Directions to Tenderer for filling in the Schedule of Quantities and Rates

1. The percentage rate should be worked out carefully, having regard toConditions of Contract, specifications, Drawings etc.

2. The percentage rate worked out by the Tenderer is to be filled up at the end ofthe Schedule of Quantities and Rates in the space provided therein. Only onepercentage rate on all items of Schedule of Quantities and Rates shall bewritten.

3. The percentage rate quoted by the Tenderer shall hold good for all the items ofthe tender, without reference to quantity or location of the work or thevariation in the estimated quantity.

4. The percentage rate should be legibly written in figures as well as in words inthe space provided for. In case of discrepancy, the percentage rate mentionedin words shall prevail.

5. Tenderers are required to add or deduct the amount due to percentage, as thecase may be and work out the final figures (amount of their tender), at the endof the Scheduled of Quantities and Rates at the space provided therein. If thetotal tender amount does not tally with the quoted percentage rate the samewill be worked out by applying percentage rate to the total of Schedule ofQuantities and Rates.

6 Erasures or corrections in figures, without tenderer's initial, will render the tender liable to rejection.

Preamble to Schedule of Quantities and Rates

1. General Instructions:

1.1. The Schedule of Quantities and Rates must be read with the Drawings, Conditions of Contract and the Specifications and all relevant standards. The Contractor shall be deemed to have examined the Drawings, Conditions of Contract and the Specifications and have acquainted himself with all the details of the work to be done and the way the works are to be carried out.

1.2. The quantities entered in the Schedule of Quantities and Rates are approximate only. No claims on behalf of contractor will be entertained on account of changes in quantities in Schedule of Quantities and Rates.

2. Rate and Prices to be inclusive:

2.1. The rates and prices set out against the items are all-inclusive rates of the finished work as described in the Schedule of Quantities and Rates. It shall cover the cost of provision of plant and equipment, materials, labour, execution, supervision, maintenance, overheads and profits and every incidental and contingent cost and charges whatsoever including all Taxes -VAT Service tax, duties, levies, GST etc. necessary for proper execution, completion and maintenance of the works.

2.2. The MbPT will deduct from contractor’s bills, the taxes like VAT, MVAT, Income Tax etc. at source as applicable as per prevailing rules and regulations.

Schedule of Quantities and Rates

DETAILS ASSOCIATED WITH BOQ.

NOTE- For all Items in all Sections: Rate shall include transportation, loading /unloading, providing / supplying / laying / fixing / installing / fabricating /testing / commissioning etc. on site. Rate shall also include all taxes such asVAT, excise, sales tax, Octroi, GST etc.

SECTION A – DISMANTLING WORKS

Note: All rates shall be compulsorily inclusive of the following scaffolds items asstated below. No extra rate will be paid for scaffolding or barricading orcordoning of areas. No extra rate will be paid for barricading and safetystandards adoption prescribed by the National Building Code and its latestrevision.

1) The external / internal scaffold would be erected on 100% of the entire area

for speedy completion of work. A team of 4 to 6 people shall remain on sitefor minor adjustment or shifting of planks etc. as required and directed onsite.

2) Steel Scaffolding / Propping: Providing, erecting and dismantling (aftercompletion of work) tubular steel scaffolding each module of 1.8 m. long,1.2 m. wide and 2.4 m. high. The scaffolding should have a provision for acontinuous cantilever working platform which is 150 mm to 200 mm awayfrom the wall surface at every 1.8 m. c/c in height whereas main scaffoldshall be 150 mm away from the chajjas or as directed with steel accessladders or built in mechanism in the scaffolding. The height of the scaffoldto be erected to be 12 m. approximately. The scaffold shall be for thecomplete period of construction. External scaffolding to include compete

new Hessian / HDP covering to prevent debris from falling out and workingplatforms as required for different agencies and for inspection.

3) Providing, erecting and dismantling (after all agencies' works arecompleted) the tubular steel scaffolding with 'H' frames erected over steelbase plates in line and in level for the working platform and properly bracedand strutted, inclusive of guard lines at working level, etc. complete.

