HERITAGE LAKE PARK COMMUNITY DEVELOPMENT DISTRICT PUBLIC FACILITIES REPORT

JANUARY 2017

1. Provide a description of existing public facilities owned and operated by the special district. This description should include the current location, capacity, and current demands placed on the facility.

The Heritage Lake Park Community Development District (the "District") currently owns and operates the community clubhouse/pool property and parking lot, streets, street lighting, master stormwater management system, master irrigation system, perimeter landscape buffer areas, and entry gates/guard house throughout the District which is located within Section 17, Township 40 South, Range 23 East, in Charlotte County, Florida.

The current capacity of the District's facilities is not quantifiable, but the facilities appear to have been constructed in conformance with the community's design and construction permits with all facilities currently considered to be operating at acceptable levels. The community is estimated to be approximately 80% - 85% developed, but the master roadway, utility, and drainage infrastructure is complete at the present time.

2. Provide a description of each public facility the District is building, improving or expanding, or is currently proposing to build, improve, or expand within seven years. For each public facility identified, describe how the District currently proposes to finance the facility.

The master roadway, utility, and drainage infrastructure located within the District is fully developed with no plans for construction, improvement, or expansion at the present time.

3. If the special district currently proposes to replace any of the facilities identified in Paragraph 1 or 2 within the next ten years, then a date for scheduled replacement of said amenities shall be provided.

There are currently no plans to replace any District facilities within the next 10 years.

4. Provide the anticipated time the construction, improvement or expansion of each facility will be completed.

The master roadway, utility, and drainage infrastructure located within the District is fully developed with no plans for construction, improvement, or expansion at the present time.

5. Provide the anticipated capacity of and demands of each public facility when completed. In the case of an improvement/expansion of a public facility, both the existing and anticipated capacity shall be listed.

The District's facilities have been sized for the District's needs, based on their current operations. The master roadway, utility, and drainage infrastructure located within the District is fully developed with no improvement and/or expansion currently planned.

INTRODUCTION

Heritage Lake Park Community Development District (the "District") encompasses approximately 91 acres within the unincorporated area of Charlotte County, Florida commonly known as Port Charlotte. The District was established for the purpose of financing and managing the acquisition, construction, maintenance and operation ofthe infrastructure necessary for the community development within the District. The District is located in Section 17, Township 40 South, Range 23 East. The District is located east ofl-75, south ofRampart Boulevard and west of the Deep Creek Subdivision.

The current plans for the District include approximately 470 Residential Units. The project is currently planned for 3 -·· 18 unit condominium buildings, 8 - 24 unit condominium buildings, 20 - 4 unit, 2story villa buildings and 36 - 4 unit attached villa buildings. The project currently has multiple zoning classifications, and is proceeding through a Charlotte County re-zoning for a Planned Development (PD) classification. The initial phase of the project is zoned to allow the development as planned. The projected build out for the development is year-end of 2008. Primary access to the District is via Kings Highway and Rampart Boulevard. The main focus of this report is the infrastructure improvements funded by the Special Assessment Bonds.

HLP Holdings, LLLP, HLP I, LLC, and HLP II, LLC and the District have secured Charlotte Engineering Sports Group III, Inc. to provide the professional site civil engineering services for the proposed improvements. The contract(s) for the construction ofthese improvements is pending at this time. The scope ofwork includes both on-site and off-site master infrastructure, including earthwork, wastewater collection, water distribution, roads and the stormwater management / drainage system. The on-site and off-site inftastructure improvements are proceeding through the local, regional and state approval process; and have been sized to accommodate Heritage Lake Park at build out.

GOVERNMENTAL ACTIONS

The District was established by the Charlotte County Board of County Com.missioners on June 22, 2004. At the present time, the project has received a Charlotte County Preliminary DRC Approval for Phase I and an ISA Pennit from the Southwest Florida Water Management District. Please refer to Appendix A for a tabulation of the site development permitting/approval status as ofJuly 26, 2004.

Based on meetings with the applicable Charlotte Cowity departments associated with the local site development approval process and the Southwest Florida Water Management District's issuance of the ISA Permit, it is my opinion that there are no technical reasons existing at this time which would prohibit the implementation of the site development plans and the associated opinion ofestimated project cost for the District as currently prepared. This opinion assumes that the pending pennits / approvals / conditions will be consistent with the current plans; and implementation will be in compliance as well.

STORMWATER MANAGEMENT

Charlotte County and the Southwest Florida Water Management District (SWFWMD) regulate the design criteria for the District's storm water management system. During the SWFWMD permitting process, the project's pre-development runoff rate and flow characteristics, along with the hydrological requirements of the existing on-site wetland systems were defrned.

