RULES

RULE 1: NAME

The name shall be Hawkes Bay Poverty Bay Swimming

RULE 2: OBJECTS

The objects of the Centre shall be: -(a) To promote and encourage a knowledge of the sport of swimming and life saving, the

game of water polo, synchronised swimming and the sport of diving

(b) To promote and hold competitions and demonstrations in order to further the above objects

(c) To buy, lease, hire or otherwise acquire any real property whether freehold or leasehold or any personal property and to sell let, lease, mortgage, charge, exchange or in any other manner deal with such property, with or without consideration of rental, upon such terms and conditions as the Centre's Management Committee shall from time to time decide

(d) To construct, maintain and improve any building or buildings which the Management Committee may from time to time decide to be necessary, convenient or desirable for the work of the Centre or the achievements of its objects

(e) To undertake, carry out, sponsor, promote and assist such plans or schemes as the Management Committee may from time to time deem to be of benefit to the Centre and to sponsor promote and assist and co-operate with other centres, clubs or Bodies whether incorporated or not in pursuance with the objects of the Centre

(f) To invest any money belonging to the Centre in such manner, and upon such security as the Management Committee may from time to time decide and to vary or transpose such investments

(g) To subscribe to, make donations to, acquire shares in, become a member of, amalgamate with or become part of any other Centre, Association, Club, Society or Organisation whether incorporated or not, whose objects are altogether or in part the same as or similar to those of the centre in the furtherance of the above named objects

(h) To borrow money either with or without security to be applied to the attainment of the foregoing objects

(i) To contribute to, give to, assist or support any hospital, charitable, social sporting or benevolent Society, Institution, Board, Club, Centre or Association

(j) To remunerate any person, firm or company, society or body corporate, for services rendered to the Centre.

(k) To indemnify all members the Management Committee and all agents of the Centre against all claims and demands made on them or arising from acts done by them in good faith on behalf of the Centre or in the furtherance of the objects of the Centre

(l) To co-operate with other Centres, Associations, Clubs and Bodies Corporate in New Zealand or elsewhere for the purposes of attaining any of the foregoing objects

(m) To do all other acts and things incidental to or conductive of the attainment or furtherance of the aforesaid objects.

(n) To carry out all things within the Rules and laws of the NZSF and those rules as may in the opinion of the Centre be calculated to forward the Centres objects.

RULE 3: INTERPRETATION

(1) These rules and any regulations made hereunder shall be read together with and form part of the rules and laws of the NZSF

(2) These Rules and any Regulations made there under, unless repugnant to the context:-(a) The singular shall import the plural

(b) The male shall import the female

(c) 'Club' shall mean a bona fide swimming club. A bona fide swimming club to be recognised as such by the Federation must number not less than twenty members liable under the rules of the club for the payment of the regular subscription, such members to be amateurs as defined by Laws of the NZSF, and must have a published rule to that effect.

(d) 'Member' of a club shall mean a financial declared member, one who is liable under the rules of the club for the payment of the regular club subscription

(e) 'Honorary Member' of a club shall mean one coming within the definition set out in the Laws of the NZSF.

(f) 'Member's of the Centre shall mean any delegate duly appointed by a Club to the Centre under Rule 16 hereof, or any officer who under the rules or Regulations of the Centre is an exofficio member of the same.

(g) 'Federation' shall mean the New Zealand Swimming Federation

(h) 'NZSF' shall mean the New Zealand Swimming Federation (Incorporated)

(i) 'Council' shall mean the Council of the NZSF as constituted by the Rules and Laws of the NZSF.

(j) 'Delegate' shall mean a representative of a club on the Centre duly appointed in accordance with Rule 15 hereof.

(k) 'Inter-club carnival' shall mean a swimming carnival or competition at which members of clubs in addition to members of the promoting club may compete, or any carnival or competition organised by the centre, or by any person or body under Centre permit at which members of more than one club competes

(l) 'Centre' shall mean Hawkes Bay Poverty Bay Swimming

(m) 'Rules' of the Centre shall include any Regulations made thereunder.

(n) 'Rules' of the Federation shall include the Laws of the Federation

RULE 4: BOUNDARIES

The boundaries of the Centre shall be those laid down from time to time by the NZSF

RULE 5: HEADQUARTERS

The headquarters of the Centre shall be at Napier or at such other place as shall be determined by a vote of the clubs affiliated through the Centre, provided always that the headquarters of the Centre shall be the headquarters of a club

RULE 6: COLOURS

The colours of the Centre shall be Black White and Red

RULE 7: CONSTITUTION

(1) The Centre shall consist of such recognised bona fide swimming clubs within the Centres district as are now affiliated with the Federation and such clubs as may from time to time be affiliated in the manner provided in the Laws of the Federation and that have signified their consent to be governed by the Rules and Laws of the Federation and the Rules and laws of this Centre, but no club shall have the to take part in the management of the affairs of the Centre except by delegates as hereinafter provided.

(2) The Centre shall have over clubs, members, officials and others within its district power of suspension or cancellation of appointment similar to the powers of the Council.

(3) Subject to the provision of Rule 40 hereof clubs shall have over their own members and officers powers of suspension or cancellation of appointment similar to the powers or the Centre

(4) The Centre may delegate administration and control of swimming to Sub Centres

a A Sub Centre (known as Eastland Swim) and consisting of at least one representative from each affiliated club in the Gisborne / Wairoa area

andA Sub Centre (known as Swim Hawkes Bay) and consisting of at least one representative from each affiliated club in the Napier / Hastings / Central Hawkes Bay areas.

b Each Sub Centre will elect its own Chairperson and Administrator (Secretary / Treasurer)

c Each Sub Centre will organise swimming in its own area, subject only to directives from the Centre where any decision by a Sub Centre conflicts with a decision made by the Centre.

d Each Sub Centre will be responsible for all aspects of publicity and promotion within their respective areas

RULE 8: AFFILIATION

(1) A club wishing to join the Federation shall apply in writing to the Secretary of the Centre. The application must be accompanied by a copy of the club's rules and a statement of the number of its members, together with such information as the Centre may require or as may be called for by the Council.

(2) The Centre shall forward the application together with such recommendation as it may deem proper, to the Council, which alone shall decide whether the affiliation shall be granted.

(3) The affiliation of the club shall operate as an agreement binding such club and the members thereof to abide by the Rules and Laws of the association and of the Centre and to accept and enforce all their lawful decisions. Any breach of this agreement shall render such club liable to suspension either by the Council or the Centre or to expulsion by the Council

RULE 9: CLUB COLOURS

All clubs shall register their club colours with the Centre and a register of such colours shall be kept by the Secretary.

RULE 10: FEES(1) Each club shall pay to the Centre such affiliation fee as shall be approved from time to

time by the a General Meeting of the Centre, and in addition thereto shall pay to the Centre for transmission to Council, an affiliation fee as set out in the Rules of the NZSF

(2) Club members must be registered and affiliated before they can enter in any competition sanctioned by the NZSF or HBPB Centre. A person will be considered registered when the Centre Registrar has received that persons name and appropriate fee.