4) Providing and fixing new corrugated GI sheets at the convenient heightsusing the scaffold with additional frame supports as directed for the entireduration of external works to cover some areas as directed and protect thearea below in use while the work is in progress and to protect from fallingdebris or paint. Dismantling the same after the works are completed.

5) On direction of Engineer-in- charge in difficult area providing, erecting anddismantling(after completion of work) double bamboo scaffold with verticalsin one direction at 1.2 M and 1.8 M in other direction and height wise @ at1.2 M to 1.8 M as directed for the use by different agencies for totalduration of the project. The height of the scaffold should have a provisionfor continuous cantilever working platform which is 150mm to 225mm awayfrom the wall at every 1.8 M in ht. whereas the main scaffold should be150mm away from the chajja. External scaffolding to include complete newHessian / HDP covering to prevent debris from falling out and workingplatforms as required for different agencies and for inspection.

6) Providing and fixing wherever directed with suitable fixing arrangement, highstrength nylon net to catch the falling plaster debris for entire duration ofwork.

7) Providing temporary cover in the form of a tarpaulin sheet with bambooframed structure over terraces to allow for work of dismantling of existingcoba and china mosaic over the terraces and also to carry out relaying ofthe same including carrying out water proofing work during the monsoonseason. The cover should be watertight and adequately tied and bracedagainst strong winds as well as large enough so have sufficient room insidefor carrying out the works. The cover should cantilever 2.0 meters outsidethe periphery of the building to permit and protect other external workduring monsoon. Layout, design and size of the pandal to be approved byEngineer-in- charge before start of work.

8) Contractor shall ensure security of all salvageable material. The rates oftransportation of salvageable material to MbPT yard anywhere in MbPTestate are deemed to be included in the respective item. The surplus earth/debris/unserviceable material shall be transported by the contractoranywhere outside MbPT estate at no extra cost to MbPT.

SECTION B- EARTHWORK AND METAL PACKING –

Note: 1) The items given below shall be as per Section B of the specifications. 2) Rate for excavation shall include dewatering during the excavation including

shoring, strutting etc. and keeping it dry during excavation and construction. 3) All earthwork shall be carried out as per Engineer-in- charge instructions and

safety norms as per relevant IS code. The rate shall include all scaffolding andmeasures for cordoning off areas during dismantling, providing sign boardsetc.

4) All debris and scrap materials from earthwork shall be contractor’s propertyother than that which is reused for back-filling etc. and this debris and scrapmaterials shall be removed away from site immediately on his own. Thecontractor to give rebate in rates against materials and scrap / debris fromsuch dismantled work which shall be contractor's property.

5) For all earthwork items, the contractor should carefully stack all excavatedmaterial at site as per the instructions of the Engineer-in- charge. All debrisassociated with the earthwork should however be disposed of by theContractor.

6) The measurement of excavation shall be taken in Cu.m. as per rectangulartrench of bottom width of plain cement concrete multiplied by vertical depthof foundation from ground even though contractor might have excavated withsloping side/ full length trench for his convenience.

SECTION C- FORMWORK, CONCRETE-PLAIN & REINFORCED-

NOTES FOR FORMWORK-

1) The items given below shall be as per Section C: 'Formwork' of thespecifications

2) Contractor should submit for the Consultant's approval design and drawingfor all formwork showing sizes of member including props and its foundationconsidering RMC by pumping

3) A mockup of formwork for columns, typical column-beam junction, beamsshould be made and only after obtaining approval of the mockup, thecontractor will be allowed to proceed with the work.

4) All surfaces of concrete elements shall not be treated in any way unlessotherwise instructed.

5) All concrete surfaces shall have smooth and even finish originally bythemselves without any finishing or rendering. In case the Engineer-in-charge is not satisfied with the finish obtained, remedial measures forimproving them shall be carried out by the Contractor at his cost.

6) Rate shall include use of 5mm thick compressible gasket materials, fixingagent, adhesive tape and mechanical buffing of shuttering plates.

7) Only approved mould release agent should be used. 8) Manual/mechanical cleaning of shutter plates after every use is a must. 9) The rate shall include hacking of concrete surface required to be plastered

immediately after removal of formwork. 10) Only new steel and plywood shuttering shall be permitted for its first use at

site, and its number of uses will be solely with discretion of Architect. 11) Providing cutouts, holes, slits, depression etc. for electrical fixtures shall not

be paid separately. 12) Size of the panels used for exposed concrete finish areas shall be approved

by the Engineer-in- charge. 13) The supporting system for platform door shall be having self-alignment

devices to ensure perfect line and level, and verticality of the shuttering,staging to achieve required degree of perfection.

