablecooperation at the local le\el in such matters as, forexample, suggesting the names of individual re-servists to" represent the Resi;rve components atpatriotic gatherings but rather to prevent thecompilation of mailing lists by persons and organi-zations outside the Military Establishment.

b. To be effective, this policy must be applicableat all levels of command in the field as well as atthe departmental level. Commanders at all levels''

41. Congressional activities, a. Communicat-ing with a Member of Congress. No person mayrestrict any member of an armed force from com-munication with a Member of Congress, unless thecommunication is unlawful or violates a regulationnecessary to the security of the United States(10 U.S.C. 1034). Leaders are responsible, how-ever, for continually advising subordinates to seekadvice or assistance within the chain of command,from appropriate staff agencies, or from an in-spector general if there is a complaint, and that acommunication'concerning a personal problem for-warded to anyone who is not in the local chain ofcommand inevitably must be returned to the localcommander for consideration before action can betaken to render assistance; also that service mem-bers should so inform members of their families.

b. Appearance before congressional committees.It is the policy of the Department of the Army tomake the maximum information available to con-gressional committees as to its operations and

activities, subject to the provisions of AR 380-ii.When requested to appear before a committee ofCongress, military personnel of the Army willeffect coordination with the Chief of LegislativeLiaison, Office, Secretary of the Army (or theComptroller of the Army on matters pertaining toappropriations) for guidance or assistance.

42. Political activities. Members of the Army,while on active duty, will not iise their officialauthority, position, or influence for the purpose ofinterfering with an election or affecting the course-or outcome thereof. Such persons, while on activeduty, retain the right to vote, to express their opin-ion privately and informally on all political sub-jects and candidates, and to become candidates forpublic office as permitted by this regulation. Theymay not participate in political management or bemembers of political committees, nor may theytake an active part in other political activities, in-cluding but not limited to political conventionsand campaigns, political speeches, the publicationof articles, and any other public activity designedto influence the outcome of an election or solicitvotes for themselves or others. Members partici-pating in activities not prohibited by this para-graph will not publicize their rank or militaryaffiliation. Further,they aresubject to the prohibi-tions of 5 U.S.C. 2195, and 18 U-SiC. 602 and 607.They may not attempt to influence''any memberof the armed forces to vote or not to vote for anyparticular candidate (5 U.S.C. 2195). They areprohibited by 18 U.S.C. 602 and 607 from solicit-ing, receiving from, or giving to, any other officer,employee, or person .paid from Federal funds, anycontribution, subscription, or assessment for anypolitical purpose, or for the promotion of any po-litical object. The foregoing statutes are appli-cable to retired Regular Army personnel also.

43. Election to, and performance of duties of,public office, a. Members of the Regular Army,while on the active list, may accept nomination forpublic office, provided such nomination is tenderedwithout direct or indirect activity or solicitationon their part. They then may file such evidenceof their candidacy as required by local law.' At-tention is directed, however, to the following stat-utory provisions: " :.

Except as otherwise provided by law, no commissionedoflicer on the active list of the Regular Army may holda civil office by election or appointment whether under

the United States, a Territory or possession, or a State.The acceptance of sue!) a civil office or the exercise of itsfunctions by such an officer terminates his appoint-ment in the Army (10 U.S.C. 3544(b)).

b. Members-of the Army, other than the Regu-lar component, while on active duty, may becomecandidates for election to public office, without thetender of nomination as provided in a above, andmay file such evidence of their candidacy as re-quired by local law.

c. Tlie permission expressed in a and b aboveis conditional upon the following:

(1) That the candidacy will not interferewith the performance by the individualsconcerned of tlieir duties in the Army.

