Massachusetts Hate Crimes, 2016

Executive Summary Notes on Data The 2016 Hate Crime report for Massachusetts was compiled using data voluntarily supplied from police departments across the Commonwealth. The Executive Office of Public Safety & Security (EOPSS) received a total of 391 reports of incidents of hate crime (down from 411 in 2015) from 70 municipal police departments, 11 campus police agencies, one hospital and the MBTA. In addition, 267 agencies successfully submitted “zero reports” (indicating that they had experienced no bias-motivate incidents) and there were 60 non-reporting agencies, down from 70 in 2015 and 105 in 2014. In 2016, reporting agencies and zero-reporting agencies covered approximately 95% of the population of Massachusetts. After receipt and state data quality checks, EOPSS submits all Massachusetts hate crime data to the FBI for further analysis, verification and inclusion in its annual Hate Crime Statistics publication. Data was collected utilizing two methods. Agencies who report data via the National Incident Based Reporting System (NIBRS) have their data automatically uploaded to EOPSS and the FBI. EOPSS then extracts the required data for analysis. Agencies who submit via the Uniform Crime Report (UCR) manually fill out forms and submit them to EOPSS. These forms are then collated and sent to the FBI. This is the last year of this process. In 2017, UCR agencies will automatically upload their data to EOPSS and the FBI utilizing the FBI’s hate crime forms. This will allow all of the data to be error checked and reside in one data set. Going forward, some of the categories displayed in this report may only be available from the NIBRS–reporting agencies, as NIBRS captures many data elements that UCR does not capture. In 2016, 259 reports were submitted via NIBRS, while 132 were submitted via UCR. Bias Motivation “Hate crimes,” also referred interchangeably as “bias crimes,” or “bias-related / motivated crimes” are not reported as a stand-alone offense, but rather as part of a separate criminal violation, ranging from violent crimes to harassment to vandalism. Of the 411 hate crime offenses reported in 2016, the most frequent offense was Vandalism / Damage / Destruction of Property (33.1%), which is often graffiti or the defacing of property. Intimidation was the second most frequently reported crime at 30.4% of offenses. Simple Assault and Aggravated Assault incidents were the only remaining incident types with double digit percentages with 17.3% & 11.7% respectively. In terms of violent crime, there were 48 bias-motivated aggravated assaults reported in 2016, which is comparable to the 49 reported in 2015. Historically, Vandalism and Intimidation are the top two offenses reported during bias incidents and in recent years have each accounted for approximately 30% of offenses. (See Table 1.) In 2016, similar to years past, prejudice against race / ethnicity or national origin was the most widely reported bias motivation, representing 52.8% of the total (up from 47.6% in 2015). Bias against religious groups was the second most frequent bias motivation with 20.9% of the total (up from 19.1% in 2015). Sexual Orientation bias was third with 18.5% (up from 18.2% in 2015). (See Table 2.)

Victims and Offenders As in previous years, males were the most frequent victims (60.2% of known victims). This number had been steadily falling for the past several years with the 2015 number falling to 53.7%, with prior numbers reaching 70% of male victims as recently as 2012. The known offenders of hate crimes continue to be predominantly male with 71.2% of offenders identified as males. Females were victims in 39.8% of incidents where the sex of the victim was identified. Females as a percentage of offenders where sex was determined accounted for 28.8% (up from 22% in 2015). (For a breakdown of victims and offenders by gender, please refer to Tables 13 and 15.) Whites were the most frequent racial category as victims (53.2%, down from 61.3% in 2015, but consistent with the prior three years where numbers were in the low 50’s), and also as offenders (63.4%, down from 73.3% the previous year). African American victims of both genders composed 34.7% of the total victim population, up from 29.4% the previous year. African American offenders comprised 33.5% of offenders, up from 22.9% the previous year. (See Table 14.) Victims were reported to have some type of injury in 23% of cases where injury information was captured. This is down from 2014 and 2015, where approximately 30% of victims were injured in cases where injury data was reported. If you divide the 55 total injuries by the total incidents, only 14% of the total incidents reported some type of injury. (See Table 16.) Location Bias incidents reported by police agencies in Massachusetts occur in a variety of locations, both public and private. In 2016, 29.2% of incidents occurred in or at a residence, while an additional 17.8% occurred on a highway or street. Combining all school categories resulted in 17.8%, which is an increase over the 12.2% from 2015. (See Table 10.) Other location types with over 10 incidents were Church / Synagogue / Temple / Mosque; Other; Parking / Drop Lot / Garage; Restaurant and Air / Bus / Train Terminal, although the only location type to eclipse 5% of the total was the religious locations with 5.4%.   Targets Individuals and private property were the primary targets for hate crimes in the Commonwealth, with 74.6% of the reports, down from 80.4% in 2015. Businesses were again the second most-frequent target in 2016 with 9.5% of the reports. Government and Religious Organization targets, comprising 7.8% & 2.8% of the incidents were notable, as well as other targets with 3.3%. (See Table 9.) Hate Crimes Historical Perspective Over the past 16 years, the numbers and the categories of bias motivations have remained fairly consistent. Between 2000 and 2002, approximately 500 bias motivations were reported each year. From 2003 through 2015, the number declined to an average of about 350 bias motivations per year and has remained extremely consistent over this extended period. Over this time period, the most frequently reported bias motivations have remained

similar: Anti-Black bias has consistently been most frequent (29.1%), followed by Anti-Gay (17.8%), Anti-Semitic (14.1%) and Anti-White (9.5%). (See Table 16.)