14) For quick erection of shuttering and staging the system should have suitablearrangement for moving entire set in transverse as well as in longitudinaldirections and rails/wheels on any suitable arrangement which will beapproved by the consultant.

NOTE FOR CONCRETE WORK

1) The items given below shall be as per Section C" Concrete-Plain &Reinforced" of the specifications.

2) For small concrete on approval of Conservation Architect, weigh batchedconcrete as per design mix, in manually or mechanical type operated weighbatcher dial type or mechanical type of minimum capacity 650 Kgs shall beused. Weigh batcher shall be calibrated regularly.

3) For all major concrete pours, Contractor shall use ready mixed concrete(RMC) of Unitech Prefab Ltd. or M/s. Larsen & Toubro Ltd. Or M/s Lafarge Orany other approved Agencies by the Chief Engineer. Only 53 grade cementshall be used in RMC. Aggregate properties and grading design mix, quantityof super plasticizer, setting time, amount of slump at the pouring site shall begot approved before its use in each major concreting.

4) Concrete mix proportion will be based on 50 kg. weight of cement bagsdelivered at the mixer.

5) The Contractor is entirely responsible for the design of concrete mixes. Thedesign is however, to be approved by the Chief Engineer.

6) Concrete M-20/20 means concrete mix M-20 grade using maximum size ofcoarse aggregates 20mm.

7) Shuttering, form work, centering shall not be paid separately and shall

conform to notes for Form work above. 8) Curing compound may be permitted only for inaccessible locations. 9) Only River Sand should be used. Washing of sand in rotary screw type

washing machines is a must. 10) Rates shall be inclusive of cost of Super plasticizer of approved quality and of

approved dosage. 11) Rates shall be inclusive of providing pockets, holes, inserts, pipes, etc. 12) Mechanical vibrators, internal and/ or external to be used. 13) All defective concrete if approved by Architect, shall be repaired by the

contractor at his own cost, using approved epoxy mortar or Polymer modifiedmortar as per Manufacturer's specifications.

14) The rate shall include the cost of applying 2 coats of polymer bonding agenton all surface of old or new concrete at construction joint prior to concretingagainst the same.

15) Use of fine sand with proper grading is a must. 16) Screening of metal -I and II for removing excessive flaky under and over

size material, stone dust etc. is a must. 17) Only approved mould releasing agent should be used. 18) Cleaning of shuttering plates by mechanical buffing after every use is a

must. 19) All concrete surfaces shall be form finished. 20) Where plastering is specified, concrete surfaces are required to be hacked

immediately after the removal of form work as directed by the Architectwherever required. Additional rate shall not be paid to contractor for hacking.

21) Contractor should make arrangement for table vibrator for casting the coverblocks of required size and grade.

22) Rate shall be inclusive of providing cover blocks. Cover blocks shall be madeof the same grade of concrete of structural member in which the blocks are tobe used.

23) All joints in shuttering shall be sealed by use of 5mm thick compressiblematerial gaskets and fixing agent.

24) Construction joint shall be minimum in numbers and their location shall beapproved by the Consultant. Construction joints shall be treated properly withbonding coat of approved material to be applied at the old concrete beforecommencing the fresh concreting operations.

25) In form finish surfaces the patterns to be provided for the formwork shall beas per Engineer-in- charge’s suggestions

26) All sack-rubbed surface shall be sack rubbed with white cement of suggestedproportion as per Engineer-in- charge’s approval.

27) All concealed items like conduits, junction boxes, fixtures etc. shall belocated as per details and locations to be approved before casting.

28) Please refer Volume-IA for Detailed Technical Specification.

SECTION D- REINFORCEMENT-

Notes: 1) The items given below shall be as per Section D: 'Reinforcement' ofthe specifications.

2) Cover blocks shall be of good quality concrete M30/10 and shall be vibratedon a table vibrator to reduce the permeability.