(2) That the individuals concerned, if elected,will not at. any time while in active dutystatus act in their official capacities asholder of the office, or perform any of theduties thereof, nor, if members of the

. Regular Army, accept the • office while. they remain on the .active list. -

d. A-member of tlie Army on active duty mayin a proper case be discharged for the convenienceof tlie Government under honorable conditions,retired,' or released from-active duty, as may beappropriate, for the purpose of performing theduties of President of the United States, or of oneof the following public offices: Vice President ofthe United States, public officers appointed by thePresident of the United States, tlie governors andall other State officials chosen by-the voters ofthe entire State of the several States and terri-tories, members of the legislative bodies of theseveral'States and territories and the judges of thecourts of record of the United States and of theseveral States and territories and the District ofColumbia. Separation from the service or fromactive duty, as may be appropriate, is mandatoryfor any member o'f the Army on active duty wliobecomes a member of either of the legislativebodies of the United States. In such cases thefollowing rules will apply:

(1) If eligible for retirement, the individual" concerned may be retired.

(2) If serving- on active' duty as a retiredRegular Army oflicer, he or she will berelieved from active duty.

(3) If a member of a Reserve component heor she will be relieved from extended

active duty, but while holding suchcivilian office may, upon his or her re-quest, be ordered to active duty for train-ing for limited periods of time.

(4X All other persons will be discharged,relieved from active duty, or permitted toresign, -as appropriate.

44. Publishing of articles. The policy of theDepartment of Defense is that military personnelwho desire to engage in public writing for per-sonal profit are on- an exact parity with civilianprofessional writers so far as access to classifiedcurrent technical or operational military infor-mation is concerned. See AR 360-5.

.45. Student officer studies. All studies pre-pared as a part of their official duties by studentsat Army service. schools will.be used for officialpurposes only and will not be made available forpublication or release in any manner which wouldindicate Department of the Army indorsement.This is not intended to preclude the writing ofspecial articles on military subjects for publicationprovided review and clearance for publication areobtained as prescribed in AR 360-5.

46. Participation in public, demonstrations.Participation in picket lines or any other publicdemonstrations, including those pertaining to civilrights, may imply Army sanction of the cause forwhich the demonstration is conducted. Such par-ticipation by members of the Army, not' sanctionedby competent authority, is prohibited —

a. During the hours they are required to bepresent for duty. ' •

b. When they are in uniform.c. When they are on a military reservation.d. When they are in a foreign country.e. When their activities constitute a breach of

law and order./. When violences is reasonably likely to result.47. Participation in pageants and shows for

civilian entertainment. Military personnel willnot participate in military pageants or showswhich are designed primarily for the entertain-ment of the public and which require an absencefrom their normal military, duties for a period inexcess of 14 days, without the specific approval ofHeadquarters, Department .of the Army, in eachcase.

48. Medical care. a. General. A member ofthe Army on active duty or active duty for train-

ing usually will be required to submit to medicalcare considered necessary to protect or maintainthe health of others, to preserve the member's life,or alleviate undue suffering by the member. Acommanding officer may, with the concurrence ofthe medical treatment facility commander, orderthe h capitalization of any member of his commandor order him to submit to a physical examinationwhen indicated.

b. Explanation of term. Medical care, as usedin this paragraph, means preventive, diagnostic;therapeutic, and rehabilitative medical, surgical,psychiatric, and dental procedures.

c. Medical care performed with or without themember's permission. Under the following cir-cumstances medical care may be performed withor without the member's permission:

(1)'Emergency medical care which is re-quired to preserve the life or health of the

directives).(3) Isolation and quarantine for cases of sus-

pected or proven communicable disease,when appropriate.

,- (4) Detention on closed wards when neces-sary to insure appropriate medicalsupervision or to protect the member orothers from harmful acts.

(5) Medical care related to the mental dis-orders of members who have been foundincompetent by a medical board, or whenbelieved to be incompetent and pendingmedical board action, provided life orhealth is not-likely to be endangered bysuch procedures or care. These membersmay also be given routine medical carenecessary to treat minor ailments.

d. Refusal to submit to medical care other thancare described in c above. A member of the Armyon active duty or active duty for training whorefuses to submit, or whose court appointedguardian or other legal representative objects, torecommended medical care will be referred to amedical board (AR 40-3). When a member re-fuses to submit to recommended care because ofreligious beliefs, a chaplain will be appointed asa member of the board.