Definitions

Hate Crime Any criminal act to which a bias motive is evident as a contributing factor. The MA Hate Crime Reporting Act of 1991

covers bias on account of race, religion, ethnicity, handicap, gender, or sexual orientation. Hate crimes can be reported only by law enforcement agencies. See M.G.L. c. 22C, § 32 for more details.

Zero Report An official report by a police department stating no hate crimes were reported to the department during the reporting

period. Non-reporting agencies Local police departments, and other law enforcement agencies, which are not in compliance with the provisions of the

Reporting Act. These agencies failed to indicate how many, if any, bias crimes occurred in their jurisdiction. Reporting agencies Local police departments, as well as other law enforcement agencies, who have voluntarily reported the incidence of

identified bias crimes in their jurisdiction. Agencies can comply with the Reporting Act by reporting the number of bias crimes, even if zero.

Reports by Law Enforcement Agencies In the statistics that follow, it should be noted that a single incident report may include multiple offenses, bias motivations, victims or offenders. As a result, totals in some categories may exceed the number of reports. Similarly, some reports omit information in certain categories, resulting in totals lower than the number of incident reports collected. Hate crimes were reported by a total of 84 different law enforcement agencies. A total of 389 hate crime reports were filed by these agencies, which included 411 separate offenses. Boston reported 120 hate crimes in 2016. Other agencies that reported 10 or more hate crimes were: Cambridge (25), Newton (21), Boston University (19), University of Massachusetts Amherst (11), Arlington (10) and Somerville (10). (See Figure 7 and Table 18.)

Categories of Bias Reported

Of the 411 bias motivations for particular incidents reported, race / ethnicity / national origin bias constituted the largest category of reported motives, with 52.8% of the total (up from 47.6% in 2015). Offenses related to religious affiliation were the second most prevalent, with 20.9% (up from 19.1% in 2015). Offenses motivated by sexual orientation bias were the third most frequent category, with 18.5% of the total (up from 18.2% in 2015) In 2015, anti-gender identity incidents accounted for over 10% of the incidents, while in 2016 they represented only 3.6% of the incidents.

Categories of Crimes Reported

Of the 411 total offenses reported, Destruction of Property / Vandalism were the most frequently reported offenses representing 33.1% of the total with over 130 incidents reported. Threats & Intimidation was the second most frequently reported offense, with 125 incidents representing 30.4% of the total offenses. Assaults also formed a significant portion of incidents, accounting for 17.3% and 11.7% respectively. Combining Aggravated and Simple Assaults would yield 119 assaults where offenders physically confronted a victim, which is down from 144 in 2015.

Victim and Offender Profile An Individual / Person (including private property) was the target in 74.6% of cases (down from 80.4% in 2015). Businesses were second, with 9.4% (up from 7.3%). Government targets were the third most frequently targeted group with 7.8% of the incidents (up from 2.8% in 2015). Religious targets were targeted in 2.8% of incidents (up from 2.7% the previous year). In the 314 incidents where the victim’s race was reported, whites were victims 53.2% of the time (down from 61.3% in 2015), while African Americans were victims in 34.7% of cases (up from 29.4% in 2015). The victims were male in 60.2% of cases. This year, again, the most common age group reporting hate crimes was 26-30 year olds. One surprise was the substantial number of individuals 60 years or older reporting as 40 individuals were victimized. (See Table 7&8.) The perpetrator(s) of hate crimes were white in 63.4% of cases (down from 73.3% in 2015), and African American in 33.5% of cases (up from 22.9% in 2015), in the 194 cases where this information was identified. The perpetrator was male in 71.2% of known cases (up from 78% in 2015), and of the cases where the offender(s)’s age group was identified, the most frequently reported age group was 51-55 years of age, which is significantly older than year’s past.

Characteristics of the Incidents The majority of hate crime incidents in 2016 occurred in residences (29.2%, down from 31.1% in 2015); followed by highways or streets (17.8%, down from 18.9% in 2015). (See Table 10.) Weapons of some type were reported in 110 incidents. In cases where the type of weapon was identified, hands / fist / feet were used the most frequently (54.5%, up from 30.7% in 2015). Other weapons were the second most frequently, listed in 20% of cases. Knives and blunt objects were both utilized in approximately 10% of cases. Firearms were only used in 3 incidents in 2016, the same number as 2015. (See Table 11.)

Of the 239 incidents in which injury information was submitted, no visible injuries were reported in 149 of the incidents. Minor injuries were reported in 38 incidents; severe lacerations were reported in 8 incidents and the other major injury types were reported infrequently. Overall, injuries were only reported in 14% of the incidents. (See Table 16.)
