    voluntary basis. Editorials reflect the opinions of the

    staff and are not construed as representative of the general

    membership of the Association.

    The Herald welcomes comments, suggestions and articles

    BOARD OF DIRECTORS MEETING MINUTES - November 17, 2014

    Te monthly meeting o the Board o Directors o Highland Lakes Condominium Association was held on the thirdMonday o the month, in accordance with the By-Laws o the Association. Vice President Michelle odorov calledthe November 17, 2014, regular meeting of the Board of Directors to order at 7:30 p.m.

    Attendance

    Te ollowing Directors were present: Kathy Baldwin, Michelle odorov, om Byrne, Sandy Nolan, Guy Balok, andJudy Nakdimen. (Kathleen Connor was excused). Also present was Joe Poma, Property Manager. Approximately 6

    Approval of Minutes:Minutes o the October 20, 2014 regular meeting o the

    Board o Directors.

    Board Action: Motion by om Byrne, support by JudyNakdimen, to approve and file the Minutes o the

    October 20, 2014 regular meeting o the Board oDirectors. All in favor. Motion passed.

    reasurers Report

    om reviewed the October financial statement.

    It is the first month o the new fiscal. We are avorable by

    a couple thousand dollars.Tere are no accounts that are particularly noteworthy

    that would lead us to believe that we have run off course.

    In closed session the Board discussed a ew units that arebeing moved on with oreclosure due to the amount omoney that is owed.

    Accounts receivable is in as good a shape as it has beenin the last 6 years. Joe has managed through this prettywell.

    By oreclosing on the units, we should be able to take over

    the lesser mortgage and sell the units at a profit, takinginto account current market values, thus netting ouo.k. and overtaking the assessments that are in arrears.

    Court Captain Committee Report:See page 10

    Joel Lutz reported to the Board.Joe Poma, Property Manager, commented on the

    committee report, clariying how new residents areinormed o the bylaws. Historically, the bylaws and co-owners manual were handed down to the new owneror new documents could be purchased at the ront deskor $25. Te documents are now available or ree on thewebsite (www.hlca.us) and co-owners are bound by themregardless o receipt. Joe stated that he knows o everysale that takes place due to requests or status letters andcondo certs so long as a lending institution is involved. I

    its a cash sale, it is harder to track. Engineering violationsare acted on immediately, and not just at the point osale, but the ailure o a ew residents to ollow the rulesremains a problem.

    Clubhouse Committee Report: See page 11Judy OConnor reported to the Board.

    Welcome back, Judy Alessandri and thanks to JudyNakdimen or re-shelving books.

    Joe asked i the committee reports were being transcribed

    correctly using the proper wording. Judy confirmedthat they were. Michelle asked as to a date or the un-decorating party. Judy stated that it was January 3rd.

    Board Action: Motion by Judy Nakdimen, supporby Guy Balok, to accept the Clubhouse Committeereport dated November 3, 2014. All in favor. Motionpassed.

    Joe stated that he was at the Engineering Committeemeeting and could speak as to the committee report inthe absence o om Werner.

    Recommendations to the Board: Approve items 2-8 asmeeting HLCA guidelines. able item #1 or lack oproper paperwork and drawings.

    Community Social Committee Report:Verbal

    Michelle odorov reported to the Board. Te Youth andCommunity Social Committees are reminding everyonethat they are helping the Clubhouse Committee todecorate the clubhouse. She also reminded everyoneabout the Bell Choir, Adult Christmas Party and aGingerbread Decorating Party that is being sponsored

    by both the Community Social and Youth Committees.Tere will be a party, contest and 10 houses that theyare helping to decorate along with gingerbread peoplerom 9:30 to 11:30 on December 13th that people maytake home aferward.