3) Wherever welding of reinforcement is specified, the same shall be carried outconforming to IS:9417 or IS:2751. Welding shall be carried out by approvedqualified welders only. One percent testing of welds shall be carried for alltypes of welds.

4) Overweight of the steel shall not be considered for calculating consumptionand payment purpose, I.S. constant for weight of different dia. of bars shallbe considered for payment as well as consumption purpose.

5) Column reinforcement bars are required to be lapped in the middle portion ofcolumns as per IS 13920. Proper arrangement shall be made to supportreinforcement projecting above floor level. Similarly laps within a distance of2 D (depth of beam) or 1/4 span from the face of the column are not allowed.The overhanging bars should be properly supported. The cost of these worksis deemed to have been included in the rate.

6) Please refer Volume-IA for Detailed Technical Specification.

SECTION E- STRUCTURAL STEEL WORKS AND OTHER FABRICATIONITEMS –

SECTION F- ROOFING- Note: 1) Measurement shall be taken for complete laid roof in square meter for

flat superficial and not gathered / sloping. The rate shall include all thematerial, labor bolts, nut washers and tools and plants etc. complete.

SECTION G- MASONRY WORK-

Note: 1) The items given below shall be as per 'Masonry Work' of thespecifications.

2) Rate should be inclusive of scaffolding, curing and also dewatering & keep ginsurface dry during construction.

3) Cement for manufacturing concrete blocks to be provided by Contractor. 4) Only self-supporting scaffolding will be allowed, no holes in masonry would be

permitted.

5) Contractor will be responsible for making good all the surfaces of brick/blockmasonry wall in its original form wherever in chasing the wall is done forproviding service lines like electrical, telecommunication and water supply andplumbing etc.

6) Factory including block making machine for manufacturing of concrete blocksshall be approved by Engineer- in -charge.

7) The cement for block masonry shall confirm to the requirement of minimumcement requirement for P.C.C. of concrete specifications.

8) Required quantity of concrete blocks are to be manufactured with grooves toaccommodate the conduit pipes/water pipes etc. The grooves should bestaggered on both sides.

9) The rate for concrete block masonry walls shall be inclusive of producing halfblocks and odd sized blocks to suit the construction.

10) Mortars for all masonry work shall be mixed in an approved mortar mixer orconcrete mixer.

11) Hand mixing of mortar will not be allowed. 12) Only river sand and 43 grade cement shall be used. 13) Washing of sand in rotary screw type washing machines is a must. 14) Bricks used shall be of first class and shall be of regular in shape and their

edges should be sharp and shall be free from crack. Brick shall be fully soakedin clean water by submerging in a tank for a period of 12 hours immediatelybefore use.

15) Curing period should be as per Volume-IA Detailed Technical Specificationfor masonry works.

SECTION H -PLASTERING AND POINTING –

Notes :1) The items given below shall be as per 'Plastering of the specifications. 2) Scaffolding for plastering shall be of self-supporting type. Holes will not be

allowed, to be made in the masonry or RCC work for anchoring thescaffolding.

3) Only River Sand should be used. However, washing of sand in rotary screwtype washing machines is a must.

4) Mortar for plastering work shall be machine mixed in a mortar mixer orconcrete mixer. Hand mixing of mortar will not be allowed.

5) The rate for plastering shall also include providing and mixing/ applying anapproved bonding agent as per direction of Engineer-in- charge, and alsoapplying approved hack-aid on surface receiving plaster.

6) Only 43 grade cement shall be used. 7) Rate should be inclusive of scaffolding and curing shall be started as soon as

the plaster has hardened sufficiently not to be damaged when watered. 8) Curing period should be as per Volume-IA Detailed Technical Specification for

plastering and pointing works.

SECTION I - PAINTING-

Notes: 1) The items given below shall be as per 'Painting of the specifications. 2) Scaffolding for Painting shall be of self-supporting type. Holes will not be

allowed, to be made in the masonry or RCC work for anchoring thescaffolding.

3) The brands of the Paint shall be specified and readymade paint of requiredshade should be used.

4) The surface shall be made perfectly smooth by rubbing with sand paper ofdifferent grades.