(3) Any club which shall have failed to pay its subscription by due date, shall be excluded from representation on the Centre during such period as the default shall continue, provided that the Centre may, by special resolution, assented to by three fifths of the delegates present at the meeting at which the matter is considered, grant an extension of time to such Club, or an exemption from the payment of Centre fees if the circumstances, in its opinion warrant such a course; and the Centre may further make to the Council such recommendation as it may deem fit regarding any sum due by such Club to the Council. Exclusion from representation on the Centre shall have the effect of suspension on the Club and the members thereof.

(4) Affiliation fees to the HBPB Centre will be set at the Annual General Meeting to take effect from the 1st April following. These fees will be in addition to any fees set by the NZSF

(5) Swimmers belonging to the “United Swim Team” will not have to pay any levies as they will already have paid a levy through their parent club.

(6) Levies to NZSF for swimmers belonging to “United Swim Team” will be paid to NZSF as “United Swim Team” and not their parent club as a swimmer will only have to pay one levy per season to NZSF regardless of how many clubs they belong to. The “United Swim Team” will confirm to the Centre registrar who these swimmer will be by due date as agreed by the Centre Management and the “United Swim Team” each season

The levy to the Centre for “United Swim Team” swimmers will continue to be paid to the Centre by the “Parent Club” and not the “United Swim Team” as a swimmer only has to pay one levy per season to the Centre regardless of how many clubs they belong to.

RULE 11: ARREARS OF FEES

(1) Any member of an affiliated club who is in arrears with the payment of any subscription or other money owing by him to such club or to any other club, Sub Centre or other swimming Authority shall be posted to the Centre as a defaulter and thereupon he shall not be permitted to swim in any race under the control of the Centre or any club affiliated through the Centre until such monies are paid

(2) The declaration by the Centre that a person is a defaulter shall have all the effects of suspension upon the said person

(3) The Honorary Treasurer of each club shall furnish to the Secretary of the Centre in time for presentation at the annual meeting of the Centre a list of such defaulting members at that date together with the sums due by each of them respectively and may at any time subsequently furnish the Secretary of the Centre with additional names of defaulters together with the amounts due by each of them.

(4) Any person posted to the Centre as a defaulter shall pay the amount due, plus the surcharge as herein after provided into the hands of the Treasurer of the Centre, or in the manner provided in Clause 5 Rule 11 hereof before he may be reinstated, but, unless the Centre has specifically determined otherwise in a particular case or cases, reinstatement shall follow immediately and automatically upon the due discharge of the debt. Where the Centre has specifically determined otherwise in a particular case or cases reinstatement shall be subject to such conditions as the centre shall determine.

(5) In the case of a club situated more than five miles from the headquarters of the Centre payment made to the Honorary Treasurer of the Club and by him notified to the Secretary of the Centre shall be deemed sufficient.

(6) In every instance the amount due by any defaulter and outstanding for 14 days after being demanded shall be subject to a surcharge of 25 per cent which shall become the property of the Centre.

RULE 12 : ANNUAL RETURNS

Each club shall, prior to the Annual Meeting of the Centre, forward to the Secretary of the Centre: -(a) A copy of the club's annual report and a duly audited balance sheet.(b) All affiliation fees and forms as required by rule 10 hereof.(c) The name and address of the delegate(s) who will represent the Club on the Centre

during the ensuing year.(d) The Annual Balance date of each financial year of the Centre shall be 31 March.

No club that has failed to comply with this provision may be represented at the annual meeting of the Centre and such club shall be excluded from representation while such default continues. Exclusion from representation on the Centre shall have the effect of suspension on the club and the members thereof, and in such cases the provision of the Laws of the NZSF apply.

RULE 13: RESIGNATION AND STRIKING OFF

(1) Any Club or Federation may resign from the centre by giving written notice of such intention to the Secretary of the Centre, but such Club or Association shall continue liable for all affiliation fees and other monies due or accruing due to the Centre or Association and unpaid at the date of such resignation.

(2) Any Club or Association may by resolution passed at a special meeting of the Centre be struck off the roll in cases where such Club or Association:-

(a) has ceased to be financial.(b) has committed a breach of the rules of the Centre or Association or permitted or

condoned any breach thereof by any of it's members.(c) has ceased to exist.(d) has by alteration of boundaries ceased to be within the Centre's territory.

(3) The provisions of Rule 39 hereof shall apply in all cases of striking off under Clause (a) and (b) of the last preceding section.

(4) In the event of the dissolution of a club or a club through any other cause ceasing to exist the funds and property thereof after the discharge of all liabilities shall in the absence of a specific rule to the contrary in the rules of such club be handed to the Centre to be disposed of as the Centre shall determine. In no event shall the surplus assets of a club be divided among the members thereof nor shall the members of the club have any beneficial interest therein.

RULE 14: TRANSFERS

(1) No swimmer whose name appears on the membership list as a member of a club shall represent any other club during the season then current unless a transfer of the said member from that club to the other club has been granted by the Centre. The appearance of the name of any swimmer on the membership list of a club submitted by the Secretary of the club to the Centre in the number laid down in rule 12 hereof shall be accepted by the Centre as prima facie evidence that the said name is properly included in such list.

(2) Application for a transfer shall be made by the swimmer concerned to the Centre in writing and the Centre shall have discretion to grant or refuse such transfer.

(3) In no case shall a transfer be granted by the Centre unless evidence satisfactory to the Centre is produced that the Laws of the NZSF has been complied with.

(4) Each application for a transfer shall be accompanied by a fee of $5.00 which shall remain the property of the Centre except in the case of swimmers transferring to and from the “United Swim Team” where in that instance the Fee would be waived

(5) Notice of the receipt of an application for a transfer shall be forwarded by the Secretary of the centre to the Club which the swimmer proposes to leave and to the Club which the swimmer proposes to join, and both clubs shall be entitled to make such representations to the Centre as they shall deem fit, but neither Club shall be entitled to vote on the application.

(6) "The Season then Current" for the purpose of this rule shall mean from the 1st day of April in one year to the 31st day of March in the following year.

(7) Temporary transfers may be granted to former swimmers of the Centre wishing to return for periods not exceeding 12 weeks and compete in Centre Championships provided that they

i) have been a member of a HBPB Swimming club for at least 1 financial year

ii) are currently registered with another RegionHBPB Swimming affiliation (not SNZ) fees only will be payable.All other applicants must comply with Rule 36 (6).

RULE 15: REPRESENTATION

(1) Each club or other body affiliated with the Federation through the Centre shall be entitled to representation on the Centre as follows:-

(a) One delegate for each complete 50 members with the exception for any number up to the first 50 who shall be entitled to a vote with a maximum of three delegates from any one Club. Membership to be taken on each year's return of clubs which shall remain for that season.

(b) The representation of any organisation other than those enumerated above shall be as the Centre shall by Regulation prescribe.