    Co-Owner Forum

    Resident from Savoy Court - a resident rom Savoy Courtstated that he had received a notification o fines andpenalties as a result o a supposedly hazardous fireplace.He said that he strenuously objects to them. He doesnot oppose the right o the Association to go into any

    condominium and veriy that it is sae and up to code,nor does he object that the Association notified him o ahazardous situation and urther stated that he promptlyturned off the gas supply to the fireplace. He said that hehad no problem doing repairs that were brought to hisattention. Te resident showed the Board pictures o thefireplace as it was and the way it is now. He explained theprocess by which he installed wood around the perimeterto a depth o 9 inches around the fireplace, and finishedit with drywall and tiles. He then showed the Board acopy o the receipt or the materials dated March o 2010,stating that he had purchased the tiles on that date. Te

    resident and his wie have owned the condominium sinceabout 2009. Te fireplace was part o the renovation othe condominium. Michelle asked i the repairs weredone prior to the proeprty-wide inspection o all othe fireplaces and the resident said that they were. Teresident said that they moved into the condominiumaround Memorial Day o 2010. Shortly thereafer, heclaimed that they received notification that the fireplacewould be inspected, and it was inspected in the presenceo his wie and passed inspection. Te resident said thatthe work to the fireplace was completed by Memorial Dayand the inspection took place afer. Afer the work was

    complete, the resident noticed that there were loose tilesaround the fireplace and contacted contractors to have itrepaired and also to install a new gas log set. He said thattwo contractors said that they had no problem repairingthe fireplace. Shortly afer that, he said that his wiereceived a phone call rom the Property Manager statingthat the fireplace was dangerous and needed repairs. Shesaid that the fireplace had already been inspected andthat it passed inspection. Te resident stated that hesubsequently was also contacted by the manager.

    Michelle asked why the manager had contacted them.

    Te resident stated that he assumed it was because oneo the two contractors contacted him and notified himo a situation.Te resident stated that the contractor mayhave been good riends with the manager or maintenancesuperintendant. Joe stated that Ken (maintenancesuperintendant) orwarded an e-mail to him rom acontractor that had seen the fireplace and reused to dowork on it because it was dangerously constructed. Joe

    said that the fireplace bump-out was not in accordancewith the installation guidelines and was a hazard andsaid that he subsequently called the residents wie andinormed her o the issue. Joe claimed that the fireplacepassed inspection when it was inspected, but he was alsotold that the work was done afer the inspection. Hethen claimed that months had elapsed with no results onhis concerns and at that point, he contacted them againand ultimately orwarded the issue to the CorporateCounsels office. Te resident claimed that he thenagreed to hire an independent inspector to inspect thefireplace (Alex Mamo), whom he claimed had 30 years

    o experience as an inspector and was currently thebuilding inspector or the ownship o Canton. MrMamo came out, inspected the fireplace and the residentsaid that he agreed that it was sae, but also stated thathe was not very orthcoming in getting his report backTe resident gave the contact inormation to Joe and toldhim to call him i necessary. Te resident produced acopy o an inspection report dated September o 2014om asked why the report was dated in September, whenthe inspection was done long beore. Joe stated thatthe report was obviously based on an inspection doneafer repairs were made and not afer the pictures o the

    dangerous condition were taken. Te resident producedcopies o e-mails rom Joe that claimed that Mr. Mamohad no jurisdiction in Northville ownship to certiy thefireplace as sae. Te resident said that he is licensed bythe state to inspect homes. Te resident also produced hisresponse to the letter sent rom the Corporate CounselMichelle asked the resident to describe the repairs. Teresident stated that the marble / tiles surround the insideo the fireplace opening and a heat-resistant backerboardis behind them. He said that the original contractorneglected to use heat-resistant mortar, so the tiles cameloose once the mortar dried out rom the heat. He hired

    another contractor to fix the tiles. Joe asked the residenti there was a difference between the pictures that wereprovided to him earlier in the year versus those that wereproduced at the meeting and also whether the bump-ouis still there. Te resident said that the bump-out is stilthere. Joe stated that the legal counsel has told him thathe fireplace must be certified as sae and that is the goalom asked Joe whether the letter rom Alex Mamo wassufficient and Joe said that the problem is that Mr. Mamois not a licensed fireplace and chimney inspector in

