The minutes of the regular session of the March 8, 2018, meeting with the following amendments:

On page 5, the second paragraph should read as follows:

Adjudicatory Chair Geimer-Flanders called for a recess from the meeting at 1:03 p.m. Matter: to discuss and deliberate on the following adjudicatory matters pursuant to Chapter 91, HRS:

a. In the Matter of the Physician’s License of Thomas Masato Suyeoka, M.D.; MED 2016-147-L

Dr. Young recused herself from the discussion and voting on this matter and left the meeting room at 1:03 p.m. After discussion, it was moved by Dr. Sept, seconded by Dr. Bintliff, and unanimously carried to require that Dr. Suyeoka take the Professional Boundaries and Ethics Course - Extended Edition offered by Professional Boundaries, Inc., and no later than Monday, October 1, 2018, provide verification of successful completion of the approved course. Dr. Young returned to the meeting room at 1:11 p.m.

Following the Board’s review, deliberation and decision in this matter pursuant to Chapter 91, HRS, Chair Geimer-Flanders announced that the Board reconvene to its regular Chapter 92, HRS, meeting at 1:11 p.m.

who recused herself from discussion and voting on the matter, and Dr. Chun, who opposed the motion, to:

(1) Approve Dr. Boorman’s application for licensure subject to certain conditions;

(2) Issue a non-disciplinary letter of education reminding Dr. Boorman of his responsibility to disclose and provide accurate information at all times; and

(3) Require Dr. Boorman to submit a corrected

and revised application answering affirmatively to question 10.d.

With regarding to (1) above, the Board based its decision on the following grounds of the Hawaii Revised Statutes (“HRS”): HRS §436B-19(3): Being addicted to, dependent on, or

a habitual user of a narcotic, barbiturate, amphetamine, hallucinogen, opium, or cocaine, or other drugs or derivatives of a similar nature; and

HRS §436B-19(4): Practicing the licensed profession or

vocation while impaired by alcohol, drugs, physical disability, or mental instability.

Further, for reasons contained in the records and files of Dr. Boorman’s application, the Board placed the following conditions on his conditional license:

1. Dr. Boorman shall enter into a monitoring contract with Pu`ulu Lapa`au (“Pu`ulu Lapa`au”), The Hawai`i Program for Healthcare Professionals, for a length to be determined by Pu`ulu Lapa`au. However, said monitoring contract may be extended by the Board if the Board believes that reasonable grounds exist.

2. If, at any time, Pu`ulu Lapa`au determines that Dr. Boorman is not in compliance with the monitoring contract, he shall immediately notify the Board and immediately cease practicing medicine until Pu`ulu Lapa`au specifies to the Board what conditions, if

any, it recommends for him to safely resume the practice of medicine.

3. During the period of Dr. Boorman’s conditional

license, he shall ensure that Pu`ulu Lapa`au submits quarterly written reports to the Board.

4. Should Dr. Boorman wish to have any condition

removed from his license he shall make a request in writing to the Board, at which time the Board would consider such request.

o. Evan J. Zimmer, M.D.

After due consideration of the information received, it was moved by Dr. Holt, seconded by Chair Geimer-Flanders and carried by a majority, with the exception of Dr. Young, who recused herself from discussion and voting on this matter, and Dr. Chun, who opposed the motion, to defer Dr. Zimmer’s application for licensure. In deferring this application, the Board determined that Dr. Zimmer must undergo a comprehensive evaluation to determine his ability to safely and competently practice medicine in the State of Hawaii. Dr. Zimmer shall contact Pu`ulu Lapa`au, The Hawai`i Program for Healthcare Professionals to request that they refer him to an appropriate organization for the comprehensive evaluation. The Board is authorized to require further evaltion to ensure that Dr. Zimmer is both competent and professional: Hawaii Revised Statutes (“HRS”) §453-4(b)(1) (the applicant shall furnish proof satisfactory to the board that the applicant is of demonstrated competence and professional knowledge); HRS §453-8(b)(1) and (4) (the board may impose as a condition of licensure a physical and mental evaluation of the applicant by a licensed physician or osteopathic physician approved by the board, and further education or training or proof of performance competency); §436B-10(a)(9) (an applicant shall provide any other information the licensing authority may require to investigate the applicant’s qualifications for licensure); and Hawaii Administrative Rules §16-85-7(c) (it shall be each applicant’s responsibility to furnish any information and documentation requested by the board).