(1) The examining medical board's reportshould contain answers to the followingquestions:

(a) Is the proposed treatment required to- relieve the incapacity and restore the

individual to a duty status, and may itbe expected to do so ?

(b) Is the proposed treatment an estab-lished procedure that qualified and ex-perienced physicians ordinarily wouldrecommend and undertake ?

(c) Considering the risks ordinarily associ-ated with the proposed treatment, themember's age, and general physical con-dition, and his reasons for refusingtreatment, is the refusal reasonable orunreasonable or in the case of an in-competent member, is compulsory treat-ment warranted ?

(2) In determining whether refusal of medi-• cal treatment, .including surgery, is rea-

sonable or unreasonable, the board shouldconsider, among other tilings, the existingphysical or mental contraindications,previous unsuccessful operations and pro-cedures, and any special risks. Generally,the refusal of medical care may be con-sidered as unreasonable in the absence ofsubstantial contraindications.

(3) The report.of the medical board proceed-ings will show the need and risk of therecommended-medical.care which is re-fused by the member. A member who isbelieved to be incompetent or has been so

.determined by a medical board will beaided by an appointed counsel ,who neednot be legally qualified, who may appearin his behalf.

(4) Tlie report of the medical board proceed-ings will show that the member was giventhe opportunity to appear in person, ifhis condition so permitted, or that themember was afforded an opportunity to

. submit a written statement explainingthe grounds for his refusal. Any state-ment submitted will be forwarded withthe report.

(5) If .the approved,findings of the examin-ing medical board are that the proposedmedical care is necessary for the protec-

tion of the health, of the member andothers or to enable the member properlyto perform his duties and normally willhave this effect, such findings must bemade known to the member and he willbe afforded the opportunity to accept theprescribed medical care. If the memberstill persists in his refusal, the medicaltreatment facility commander will for-ward tlie medical board proceedings toThe Surgeon General, ATTN: MEDPS,Department of the Army, Washington,D.C. 20315, for review. In those caseswhere the refusal to submit to the pre-scribed medical care is based on religiousgrounds,'The Surgeon General will referthe medical board proceedings to theChief of Chaplains for review prior toaction. The Surgeon General will indi-cate his approval or disapproval of themedical board proceedings and returnthem to the medical treatment facilitycommander. If The Surgeon General ap-proves the medical board proceedings, themember will again be afforded the oppor-tunity to accept treatment. If the mem-ber persists, in refusing the proffered

- medical care, the medical treatment fa-cility commander will refer the matter(including copies of the medical boardproceedings) to the appropriate CCXNUSArmy or major oversea commander. TheCONUS Army or major "oversea com-mander will determine whether the mem-ber will be ordered to submit to the rec-ommended'medical care. b. Commanding officers of units or installations,upon receipt of written complaints or accusationsagainst military personnel, will take the actionindicated below. All complaints will be acknowl-edged.

(1) Forwarded from higher headquarters.When final action on a complaint receivedfrom higher headquarters for investiga-tion and report of findings is completed,the complaint accompanied by the reportof investigation will be returned to theheadquarters from which received. Un-less higher headquarters has indicated adesire to reserve decision on the disposi-tion of the complaint or accusation pend-ing receipt of report of investigation, thecase will be disposed of at the lowest levelhaving authority consistent with thegravity of the case. Where higher head-quarters has reserved the right of ap-proval on the disposition of the case, thereport of investigation will be returned-and final action withheld pending dispo-sition ' instructions. Higher headquar-ters normally will reserve the right offinal disposition only in cases involvingcomplex issues or of such a nature thatthe commander desires, in the interest ofjustice and morale, to insure uniformhandling throughout the command.Complaints received after a service mem-ber has been transferred and which indi-cate investigation is warranted by thenew commanding officer, will be for-warded to the current organization of theservice member if the latesfassignment isavailable. If the service member has de-parted on orders for oversea duty or onorders to return to CONUS, and his cur-rent organization is not known, the com-plaint will be forwarded to the command-ing officer of the service member con-cerned in format' indicated in paragraph36rf. The headquarters from which thecomplaint was received will be advised ofthe referral.