(2) Delegates shall be members of the clubs they represent, subject to the following exception:Where the headquarters of a club are situated a distance of more than five miles from the headquarters of the Centre, such club may delegate a representative or representatives other than a member to represent it on the Centre, provided that unless the council upon the advice of the Centre has authorised to the contrary the representative or representatives so appointed shall not be members of clubs with more than one member already acting in such a capacity. Should a representative appointed under this exception not be a member of any club, his admission as a delegate on the Centre, shall be subject to his being an amateur and subject further to the approval of the Centre, and the Centre may decline to accept him as a delegate without giving any reason therefore.

(3) For the purposes of this Rule the headquarters of the Centre shall be deemed to be the place at which meetings of the Centre are customarily held.

RULE 16: OFFICERS

(1)The Officers of the Centre shall be-a Patron, a Vice Patron, a President/Chairperson, two Vice Presidents (one from Eastland Swim, one from Swim Hawkes Bay), a Secretary, a Treasurer (or Secretary/Treasurer), two Selectors (one from Eastland Swim, one from Swim Hawkes Bay), a Registrar, a Recorder and members of the Centre Management Committee

The President of the Centre shall be independent of the Regional Committees"

(2) The officers named in Section 1 hereof shall be ex-officio members of the Centre. They may be chosen from the delegates to the Centre or otherwise as the Centre shall determine.

(3) The Management Committee shall consist of 6 members. The President / Chairperson and 2 members nominated by Eastland Swim and 2 members nominated by Swim Hawkes Bay and 1 member nominated by SCAT

The President/Chairperson shall be Chairperson of this Committee"

(4) In addition to the foregoing officers the Centre shall appoint an Honorary Auditor and an Honorary Solicitor who shall be qualified by professional status.

(5) The duties of the Officers of the Centre shall be as the Centre shall by regulation prescribe.

(6) The President, Honorary Secretary, Selectors, and Life Members of the Centre shall have the right of entry free of charge to any swimming meeting of the Centre or any Club within the Centre's district held under the Rules of the NZSF

RULE 17: ELECTION OF OFFICERS

The Officers of the Centre shall be elected at the Annual Meeting of the Centre in eachyear. In all cases of contested offices the voting shall be by secret ballot.

No nomination shall be accepted unless the Chairman is satisfied that the nominee is willing to accept office. Scrutineers for the examination of ballot papers shall be appointed by the Chairman.

RULE 18: ANNUAL MEETING

(1) The annual meeting of the Centre shall be held on or before 31 July in each year.

(2) The Order of Business at the Annual Meeting shall be:-

(a) Apologies for the absence and verification of proxies.(b) Confirmation of the Minutes of the proceeding annual meeting.(c) Notification of the names of delegates appointed by clubs for the ensuing year.(d) Tabling of Reports, Balance Sheets and Returns of Clubs from Clubs. No Club that

has failed to provide copies of it's Report and Balance Sheet and it's Return of Clubs shall be permitted to participate in the meeting.

(e) Consideration of the Centre's Annual Report and Balance Sheet.(f) Consideration of motions of which notice has been given.(g) Election of Officers.(h) Consideration of Registration Fees, Levies, Honorariums.(i) Determine dates and entry fees for Centre Championships.(j) General Business.

The order in which the business is to be taken may be varied by the Chairperson for any reason which he/she deems sufficient.

(3) Notice of the date, time and place of holding the annual meeting shall be forwarded to the Secretary of each affiliated club and to each member of the Centre at least twenty eight (28) days before the date of the meeting. When practicable such notice shall be accompanied by a copy of the Centre's annual report and balance sheet.

(4) The Centre Secretary shall immediately after the annual meeting of the Centre furnish to the Secretary of the Council:-

(a) The name of each club affiliated through the Centre.(b) The name and address of the Secretary of each Club.(c) The number of members of each club as at the annual meeting of the club last past.(d) A copy of the Centre's annual report and a duly audited balance sheet.(e) The name of the delegate elected to represent the Centre on the Council for the

ensuing year.

(5) The venue of the Centre AGM for the following year shall be decided at the AGM

RULE 19: REMITS

19 All remits to be brought before a General Meeting shall be in the hands of the Secretary at least forty two (42) days before the date of the meeting and shall be circulated to all club delegates at least twenty eight (28) days before the meeting.

19(1) Remits may be submitted by the Centre, Sub Centre, Clubs or a member affiliated to the Centre

RULE 20: NOMINATION OF OFFICERS

All nominations for Officers of the Centre shall be in writing and in the hands of the Secretary at least forty two (42) days before the date of the meeting and circulated to all club delegates at least twenty eight (28) days before the meeting and signed by the nominee as an acceptance of the position should he/she be elected to it. Provided that if no nomination is received for any position the chairperson may, with the consent of the meeting, accept suitable nomination from the floor, such nominations to have the prior consent of the nominees.

RULE 21: GENERAL MEETINGS

(1) Special Meetings of the Centre may be called by the Management Committee at any time. Notice of the holding of a Special Meeting shall be given by the Secretary in writing to each member of the Centre and to the Secretary of each Club at least fourteen (14) days before the date set down for the meeting. The notice shall state the business to be transacted at such meetings and, except with the assent of three-fifths of the delegates present and entitled to vote at the meeting, no business other than that set out in the notice shall be transacted at such meetings.

(2) Extraordinary General Meetings shall be called by the Secretary on receipt of a requisition signed by at least two thirds of the clubs and setting forth the nature of the business to be transacted at such meeting. Immediately upon receipt of such a requisition the Secretary shall take steps to convene the extraordinary general meeting.At least fourteen (14) days notice of such meeting shall be given in writing to each affiliated Club, and the notice shall be set out explicitly the nature of the business proposed to be transacted in accordance with the requisition. At such extraordinary general meetings no business other than that set out in the notice calling the meeting shall be transacted.

(3) If at the time when any meeting of the Centre must terminate the business set down to be transacted has not been completed, the Chairperson with the concurrence of the meeting, may adjourn such meeting, and such adjournment may be repeated as often as is necessary to complete the business set down to be transacted. The verbal announcement of the Chairperson of the time, date and place of such adjourned meetings shall be sufficient notice of same.

(4) At all meetings of the Centre where not specifically provided for under these Rules. Parliamentary Standing orders shall apply.

RULE 22: QUORUM

(1) Three fifths of the members of the Centre entitled to attend a General Meeting thereof shall constitute a quorum at such meetings.

(2) Except as hereinafter provided no business shall be transacted at any General Meeting of the Centre unless a quorum of members is present in person or by proxy

(3) If within fifteen minutes from the time appointed for the commencement of the meeting a quorum is not present the Chairperson shall declare the meeting lapsed, and the meeting shall then stand adjourned to the same day in the next week at the same time and place, or to such other day, time and place, not being more that fourteen (14) days after the date of such meeting as a majority of the members present shall determine; and if at such an adjourned meeting a quorum is not present at the expiry of fifteen minutes from the time appointed for the commencement of the meeting, then those members who are present shall constitute a quorum and may transact the business for which the meeting was called. The verbal announcement of the Chairperson of the day, time and place shall be sufficient notice of such adjourned meeting.

(4) If within fifteen minutes from the time appointed for the commencement of an extraordinary general meeting called by requisition a quorum is not present the Chairperson shall declare such meeting dissolved.