5) All holes and open joints should be filled with strong putty or with a mixtureof glue and plaster of Paris and smoothened by rubbing sand paper.

6) In steel work, all scales, dirt, supplier’s delivery mark, oil, grease etc. shall beremoved with sand paper before painting. Special care shall be taken forcleaning the corners

7) Each coats shall be allowed to dry up perfectly before the succeeding coat islaid over it.

8) Rate should be inclusive of scaffolding, curing and also dewatering & keepingsurface dry during construction.

SECTION J- FLOORING & PAVING-

Notes: 1) The items given below shall be as per 'Flooring' of the specifications. 2) At least 6 samples for all finishing items of work, from different approved

sources shall be submitted before starting the work for approval. Architect incharge decision regarding the shade, quality and the source is final. All likematerials of flooring, cladding, etc. to be from same batch as per approvedsample

3) Rate shall be inclusive of all exposed stone edges to be chamfered/ mouldedand hand polished as directed.

4) Rates for vertical cladding in stone of thickness from 6mm to 25mm shallinclude exposed right angular corner joints finished and edges polished andmoulded as per Architect's instruction, with cutting 6 mm grooves and alsoedge preparation to suit corner angles.

5) Skirting/dado/cladding, because of varying height will be measured and paidon square meter basis instead of on running meter basis.

6) The rate for flooring/cladding should be inclusive of bedding/ back coat asspecified. The thickness of mortar bedding or back coat specified is minimum.This thickness will vary according to the thickness of flooring or claddingmaterial so as to suit the specified level or line. The Contractor shall beresponsible for proper bonding between backing coat & masonry work or RCCwork and his rate shall be inclusive of providing and applying approvedbonding agent.

7) For all vertical cladding, an approved chemical adhesive for tiles as permanufacturer's instructions shall be used and the rates quoted shall beinclusive of the cost of this adhesive, for a thickness 3mm to 4mm.

9) Unless otherwise specified, all sizes to be in metric system. 10) Scaffolding for external cladding shall be of self-supporting type. Holes will

not be allowed to be made in the masonry or RCC work for anchoring thescaffolding.

11) The rate for vertical cladding should also include the work on isolatedcolumns, chamfers, etc.

12) No separate payment will be made for providing and fixing, odd sized tiles ofany shape and size to suit consultant requirement.

13) White/Colored cement with matching pigments or Johnson BAL grout withappropriate color shall be provided by Contractor at his cost.

14) The Contractor shall provide suitable supports for supporting the claddingtiles and remove it only after the tiles have firmly adhered to location.

16) The maximum thickness of the paste prepared by using tile adhesive andapplied on the wall and column surfaces should not be more than 3mm.Contractor shall have no extra claims on account of increase in the thicknessof the paste beyond maximum thickness as specified above due to faultyworkmanship or any other reason.

17) Mortar required for bedding/ back coat shall be mixed mechanically inmortar mill. Only river sand shall be used in the mortar.

18) All fixtures, electrical points, lights etc. to be aligned with tiling, grooves andpattern, flush with the wall face as per details and drawings. A mockup for thesame shall be got approved from Architect.

19) The contractors are required to study drawings carefully to understand fixingdetails of flooring, skirting, cladding etc., to keep required grooves betweendifferent finishes at door and window locations flooring and skirting junction,wall and ceiling junction etc. to match flush line i. e. vertical plane of wall andskirting etc.

20) Rate shall be inclusive of cost of scaffolding, grouting, curing, final polishingby non-slip wax polish and cleaning of surfaces and also dewatering &keeping surface dry during construction.

21) A sample/ mockup of flooring, cladding, etc. to be got approved from, ChiefEngineer.

22) All additional grooves to be provided in vertical, horizontal and direction asshown in detailed drawings or as directed.

23) To make wall cladding surface and skirting surface flush, wall at skirting levelshall be required to recess inside as per fixing details. The necessary recessesin RCC wall etc. shall be taken at the time of construction itself.

24) Only 43 grade cement shall be used.

SECTION K- DOORS & WINDOWS

Notes: 1) Carpentry and Joinery, Timber, Steel casement, Aluminum DoorsWindows, skylights openable, sliding windows, rolling shutters andpolycarbonate sheet, curtain walls, etc.