After due consideration of the information received, it was moved by Dr. Young, seconded by Dr. Holt, and unanimously carried to approve Dr. Lawrence’s application for licensure pending submission of a corrected and revised application answering affirmatively to question 7.a.

(ii) Physician Assistant:

a. Stephen B. Futh, PA-C After due consideration of the information received, it was moved by Dr. Sept, seconded by Dr. Bintliff, and unanimously carried to defer Mr. Futh’s application for certification. In deferring this application, Mr. Futh shall have his physician assistant program provide to the Board information regarding whether his physician assistant program was accredited by the Accreditation Review Commission on Education for the Physician Assistant (“ARC-PA”) at the time he graduated. Should the physician assistant program provide information which indicates that the program was accredited by the ARC-PA at the time of graduation, the Board stated that its Executive Officer may approve Mr. Futh’s application for certification.

b. Tyler S. Truskoski, PA-C

It was moved by Chair Geimer-Flanders, seconded by Dr. Bintliff, and unanimously carried to approve Mr. Truskoski’s application for certification.

(iii) Emergency Medical Personnel:

a. Aaron P.K. Moniz, EMT Chair Geimer-Flanders recused herself from voting on this application and left the meeting room at 3:21 p.m. It was moved by Dr. Bintliff, seconded by Dr. Sept, and carried by a majority, with the exception of Chair Geimer-Flanders, who recused herself from the discussion and voting on this matter, to approve Mr. Moniz’s application for certification. Yoon, M.D., and left the meeting room at 3:22 p.m. It was moved by Chair Geimer-Flanders, seconded by Dr. Sept, and carried by a majority, with the exception of Dr. Egami, who recused himself from voting on this matter, to affirm its denial of Dr. Yoon’s application for medical licensure at its meeting on February 8, 2018, and by letter dated February 27, 2018.

Applications for b. Ratifications: License/ Certification: (i) List

It was moved by Dr. Bintliff, seconded by Dr. Holt, and unanimously carried to ratify the attached list of individuals for licensure or certification.

Qualifications for a. Email inquiry from John Zhang, M.D. dated March 23, 2018, Examination and regarding whether a Hawaii medical license is required to receive Licensure: pathology slides from a Washington-based organization for

patients physically located there in order to complete those cases while vacationing in Hawaii. Members reviewed Dr. Zhang’s email dated March 23, 2018, regarding whether a Hawaii medical license is required to receive pathology slides from a Washington-based organization for patients physically located there in order to complete those cases while vacationing/attending conferences in Hawaii. In consideration of this matter, members reviewed its Minutes of the Meeting of October 12, 2017, in which the Board informally opined that the practice of medicine occurs where the patient is physically located. After due consideration of this information, the Board, by consensus, informally opined that a physician licensed in the state of Washington may receive pathology slides from a Washington-based organization for patients physically located in Washington in order to complete those cases while vacationing/attending conferences in Hawaii. Lastly, in accordance with Hawaii Administrative Rules section 16-201-90, the above interpretation is for informational and explanatory purposes only. It is not an official opinion or decision,

and therefore is not to be viewed as binding on the Board or the Department of Commerce and Consumer Affairs.

Federation of State a. FSMB Resolution 18-3, requesting among other things, that Medical Boards the FSMB adopt an advocacy position for the voluntary full

Optimal Team Practice of physician assistants up to the full scope of their education and training. The Board members noted that the resolution stated among other things that:

“…the FSMB will collaborate with the USMLE and its stakeholders to allow physician assistants to take the appropriate levels of the exam and satisfy requirements for licensing bodies in lieu of or in addition to other national exams;…”.