(2) Received initially by units or installa-tions,

(a) When warranting investigation. The

complaint will be investigated and ap-propriate action taken. Complaintsreceived after a service member hasbeen-transferred and which indicate in-vestigation is warranted by the newcommanding officer, will be forwardedto the current organization of the serv-ice member if the latest assignment isavailable. If the service member hasdeparted on orders for oversea duty oron orders to return to CONUS, and hiscurrent organization is hot known, thecomplaint will be'forwarded to thecommanding officer of the service mem-ber concerned in the manner indicatedin paragraph 36c2. The complainantwill be advised of the referral.

(b) When not warranting investigation.If in the opinion of the commandingofficer the complaint is of insufficientimportance to require an investigation,the statement "does not warrant inves-tigation" will be recorded on tlie com-plaint and the initials of the command-ing officer or a responsible officer desig-nated by the commanding officer will beplaced after the statement. The com-plainant will be advised that a deci-sion has been made that further actionon the complaint is not warranted.Such complaints will be retained for aperiod of 90 days and then destroyedunless further correspondence relativeto the complaint, warranting actionthereon, is received.

(3) Concerning retired personnel not on ac-tive duty. Complaints or accusationsagainst retired personnel • not on activeduty normally are outside the responsi-bility of the Army. Upon receipt ofwritten complaints or accusations againstsuch personnel, reply will be made thereto

. advising that such matters are outside. the responsibility of the Department of

the Army and should be pursued throughthe civil courts. -As an exception, uponreceipt of a complaint or an accusationof fraud against the Government, or ofengaging in prohibited procurement

Section VI. DETERMINATION OF PRECEDENCE AND DATE OF RANK

53. Commissioned officers, a. Precedence orrel-ative rank. Title 10, U.S.C., section 3571, pro-vides the general rule for determination of pre-cedence among all commissioned officers of theArmy serving on active duty in the same grade,whether temporary or permanent.. Among offi-cers of the same grade in active military service,including retired officers on active duty, precedenceor relative rank is determined, except in case ofspecial assignment made by the President, asfollows:

(1). By date of rank. .(2) When dates of rank are the same, by

length of active Federal coin missionedservice in the Army.

(3) When dates of rank and active Federalcommissioned service in the Army are thesame, Regular Army officers will takerank among themselves in accordancewith their promotion list positions, pre-ceding officers of the Anny NationalGuard of the United States, U.S. ArmyReserve, Army of the United States, andretired officers on active duty who willtake rank among themselves according to

^ age. Promotion list positions for Regu-lar Army officers are determined in ac-cordance with title 10, U.S.C., section3574. Active F e d e r a l commissionedservice in the Army includes all timeserved on active duty or active duty fortraining as a commissioned oflicer in theFederal service and service performedunder title 32, U.S.C., sections 502-505;and for other than Regular Army officers,also includes total number of days cred-ited in any commissioned grade forpoints earned in the manner prescribed inZ*(2)(e) below.

b. Date of ranlc.(1) The date of rank of an officer on the active

list of the Regular Army is the date ofrank stated in'his commission or Head-quarters, Department of the Army orders.

(2) The date of rank of an officer of the ArmyNational Guard of the United States,'U.S. Army Reserve, or Army of tlieUnited States, entering on active duty oractive duty for training in any commis-sioned grade, precedes the date on whichthe officer enters on active duty by aperiod computed by adding:

(a) One year for each qualifying year forretirement, under title 10, U.S.C.,section 1332(a)(2), earned after 30June 1955 in the grade (without re-gard to component) in which orderedto active duty or higher grade. SeeAR 140-185 or NGR 23, as applicablefor procedure for establishing retire-ment years. Fractional years are notcreditable under this subparagraph.

(b) For officer entering on active duty after29 June 1960, the elapsed portion of theretirement year during which he enterson active duty, provided the total num-ber of points earned in his current orhigher Reserve grade during such.period equals the minimum prescribedin appendix II, AR 140-185, for thatportion of a qualifying year for retire-ment.

