ST. PETERSBURG: St. Pete Beachvoters approved all six ballot decisionsTuesday, referenda that affect the heightand density of new development.

But the vote may be thrown out incourt, as one advocacy group says voterswere misled by information printed onthe ballot.

Citizens for Responsible Growth filed a lawsuit Monday,asking the Sixth Circuit Court to declare the ballot sum-maries misleading. If the court agrees, the election’s re-sults would be set aside, the ballot summaries would be re-done and a new election would be scheduled.

The advocacy group’s attorney, Ken Weiss, said thesummaries were written by city developers and were mis-leading.

“We are not opposed to people voting on this, but wethink that they should be informed on what they are vot-ing for,” he said.

The city, which is responsible for the ballot summaries,approved the language.

� Measure the size of your blind zone(area) behind the vehicle(s) you drive. A5-foot-1-inch driver in a pickup truckcan have a rear blind zone of about 8feet wide by 50 feet long.

� Be aware that steep inclines andlarge SUVs, vans and trucks add to thedifficulty of seeing behind a vehicle.

� Hold children’s hands when leavingthe vehicle.

ST. PETERSBURG: Volunteersfrom Raymond James Financialpitched in Saturday for Habitat forHumanity at the organization’s firstmultifamily home.

The home, at 3460-70 19th Ave.S., is part of Habitat’s 2008 WomenBuild project. The project encourageswomen to help build Habitat homes,while empowering them to addressthe issues of children living inpoverty by building homes wherefamilies can flourish.

The Women Build project alsoprovides an environment in whichwomen can feel comfortable learningskills they might not otherwise havethe opportunity to learn.

No experience in construction isnecessary for the volunteers as toolsand instruction are provided by theHabitat staff.

As part of the firm’s commitmentto give back to the communities inwhich they do business, RaymondJames is a $25,000 sponsor of the

Habitat for Humanity 2008 WomenBuild project, in addition to providingthe volunteers for the build day. Ad-ditional volunteers will be providing

lunch for the construction crew.Construction for the duplex has

2. People who wear Bluetoothheadsets and, while it looks likethey’re talking to you, they’re not.Either look at me and talk to me,or look away and talk to yourimaginary friend.

3. Anyone who says “irregard-less.” That isn’t a word, regardlessof what you may think.

4. Anyone who says “I couldcare less.” That means that youCOULD care less. Instead, youCOULDN’T care less, whichmeans, well, that you couldn’t careany less.

5. People who are too lazy toreturn shopping carts to a cart re-turn. Instead, they either just let‘em roll around in a parking lot, orleave them between cars, so whenone rolls forward, it dings your car.Karma will come back to you.

6. Big rig drivers who insist ondriving 10 mph slower than theposted speed limit… in the leftlane! MOVE IT.

7. Spam e-mail telling me Ineed to augment any area of mybody. Especially when it’s totallyunnecessary.

8. “Can I axe you a question?”It’s ASK. An ax is what someoneshould take to his own head for be-ing that ignorant.

9. Police speed enforcementthat only comes out when there’sa budget crunch. (Anyone in Largosee this?)

10. Anyone who blocks a super-market checkout line just toCOUNT CHANGE. You’re holdingup the line.

11. Drivers who can’t take acell phone away from their facelong enough to see they’re eitherin the way or totally distracted.It’s about time Florida had a lawmandating hands-free phone usewhile driving – that is, if phoneuse is allowed at all by a motorist.

12. Improper, and incessant,use of the word “like.” Grow up,already.

13. Handles on the INSIDE ofbathroom doors that you have togrip and pull. Especially bad be-cause of No. 1… and the Nos. 1and 2 that they don’t wash after.Especially if there’s no paper-towel dispenser in the bathroom.

14. Use of the word “methinks”outside of Shakespearean lan-guage.

15. Chewed gum tossed to asidewalk for someone to step on.

16. People who insist on stand-ing up and leaving their seat DUR-ING an inning of a baseball game.Get up on the breaks, so as not tobe in anyone else’s way.

17. People who remain standingafter the seventh inning stretch.Do the words “DOWN INFRONT!” mean anything?

18. Smokers who can’t waitlong enough to get a drag oncethey walk out of a building… thatthey stand right in front of thebuilding’s door to suck one down!Enjoy your smoke without me. Goanother 20 paces.

19. Body piercings. Ever seeone of these people and want toget their attention by pulling onthe thing that has grosslystretched their ear lobe out, or onthe chain that connects their earand nose rings? (“Hey, come lookat this!”)

20. Uncontrollable teenagers atmovie theaters or drive-ins. Takeyour cell phones and go home al-ready. And get off my lawn.

The thingsthat annoy,pesterand plague Wal-Mart scholarships given

to two St. Pete StudentsTwo St. Petersburg high school

students were presented with $1,000SamWalton Community Scholarshipsby the Pinellas Park Wal-Mart.

Colleen Brendla of St. PetersburgHigh School and Luke Schmidt of St.Petersburg Catholic High School areamong several thousand studentshonored with the scholarship.

