3. ROLL CALL & ANNOUNCEMENTS-continued Ms. Robinson stated an Executive Session was held this evening from 5:30-6:34pm to receive information regarding transportation, city trash removal fees, personnel matters, tax assessment matters, and legal matters.

4. APPROVAL OF FEBRUARY 16, 2016 AGENDA

Motion: Mr. Roy moved to amend the February 16, 2016 agenda as follows:

Combine language of Item 9.3H with Item 9.3G because they refer to the same contract;

Add Item 9.3H Approve the Release and Settlement Agreement between a former employee and the Harrisburg School District, as presented;

Add Item 9.3M Approve contract with Transportation Consultative Services, Inc. not to exceed an amount of Five Thousand Dollars ($5,000.00);

Add Item 9.3N Approve STIPULATION AND JOINT MOTION FOR AGREED UPON ORDER regarding South Lodging, Ltd. vs. Dauphin County Board of Assessment Appeals, located at 23 South Second Street, Harrisburg, Dauphin County, Pennsylvania (a/k/a "Crowne Plaza Hotel"), Parcel No. 03-004-018), in the matter of 2013-CV-8870-TX;

6. PUBLIC COMMENT-AGENDA ITEMS (Time limit of three minutes per person) Sylvia E. Rigal-609 Curtin Street-asked who Hasan Educational Consultant on a check register. Item 10.1,

#14 is missing the word “Academy “ under Location for Camp Curtin.

At this time it was brought to the Board’s attention that two John Harris students had a non-agenda item to present to the Board. Ms. Robinson called for a motion to allow the students to present their concern at this public comment period rather than have them wait until the end of the meeting. Motion: Mr. Krupp moved to permit two John Harris students to present a non-agenda item concern at this point in the meeting. Akeim Murray, 1505 Vernon Street, and Kenneth Lee, 1J Hall Manor, presented updated information regarding the lack of Advanced Placement (AP) courses at John Harris campus. This matter impacts another student and prevents the student from being the class valedictorian because AP courses are weighted different than regular courses. Mr. Murray and Mr. Lee brought this matter to the Board on November 14, 2015 and were asked by the Board at that time to collect additional information regarding the number of students who this impacts. Mr. Murray and Mr. Lee provided a petition with student signatures asking for more AP classes at John Harris. The list was given to Mr. Pittman as chair of the Academic, Instruction, and Student Services Committee of the Board. Mr. Murray and Mr. Lee told the Board there is no AP certified teacher at John Harris, however, they do know a teacher who is willing to become certified if the District pays the associated costs. Several member commented, Ms. Robinson thanked the students for their follow-up, and stated the matter will be addressed by administration.

Ms. Snider reported that the Adopt-A-Classroom project is about half-way complete; mini-grants totaling $19,000 have been awarded; EITC contribution total nearly $500,000, the highest contributor is Penn National at $300,000 and recently added Phillips. A summary handout was distributed to the Board. A writer’s workshop is pending and support will be provided to the ROAR Academy. Teacher Recognition Award nominations will be accepted until March 31, 2016. Ms. Snider stated anyone can nominate a teacher. Ms. Robinson thanked Ms. Snider for her work and that of the Foundation.

7.3 Academic, Instruction, and Student Services Committee-Judd Pittman, Chair Mr. Krupp reported that a meeting was held on February 11, 2016 to review the 2016-2017 school calendar and the secondary course catalog. The next meeting will be February 23, 2016 at 6:00pm in the boardroom.

7.4 Ad Hoc Negotiations/Human Resources Committee-Danielle Robinson, Chair Ms. Robinson reported that she met with Dr. Knight and Mr. Freeman on February 11, 2016 to review the personnel actions for the February 16, 2016.

7.5 Budget, Facilities, and Finance Committee-Matthew Krupp, Chair Mr. Krupp reported that meetings were held on February 1 and 8 to discuss and review items related to the February 16, 2016 board meeting, the refinancing of loans, and received the 2014-2015 audit report on February 8.

7.6 Community Relations Committee-Ellis Roy, Jr. Chair Mr. Roy stated he met with Dr. Knight and Mr. Wilson on January 28, 2016 to discuss current partnerships and to learn about current public relations efforts to alter the perception of the District to something more positive. The Committee plans to hold a community forum to gain input to promote a positive image.

7.7 Policy and Procedure Committee-Alan Kennedy-Shaffer, Chair Mr. Kennedy-Shaffer reported that Committee meetings have moved to the fourth Tuesday of each month at 5:30pm and will be held in the boardroom at Lincoln preceding the Academic Committee meetings. Mr. Kennedy-Shaffer pointed out that the second reading of Policy 903 Public Participation in Board meetings was on tonight’s agenda. Adoption of the revised policy means residents do not have to fill out comment slips in advance and there is no more separation of agenda and non-agenda items. The next meeting will be on February 23, 2016 at 5:30pm.