The proposed stormwater management system for the District will utilize newly constructed ponds along with the reconstruction/enhancement of the existing onsite wetlands for stormwater treatment and attenuation. The final discharge will essentially be in a "sheetflow" format, across the southerly property line, as the site has discharged historically. The District will be responsible to regularly monitor and maintain the discharge/outfall structure, as well as all other components of the system.

The primary objectives of the storm water management system for the District are:

I. To provide a stormwater conveyance and storage system which includes storrnwater quality treatment.

2. To provide adequate flood protection within the District from the 25 year/24 hour regulatory storm event.

3. To insure that adverse stormwater impacts do not occur upstream or downstream as a result of the development.

4. Satisfactorily accommodate storm water runoff from adjacent off-site areas which naturally drain towards the District.

The stormwater colle1,-tion system and outfall system for the project will be a combination of swales, inlets, pipes, ponds/wetlands, control structures and a "sheetflow'' outfall structure. It is not contemplated that other infrastructure improvements are required for this system to operate as designed.

WASTEWATER COLLECTION

The District is within the unincorporated limits of Charlotte County with wastewater treatment service to be provided by Charlotte County Utilities (CCU). The current wastewater collection design has been prepared in coordination with the engineering staff at Charlotte County Utilities. The District's sanitary sewer system will consist ofon-site 8" gravity mains, service laterals, appurtenant manholes and one (1) pumping station. The District will need to construct an off-site 8" force main that will run west and then southerly, connecting to an existing CCU force main. It is not contemplated that other infrastructure improvements are required for this system to operate as designed.

WATER DISTRIBUTION SYSTEM

The District is within the unincorporated limits of Charlotte County with potable water distribution service to be provided by Charlotte County Utilities (CCU). The District will be served from an existing 12" potable water main located on Rampart Boulevard. The District's potable water distribution system will be constrm,ied with proceeds from the Bonds. The potable water distribution system will consist of 12" and 8" water mains with appurtenant valves and fire hydrants. It is not contemplated that other infrastructure improvements are required for this system to operate as designed.

ROADWAYS

Vehicular access to the District is provided from Rampart Boulevard. Currently, Rampart Boulevard is a two-lane rural roadway section, running east/west; with Kings Highway serving as the main arterial to the west.

The internal road design for the District will comply with current Charlotte County roadway design criteria. There are no internal roads that are planned to be stubbed-out from the District to adjacent properties. The District plans to construct and acquire the entry feature improvement and landscaping along Rampart Boulevard as well as landscape buffer areas throughout the project with proceeds from the Bonds.

RECREATIONAL AREA AND COMMUNTIY CENTER

The District plans to construct a recreational and community center between 2 lakes. The community center is designed with approximately 5,000 sq. ft. under roof with a grand room, kitchen, game room, play room, grand hall, men's and women's restroom, office storage and large lanai. Additionally, the recreation area around the community center will contain a swimming pool, tennis courts and shuffleboard.

UNDERGROUND AND STREET UGHTING ELECTRICAL SYSTEM

The District lies within the area served by Florida Power and Light Company service area. FP&L will provide underground electric service to the site from lines within the public right-of-way ofRampart Boulevard. It's our understanding that the District's internal electrical distribution system will he constructed with proceeds from the Bonds and will consist ofunderground cable with appurtenant transformers and service pedestals.

PROJECT COSTS

The Opinion of Estimated Project Site Development Costs, Appendix B attached hereto, outlines the anticipated costs with the construction of the infrastructure for the District. The project's identifiable costs are associated with the abovementioned infrastructure improvements.

SUMMARY AND CONCLUSION

The infrastructure, as outlined in this report, is necessary for the functional development of the District as required by the applicable independent unit oflocal government. The planning and design ofthe infrastructure will be in accordance with the applicable governmental regulatory requirements. The infrastructure will provide their intended function so long as the construction is in substantial compliance with the final design and associated permits/approvals/conditions.

Items of site construction in this report are based on current plan quantities for the site infrastructure construction as shown on the plans as of July 26, 2004.

It is my professional opinion that the infrastructure costs provided herein for the District improvements are reasonable to complete the construction of the infrastructure described herein, and that these infrastructure improvements will benefit and add value to the District All such infrastructure costs are public improvements or community facilities as set forth in Sectionl90.012 (l) and (2) of the Florida Statutes.

The Opinion ofEstimated Project Site Development Costs is only an estimate and not a guaranteed maximum price. The estimated costs are based on unit prices currently being experienced for ongoing and similar items of work in Charlotte County and quantities as represented on the current construction plans. The labor market, future costs of equipment and materials, and the actual construction process are all beyond my control. Due to this inherent opportunity for fluctuation in costs, the total final cost may be more or less than this opinion of costs.

The professional service for establishing this opinion of costs is consistent with the degree of care and skill exercised by members of the same profession under similar circumstances.