RULE 23: VOTING

(1) Delegates shall be entitled to vote at meetings of the Centre, but the Chairperson shall be entitled to a vote whether he is a delegate or not.

(2) In the case of equality of voting the Chairperson shall have a casting vote at well as a deliberate vote.NOTE: It is correct practise in Chairpersonship to give the casting vote in favour of the status quo.

(3) Voting shall be on the voices save where a vote is challenged, when a show of hands may be taken. When demanded by two or more delegates representing different clubs a division shall be taken. In all cases of division the voting shall be recorded in the minutes.

(4) Ex-officio members of the Centre may move or second motions but unless they are also delegates they may not vote.

(5) Members of the Hawkes Bay Poverty Bay Swimming Centre Management Committee shall have the same voting rights as delegates at the Centre A.G.M. and at full Centre meetings. These members shall only have the right to one vote. If a Management member attends a meeting as a club delegate he or she shall only have the right to vote as a delegate.

RULE 24: PROXIES

(1) Any delegate representing a club or the Secretary of such club may appoint a proxy to represent such delegate at any meeting of the Centre; any member of management may appoint a proxy, and such proxies, unless limited by the document appointing them shall have all the powers of speech and vote possessed by the delegates for whom they have to act.

(2) All proxies shall be in writing and shall be handed to the Chairperson at the commencement of the meeting.

(3) Proxies may not, without the consent of the Centre, be given for more than two consecutive meetings in respect of the same delegate.

(4) Except in the case of a delegate coming within the scope of Section 2 of Rule 15 hereof of a proxy may be given only to a member of the Centre or to a member of the club in respect to whose delegate such proxy is given.

RULE 25: MANAGEMENT COMMITTEE

(1) The Management Committee shall be the executive of the Centre. In addition to the powers and authorities by these rules either expressly or implied conferred upon it the Management Committee may exercise all such powers and do all such acts and things as may be exercised or done by the Centre and are not required by these rules or by any statute and to the rules and bylaws of the Centre for the time being in operation provided that the making of any new bylaw or the revision or alteration of any bylaw shall not invalidate any prior act of the executive committee which would have been valid if such new bylaw or such revision or alteration had not been made.

(2) The Management Committee shall have power to make at all competitions or other

functions controlled or held by the Centre bylaws for carrying out and enforcing these rules and for conduct of all competitions and for the conduct of all members and may repel or alter such bylaws from time to time.

(3) The Management Committee may from time to time appoint subcommittees to deal with any such matter relating to the affairs of the Centre as the Management Committee itself has power to deal with and may from time to time delegate to such subcommittees or to any members of the Centre any of the powers conferred upon it by these rules including this power of delegation.

(4) The Management Committee shall furnish a report to the Centre at each General meeting on the working of the Centre during the year.

(5) Members of the Management Committee who wish to resign may do so on giving the Secretary twenty eight (28) days written notice of the intention to do so and shall continue in office until the expiry of the time or until a replacement has been appointed whichever first shall happen.

(6) The office of any member who is absent three (3) consecutive meetings of the Management Committee without reasonable excuse shall, at the discretion of the committee, be declared vacant and be filled.

(7) Any vacancies occurring in the Management Committee during the year may be filled by Eastland Swim or Swim Hawkes Bay as is appropriate.

(8) The date and time of the following Meeting shall be set during the current Meeting. The Chairperson may also call for a Management meeting.Management Committee meetings may be held by Conference Telephone

Meetings shall be convened by the Secretary giving to each member of the Committee at least fourteen (14) days written or verbal notice.

(9) Four members personally present shall constitute a quorum.

(10) At meetings of the Management Committee the Chairperson shall have deliberate vote and in the event of an equality of votes also a casting vote.

(11) Proper minutes shall be kept of each meeting of the Management Committee and such minutes signed or purporting to be signed by the Chairperson of the meeting or by the Chairperson of the next succeeding meeting prima facie evidence of the matters set out in such minutes.

(12) Management to appoint from their Committee annually one person responsible for all aspects of publicity and promotion.

RULE 26: COMMITTEES

(1) The Centre may at any time appoint emergency or other committees and shall on appointment prescribe The duties of such committees and may from time to time dissolve such committees and appoint others in their stead or alter the personnel of such committees as the Centre shall determine.

(2) The Centre may at any time appoint sub-committees and in the appointment of such sub-committees shall not restrict from choosing from among its members. The Centre shall prescribe the duties of such sub-committees and may from time to time dissolve such sub-committees and appoint others in their stead or alter the personnel of the sub-committees as the Centre shall determine.

(3) A committee or sub-committee shall be bound by its order of reference and shall carry out the duties assigned to it by such order of reference with due dispatch and shall where such order requires a report by a given date report to the Centre on such date, or in default of such report it may apply to the Centre for further time and the Centre may grant such further time or dissolve the committee or sub-committee as the Centre shall determine.

(4) The Centre may delegate all or any of its powers to a committee or club.

(5) Club delegates to the Centre be required on request to serve on Management sub-committees.

RULE 27: ATTENDANCE AT MEETINGS

Any delegate absenting himself from two consecutive meetings of the Centre without cause to the satisfaction of the Centre having been shown shall be deemed to have vacated his seat and the seat shall be declared vacant. The club which such delegate represented shall have the right to appoint another delegate, but it may not in the season then current re-appoint the delegate whose seat has been declared vacant.

RULE 28: LIFE MEMBERSHIP & BLAZER COMMITTEE

(a) The Life Membership and Blazer committee shall consist of:-One Life Member of the Centre.Two Service Award holders of the Centre.Plus the President who shall be the independent Chairperson

(b) A member shall retire by rotation annually, and be replaced at the Annual General Meeting by a member with comparable qualifications. The retiring member shall be eligible for re-election.

(c) If for any reason, a position becomes vacant out of rotation, a replacement by a member of comparable qualification shall be appointed by Management to serve until the next full Centre Meeting.

Responsibility of the Life Membership and Blazer Committee:

The Committee shall govern life membership and other awards.

The Committee shall strictly guard the status of all awards.

The Committee's decision shall be final.

Only affiliated members will be considered for awards

All representation by the Committees and to the Committees shall be treated as strictly confidential.

The Awards shall be firstly and finally announced at the Centre's Annual General Meeting.

Those not granted an award can re-apply next year.

Nominations close with the Centre Secretary on 30 April each year. No late entries.

Clubs to be reminded in December to work on citation.

Five copies of Citation to be sent Centre Secretary to pass on to the Judges.

1. The Life Membership Award.

(a) The Centre may elect to Life Membership of the Centre any person who in the opinion of the Centre has rendered conspicuous service over a long period of time.

(b) A candidate for Life Membership may be nominated by the Centre Clubs and forwarded to the Blazer Committee together with the grounds of support thereof.

(c) A Life Member of the Centre shall not, unless he is otherwise qualified, have the right to vote on matter before the Centre, but he shall have the right to speak and to move and second motions.

(d) A Life Member of the Centre shall have the right of entry free of charge to all meetings held within the Centre's district under the Rules of the NZSF

(e) The number of Life Members of the Centre should not be capped and should be based purely upon service to the Centre.