Every Wal-Mart and Sam’s Clubin the country will present two of thescholarships, for a total of nearly $8million nationwide this spring.

The scholarship program is one ofthree that the Wal-Mart Foundationprovides annually to help with col-lege expenses for associates as wellas the general community.

“For many students, paying for col-lege can be a real financial burden,”Wal-Mart St. Petersburg MarketManager Rob Goding said. “The SamWalton Community Scholarships are away to recognize these students fortheir hard work and achievement andto help them get the education theywant and deserve.”

The scholarships are awardedbased on financial need, academicrecord, test scores, community in-volvement and work experience. Lastyear, more than 7,200 high schoolseniors received scholarships for atotal of more than $7.2 million.

The company also supports pro-grams that improve graduation ratesand adolescent literacy.

ST. PETERSBURG: Fund-rais-ing events this past weekend raisedmore than $4.2 million for All Chil-dren’s Hospital, money that will helpfund construction of a new, larger hos-pital facility.

In spite of difficult economic times,hospital spokespeople say, the 2008All Children’s Hospital Telethonraised nearly $4 million. “A Taste ofPinellas,” now in its 22nd year, raisedmore than $200,000, setting a newrecord. The Saturday night “VIP Auc-tion Kickoff Party” at the Hilton St.Petersburg Carillon Park added an-other $200,000.

The weekend’s toteboard totalpushes the cumulative, 25-year totalof donations to more than $66million.

“A Taste of Pinellas” at Vinoy Parkin St. Petersburg drew record crowdswith a lineup of headlinemusic acts in-cluding Rick Springfield, Jonny Langand Eddie Money, thanks to a cooper-ative effort with Ruth Eckerd Hall andsponsorship by BB&T.

This year’s telethon theme, “Build-ing Miracles,” reflected constructionunderway on the new hospital, withroom for individual patient rooms andstate-of-the-art technology to providespecialized care to patients. The newstructure will be at the corner of 6thStreet South and Interstate 175,

across 6th fromBayfrontMedical Cen-ter and just down the street from theexisting All Children’s. It is slated toopen in 2009.

St. Petersburg city documentsshow the city discovered the presenceof a black, tarry hydrocarbon in 1987during stadium construction – abyproduct of coal gasification.

From 1914 to 1960, a city-operatedcoal gasification plant converted coaland coke to gas to be used for illumina-tion and cooking. The heavy tar sub-stancemade in the gasification processis known as polynuclear aromatic hy-drocarbon.

The plant site is under TropicanaField parking lot 7A, south of 3rd Av-enue South and the tile walkway on theeast side of the stadium.

City documents also show the sitewas contaminated by multiple busi-nesses across the site through the1980s – including a city asphalt plant,three gas stations, a dry cleaner andpaint storage company.

Another byproduct that may be onthe site is trichloroethylene (TCE),commonly used as a degreaser in gasplants and at dry cleaners.

On July 5, 1988, the city enteredinto a consent order with the FloridaDepartment of Environmental Protec-tion (DEP) to assess and remediate thesoil, surface and ground water of thesite.

The contaminated area was cappedby the parking lot to prevent furtherwater contamination. The site, which isstill contaminated, is monitored semi-annually through monitoring wells, ac-cording to DEP documents.

To bring the site to closure, con-taminants have to be at or below ap-proved levels. In addition, the DEP has

been asking the city since 2000 to exe-cute a deed restriction prior to closure.

A deed restriction would prohibitthe site owner from doing certainthings on the property, like remove thecapped parking lot.

The consent decree does not de-mand a deed restriction, according tothe DEP.

“It would give assurance to the de-partment that if the land use were tochange, the pollution would be ad-dressed,” DEP spokeswoman PamVazquez said.

The federal Comprehensive Envi-ronmental Response, Compensation,

and Liability Act, more commonlyknown as “Superfund,” was enacted in1980. The law gives broad federal au-thority to respond to releases or threat-ened releases of hazardous substancesthat may endanger public health or theenvironment.

Under Superfund, liability to reme-diate contaminated sites extends to anyowner, operator or transporter wherehazardous materials are found – mean-ing, the city, county, the Rays and anyfuture developers or financing agentsare liable for remediation of contami-nation that occurred as early as 1914.

Bids on theTropicana site exclude li-

ability for or dealing with environmen-tal issues, leaving the city to assumecleanup costs.

The extent and location of currentcontamination is unknown. Accordingto the St. Petersburg Downtown Resi-dents Civic Association, the original re-mediation cost taxpayers about $8 mil-lion, and met less stringent standardsthan for residential use.

The DEP will not speculate on theamount of remediation needed or thepotential cost until a formal permit ap-plication is submitted. The amount ofremediation will depend on the futureuse of the site.

CLEARWATER: U.S. 19 wasclosed for about two hours after a mo-torist struck a tractor-trailer truckmak-ing a delivery Wednesday morning.

The truck was attempting to backinto the parking lotof CountrysideFord, 24825U.S. 19N., tomake a deliv-ery at about 4:40a.m. AsRobert S. Fernandez, 47, backedthe truck into the dealer lot, his truckblocked all the highway’s northboundlanes.