(c) All periods of active duty in tlie mili-tary service of the United States, per-formed in the grade in which orderedto active duty or a higher grade, thatare not credited to him under (a) or(b) above.

(d) The periods of service performedtinder title 32, U.S.C., sections 502-50D,in his current grade or higher grade,

(e) One day for each retirement point fordrill or equivalent instruction, earnedafter 30 June 1955 in his current orhigher grade, that is not credited tohim under (a), ( b ) , ( c } , or (d) above.

(3) The date of rank of an ROTC cadetgraduating in 1965 or later who acceptsappointment in the Reserve, under theprovisions of title 10, U.S.C., section 2106or 2107, in May or June of any year, willbe the date of graduation of the U.S. Mil-itary Academy class of that year. Thispolicy applies whether appointee gradu-ated during the 2-month period indicatedor earlier in the school year..

(4) The Regular Army date of rank of anROTC cadet graduating in 1965 or laterwho accepts appointment in the RegularArmy, under the provisions of title 10,U.S.C., section 2106 or 2107, in May orJune of any year, will be the date ofgraduation of the U.S. Military Academy

class of that year, whether or not the in-dividual graduated during the 2-monthperiod indicated or earlier, and whetheror not .he was serving on active dutyunder a'Reserve appointment at time ofacceptance of appointment in the Regu-lar Army. In the event he did not ac-cept his appointment in the RegularArmy until after 30 June, but was onactive duty with date of rank determinedunder (3) above, such date will be liisdate of rank in the Regular Army.

(5) The date of rank of a retired officer uponbeing ordered into the active militaryservice is the date of rank stated in Head-quarters, Department of the Army ordersplacing him on active duty. .Such dateof rank is computed by adding to thedate of rank at time of retirement theperiod of time between the date of retire-ment and the date of return to activeduty. In case of additional periods ofinactive service, the date of rank will beadjusted further in accordance witli theforegoing procedures.

John Doe accepted appointment as second lieutenant, USAR, 8 June I960. He entered on extended active duty14 November 1960, was promoted to the temporary grade of first lieutenant, AUS, 14 May 1062, and was relieved fromactive duty 13 November 1962.' He was promoted to first lieutenant, USAR, 14 November 19G2. His unbroken serviceas first lieutenant for the retirement year 8 June 1962-7 June 1963—AUS and USAR, with at least 50 days activeduty during that period entitle him to full credit for the retirement year in the grade of first lieutenant. He earneda total of 53 retirement points for the following retirement year. For retirement year ending 7 June 19G5 he earned47 retirement points—17 assemblies, 15 days active duty training (25 July 1964 to 8 August 1964) and 15 retirementpoints for.membership; however, membership points are not creditable unless with other points earned they total 50points or more. For the elapsed portion of the retirement year in which he was ordered to active duty in the grade offirst lieutenant he earned 10 retirement points, which meets the minimum requirements for credit for a partial year ofthat length—2 months, 18 days (app. II, AR 140-185). He entered on current tour 26 August 1965, with date ofrank computed as follows (periods of 30 days or less ore computed to credit calendar days service; over 30-day periodsare computed on a 30-day basis) :

b. Date of rank.(1) The date of rank of a warrant officer on

the active list of the Regular Army is thedate of rank stated in his warrant, pro-motion order, or letter of appointment.

(2) The date of rank of a retired warrant of-ficer or a warrant officer of the Army Na-tional Guard of the United States orU.S. Army Reserve serving on activeduty or active duty for training with anactive Army unit is a date preceding thedate of entry on active duty by a periodequal to the total prior service creditable.This service will be computed in the samemanner as prescribed for commissionedofficers in paragraph 536(2) subject tothe following conditions:

(a) Prior service as a warrant officer, W-l,and service as chief warrant officer,prior to 1 October 1949, or as a chiefwarrant officer in pay grade W-2 there-after, will be counted as service as achief warrant officer, W-2.