2, Service Awards

(a) The nominee must for a lengthy period, have given outstanding service to the Centre (not less than 12 years).

(b) Honours to Service Award.Five years after receiving service award, if these years are of the high standard which gave the first award.

(3) Officials Awards

(a) The nominee must have officiated at two or more Centre Championship meetings, and as a club official for at least six years, i.e. Club Secretary, Pool Official, Office Official, Learn to Swim, and in all aspects of the sport.

(b) And/or the nominee must have officiated for two or more years as an official at carnivals controlled by district Central Committees and as a club official for at least six years. Note: 'Official' for the purposes of this rule shall include Team Managers and Club Secretaries.

(4) Competitors Award

(a) A certificate will be presented to a swimmer swimming ten representative swims for HBPB Swimming.

(b) Swims to be Junior Nationals, National Age Groups, Div. II Age Groups, Winter Nationals, Open Nationals, North Island Champs and any other Centre representative team.

(c) Open Nationals and National Age Groups individual medallists to have automatic qualification.

(5) General

(a) The cost of the Blazer and Pocket Award shall be borne by the applicant.

(b) The Blazer, Cardigan or Jersey shall be black with NZSF buttons.

(c) The pocket award or monogram shall be worn on a Blazer, Cardigan or Jersey.

(d) The Service and Officials awards shall be a certificate

The Honours to Service Award shall be a metal badge of a design approved by HBPB Swimming

(e) The Management Committee is empowered to grant permission for a person to wear the Official Blazer pocket of the Centre where circumstances are justified i.e Managers and Chaperones where they are not otherwise qualified. Permission is of a temporary nature for the meet current only.

RULE 29: THE SECRETARY

The Secretary shall:-

(a) Attend all meetings of the Centre and of the executive and General Committees and shall keep a Minute Book and record therein all proceedings that take place at meetings and all resolutions that are passed before such meetings and whether such resolutions are carried or defeated.

(b) To complete a roll of members.

(c) Keep all records of all Officers and representatives of the Centre and off all Championship winners.

(d) Conduct all correspondence on behalf of the Centre.

(e) Carry out all the other duties that are normally the responsibility of the Secretary.

RULE 30: THE TREASURER

The Treasurer shall perform all the duties in connection with the finance of the Centre and in particular shall receive all moneys belonging to the Centre and lodge them to the account of the Centre and shall keep a true and correct record of all financial transactions and of all moneys paid or payable to or by the Centre. At the end of each year he/she shall prepare a balance sheet and a statement of income and expenditure for presentation at the Annual General Meeting.

RULE 31: LOCAL OFFICERS

(1) Their duties shall be to attend all Centre swimming meetings in the Centre areas and to report to the Secretary of the Centre on the general conduct of such meetings.

(2) At every swimming meeting the Local Officers shall have access, free of charge, to all parts of the pool.

(3) They shall work with the Centre Billeting Officer, help Clubs in their area with the smooth running for all Club affairs and carnivals and advise who to contact where problems occur.

RULE 32: POWERS OF THE HANDICAPPER

(1) No handicap shall be altered after it has been declared except in the following cases:-

(a) Mistaken identity.

(b) Where a competitor's performance is not known to the handicapper.

(c) Where the competitor has won a race since the handicaps have been declared. ('Declared' for the purposes of this rule shall mean the time when the handicapper delivers the handicaps to the Secretary of the meeting.)

(2) The duties of the handicapper will be carried out by the Convenor of Centre Selectors.

RULE 33: DUTIES OF THE SELECTORS

The duties of the selectors shall be:-

(1) To select representatives teams as directed by the Centre.

(2) To select and announce the "Swimmer of the Year"/Diver of the Year" Award half way between the meeting at the Hawkes Bay Poverty Bay Championships.

(3) The selectors shall appoint their own Chairperson from their own number.

RULE 34: FUNDS

(1) All monies received by the Centre shall be placed to the credit of the Centre's account in a bank approved by the Centre and all disbursements of Centre funds shall be by cheque signed by the Hon. Treasurer and by one of the other members appointed by the Centre for that purpose. No money from the Centre's account shall be paid expect pursuant to a resolution duly recorded in the Centre's Minute Book.

(2) The income of the Centre from whatever source derived, shall be applied solely towards the promotion of the objects of the Centre or towards the repayment of monies borrowed by the Centre.

(3) The Management may from time to time set aside such funds as it may consider to be surplus to current requirements such surplus funds may be invested in the name of the Centre in:-

(a) A Trustee Savings Bank.

(b) Fixed Deposits with any Trading Bank in New Zealand.

(c) A Building Society registered under the Building Society's Act, 1908 or it's amendments.

(d) Mortgages or contributory mortgages of freehold or leasehold land.

(e) Such investments as are for the time being authorised for the investment of trust funds AND the Management Committee may deal with, dispose of, vary or transpose such investments or any part thereof as it may think fit for the benefit of the Centre.

(4) All cheques, bills of exchange, promissory notes, deeds, agreements or documents of any kind to be executed accepted or endorsed by the Centre shall be signed by the Treasurer and any one of the President, Secretary or Trustees.

(5)a The Centre may have a travel account.The Travel Account to be funded by a levy of $1.00 from every registered competitive and learner swimmer in the Centre

(5)b A levy be paid of $1.50 from every entry in the HBPB Summer and Winter Championships to cover Centre Expenses e.g. Managers expenses, with the excess income to remain in the Travel Account for the use of swimmers representing the Centre, or for any other purpose as the management committee may decide which directly relates to swimmers activities

RULE 35: INTER-CLUB COMPETITION

(1) All interclub races, carnivals and competitions shall be under the control of the centre.

(2) A club desiring to conduct an inter-club carnival shall make application to the Centre for permission to do so, and the Centre shall grant such application or not as it shall deem fit, and, in granting permission, may impose conditions as it shall determine.

RULE 36: CENTRE CHAMPIONSHIPS

(1) The Centre may conduct annually such Centre Championships as it shall determine. The Championships events shall be those prescribed by the Regulations of the Centre.

(2) The Centre shall allocate annually the venues and duties of the Championships, which will be run by the respective Sub Centres.

(3) Any club wishing to conduct a Centre Championship event or events shall apply to their Sub Centre in writing for permission to so do, and the Sub Centre may grant such application on such terms as it shall deem fit.

(4) All swimmers in the Centre Championships must be nominated by their clubs which shall be responsible for their entrance fees, and in the event of the entrance fees being unpaid the swimmers shall be absolved from all liability under Rules 11 and 37 hereof, but their clubs shall be regarded as unfinancial until such fees are paid.

(5) The Centre reserves full power over Centre Championships events whether conducted by a Sub Centre or by a club or clubs.

(6) Centre Championships shall be open only to swimmers of the Centre, i.e. swimmers whose permanent homes are within the Centre's territory and who are members of the clubs affiliated through the Centre. Swimmers from another Centre moving into the territory of the Centre to take up permanent residence must have been so resident for not less than on calendar month before qualifying as swimmers of the Centre.