    the State o Michigan and only a licensed inspector per themechanical engineers could certiy the saety o the appliance.Joe stated that he has no motive, reason or otherwise to putsomeone through something like this unless there is a saetyhazard to a unit or to the surrounding building and itsoccupants. Joe said that corporate counsel has stated that i alicensed chimney inspector certifies it as sae, that will resolvethe issue. Guy Balok spoke as to the UL rating and what it

    means or a fireplace appliance and Joe provided a copy o theoriginal fireplace installation manual. Te Board stated thatan indpendent and licensed fireplace and chimney inspectorshould certiy the unit as sae. Kathy said that i that was doneand they assumed the liability or doing so, then it would beaccepted. Joe then brought up the issue o legal ees and costsassociated with the matter that were on the residents account.He said that there was an invoice orthcoming o roughly $290and asked the Board what should be done about the charges.

    Te Board stated that they would have to talk about that alittle more and get back with the resident. Te problem withthe repairs as stated by the Association is that the bump-outconstructed around the fireplace does not meet the criteriaas outlined in the installation instructions and per the ULfire rating, and thereore is not a permissible contructionand violates the fire rating or this appliance. Only a licensedchimney inspector that inspects it and certifies it as sae, afer

    review o the installation manual may resolve the issue.

    MEEING DAE:November 6, 2014

    SUBJECS DISCUSSED:

    1. Joel brought up the kind o Emergency Plan that is in place in the event o a disaster in Northville ownship.Teir main concern is the Northville High School since that is where the largest concentration o population isduring the school year. One other serious concern was the possiblity o a train derailment that might be carryingflammables or toxins that could also be o concern in our community since the tracks are so close to our west end.

    2. It was also discussed i there was a possibility o reaching out to residents with health issues or who may be elderlyand living alone and not be able to help themselves in the event that an emergency should arise and residentsneeded to be evacuated.

    3. It was determined that the above is a sensitive issue and some thought about how we could assist those withoutinvading the privacy o our residents. Court Captains should be amiliar with the needs o some o their courtsresidents in such situations.

    4. Diane Pittaway investigated the question raised at the last meeting o whether new owners were getting inormationabout how to proceed when making condo improvements and changes. She reported that Joe explained to her thathe knows o every sale except ones by the owner. New owners are getting the inormation. Te problem is whetherthey choose to ollow the requirements. I co-owners violate and do not rectiy, at resale time they will have to fixor the bank will not okay a sale or loan.

    SUBJECS DISCUSSED:

    1. We welcomed back a new member Judi Alessandri who will be such a wonderul addition to our Committee.She has served in so any capacities here in Highland Lakes and this knowledge rom all her previous backgroundwill be such an asset to our Committee. Welcome Judi.

    2. A Tank you given to Judy Nakdimen or showing up and helping to re-shelve Library books on October 27,2014.

    3. Photos taken o the 2013 Clubhouse Christmas dcor were passed around and there was discussion o how wecan add and make our Clubhouse look terrific this year! We want everyone walking in, to Oooo and Ahhhhat how estive everything looks!

    4. A date o November 10, 2014 was set and a request or volunteers to go Christmas shopping or the Clubhousewas readily filled. (We went, and you just wait and see how happy youll be!)

    5. A reminder was given again that the decorating o the Clubhouse is open to all. Tis will take place the Saturdaybeore Tanksgiving at 1:00. We have always done this in conjunction with the Family Social Committee withpizza and pop being served once everything is done and we are all totally exhausted. I you havent been ableto join us beore, its really a relaxed and un afernoon, Cmon by!