The Board agreed by consensus to seek clarification from FSMB regarding this matter, and whether physician assistants would be eligible/qualify to take the USMLE.

Correspondence a. Letter dated March 6, 2018, from Robert L. Sumwalt, III, Chairman, National Transportation Safety Board, regarding Safety Recommendations I-14-1 and -2, as a result of the safety study, Drug Use Trends in Aviation: Assessing the Risk of Pilot Impairment. The Board reviewed the NTSB’s correspondence regarding its Safety Recommendations I-14-1 and -2. In particular, the NTSB is requesting whether the Board either confirm that its Pain Management Guidelines (“Guidelines”) recommend that health care providers discuss with patients the effect of their medical conditions and medication use may have on their ability to safely operate a vehicle in any mode of transportation or amend its Guidelines satisfy the NTSB’s Safety Recommendation I-14-1. After due consideration of this matter, the Board determined that it will not amend and/or revise its Guidelines. In its opinion the following language satisfies the NTSB’s Safety Recommendation I-14-1:

Section III: Practice Guidelines for Chronic Pain Management Informed Consent and Agreement for Treatment – The physician should discuss the risks and benefits of the use of controlled substances with the patient, persons

designated by the patient or with the patient’s surrogate or guardian. Medical Records – The physician should keep accurate, current and complete medical records. Elements considered for completeness may include, but are not limited to the following: 5. Discussion and documentation of risks, benefits

and alternatives; 6. Results of treatment(s) provided (changes in pain

intensity and character, interference with activities of daily living), and management of side effects.

Compliance With Controlled Substance Laws and Rules – To prescribe, dispense or administer controlled substances, the physician must be licensed in the state and comply with applicable federal and state laws.

Further, the Board agreed by consensus to direct its Executive Officer, Ms. Quiogue, to: (1) post on the Board’s webpage, as a separate document and/or addendum to its Memorandum dated March 2016, the article entitled “Evidence that Pilots are Increasingly Using Over-the-Counter, Prescription, and Illicit Drugs”; (2) refer Mr. Marcus to Hawaii Revised Statutes section 329-38.5 (Act 66, SLH 2017), which required the Department of Health to create and place on its website a template for informed consent and requirement for written policies; and (3) provide Mr. Marcus a copy of the of “Informed Consent for Opioid Prescribed Pills”, which contains a statement that a patient must review, understand, and accept regarding the possible hazards of driving, operating machinery, etc. while taking opioids.

2018 Legislation: The Board reviewed the following legislative measures:

a. SB2653, SD 1, HD 1 Relating to Chapter 453, Hawaii Revised Statutes

The above bill was reviewed and discussed in detail at the previous meetings. The Board strongly supports this bill. The purpose of the bill is to establish licensing requirements by endorsement for physicians, surgeons, and osteopathic physicians to practice medicine in Hawaii.

Ms. Quiogue informed the Board that the House Committee on Finance amended the measure by deleting section 1, the

preamble or purpose of the measure. She went on to say that this measure would most likely be scheduled for conference.

b. HB2578, HD2, SD 1 Relating to Physician Assistants

The above bill was reviewed and discussed in detail at the previous meetings. The purpose of the bill is to require continuing education for physician assistants to renew their licenses. Prohibits the Board from requiring a physician assistant to maintain or receive certification by the National Commission of Certification of Physician Assistants (“NCCPA”) to satisfy the requirement for continuing education or for license renewal. The Board supported this measure and noted that the latest draft clarified the when the CME requirement would take effect and added an additional acceptable organization that physician assistants may obtain their CME from.

c. HB1813, HD2 Relating to Health The Board discussed the above bill in detail at the previous meeting. The Board’s position is to oppose the bill. The purpose of the bills is to establish a three-year pilot program to create a new category of professional licensure for assistant physicians, through which recent medical school graduates who have passed certain medical exams but have not been placed into a residency program may work under the supervision of a licensed physician to provide primary care in medically underserved areas. Ms. Quiogue informed the Board that there have been no hearings scheduled for this bill since February 16, 2018.

d. SB2298, SD2, HD2 Relating to Healthcare Preceptor Tax Credits

The above bill was reviewed and discussed in detail at the previous meetings.

