In addition, beginning next year, Breeders= Cup will neither fund purses nor award Breed- ers= Cup Challenge races to racetracks in the U.S. and Canada which do not adopt the Racing Commissioners International (RCI) model rules on anabolic steroids, via state regulations or house rules. AThe Breeders= Cup Board believes it=s crucial that we take a leadership role in eliminating anabolic steroids from our sport,@ stated William S. Farish Jr., chairman of Breeders= Cup Ltd. AWe encourage each race track and racing jurisdiction to move swiftly in enacting these much needed regula- tions. TrainerRick Dutrow Jr. reports that he will send Big Brown byvan to the Jersey Shore this morning and that the coltis scheduled to school in the paddock with the field fortoday=s first race. The Haskell marks the first start forBig Brown since being eased down the stretch whiletrying to secure the Triple Crown in the GI Belmont S.in New York June 7. Family of Injured Police Officer to Attend Haskell... Family members of a critically injured Nassau County(New York) police officer along with Nassau CountyPolice Commissioner Lawrence W. Mulvey will joinIEAH Stables= Mike Iavarone and Richard Schiavo atSunday=s race. Officer Kenneth Baribault was on dutyand pulled over a suspected drunk driver on the LongIsland Expressway May 18 when his car was rear-ended by another alleged intoxicated driver.

Baribault remained hospitalized at the Nassau Univer-sity Medical Center until July 14, at which time he wastransported to the Kessler Rehabilitation Clinic in WestOrange, New Jersey. In response to the incident,Iavarone and Schiavo, both Long Islanders, pledged aportion of any earnings from the Belmont S. to a fundset up in the officer=s name. Despite failing to earn anymoney in the race, the owners nonetheless donated$50,000 to the Kenneth and Christopher BaribaultBenevolent Fund. RCI MODEL RULES COMMITTEE MEETS ATSPA The Racing Commissioners International ModelRules Committee met in all-day session yesterday inSaratoga Springs, and issued the following recommen-dations to the RCI Board for their adoption. The com-mittee suggests that further restrictions be imposed onthe use of toe grabs in Thoroughbred racing, limitingtheir size to two millimeters. The committee also rec-ommends a new requirement on licensed trainers toundergo at least four hours of continuing educationeach year as a pre-condition to maintaining their li-cense. The Model Rules Committee also voted in favorof making significant changes to the rules concerningthe use of the riding crop (whips), specifying limits onthe size and weights of the crop, allowing only flapsand further defining Aproper use@ of the crop. The com-mittee failed to adopt a proposal to modify the ClaimingRule, which would allow a claim to be voided undercertain circumstances where a horse fails to return tothe unsaddling area.

NEW TAX BENEFITS SHOULD STIMULATEPURCHASES by Jay Hickey

Anyone thinking of getting into the horse business orpurchasing more horses should do so this year. LastFebruary, Congress passed the Economic Stimulus Actto boost the lagging U.S. economy. That law includestwo tax benefits that are available only for 2008 thatshould spur purchases of horses and other assets usedin the horse business.

Expense Deduction Doubled... The first incentive raises the so-called "Section 179expense allowance" for horses purchased and placed inservice in 2008 from $128,000 to $250,000. Theallowance also applies to farm equipment and mostdepreciable property. Once total purchases of horsesand other eligible depreciable property reach $800,000,the benefit phases out dollar-for-dollar, but that leavesa lot of room to purchase some nice horses. The horse industry almost lost the Section 179 ex-pense deduction in 1996 when the House of Represen-tatives passed legislation taking it away from the horseindustry. But the American Horse Council convinced theSenate to remove that limitation before passing thefinal bill and the deduction was preserved. It was worth$17,500 then. It has increased gradually since then andwill nearly double to $250,000 for 2008. Since most horses cost less than the $250,000 limit,this means that most horse owners can write-off theentire cost of a horse purchased and used in 2008. Thisis a real attraction for horse owners and breeders topurchase horses in training or increase their breedingstock.

A misconception that surrounds the expense deduc-tion is that it can only be taken against income fromyour horse business. Not so. It can be used against anybusiness income, including wages, salary and similarcompensation or income from any business a horseowner has. In 2009, the allowance will revert to $128,000.

Fifty Percent Bonus Depreciation Re-Instated... The second incentive brings back the 50 percentfirst-year bonus depreciation. This means that a personcan deduct 50 percent of the cost of a horse or otherdepreciable asset purchased and placed in service dur-ing 2008. The industry enjoyed bonus depreciationfrom 2002 through 2004. It was a benefit then and itshould be again. This write-off applies to all depreciableproperty, unless the property has a depreciation life ofover 20 years. There is one limitation. As was the case when bonusdepreciation was available in 2003 and 2004, the prop-erty must be "new," meaning that the original or firstuse of the horse or other property must begin with thepurchaser. If a horse has been used by one person, it isno longer eligible for bonus depreciation. For example, aperson could not purchase a horse that had raced anduse it for breeding and enjoy bonus depreciation. Butunlike the expense deduction there is no limit on theamount of bonus depreciation that can be taken; it issimply 50 percent of the purchase price. On top of both deductions, a horse owner can alsotake regular depreciation on any remaining basis. To illustrate, assume that in 2008 an owner pays$500,000 for a colt to be used for racing and $50,000for other depreciable property, bringing total purchasesto $550,000. The young colt had never been raced orused for any other purpose before the purchase. Theowner would be able to expense $250,000, deductanother $150,000 of bonus depreciation (50 percent ofthe $300,000 remaining balance), and take regulardepreciation on the $150,000 balance.

The tax bill is intended to provide a shot in the armfor the economy. Clearly, these provisions offer somevery attractive economic reasons to buy horses in2008.

Younger Race Horses to Be Depreciated More Quicklyafter 2008... A third provision allowing a faster write-off for youn-ger race horses will kick-in in 2009 when the aboveprovisions expire. Congress included a provision in thenew Farm Bill to amend the current depreciation sched-ule for race horses to make it uniform at three years.Effective January 1, 2009 all race horses will be depre-ciated over three years, regardless of their age whenplaced in service. This change to the tax code for racehorses will "sunset" after five years, ending at the endof 2013, unless Congress extends it. For 2008, race horses will continue to be depreciatedover seven years if they are placed in service beforethey turn two; three years if after two. But beginning in 2009, horse owners will no longerhave to decide whether to place their race horse inservice at the end of its yearling year, and depreciate itover seven years because it is under two, or wait untilthe horse reaches 24 months and a day in order to usethe three-year depreciation schedule. The difference intime placed in service may be only a few months, butthe result is a four-year difference in the write-off. Thisamendment ends the inequitable situation of depreciat-ing race horses over seven years, a period that is abouttwice as long as their actual racing time.

Always Check with Your Advisors... As with all tax changes, horse owners should checkwith their CPA or attorney to ensure the benefit isavailable to them and their situation. But for most horseowners, each of the changes is very favorable and theAmerican Horse Council is pleased to have been able toensure horse owners are eligible for them.Jay Hickey is president of the American Horse Council.