    6. An announcement was made that this would be our last ormal meeting until the New Year, January 5, 2015

    COMMIEE: Lakes Ecology MEEING DAE: November 4, 2014

    Subjects Discussed:

    1. Discussion about who the committee members are, since only a ew were able to attend the meeting.

    2. Tere is an issue with the boat racks not having enough space or all the different types o water crafs. Some

    growth was removed on Silver Spring Lake adding more room or a new boat rack, but there is a stump impeding the

    construction that will need to be removed, but that cannot be completed until spring. Tere needs to be more specifics

    on cost and type o boat rack such as two tiers or three tiers. Construction cost could be between $1,000 and $2,000,

    with the average being $1,200. Committee came to a consensus that there needs to be more inormation beore making

    a decision.

    3. Te bylaws call or an election or the three elective posts: chair person, co-chair person, and secretary. Tere were

    not enough members present who were eligible to vote to hold an election.

    4. Te committee discussed when would be the next appropriate time to hold a meeting, whether to continue the

    meetings through the winter or wait until spring. Tey did not reach a consensus.

    5. Fertilizer runoff is an issue with ueling the growth o algae and seaweed. Different approaches were discussed in

    preventing the ertilizer rom leaching down into the lake.

    6. Gooseworks is chasing away the geese as necessary, but they cannot get them to leave because the geese nest on Swan

    Harbor properties, and the management and owners o Swan Harbor like the geese.

    7. A need or more members is a necessity. Te committee wants to do more recruiting to get more people involved

    Tere was some hesitation on whether or not that should be done now since it is late in the season and people are not

    thinking about lakes ecology.

    1. Te gutters and downspouts on the property are scheduled to be cleaned starting on November 17th. I you notice

    any waterall effect when it rains, they most likely missed a spot and although it doesnt happen ofen, we do have a

    warranty on their work that runs through April. Accordingly, please call the office i you suspect that your gutters

    are still ull o leaves.

    2. Te Lakes Ecology Committee will most likely be hosting a fishing seminar, taught by Highland Lakes resident and

    seasoned angler, James Jim Delaney. Jim has 60 years o fishing experience and has taken a scientific approach to

    catching fish that has been shared in proessional publications and discussions with proessional fishermen over the

    years. He said that people are ailing to use temperature, depth, color and a variety o other actors that come into

    play when catching fish. He will be teaching the seminar as it applies to our lakes specifically, including the entire

    ecosystem, bottom layout, and other things that will make you a better fisherman. Although he actually teaches aclass on fly fishing elsewhere, his experience extends to rod & reel / standard bait as well. Stay tuned or details on

    this event.

    3. We all know the snow is coming, so just a reminder to help protect the maintenance equipment by removing al

    dog leash cables, newspapers and other implements off the ground that could be hidden by the snow. When a

    snow tractor runs over newspaper, you get conetti. When it runs over a dog leash, we get a $500 repair bill and a

    potential injury. As in previous years, we have barrels o ice-melter by each entrance o the clubhouse. Grab a coffee

    can-ull and use it on your approach walks to prevent a slip & all. You will know i you are overdoing it i it clumps

    on the walkway; sprinkle it like salt, because its expensive or our snow budget.

    4. Remember that the clubhouse now has a flat screen V in the billiard room and in the sitting area near the poo

    doors. Te coffee is always resh, so eel ree to stop in and warm up.

    5. Te maintenance staff got quite a jump on the leaves this year, but the Maple trees and Willows drop last. Please

    be patient as we make our way around the property and get to your area. We will get as many leaves and twigs as

    possible beore the snow starts flying. Now is a good time to blow the leaves off o your patio also, but remember

    that they are not picking mulch bags up rom the trash corrals until spring, so do not place lawn and lea bags by

    the trash corrals.

    6. By the time you read this, it will be too late to wish you a Happy Tanksgiving, but the Clubhouse Committeeand Community Social Committee have become very adept at offsetting this cold weather by bringing you severa

    wintertime activities to get everyone out o the house and discover the true meaning o the holidays. Te Clubhouse

    Decorating Party is on November 22nd, the Belle Choir Sing-A-Long is on December 5th, the Christmas Party is

    on the 6th and the Gingerbread Decorating Party is on the 13th. Tere are movie nights planned or January and

    other events that will get us through the season. Go ahead and take pity on all o those that are stuck in the 80

    degree beach weather in Florida.