(7) Nothing in this rule shall debar the Centre from permitting a visiting swimmer from another Centre to swim in a Centre Championship Event, but such visiting swimmer, should he/she win, may not hold the title nor receive any prize, save, with the prior approval of the Centre. Only one visiting swimmer may swim in each final except where there are insufficient Hawkes Bay / Poverty Bay swimmers to fill all lanes.

(8) No Club, sports promoter or other body or person shall employ or permit to be employed the term championship in respect to any race other than a club championship or a school or similar scholastic championship, or a purely naval, military or Air Force competition conducted by those services respectively without the approval of the Centre, nor, without the prior approval of the Centre shall any description be applied to any race or any device or advertisement employed that will or may convey the impression that any event is a championship event carrying a title reserved by these Rules to events held under the Rules of the NZSF

(9) (a) Points be allocated to club and individual swimmers for all open events in Centre Championships.

(b) The 1500m and 800m freestyle events to be swum prior to Centre Championships on time trial basis in both Hawkes Bay and Poverty Bay.

(c) 400m Individual Medley to be swum as a straight final in the heat time. Fastest swimmers in one heat. Fastest 7 times gain points.

(d) That any race in any stroke requiring two or more heats be finalised on a times basis where the race is 400m or more.

RULE 37: ENTRANCE FEES

(1) Entry Fees to the Hawkes Bay/ Poverty Bay Championships shall be decided annually.

(2) No entry shall be in order where the entrance fee is not paid, and scratching for a race shall not relieve the competitor of the liability of paying his entrance fee.

(3) Under no circumstances shall a competitor be permitted to participate in a competition in contravention of the provisions of the preceding section; the club or sports promoter shall not be entitled subsequently to recover such entrance fees.'

(4) A competitor starting in any race when he has made default in payment of any entrance fee for that or any prior event or events shall be disqualified and shall be reported to the Centre in accordance with Rule 11 hereof.

RULE 38: SUSPENSION

Rules of NZSF will apply.

RULE 39: EXPULSION

Rules of NZSF will apply.

RULE 40: DISQUALIFICATIONS

Rules of NZSF will apply.

RULE 41: APPEALS

(1) Any person or body within the jurisdiction of the Centre may appeal to the Centre.

(2) All appeals shall be governed by the Rules of the NZSF

(3) A fee of $10 is payable for each appeal lodged.

RULE 42: RECORDS

(1) The Centre will recognise records only for current Centre (and/or New Zealand National) Championship distances and other events and distances as determined by the Centre.

(2) The Centre shall recognise a record establishment only in a pool of a length of 25 metres or longer. The Centre shall recognise only one record for each distance. Long course records must be broken in a 50m or 55 yard pool and Short course records must be broken in a 25 metre or 36 2/3 yard pool.

(3) (a) With the exceptions quoted in 3 (b) and 3 (c) below, Centre records may be broken only by affiliated Centre swimmers and within the boundaries of the Centre.

(b) A centre swimmer, competing at an International Meet, the National Open or National Age Group Championships, or a recognised meet conducted under the Rules of the NZSF may have his/her performance recognised as a Centre record.

(c) A Centre swimmer, who breaks a New Zealand Record, shall have his performance recognised as a Centre Record, if it be one.

(d) A record must be held for 24 hours before it will be recognised. Records which are made then broken at the same meet will not be recognised.

(4) (a) Any Centre swimmer may break the Senior record for his/her sex.

(b) With the exception of 4 above, an age-group swimmer may not break a record in any other age group but his/her own. The age for establishing a record is age on day of swim.

(c) A record may be recognised for a performance in an event comprising any mixture of age group, and style of swimming, provided that the Referee of the meeting is satisfied that no 'Pacing' has taken place.

(d) A swimmer who wishes to attempt to break a record, swimming backstroke, breaststroke, or butterfly, in a freestyle race must advise the Referee of the meeting of his intention before the start of the race.

(e) A record will be allowed only in a "scratch" race or in an individual race against time.

(5) (a) A performance for which a record is claimed, must be under the direct control of a Referee who must ensure that all Rules of the NZSF pertaining to records are fully observed.

(b) Three timekeepers shall independently keep the time for the performance. They must not perform any other duties.

(c) A Chief Timer shall personally examine the watch faces and sign the statement on the record application form, quoting the three times, and the resultant computed time. Where two watches agree, that time shall be taken, but where all differ, the time of the middle watch shall be taken.

(d) The Referee may also examine the watches, which must not be cleared back until authorised by the Chief Timer.

(6) Electronic watches may be required to be certified as accurate.

(7) (a) Application for recognition of a record must be made on the prescribed form. It shall be the responsibility of the Manager of the swimmer seeking to have a time recognised to have the form completed and sent to the Centre Recorder.The Referee and Chief Timekeeper shall provide without undue delay any signed statement required"

(b) No application will be considered by the Centre, unless it is received within fourteen days of the date of the performance. However, if an unavoidable delay, greater than this period, is anticipated, a verbal report to the Recorder, in advance of the written application may be considered by the Centre.

(c) Nothing in 7 or 7 (b) above shall debar a swimmer from making a personal application for recognition of his own performance as a record, provided that all the Centre requirements are met.

(8) (a) Record applications shall be received by the Recorder, checked for correctness of application and then submitted to the Centre meeting for approval.

(b) If approved, full details of the Record shall be published in the Minutes of such meeting, and such minutes shall be the authority for the entry of the Record in the Record Book.

(c) The Centre may appoint a Recorder / Record Keeper, who shall be responsible for entering all approved records in the record book and for providing a complete and up to date list of current records when requested by the Centre. He/she shall also provide to the Centre Secretary, a record certificate for every approved record, for forwarding to the swimmer concerned.

(d) Records established at the HBPB Summer and Winter Championships, the North Island, Age Group, Division II, Junior National, Open National and Winter National Championships do not require an application form to be submitted.

The Sub Centre holding the HBPB championships will supply to the Recorder a complete list of results and times with any new possible records noted. The Secretary will send the Recorder a complete meet results of any National Championship.

Any records will then submitted to the Management for ratification

(9) Equalled records, if approved, shall be recognised and entered in the Record Book, but no certificate shall be issued.

(10) (a) When a new event is instituted, the term "Best Performance" and not "Record" will apply for the first performance. Thereafter any bettered time will become the record if approved.

(b) Best Performance will be entered in the Record Book as such, but no certificate will be issued.

(c) If, at the Centre Championships, 12 months after the inception of such new event, the initial best performance is not bettered, such best performances automatically becomes the Record, the Record Book will be so amended, and a certificate will be issued.

(11) The only teams races, for which the Centre will recognise records, are the "Cup Relays" as swum annually at the Centre Championships.

(12) The Centre does not recognise any conversion times for records, and has long and short course only, whether set in metre or yard pools, and are all called metric records.

(13) Swimmers breaking Centre Records while swimming for the “United Swim Team” will have the Record registered in their name and their Parent Clubs name not the “United Swim Team” name. The “United Swim Team” may not have any Centre Records registered under its name.