George W. Sturm, 67, was north-bound on the highway at the time. Au-thorities say that for undetermined rea-sons, Sturmmade no attempt to stop orgo around the truck.

Sturm’s small car crashed into thetruck at what authorities call “a consid-erable rate of speed.” The car waswedged almost completely under thetruck’s trailer.

Clearwater Fire and Rescue extri-cated Sturm, who suffered serious butnot life-threatening injuries. He wastaken by air ambulance to BayfrontMedical Center.

While the highway was closed, traf-fic was re-routed to Sunset Point Road.

Serial rapist/burglararrested in Pinellas Park

Shortly before midnight May 20,Pinellas Park police responded to amo-tel on U.S. 19 to a possible attemptedburglary.

Witnesses at theDays Inn directed offi-cers to the suspect’slocation, and JerralDavidMartin, 32, wastaken into custody. Af-ter an investigation,he was arrested forburglary.

But after that ar-rest, officers located

evidence possibly linking Martin to aburglary and sexual battery case re-ported at 2 a.m. that day at WhetstoneApartments, 8400 49th St. And sincethatMay 20 arrest,Martinwas linked toa series of burglaries and one other sex-ual battery.

Police have chargedMartin in theseadditional incidents:

� Sept. 19, 2007: Burglary and falseimprisonment, Residence Inn, 5050Ul-merton Road

� March 28: Burglary and sexualbattery, Gator LakeMobileHomePark,9100 41st St. N.

Police say theft was not the motivein these cases.

Martin has an extensive criminal his-tory, police said, and hewas living in hisFord conversion van at the time of hisarrest.

A “large amount” of women’s un-dergarments was located in Martin’svehicle, police said, adding that investi-

gators believe more victims may comeforward.

Evidence was also located, linkingMartin to a burglary in Texas.

Detectives continue to work withother agencies to determine if Martinmay be a suspect in additional crimes.

Man nabbed in connectionwith double shooting

The man suspected of shooting acouple near Lake Maggiore on May 9was apprehended by St. Petersburg po-lice.

Dangelo Q. Hutchinson, 27, of 163015th Ave. S., is charged with first-de-greemurder and attempted first-degreemurder in the double-shooting incident.

The homicide victim, AngelaBurgess, 33, was shot and killed as shesat in a vehicle while her acquaintance,Willie C. Edwards, 33, was fishingnearby on the lake. Edwardswas shot inthe leg before he dove into thewater toescape.

According to the FloridaSupreme Court, the chief pur-pose of ballot summaries is toprovide voters clear informa-tion about the issue.

Weiss said the ballot sum-maries did not disclose that thereferenda could allow the max-imum height of buildings to in-crease from 50 feet to 146 feetin some locations.

One of the six decisions al-lows a density increase from 30units an acre to up to 80 unitsan acre, which Weiss said couldmean 2,000 to 5,000 more unitsand the accompanying traffic.

Zoning is another issue notaddressed in the summaries,the group says.

The city would be rezonedinto commercial and residen-tial uses. If a residential homeis rezoned into the commercialarea, a resident may not be ableto make changes to it, althoughthey would be able to continueuse of the home, he said.

A proposed impact feewaiver, designed to encourageredevelopment, could result ina tax hike for residents.

Impact fees are fees levied

on redevelopers to cover thecity expenses like new roadsand sewers that are needed forpopulation growth.

A Lutz woman was arrested forcommitting at least six residential bur-glaries during her midday lunchbreaks.

Lisa Anne Williams, 39, of 1734Tinsmith Circle, Lutz, was nabbedTuesday after deputies said they ob-served her acting suspiciously. Theburglaries were committed betweenMay 29-June 2.

A large amount of stolen propertywas recovered from Williams’s home.She is suspected of additional burgla-ries in Pasco County.

Sheriff ’s detectives say that dur-ing Williams’s lunch breaks, shedrove to a nearby neighborhood andrandomly selected a home to bur-glarize.

The new bridge, which opened inAugust 2007, is 20 feet higher thanthe bridge it replaced, a 1939 struc-ture which was five feet above water.It opens an average nine times a day,less than a third as many instances asthe old bridge, saving the city moneyin electricity.

The new bridge is one of three“closed-deck” bridges in the state. In-stead of metal grating on the bridge’stravel surface, drivers ride smoothlyover concrete, which Bruce said lastslonger.

The new bridge is equipped with12 computer systems, multiple sen-sors, and generators in case of poweroutages.

“It’s probably one of the most so-phisticated bridges in the world,”Bruce said.

The new bridge is a hydraulic, four-cylinder “push-push” bridge – the twofront cylinders to raise the bridge,while the back two cylinders push tolower it.

The hydraulic system built byEaton Corp. of Cleveland replaces theelectromechanical system of the oldbridge.

Redundant systems are in placeshould the power go out, computersfail or machines need replacing. Thebridge can run on only two cylinders,off of a generator and on the backupcomputer.
