Those slow drivers who drift out of their lanes may become a little less frequent after Tuesday,
when Gov. Rick Scott plans to sign into law a measure banning texting while driving.
Scott is scheduled to sign the bill during a ceremony this afternoon at Alonzo and Tracy
Mourning Senior High School in Miami, according to an advisory from the governor's office.
Florida will become the 41st state to ban the practice. It's been an embarrassment that the
state of Florida for all these years had no law on the books on texting while driving," said state
Rep. Lori Berman, D-Delray Beach.
Scott said it would make the state's roads safer. "As a father
and a grandfather, texting while driving is something that
concerns me when my loved ones are on the road," he said
in a statement.
Still, the new law isn't especially tough, Berman said earlier
this month in an appearance at the Voters Coalition in
Palm Beach County. "They took a lot of the teeth out of
it."
The ban is a secondary offense, which means police can't
pull over someone for texting while driving. A driver must
be stopped for something else to get cited for texting while
driving. And billing records, which would prove the driver
was texting, can only be accessed if there's been a crash

New rules could
take the pain out

Punishment for a first violation is a $30 fine plus court
costs. A second violation within five years carries a $60 fine
plus court costs.
The new law will ban operating a motor vehicle "while
manually typing or entering multiple letters, numbers,
symbols, or other characters into a wireless communications device or while sending or
reading data in such a device for the purpose of non-voice interpersonal communication,
including, but not limited to, communication methods known as texting, emailing and instant
messaging."
The distracted drivers won't disappear. It will still be legal to talk on a cellphone.

The question I have is, this topic has been in front of our legislatures before so, why didit take so long to do this? We are the 41st state to enact this law and that is a shame. Iguess they were waiting for more deaths to prove texting was dangerous..Hmmm.

but still ok to do following that I have seen on roads: fumble with radio/stereo; turnaround and yell at kid(s) in back seat, read, shave, put on make up, eat, smoke weed,drink alcohol...great country where we have to legislate common sense...