The purpose of the bill is to allow advanced practice registered nurses and physicians to receive income tax credits for acting as preceptors in volunteer-based supervised clinical training rotations provided to eligible students that enable the students to obtain an eligible healthcare professional degree or certificate.

Ms. Quiogue provided the following update regarding the bill’s current version:

The House Committee on Finance passed the measure with a HD2 which: 1) expands the eligible academic programs in which a preceptor may supervise rotations to include programs that may not have their principal accreditation in Hawaii, but have a physical location in Hawaii; 2) requires an academic program in which a preceptor supervises a rotation to provide education to students of whom more than fifty percent are residents of Hawaii; 3) removes the requirement that an eligible student must be a resident of Hawaii; 4) removes the Preceptor Credit Assurance Committee’s exemption from the Sunshine Law, which requires open meetings, public notice, and written minutes; 5) allows the Preceptor Credit Assurance Committee to hold a meeting closed to the public for the purpose of considering information affecting the privacy of an individual; and 6) technical, non-substantial amendments.

The Board agreed by consensus that, in the current version, the Board will only continue monitoring the bill.

e. HB1906, HD2, SD1 Relating to Health Care Workers

The above bill was reviewed and discussed in detail at the previous meeting. The Board is monitoring the above bill. The purpose of the bill is to make intentionally or knowingly causing bodily injury to certain health care workers a Class C felony. Ms. Quiogue provided the following update regarding the bill’s current version: The Committee on Senate Committee on Judiciary passed with a SD1: 1) inserting a purpose section to clarify its intent; 2) expanding the definition of a person who is engaged in the performance of duty at a health care facility" to include administrators, students, volunteers, and any other workers supporting the functions of the health care facility; 3) removes references to persons employed or contracted by a mutual benefit society; 4) inserts an effective date of July 1, 2035, to encourage further discussion; and 5) technical, non-substantial amendments.

f. SB2374, SD1 Relating to Community Paramedic Services

The purpose of the bill is to establish and appropriate funds for a three-year community paramedic services pilot program. Establishes reporting requirements. Repeals December 31, 2021.

g. SB270, SD1 Relating to Minors (Carried over to the 2018 Regular

Session)

The above bill was reviewed and discussed in detail at the previous meetings. The Board is monitoring the above bill. The purpose of the bill is to prohibit specific state-licensed persons who are licensed to provide professional counseling from engaging in, attempting to engage in, or advertising sexual orientation change efforts on persons under eighteen years of age.

h. HB2202, HD2, SD1 Relating to Workers’ Compensation

The above bill was reviewed and discussed in detail at the previous meetings. The Board is monitoring the above bill.

The purpose of the bill is to provide that a duly qualified physician or duly qualified surgeon selected and paid for by an employer to perform a medical examination on an employee relating to a work injury under workers' compensation shall be duly qualified to treat the injury being examined, possess medical malpractice insurance, and owe the same duty of care to the injured employee as to a traditional patient.

Ms. Quiogue provided the following update regarding the bill’s current version:

The Senate Committee on Commerce, Consumer Protection and Health amended the measure by defining the term "duly qualified physician" to mean a physician holding a medical license to practice medicine in the State; requiring the IME to owe the same duty of care to an injured employee as they would any traditional patient; and defecting the date to July 1, 2055.

i. SB2646, SD1, HD2 Relating to Prescription Drugs The above bill was reviewed and discussed in detail at the previous meetings. The Board is monitoring the above bill. The purpose of the bill is to require prescribers of certain controlled substances to consult the electronic prescription

accountability system before issuing a prescription for the controlled substance. Provides exemptions for certain circumstances. Provides that a violation by a prescriber shall not be subject to criminal penalty provisions but that a violation may be grounds for professional discipline pursuant to sections 448-17, 453-8, 457-12, and 471-10, Hawaii Revised Statutes.