    Snow Removal Request FormHandicapped/Disabled List If you are in need of special attention with snow and ice removal, as

    a courtesy, the Association maintains a list of those Co-Owners and residents that need this service,

    forms can be obtained at the Clubhouse ofce.

    You must complete and return the Special Attention Form along with a copy of your handicap

    sticker that is displayed in your car. (We will make the copy for you.) Anyone with a permanent

    handicap plate will of course be on the list. However we will still need a completed form on le and

    we will need to know if this condition is a temporary or permanent condition. Additionally, those

    residents with permanent handicap plates will need to provide a copy of their vehicle registration.

    We cannot guarantee that Maintenance will be able to provide this special attention for every

    snow event; however, we will make every effort to do so.

    SNOWREMOVALPROCEDURES1. NORMALSNOWEVENTS:

    2-3 inches - Clearing will begin during the snowfall and maintenance will work normal hours

    following the established Snow Policy. 4 inches or more Maintenance will clear on weekends and at night following the Snow Policy.

    2. LARGESNOWEVENTS:6 inches or more - Maintenance will begin clearing main sidewalks and trafc lanes during the snowevent. If necessary, they will continue the removal effort until 10:00 p.m. The next morning they willbegin a second clearing effort and work until all walks and courts are cleared, or until 8:00 p.m.

    3. SNOWEMERGENCIES/BLIZZARDS:More than 10 inches - Efforts will be focused on keeping main roads, trafc lanes and main sidewalksopen to emergency trafc only. Once those elements are clear, work will begin on approach sidewalksand courts. Maintenance will work up to 14 hours per day, until the roads, courts and walks areclear. Contractors may be called in if necessary. The priority treatment of the handicapped list will besuspended during these events. Exceptions for emergencies will be handled on a case basis.

    4. PARKINGSPACES:After the primary snow removal efforts are completed, maintenance will begin clearing parkingspaces if cars are out of the court. Management encourages Court Captains to facilitate the removal of cars and contactthe Clubhouse to advise when their court is clear and management will then contact maintenance to begin plowing theparking spaces within that court. If maintenance is ready to plow a court, the Association may also contact the courtcaptains to facilitate the movement of parked vehicles.

    5. OVERALLGOAL:The Association shall have the sidewalks, courts (not parking spots), and roads, clear within 48 hoursof the cessation of a snow event.

    6. HAZARDOUSCONDITIONS:During the winter, the weather conditions favor the potentialfor slippery sidewalks, porches and roads. Please use due care and caution duringthis time of the year and keep a supply of ice-melter, which is available at theClubhouse, at your home for your use.

    During the weekend, how much snowfall is required before maintenance will be called in?ANSWER: 4 inches or more measured in more than three areas on the property.

    Why does my court seem to be last during the recent snowfall?

    ANSWER: To attempt to bring some semblance of fairness, the starting point of snow

    removal efforts change each time.

    Why does it seem to take so long to clean my parking spaces?

    ANSWER: Maintenance depends on the cooperation of the Co-Owners to empty the courts of carsbefore plows can safely plow the spaces. The plows cannot t in between parked cars.

    Why did Maintenance leave a small amount of snow on the sidewalk this time?

    ANSWER: Leaving a small amount of snow provides traction to more safely walk.

    Why does the Association have an adopted snow policy?ANSWER:(A) To keep our Co-Owners informed of what to expect from the Association

    (B) It is required as part of our Risk Management procedures.

    How long should it take Maintenance to completely nish snow removal efforts?

    ANSWER: 48 hours or less depending on the weather and the amount of snow.

    In what order, and when, is snow blowing and plowing handled?

    ANSWER: FIRST DAY SECOND DAY