2) For all aluminum works, the contractor shall submit shop drawing for eachitem of work indicating the section of aluminum, its weight and joinery detailand total weight of window/door/partition walls etc. Wherever possibleriveting shall be resorted to for connection. Alternatively, hot dippedgalvanized pinheaded sheet metal/brass, screws could be used. No mild steelwithout hot dipped galvanizing shall be used for any fastenings, etc.

3) The rates shall not be paid separately for Aluminum sections used on weightbasis.

4) The rate shall be inclusive of providing & fixing glass panels includes cost of

7) Rates for repairs as well as providing and fixing of new doors, windows, skylight, rolling shutters, etc. in this section shall be inclusive of all the items ofhardware / fittings and no extra shall be paid to the contractor towards thecost of hardware / fittings.

8) All Hardware should be as per samples approved by Engineer. Providing andfixing following hardware items in oxidized brass (unless otherwise stated)including, fixing with appropriate screws and fasteners in brass/ stainlesssteel metal screws (Nettle fold or equivalent) wherever specified etc. ofapproved make type and thickness:

SECTION L- WATERPROOFING AND STRUCTURAL REPAIRS

Notes: 1) The contractor will give a 10 years guarantee of the work undertakenon Rs.100/- Stamp paper on the approved format duly registered.

2) Ten percent amount of value of works will be retained for the period of fiveyears from the date of actual completion of the work, will be releasedprogressively at four percent after two years’ subject to attending anyrectification of defects and balance amounts by the end of five years.

3) All work to be done through specialist waterproofing and structural repairagencies shall be undertaken only on the approval of the Engineer.

4) Curing period should be as per Volume-IA Detailed Technical Specification.

SECTION M- STONE CLEANING, POINTING AND MINOR REPAIRS –

NOTE FOR STONE CLEANING -Cleaning of ashlar stone masonry work, stainedRCC surfaces and any other surfaces instructed by Engineer.

Water for Cleaning: Clean; potable, free of oils, acids, alkalis, salts, andorganic matter. Heat warm water, if required, to temperature of 60°C to80°C. Brushes: Soft plastic or Fibre bristles only. Liquid Strippable MaskingAgent: Manufacturer's standard liquid, film forming strippable maskingmaterial shall be used for protecting glass, metal, and polished stonesurfaces from damaging effects of cleaning masonry.

NOTE FOR RE-POINTING/ POINTING OF STONE MASONARY- Removing of Hardcement pointing and re-pointing with a soft cement, lime and fine sandpointing. (External Periphery, Tower, Porch, Internal Corridor, periphery,Jambs)

i) Raking out joints: Raking out of joints of hard cement / epoxy pointing whichshall be manually done with utmost care as to not damage the lateritecladding panels. Cut out old mortar by hand with chisel, and mallet. Do notuse power tools. Remove nails, enlarge holes, except weep holes, and fillwith mortar. The cement mortar shall be raked out of the joints at least ¾"deep. The dust shall then be brushed out of the joints, and the work wellwetted and washed with water.

ii) Pointing Mortar Proportions: The mortar to be used for pointing shall not beground fine, but the sand should be finer than in ordinary mortar. A littlewood apple (bael-fruit) should be added to the mortar and the addition ofchopped hemp should be prohibited. The mortar shall consist of one portioncement, four portions of lime and twelve portions of fine sand.

iii) Apply first layer of pointing mortar to areas where existing mortar wasremoved to depths greater than surrounding areas. Apply in layers notgreater than 3/8 inch until a uniform depth is formed. Compact each layerthoroughly and allow to become thumbprint hard before applying next layer.Where existing stone units have rounded edges, recess final layer slightlyfrom face. Take care not to spread mortar over edges onto exposed masonrysurfaces or to featheredge mortar.

iv) When mortar is thumbprint hard, tool joints to match original appearance ofjoints. Remove excess mortar from edge of joint by brushing.

v) Finishing Joints flat: The joints of the pointed work shall be neatly defined bythe pointing, and the lines shall be regular and uniform in breadth, and thejoints shall be flat. No false joints will be allowed.

vi) Wetting / curing: The work pointed shall be kept wet for 3 days after thepointing is complete.