7. REPORTS 7.7 Policy and Procedure Committee-continued

Mr. Pittman thanked Mr. Kennedy-Shaffer for the collaboration to make committee meetings back-to-back.

7.8 Harrisburg Community College Delegate Report-Melvin Wilson, Jr. Mr. Wilson reported on the P.A.S. (Positive Academic Success) program, noting we have a significant number of students with disabilities that should have more opportunities for college; efforts to broaden the College in High School program so students who want to go to college have the opportunity to do so; on the SOAR (Students Occupational and Academically Ready) program which has funds available for students; and that he is meeting with HACC administration to have a culinary program at HACC Midtown and that there is a core group of our students who are interested.

7.9 Capital Area Intermediate Unit Delegate Report No report. 7.10 Chief Recovery Officer -Dr. Audrey Utley

Dr. Utley stated we are midway in the recovery plan, a CRO Advisory meeting will be held next week, and updates to the recovery plan and recommended amendments will be presented to the Board in sections.

9.3D E-Signature Resolution–authorize Danielle Robinson, Board President, to provide an

electronic signature to approve documents on behalf of the Harrisburg School District that are required by the Pennsylvania Department of Education.

The School District of the City of Harrisburg, PA

BE IT RESOLVED, by authority of the Harrisburg School Board of Directors of the Harrisburg School District, LEA, a public school district, and it is hereby resolved by authority of the same, that Danielle Robinson, who is the President of the above named body is authorized and directed to sign any and all contracts, agreements, grants and/or licenses collectively referred to as contract(s)) with the Pennsylvania Department of Education (Department); and

BE IT FURTHER RESOLVED, that the body consents to the use of electronic signatures by the above named individual and that no handwritten signature from the above named individual shall be required in order for any contract with the Department to be legally enforceable and that by affixing his/her electronic signature to an electronic file of the contract via the Department’s e-grants system, the above designated authorized individual shall have effectively executed and delivered the contract, binding the Harrisburg School District to comply with the terms of said contract; and

BE IT FURTHER RESOLVED, that no writing shall be required in order to make the contract valid and legally binding, provided that the Department and all other necessary Commonwealth approvers affix their signatures electronically and an electronically-printed copy of the Contract is e-mailed or is otherwise made available to the body by electronic means; and

BE IT FURTHER RESOLVED, that the body will not contest the due authorization, execution, delivery, validity or enforceability of the electronic Contract under the provisions of a statute of frauds or any other applicable law. The Contract, if introduced as evidence on paper in any judicial, arbitration, mediation, or administrative proceedings, will be admissible as between the parties to the same extent and under the same conditions as other business records originated and maintained in documentary form and the admissibility thereof shall not be contested under either the business records exception to the hearsay rule or the best evidence rule; and

BE IT FURTHER RESOLVED, that the body will notify the Department’s Bureau of Management Services promptly in the event that the above named individual is no longer authorized to execute agreements on behalf of the body electronically and that the Department shall be entitled to rely upon the above named officer’s authority to execute agreements electronically on behalf of the body until such notice is received by the Department’s Office of Chief Counsel.

11.2 Adopt Board Policy 903 Public Participation in Board Meetings-Second Reading Motion: Mr. Kennedy-Shaffer moved to adopt Item11.2 as presented. Second: Mr. Pittman Discussion: Mr. Thompson stated he was happy to see Mr. Kennedy-Shaffer put his stamp on the board by advocating more public participation through the revision to Policy 903.Mr. Kennedy-Shaffer stated the Board can waive the eligibility requirement when desired. Ms. Robinson expressed concerns that without comment forms how the order of speakers will be determined and is opposed to non-city residents commenting on district matters on the basis it would extend the length of the meeting and what criteria would be used to determine who can/cannot speak. Mr. Krupp commented that forms could be optional and Mr. Wilson stated that completing a form prior to speaking is not an impediment to participation. Mr. Kennedy-Shaffer stated that school code requires a public comment period and Ms. Robinson commented that the policy does not spell out how the comment periods are to be implemented. She is not in favor of changing the procedure at this time. Mr. Cooper offered that the Board could discuss the procedure at a subsequent meeting and vote on the policy adoption this evening. Second: Mr. Pittman Discussion: Mr. Thompson expressed his regrets that Ms. Whitehead-Myers resigned as she was the last holdover board member from the original Board post-mayoral control and he will miss her perspective of the Reed years. Ms. Robinson also expressed her regrets and thanked Ms. Whitehead-Myers for her service to the District. She stated the Board would like to recognize Ms. Whitehead-Myers at the next board meeting. Ms. Robinson announced that there will be a drumline exhibition on March 5 at the Kimber Gymnasium, featuring steppers, dancers, and other performers.