RULE 43: SMOKING

No smoking shall be permitteda) At any event / competition in any area designated for competitors, either prior to or

during competitionsb) At administration meeting of the Centre

Smoking shall be discouraged in areas viewed by athletes, sponsors, supporters and the public

RULE 44: REGULATIONS

The Centre may make such Regulations pursuant to the authority vested in it by these Rules as it shall determine, but such Regulations may not conflict with these Rules, Regulations shall have the same force as Rules.

RULE 45: ALTERATION OF RULES AND REGULATIONS

(1) Neither these rules nor the regulations made thereunder shall be added to, rescinded or amended, nor shall any new rule or regulation be enacted save at the Annual Meeting of the Centre or at a Special General Meeting called for that purpose.

(2) Notice of any proposal to add to or amend any rule or regulation shall be sent to each member of the Centre and to the Secretary of each affiliated club at least fourteen clear days before the date set down for the meeting at which such proposal is to be considered.

(3) No motion to amend or rescind any rule or regulation or to enact any new rule or regulation shall be declared carried unless the votes in favour thereof shall be at least three fifths of the total votes cast.

(4) Any amendment or rescission of the Rules of the Centre or any new Rules enacted shall be submitted to the NZSF for approval.

(5) Any rule or regulation change will become effective immediately.

(6) No addition to or alteration of the non-profit aims, Personal Benefit clause or the Winding Up clause shall be approved without the approval of Inland Revenue and the provisions and the effects of this clause shall not be removed from this document and shall be included and implied into any document replacing this document.

RULE 46: SERVICE OF NOTICES

(1) Any notice required to be served may be served by the Centre either by sending it by post in a prepaid envelope or wrapper addressed to the addressee at his or her last known place of address in New Zealand.

(2) Any notice served by post shall be deemed to have been served on the day on which according to the ordinary course it would have been delivered and in proving such service it shall be sufficient to prove that the envelope or wrapper containing the notice was properly addressed and put into the Post Office or posting box under the control of the New Zealand Post and Telegraph Department.

(3) Any notice served personally shall be deemed to have been served when it is handed to the addressee or delivered at his or her address.

RULE 47: ACCESS TO RULES

(1) The rules and regulations of the Centre shall be open to inspection by any member of an affiliated club or organisation affiliated with the Centre at all times that the Secretary of the Centre shall consider reasonable.

(2) Each Club shall be required to purchase from the Centre at such price as the Centre shall determine, at least one copy of the Rules and Regulations of the Centre, and shall from time to time renew such purchase as new editions of such rules and regulations become available.

(3) Every member of the Centre shall be required to purchase a copy of the Rules and Regulations of the Centre and to renew such purchase as new editions become available. A new member, on taking his seat on the Centre, must satisfy the Chairperson that he/she possesses a copy of the Rules and Regulations of the Centre.

RULE 48: INTERPRETATION OF RULES

(1) Subject to the Rules of the NZSF the decision of the Centre shall be final on all matters of interpretation of these Rules and Regulations made thereunder. The Secretary of the Centre shall keep a list of all rulings of interpretation given by the Centre and shall advise the Council Secretary of any rulings.

(2) No difference of opinion or other dispute between a member or members of the Centre or the Management Committee in respect of any matter arising from the interpretation of these rules or the conduct of the Centre's affairs in any respect whatsoever shall be referred by any party to a court of law. A decision of the Management Committee shall be absolutely final and binding when confirmed by General Committee.

RULE 49: PERSONAL BENEFIT

Any income, benefit or advantage shall be applied to the objectives of HBPB Swimming.No member of HBPB Swimming or any person associated with a member shall participate in or materially influence any decision made by HBPB Swimming in respect or the payment to or on behalf of that member or associated person of any income, benefit or advantage whatsoever.Any such income shall be reasonable and relative to that which would be paid in an arms length transaction (being open market value)

RULE 50 WINDING UP(1) HBPB Swimming may be wound up at either an Annual General meeting or a Special

General meeting if a resolution to so wind up is passed by a majority of at least 75% of those present and entitled to vote

(2) If upon the winding up of HBPB Swimming there remains after the satisfaction of all debts and liabilities any property whatsoever the same shall not be paid or distributed among members of the organisation but shall be given or transferred to Swimming New Zealand or to some other charitable organisation or purpose within New Zealand

HAWKES BAY POVERTY BAY SWIMMING CENTREREGULATIONS

CENTRE CHAMPIONSHIPS (GENERAL)

R1(a) The Centre shall annually define the Championship events to be conducted through the current season.

R1(b) A club shall not hold a club carnival when the Centre is holding an inter-club carnival

R1(c) Summer and Winter Championship programmes to be kept by the Secretary, then approved by management then sent by the Secretary six months prior to the meet to the Organising Committee for distribution. All entries to be received by the organising Committee

R1(d) All heats at the HBPB Centre Summer and Winter Championships will be deck seeded i.e. all male and female swimmers under 9 through to 17 and over swim according to time not age group. Finals to be then put into age groups.

The programme will be set at the close of entries. Events with fewer entries than lanes available will become straight finals. Subsequent scratchings which reduce entries in an event to less than the available lanes will still be run as a heat, but with empty lane(s). Competitors will be required to swim in those heats as if there were more entries than lanes available.

R1(e) Except for Individual Medleys, relay team swimmers may swim in any order

R1(e) The 100m butterfly events for both the Summer and Winter Championships be for age groups from 10/under to 17/over

R1(f) The following races be timed finals at both the Summer and Winter Championships1500m Freestyle 800m Freestyle400m Individual Medley 200m Butterfly

R1(g) The entry fee for the HBPB Championships and the Winter Championships be $5.00 per swim event and relays

R1(h) The maximum entry fee for Summer and Winter Championships will be $50.00 per swimmer

R1(i) Swimmer of the Meet

A Swimmer of the Meet trophy may be awarded at the HBPB Championships.Open only to HBPB swimmers, one award to a Male swimmer, another to a Female swimmer.

Award will be based onPoints awarded in finals of events, plus Bonus points for breaking New Zealand and HBPB records. Only one set of bonus points per swim.Bonus points calculated as Time differential / old record x 100 = percentage

R1(j) HBPB Swimming Scratching Rule

For Heats:If a swimmer does not turn up for their heats event they are scratched.

For Finals:Competitors wishing to withdraw from finals events shall do so in writing, through their Manager and lodged with the Meet Controller within the following times -

a) for finals swum in the same session as heats, within 15 minutes of the posting of the list of finalists for that particular event.

b) for finals to be swum at a later session, within 15 minutes of the posting of the list of finalists for the last event swum at the heat session.

Penalty - Finals:Any competitor not having withdrawn as herein before provided and who does not compete in the finals event, shall be deemed a late withdrawal except where there are medical reasons or proved hardship, and shall be debarred from competing in their next scheduled individual event.

Where a Club team is a late withdrawal, that Club shall be debarred from competing in the next teams event for which that Club has entered.

Medical Scratching for Finals:A medical certificate is necessary.For medical reasons you can scratch up to 15 minutes before a session starts (not warm up) but you must scratch for all that session. If taken ill during a session you must scratch for the rest of that session.

The Meet Director shall determine the acceptability on all matters where medical reasons or hardship are claimed.