vii) Cleaning: Clean exposed and mortar joints, installed as part of the workunder this Contract and surfaces and joints disturbed or otherwise soiledduring the work under this contract. Use bucket and brush hand cleaningmethod or high pressure water method. Clean before mortar gets too hard;do not wait until completing.

viii) Where re pointing work precedes cleaning of existing stone, allow mortar toharden not less than 30 days before beginning cleaning work.

ix) Face-work: All face or visible work shall be pointed, unless otherwisespecified.

x) Cost shall be all inclusive (including the structural scaffold for undertakingpointing)

xi) Sample of two square meter in four different locations shall be done andsubject to approval of the consultant further work to be undertaken.

Form of Tender The Chief Engineer, Mumbai Port Trust.

1. I/We ___________________________________________, do hereby offer to execute the work comprised in the annexed Tender Notice for HERITAGE CONSERVATION OF PORT BHAVAN, MUMBAI in strict accordance with the Instructions to Tenderer, General Conditions of Contract, Specifications and Addendum to Specifications, Special Conditions of Contract, Technical specifications etc. at the percentage rate entered in the attached Schedule of Quantities and Rates.

2. I/We undertake to complete the work included in the Schedule of Quantities and Rates within 18 Months including monsoon from the date of receipt of Pre-acceptance letter or from the date of release of site whichever is later. I/We also agree that this tender will remain open for acceptance until disposed off by the Trustees of Port of Mumbai. I/We have independently considered the question of the amount of loss or damage likely to result to the Trustees from the delay on my/our part in the performance of the contract and I/we agree that the Liquidated damages at the rate of ¼% of the contract price for delay in completion of work per week or part thereof subject to a maximum ceiling at 5% of the contract price represents a fair estimate of the loss likely to result from the delay.

3. I/We send herewith a sum of Rs.15,00,000/- (Rupees Fifteen lakhs only) as a deposit or earnest money deposit as proof of my/our willingness to enter into the contract if my/our tender is accepted.

4. In the event of my/our tender being accepted, I/We agree to enter into a contract in the prescribed form with such alterations or additions thereto which may be necessary to give effect to the acceptance of this tender and such contract shall contain and give full effect to the specifications, Schedule of Quantities and Rates attached to this tender. Until such agreement is executed, this Tender together with your written acceptance thereof shall constitute a binding Contract between us. I/We also agree that this agreement will remain in force even in case of any extension of the contract, on the same terms and conditions.

5. I/We also agree, if awarded the contract that the earnest money lodged with this tender will be retained by the Trustees towards part of the Security Deposit and to make further deposit by cheque/demand draft/G.P. Notes/Securities of Public Bodies/10 years defence certificates/Units from Unit Trust of India/by way of a Bank Guarantee, within Twenty one days or such extension of the period permitted by the Chief Engineer, in writing, after receipt of information that my/our tender has been accepted by the Port Trust.

6. I/We further agree, if awarded the contract, to lodge the Retention Money equivalent to 3% of the contract price of my/our tender by way of deductions from my/our bills at the rate of 5% of the gross value of work certified in each bill till the amount of 3% of the contract price is accumulated.

7. I/We understand that Mumbai Port Trust is not bound to accept the lowest or any tender, it may receive.

8. I/We certify that I/we have not made any interpolation in the tender documents.

9. I/We agree to abide by this Tender for a period of 180 days from the date of opening of First Cover (Technical Cover) and it shall remain binding upon us and may be accepted at any time before the expiry of that period.

10. I/We agree to maintain and repair the works in accordance with Clause 10 of Conditions of Contract, during the execution of the works and during the Defects Liability Period.

11. I/We shall be responsible to transport and take away the debris and surplus excavated material arising out of this work, out of MbPT Estate at no extra cost to MbPT. I/We also accept to be penalized as per the relevant clause in case of default.

12. I/We agree to provide all facilities to the MbPT site staff as stipulated in Clause 23 of the Conditions of Contract.

13. I/We agree that:

(a) If I/we fail to provide the required facilities to the Engineer or his Representative for carrying out the inspection and testing of materials and workmanship and for measurement of the works,

OR (b) If I/we incorporate into the works, materials before the same are

tested and approved by the Engineer or his Representative,