j. HB2531, HD1 Relating to Prescription Drugs

The above bill was reviewed and discussed in detail at the previous meetings. The Board is monitoring the above bill. Requires prescribers of certain controlled substances to consult the electronic prescription accountability system before issuing a prescription for the controlled substance.

k. HB1602, HD2, SD1 Relating to Opioids

The above bill was reviewed and discussed in detail at the previous meetings. The Board is monitoring the above bill. The purpose of the bill is to permit the inclusion of a label warning of the risks of addiction and death on the packaging of any opioid drug dispensed by a health care professional or pharmacist.

l. SB2811, SD1, HD1 Relating to the Uniform Controlled

Substances Act

The above bill was reviewed and discussed in detail at the previous meetings. The Board is monitoring the above bill. The purpose of the bill is to update chapter 329, Hawaii Revised Statutes, to be consistent with federal law, by allowing prescribing authorization of drugs which include buprenorphine and naloxone to patients undergoing "medically managed withdrawal", also known as "detoxification treatment" and "maintenance treatment" by practitioners who are properly registered.

m. HB2384, HD1, SD1 Relating to the Uniform Controlled

Substances Act The above bill was reviewed and discussed in detail at the previous meetings. The Board is monitoring the above bill. Updates Uniform Controlled Substances Act for consistency with federal law. Allows prescription of drugs to patients undergoing medically managed withdrawal, also known as detoxification

n. HB2391, HD2, SD1 Relating to the Uniformed Controlled

Substances Act The above bill was reviewed and discussed in detail at the previous meetings. The Board is monitoring the above bill. The purpose of the bill is to amend section 329-104(c), Hawaii Revised Statutes, to allow the Department of Public Safety Narcotics Enforcement Division Administrator to disclose, at his discretion, confidential information from the Electronic Prescription Accountability System, more commonly known as the Prescription Drug Monitoring Program, to authorized employees of the Department of Health Alcohol and Drug Abuse Division and the Emergency Medical Services and Injury Prevention Systems Branch.

o. HB2145, HD1, SD1 Relating to Medication Synchronization

The above bill was reviewed and discussed in detail at the previous meetings. The Board is monitoring the above bill. The purpose of the bill is to require health insurance and hospital and medical service plans that provide prescription drug benefits to apply prorated daily cost-sharing rates for prescriptions dispensed by pharmacies.

p. HB2729, HD2, SD1 Relating to Cannabis for Medical Use

The Board discussed the above bill in detail at its previous meetings. The Board’s position is to oppose the bill if its language allows for a physician-patient relationship to be established via telehealth to qualify a patient for medical marijuana. Ms. Quiogue provided the following update regarding the bill’s current version: The Senate Committee on Commerce, Consumer Protection, and Health amended the measure to, among other things: permit a bona fide physician-patient or advanced practice registered nurse-patient relationship to be established via telehealth, for purposes of providing written certification for the medical use of cannabis for a qualifying patient and specifying that treatment

recommendations that include certifying a patient for the medical use of cannabis via telehealth shall be allowed only after an initial in-person consultation.

q. HB2739, HD1 Relating to Health

The above bill was reviewed and discussed in detail at the previous meetings. The Board is monitoring the above bill. The purpose of the bill is to establish a regulatory process under which an adult resident of the State with a medically confirmed terminal disease and less than six months to live may choose to obtain a prescription for medication to end the patient's life. Imposes criminal sanctions for tampering with a patient's request for a prescription or coercing a patient to request a prescription. Ms. Quiogue informed the Board that this bill is with the Governor for his enactment, and that the bill signing ceremony was scheduled for April 6, 2018. Ms. Quiogue also informed the Board members that pursuant to the measure the Department of Health is required to establish an advisory committee to implement this law, and inquired whether any members were interested in participating and/or meeting with an outside organization that will be assisting the department with its implementation. The Board members declined.

r. HCR78, HD1/HR63, HD1 Requesting the insurance commissioner to assess the adequacy of the physician networks on all islands of the State