CENTRE CHAMPIONSHIPS (SUMMER)

R2(a) The events and Age Groupings in the Summer Championships programme will be 50m Free, Back, Breast, Fly 9/u, 10, 11, 12, 13, 14, 15, 16, 17/o100m Free, Back, Breast, Fly 9/u, 10, 11, 12, 13, 14, 15, 16, 17/o200m Free, Back, Breast, IM 10/u, 11, 12, 13, 14, 15, 16, 17/o200m Fly 11/u, 12, 13, 14, 15, 16, 17/o400m Free, IM 12/u, 13, 14, 15, 16, 17/o800m & 1500m Free 13/u, 14, 15, 16, 17/o

Each area will be responsible for paying for their respective pool hire costs.If necessary, 55 yard pool times can be converted to 50m times for the purpose of defining placings, and not used for any other purpose. R3(b) Times must have been swum since the 1st of January in the year of the Championships

R3(c) Long distance events to be swum at the same time and in 25m pools in both Hawkes Bay and Gisborne.Each area will be responsible for paying for their respective pool hire costs.

NATIONAL CHAMPIONSHIPS

R4(a) The Centre will provide managers for Winter Nationals, Open Nationals, Age Group, Division II, North Island and Junior Nationals.

R4(b) Entries for Age Groups, Division II, Open Nationals and Junior Nationals Winter Nationals and North Island must be made through the Centre.

R4(c) No entry will be accepted by the Centre unless accompanied by the appropriate entry fee

R4(d) All clubs to arrange their own travel and accommodation to Winter Nationals, Open Nationals, Age Groups, Division II, North Island Championships and Junior Nationals. The Centre will appoint an overall manager who takes over at the poolside.

R4(e) For any other meets other than R4(d) above, where a Centre team is selected, all members of the team will travel under Centre arrangements, at all times all teams will be under the jurisdiction of the selected Team Manager

R4(f) Every swimmer who competes at a National Event, e.g. Junior Champs, Division II Age Groups, Opens (Winter and Summer) will receive a certificate from HBPB Swimming.That is, one certificate per person per year.

TEAM MANAGERS

R5(a) The Centre will call for nominations for Team Manager for National Meets.

R5(b) The appointed managers sole responsibility will be the HBPB Team. They will not act as Club manager as well.

R5(c) Team Managers appointed by HBPB Swimming travelling to National Meets may claim expenses

AIRMay claim 1 x equivalent Thrifty or other cheapest fare from point of origin to destination and return

ROADMay claim up to 20 cents per km travelled in own vehicle from the time they leave home to the time they return bearing in mind all the travelling done was for the benefit of swimmers or swimming

ACCOMMODATIONMay claim up to $30.00 per night accommodation expenses. If staying in a team situation where the cost is less then the lesser amount to be claimed.

MEALSAn amount of up to $20.00 per day may be claimed

ADVANCESAn advance of up to $500 depending on the location of the meet may be claimed.

All claims accompanied by relevant receipts should be sent to the Secretary within 14 days of the meet finishing.

R5(d) The Team Manager may be part of one of the Teams, and may stay with the team or privately

R5(e) Any swim coach may be considered as Team Manager

CENTRE QUALIFIED OFFICIALS

R7(a) Members who wish to take Centre Officials Examination must be affiliated to the Centre and be over 15 years of age. Application to be made to examiners in Swim Hawkes Bay and Eastland Swim.

R7(b) Members will not be allowed to sit more than 2 Centre examinations in a 12 month period and must have assisted at 3 area or Centre recognised meets in each discipline between sitting each examination

MANAGEMENT

R8(a) All NZSF AGM remits will be discussed by Management as required.

DIVINGR9(a) Hawkes Bay Poverty Bay Championships to include a 1m diving competition. This to

be Open Men's and Open Women's events.

R9(b) Diving Groups will be divided in the same manner as those set down for swimming events

R9(c) Points from any Diving Competition not to be combined with points from any Swimming Competition for any Championship Cups.

GENERAL

R10(a) That all clubs running swim meets provide to all participating clubs a programme completed with times of each club's swimmers for their own records

GUIDELINES FOR TEAM MANAGERS ATTENDING NATIONAL MEETS

Responsibilities. The Team Manager (Poolside) has overall authority of all team members and any decisions made is subject to the final approval of the Team Manager.

Managers meetingThe Team Manager must attend this meeting.If the programme has been available and checked then any alterations, scratchings can be notified at this meeting

Poolside1 The Team Manager is to ensure that -

a) The Team arrives early; Suitable seating is located; The team remains together as a unit.

b) All the team know when and where to MarshallLiase with individual club coach / managers they may prefer to attend to this for their own swimmers.

2 Personally collect all information and results from designated "pick up point".

3 See attached note on the role of Coach.

4 Scratchings: Discretion should be used. Treat each request independently. Consult with the Coach but only the Team Manager may implement scratchings (See SNZ Rule SR 12.17 (attached)

5 Protests: Be conversant with SNZ Rule SR11 (attached). Only the Team Manager may lodge a protest. Fee ($20.00) payable by HBPB.Attend all disputes / meetings called on poolside for team managers.

Disciplinary ActionFor wilful misconduct the Team Manager has the right to disqualify the swimmer from future events at the Meet. The swimmer may be sent home at the swimmers expense. Minor offences should be dealt with as the Team Manager sees fit.

All infringements should be reported in the Team Managers report.

Conclusion of MeetAt the conclusion of the Meet pick up a complete meet results on disk and hard copy if available. If not leave clear details of where to send them.

Post MeetProvide a report for the Centre's Annual report. This report should include -

Meet, Date and VenueNames of swimmers competingResults, especially Finalists, HBPB Records and Personal BestsGeneral comments on any of the aboveRecommendations (if any)

If necessary provide a separate report for Management on discipline and other matters

General MeetingsManagement may require the Team Manager to attend Federation or Centre Delegates meetings as the HBPB Delegate. If required, full details including background material and the HBPB Centre viewpoint will be provided.

POOLSIDE CODE OF BEHAVIOUR

Poolside code of behaviour for all team members at National and other selected meets. Clubs travelling and accommodated individually

HBPB TEAM CODE OF BEHAVIOUR

Code of behaviour for HBPB Swimming selected teams travelling as a team under Centre arrangements.

1. The Team Manager has ultimate control of the team at all times

8. Swimmers who do not behave in accordance with the above rules will be sent home at their parents expense.

9. All swimmers taking part in a march past or a medal presentation must wear their Club Tracksuit or other appropriate tidy clothing

10. Where a swimmer is selected to be part of a HBPB Swimming relay team, and they wear a cap, it must be a HBPB Swimming cap.

GUIDELINES FOR COACHES

Coaches

It is anticipated that in instances when Swim Team members do not have their regular Coach available, those coaches present will include such additional swimmers in their programme.

Scratchings: All scratchings must be discussed with the Team Manager who has the sole authority to implement scratchings.

It is emphasised that at all times the Team Manager has overall authority of all Team Members and any undertaking by Coaches is subject to the final approval of the Team Manager.