(b) No warrant officer service prior to 1October 1949 will be counted as serviceas a chief warrant officer, W-3, or chiefwarrant officer, W-4. Service as achief warrant officer in pay grade W-3will be counted as service in thisgrade, and service as a chief warrantofficer in pay grade W-4 will be countedas a chief warrant officer, W-4.

(c) Service as a commissioned officer willbe counted as service in the warrant of-ficer grade in which ordered into theactive military service.

(d) In no event will the date of rank com-puted under this paragraph be earlierthan 1 October 1949.

(3) Tho date of rank upon appointment orpromotion to a temporary warrant officergrade on active duty is the date cited inthe order announcing the appointment orpromotion. Such dates of rank will notbe adjusted to reflect prior service in thegrade to which appointed or promotedor in a higher or comparable grade in anyof the armed services except that:

warrant officer serving on active dutyas a commissioned officer who revertsto his warrant officer status will be ad-justed in accordance with paragraph7, AR 624-100.

(b) The date'of rank of an AUS warrantofficer serving on active duty as a com-missioned officer, who reverts to war-rant officer status, and whose reversionto warrant officer status was providedfor in connection with his acceptance ofactive duty as a commissioned officer,will be his former date of rank.

55. Enlisted personnel, a. Precedence or rela-tive rank. Among enlisted personnel of the samegrade in active military service, including retiredenlisted personnel on active duty, precedence orrelative rank is determined as follows:

(1) According to date of rank.(2) When dates of rank are the same, by

length of active Federal service in theArmy.

(3) When (1) and (2) above are the same,by length of total active Federal service.

(4) When the foregoing tests are not suffi-cient, by age.

b. Date of rank.(1) The date of rank in grade of an enlisted

person of the Army who has not had abreak in service is the date indicated inthe warrant or instrument of appoint-ment. Former first sergeants who wereredesignated master sergeants on 1 Sep-tember 1942 and who have had no breakin service, will take rank from that date.

(2) The date of rank upon reenlistment aftera break in service not in excess of 3months in the case of a former enlistedpersonnel or 6 months in the case offormer officers or warrant omcers entitledto reenlist under title 10, U.S.C., section3258, is a date preceding the date of en-listment by a period equal to the amountof service in the same or higher gradeperformed subsequent to appointment tothat or higher grade. In computing dateof rank upon reenlistment, no serviceprior to a break in service in excess of3 months in the case of former enlistedpersonnel or 6 months in the case offormer officers or warrant officers, nor

service prior to service in a grade lowerthan that in which reenlisted, will becredited. The date of rank in such casesis the date of reenlistment.

(3) Date of rank upon promotion to a higherpay grade is the date of promotion.

(4) Date of rank upon appointment to agrade within the same pay grade is thedate held in the grade from which ap-pointment is to be effected. Dates of rankof noncommissioned officers previouslyappointed from specialist grades withinthe same pay grades will be adjusted toreflect the dates of rank held in such spe-cialist grades.

(5) Date of rank in the grade to which re-duced for inefficiency or failure to com-plete a school course is the date whichwould be the date of rank if the individ-ual had never attained a grade higherthan that to which reduced.

(6) Date of rank upon reduction for reasonsother than inefficiency or failure to com-plete a school course is the effective dateof reduction. (See AR 27-15 when in-dividual is reduced under article 15, Uni-form Code of Military Justice.)

(7) Date of rank upon restoration to a gradefrom which reduced following successfulappeal of the reduction, is the date heldprior to reduction. (See AR 27-15 whenindividual was reduced under article 15,Uniform Code of Military Justice.)

(8) In the case of former officers or warrantofficers (without prior enlisted service)who enlist within 3 months following re-lief from active duty from commissionedstatus, the date of rank will be the dateon which the officer last entered on a tourof active duty, adjusted by the time in-tervening between date of separation asan officer and date of enlistment.

(9) Date of rank upon initial enlistment inthe Regular Army in permanent gradeE-2 will be date of enlistment.

(10) Date of rank upon permanent promo-" tion to private first class, E-3, will be
