This handbook is intended to benefit all law students who are interested in articling and practicing in London The Handbook is your Tool The search for an appropriate summering and articling position can be a very intimidating and time-consuming process. If you are considering a career in Southwestern Ontario’s commercial and administrative centre, this handbook will help alleviate some of that stress. The 2016 -2017 Articling in London handbook is a tool designed to introduce you to the London Legal Community and provide you with practical information that will assist you in deciding where you might like to apply, and how to go about doing it. Additionally, you will find information about the city and other important resources. Our hope is that this handbook will be a key resource for law students interested in learning about what articling in London entails. Disclaimer Every effort is made to gather the most up-to-date information. The information presented in this handbook is the most up-to-date as of April 17, 2015. As some information may change we strongly encourage students to do their own research and build upon the resources provided in this handbook. THE MIDDLESEX LAW ASSOCIATION COURTHOUSE LIBRARY

Ground Floor, Unit N, 80 Dundas St. London, ON N6A 6A1

Phone: 519-679-7046 (Toll-free: 1-866-556-5570) Fax: 519-672-5917

Email: [email protected] www.middlaw.on.ca

The Middlesex Law Association has one of the finest courthouse law libraries in Ontario, both in terms of premises and collection size. Many of London’s law firms are situated near the courthouse, making our facility a convenient, and preferred, place for lawyers and articling students to conduct their research. It is a spacious and comfortable environment in which to work and provides a congenial meeting place for lawyers. The library is staffed from 8:30am to 4:30pm on weekdays but can be accessed 24/7 by members and articling students. It houses a tightly focussed collection of materials relevant to the practice of law in Ontario and most items can be signed out for use back at the office.

Librarians: Gail Brown, M.L.S. and Cynthia Simpson, M.L.I.S. The library has two professional librarians available to answer reference questions, provide one-on-one assistance with research strategy and help locating and using all library resources. Assistance can be obtained in person, by phone, fax, email or with our chat reference service, MLA Chat, available through our website. If you are unsure of how to start your research, either in print or online, or need a refresher on what you learned at law school, we should be your first stop.

The Collection: The MLA Library is a Regional Library in the system with one of the largest collections of Canadian, British and U.S. texts and loose-leaf services, periodical titles, and legislation from all Canadian federal and provincial jurisdictions. This print collection is supplemented by an increasing range of online resources, all accessible at no charge to our patrons. For materials that are not available in our library, we rely on a network of 48 Ontario courthouse libraries for copied or scanned electronic copies and the loan of print materials.

We are your library! We have developed services aimed specifically at articling students, including training sessions on electronic resources and a library orientation tour. The students are among the heaviest users of our facility and we truly enjoy helping them gain the best articling experience possible.

Middlesex Law Association

With over 800 members, the Middlesex Law Association is one of the largest and oldest county law associations in the province. We are proud to be members of a collegial local bar, which greatly enhances the day-to-day practice of law. Our Association serves its membership through the delivery of continuing professional development programs, which provide informative and timely information on recent developments in the different areas of law affecting our members. In addition, the Association is active in organizing numerous recreational and social events for its members including an annual golf tournament, family skating day at Budweiser Gardens and other social events. Our facilities are located on the ground floor of the London Court House. We have a Practice Resource Centre, which includes our law library, staffed by two full time librarians and a part time library assistant, a comfortable lawyers’ lounge, a copy station and charging station, as well as locker rooms. We enjoy a Regional Library with an extensive collection of resources; many of which are available through up-to-date electronic technology. Our library also provides delivery of legal resources to every county in the province. We believe that the law firms and sole practitioners in Middlesex County can provide a wealth of experience to both summer and articling students, in an environment of collegiality, courtesy, and respect. The Middlesex Law Association welcomes your interest in London, and encourages you to become part of our legal community. Lindsay M. Kirk President MLA Board of Trustees

2016-2017 Articling Recruitment Procedures (Excerpt)

Section D Governs Articling Recruitment by Firms Located Outside of Toronto

……

8. Additional Procedures Governing All Articling Recruitment by Firms Located in the County of Middlesex

Commentary: The following procedures, for firms located in the County of Middlesex, are in addition to B.1, B.2, B.3, and B.4. and the general procedures in Section C.

(1) Employers shall not set application deadlines earlier than Friday, May 1 2015 at 5:00pm.

Commentary: In considering whether or not an interview will be granted and the time and date of such interview, the date of receipt of an application shall not be a factor if the application is received by May 1, 2015. (2) Interviews for 2016-2017 articling positions shall be held the week of May 25, 2015. (3) No communication of offers of employment shall be made prior to 8:00 a.m. Monday, June 1, 2015. Commentary: Firms may communicate their intentions to make offers in accordance with these procedures to summer students employed with their firm in the summer months of 2015 at any time prior to this date. However, in no case may offers be made to any such students prior to the time set out in these procedures. Students receiving communications of intent may voluntarily communicate their own intentions. (4) Out of province candidates may be interviewed prior to the week of May 25, 2015; however, no offer may be extended to them prior to 8:00 am. Monday, June 1, 2015. (5) All offers made on Monday, June 1, 2015, shall remain open until 9:00 a.m. on Tuesday, June 2, 2015. (6) All offers made on Tuesday, June 2, 2015, shall remain open for a period of 24 hours. (7) All offers made after Tuesday, June 2, 2015, shall be left open for a reasonable period of time. (8) The period during which an offer shall be left open must be communicated by a firm making an offer to a student at the time the offer is made. (9) Students shall deal with offers received as expeditiously as possible regardless of the stipulated time that an offer shall remain open. (10) Students who accept an offer shall immediately notify firms from whom they have an outstanding offer or with whom they have scheduled interviews.

Section B Governs General Articling Recruitment Procedures Conducted by Firms Located both In and Outside of Toronto

1. Offers of employment shall not be made at any time on terms or in circumstances that do not give students a proper opportunity to consider the offer before deciding. Commentary: Offers shall not be made which are conditional upon the position still being open when the acceptance is received.

2. Firms may communicate their intentions to make offers, in accordance with these procedures, to summer students employed with the firm in the summer months of 2015, at any time prior to the stated offer deadline. However, in no case may offers be made to any such students prior to the time set out in these procedures. Students may voluntarily communicate their own intentions. Firms shall not put undue pressure on students to communicate their own intentions prior to the stipulated deadline.

3. Students shall deal with offers received as expeditiously as possible regardless of the stipulated time that offer shall remain open. Commentary: Failure to communicate a rejection of an offer as soon as a decision to refuse is made prejudices not only the offering firm but also fellow students to whom the offer may next be made.

4. Students who accept an offer shall immediately notify firms from whom they have an outstanding offer or with whom they have scheduled interviews.

5. Students who accept an offer shall honour the undertaking thus given, regardless of what offers are subsequently received and shall not thereafter take interviews with other firms.

6. Firms shall not knowingly make offers to students who have already accepted a position. Commentary to B.5 and B.6: The offer and acceptance of an articling position constitutes a binding contract between the principal and the student that carries professional obligations over and above the normal contractual obligations. Principals and students may refer to the Articling Program page on the Law Society of Upper Canada website for further information regarding the Articling Program (http://lsuc.on.ca/articling/).
