Summary of Problems

• Legal frame work exists; but application is weak, • Many projects are top down approached• Mistrust of stakeholders towards (governmental)

authorities• Extreme fragmentation of land ownership• Lack of appropriate instruments for land acquisition• Compensation for imposed restrictions on land use to

farmers is not existing or very limited• Implementing land use tools are hampered due to lack of

proper registration of legal ownership rights

Possible Solutions

• Start with small scale, low level land pilot projects• Enlarge compensation payments to farmers in case of

restricted land use• Apply bottom of process from the start, included

awareness raising• Establish well functioning cadastral service, make it up

dated and reliable• Start up a (small scale) land bank• Proper registration of ownership: a precondition for land

banking,land consolidation, other land use tools

• Use water act as legal tool, but only with proper compensation facilities

• Provide sufficient financial means to start a land bank• Expropriation (sensitive issue)• Establish an authority “to do the job” that is:
