1. GUJRERA Quarterly Return Filing for Projects

1.1. Background

As part of the Functions and Duties for the Project Promoter defined under Chapter III, Section 11 and

Chapter V, section 34(b) of the RERA Act read with Rule 10 of the Real Estate (Regulation) and

Development Rules, the promoter shall update the details for the project, within seven days from the

expiry of each quarter. Hence, it is the duty of the Promoter to submit/ update the details

on GujRERA Portal and the Promoter would be accountable and responsible for all

submissions made on the GujRERA Portal.

In this regard, GUJRERA authority has defined Quarterly Mandatory Details that Promoter has to

submit online under “RERA Return” Compliance. The same has been incorporated and made

accessible to Promoter through existing GUJRERA Portal on https://gujrera.gujarat.gov.in

The detailed step by step instructions to file the RERA Return is explained in subsequent sections.

1.2. Definition of RERA Return

As part of the mandatory submission and withdrawal of the money from the RERA Designated bank

Account, the Promoter is directed to submit Architect Certificate (Form 1), Engineer Certificate (Form

2) and Chartered Accountant Certificate (Form 3) in sequential manner every quarter. Under

GUJRERA Portal, the trio is defined as the RERA Return.

The Promoter is required to submit the RERA Return (which would not be allowed to be

changed/revised later) as part of the Quarterly Mandatory Compliance. It is also to be noted that

Promoter has to obtain Form 1, 2, 3, 4/ 4A, 5 (mandatorily to be prepared as per the GujRERA

Regulation prescribed formats) received from the respective professionals and attach the same in

respective sections of the RERA Return on the GujRERA Portal.

1.3. Definition of Quarter

The GUJRERA Authority has considered the dynamic rolling quarter (3 months) of a project defined

with respect to a specific logic unique to each project for which the Promoter is liable to submit the

mandatory RERA Return before the end date of the quarter shown in the promoter login.

1.4. Definition of Last Quarter – Project Completion (Q-E) Over the period of Project Life Cycle, the last quarter is defined as the quarter in which Project End Date falls.

Over and Above regular quarterly return filing (Form 1, 2, 3), the promoter also has to upload Form 4 or 4A

(Completion Certificate) and Form 5 (Annual Report if applicable) additionally using the facility provided in the

promoter login.

1.5. Definition and Structure of Quarterly Fees

As part of the processing charges, GUJRERA has defined the Fixed Quarterly Fees as prescribed time

to time to be paid before filing the Quarterly RERA Return for Project. In case of default, RERA has

also provisioned to charge the Penalty over and above the Fixed Quarterly Fees which GUJRERA shall

compel Promoter to pay before filing the Return for the defaulted quarter.

1.6. Definition of Unique Block/ Type/ Wing/ Bungalow/ Category of the Project [as per the Form 1 (Architect Certificate) OR Approved Layout Plan – Raja Chitthi

or RERA Registration Certificate Remarks if approved]

Before initiating the quarterly RERA Return Filing process, the Promoter is required to insert the Unique Block/Type/Wing/Bungalow/Category of the Project as per the Form 1

(Architect Certificate) already submitted to Authority at the time of Project Registration. Promoter

may take reference of Approved Layout Plan – Raja Chitthi or RERA Registration Certificate Remarks

before filling this section. This is the unique identification/ property of the project under which all the

unique inventories can be defined.

- For detailed guidance, please refer Annexure – 1 of this document

- NOTE (A) : This facility is available one time only for those who have not submitted

Blocks in Form A (Project Application). The same would not be available later for

change and would be pre populated for all quarters and hence this cannot be altered

later due to its dynamic nature of usage into the system. If any deviation is found

later on, the promoter has to pay the Processing Fees for the same as may be decided

by the Authority.

1.7. Definition of Quarterly Fees and Online Payment

Promoter has to pay the RERA Quarterly Return Fees as decided by the Gujarat RERA Authority.

Promoter will be able to pay this amount using GUJRERA Website only with the help of Payment

Gateway. This will allow promoter to pay fees using Net Banking, Debit Card and Credit Card options

using the payment gateway available on GujRERA Portal – Quarterly Return Section.

1.8. Definition of Quarterly Return Defaulter

Once the Quarter End Date is lapsed and the promoter has not submitted the Quarterly Return As

prescribed in the respective quarter, the Promoter will be considered as “Quarterly Return Defaulter”

and subsequently will be liable for penalized action against the project and promoter as the GUJRERA

Authority may decide.

- NOTE: If the promoter “defaults” by not filling the quarterly return, all the

subsequent quarters will be locked for filing and till the promoter comply to the

penalized action decided by the authority, promoter will not have the facility of

quarterly return filing.

2. RERA Return filing Process

2.1. Overview

The process of RERA Return filing is 5 stage process as shown above. Each Stage description is

mentioned in the following sections.

2.2.1. Step 1: Login to GUJRERA as Promoter/ Agent

- From Home Page, Click on LOGIN AS AGENT/ PROMOTER and Insert the Credentials as

received on your registered email id.

2.2.3. Step 3: Dashboard Quarter View

- As shown in above screenshot, all the quarters will be shown which are applicable over the

period of Project Life.

- Out of which The Quarter with respect to current date will be active for filing.

- Along with all quarters, the last quarter will also remain active for filing if the project has

reached completion stage before project end date.

2.2.4. Step 4: Active Quarter (Or Completion Quarter) and Payment

- For, Active Quarter, the promoter will be directed to pay mandatory fees online before filing

RERA return.

- Once the payment is successful, Promoter will get the facility to file the Quarterly Return.

2.2.5. Step 5: RERA Quarterly Return (Step by Step Guide)

- Click on RERA Quarterly Return to initiate filing process for the respective active quarter

- Promoter will be allowed to fill Form 1, 2 and 3 in chronological order and without filling and

submitting the previous form, the next form will not be available for filing.

- PLEASE NOTE THAT ALL THE FORMS WILL BE TAKEN ONCE ONLY AND NO

MODIFICATION WILL BE ALLOWED SUBSEQUENTLY AFTER SUBMITTING THE FORM

- The promoter has to add all the details as received from the respective professionals - Architect,

Engineer and CA based on their respective certificates received in hard copy.

RERA Last Quarter Return – Project Completion (Q-E)

- If the project reaches 100% completion state on or before Project Completion Quarter,

Promoter has to provide Form 4/ 4A and Form 5 (if applicable) as per the RERA Regulation as

part of the final submission in Quarter Completion as shown above.

- Promoter also has to provide Affidavit cum Declaration Document indicating transfer of

amenities

- The Project Completion Quarter will be always available for filing and after paying the

prescribed fees, promoter will be able to submit the required details.

2.2.5.1. Form 1 (Architect Certificate)

Part-1

FORM 1 (Table A)

[The Measure of Progress of each Block/ Type/ Wing/ Bungalow/ Category]

- After clicking Form – 1 (Architect Certificate), Promoter will be shown the Form 1 (Table A) as

below.

a) As per the GUJRERA requirement, Promoter has to provide Unique Block/ Type/ Wing/

Bungalow/ Category wise percentage completion against the Tasks/ Activities defined.

Promoter can select the respective Block/ Type/ Wing/ Bungalow/ Category from the

dropdown menu.

b) Promoter also has to provide NOC Name/ Type and upload the NOCs obtained from the

respective authority against each Block/ Type/ Wing/ Bungalow/ Category in this section. (eg.

Lift, Fire, Rail etc.)

- However, NOC received for entire project should be uploaded in Form 1 (Table B) (Next

Section)

- For more than 1 NOCs, “Add More” function has been given.

- Promoter has to upload all such NOCs received against each block only once over the Quarterly

Life Cycle. It means, NOC submitted in previous Quarter is not required to be re-uploaded in

next quarter.

- However, Promoter has to ensure that No NOC would remain “Non Uploaded” before end of

the 100% completion of the respective “Block/ Type/ Wing/ Bungalow/ Category”. All

applicable NOCs for the block should be uploaded before or by the progress of the block reaches

100% completion. (Need not wait till Project Completion)

c) Promoter also has to provide Photographs depicting the overall and floor wise progress of

the respective selected (from the dropdown menu) Block/ Type/ Wing/ Bungalow/ Category.

d) Size and Format

e) Process:

- After filling in the activity progress percentages and uploading relevant NOC and Photographs

for particular Block/ Type/ Wing/ Bungalow/ Category, promoter has to “Submit” the details

and move to fill details for next Block/ Type/ Wing/ Bungalow/ Category.

- On Pressing “Delete”, the data will be deleted permanently

- The already filled Block/ Type/ Wing/ Bungalow/ Category will be removed from Drop down

to make Promoter aware about which Block/ Type/ Wing/ Bungalow/ Category details are yet

to be submitted.

Form 1 (Table A) – View Submitted Data

After submission of block wise project progress details in Form 1 – Table A, Promoter can see the

submitted blocks as well as the details (% work done) filled against each block by clicking on “View

Submitted Form Data” option in Form 1 – Table A.

Note: This can help Promoter to re-check what Unique Block/ Type/ Wing/ Bungalow/

Category details is submitted. It is useful in case, Promoter has forgotten what Unique

Block/ Type/ Wing/ Bungalow/ Category detail is submitted. While filing Form – 3

Annexure, it helps define unique inventories against Unique Block/ Type/ Wing/

Bungalow/ Category submitted.

Part 2:

FORM 1 (Table B)

[The Measure of Progress & Features of the entire Project]

- After clicking Form – 1 (Architect Certificate) and once Form 1 (Table A) is filled and submitted

successfully, Promoter will be shown the Form 1 (Table B) as below.

a) As per the GUJRERA requirement, Promoter has to provide overall progress of the project with

respect to common amenities of the project in percentage completion.

b) Promoter has to provide NOC Name/ Type and upload the NOCs received for Entire Project as

a unit. (eg. NA, Airport, Environment, High Tension Line, Gas Line etc) For more than 1 NOCs,

“Add More” function has been given.

- Promoter has to upload all such NOCs received for entire project only once over the Quarterly

Life Cycle. It means, NOC submitted in previous Quarter is not required to be re-uploaded in

next quarter.

- However, Promoter has to ensure that No NOC would remain “Non Uploaded” before end of

the 100% completion of the respective Common Area/ Amenity mentioned in Table B. All

applicable NOCs for the entire project should be uploaded before or by the progress of the

Common Area/ Amenities reaches 100% completion. (Need not wait till Project Completion)

c) Promoter has to upload the scan copy of the Actual Architect Certificate received from the

Architect.

d) Size and Format

- After submitting Form – 1 (Architect Certificate), Promoter will be shown the Form 2 as below.

a) As per the GUJRERA requirement, Promoter has to provide the estimated, incurred and total

costs certified by the Engineer for the project. Out of several details, the promoter has to provide

few details in the form as shown below.

b) Promoter also has to obtain the Engineer Certificate from the Authorized Real Estate Engineer

and upload the same herewith

c) Size and Format

2.2.5.3. Form 3 (CA Certificate)

Introduction

In line with the GUJARAT REAL ESTATE REGULATORY AUTHORITY (GENERAL) (AMENDMENT)

REGULATION, 2019 released on 31st May, 2019, a newly designed Form 3 – CA certificate is

submission utility will be available on GujRERA Portal with effect from 8th June, 2019.

The new form 3 aims to cover additional aspects compared to the earlier version of Form 3 such as

encumbrance, loans & lenders details, redevelopment, allottee details, Date for Agreement for Sale etc.

The fundamental change introduced this time is the eSigning and Submission of the Form 3 to

GujRERA Authority to ensure the authenticity of this certificate ensuring the data sanctity.

As you are aware, Form 3 submission is essential while submitting Project Registration, Alteration,

Extension, Quarterly Return and End Quarter Compliance. The key features newly introduced are:

1. E-Signed Submission of Form 3 by GujRERA e-KYC Compliant CA across the GujRERA Project

Lifecycle Applications

2. Unit wise Encumbrance Reporting

3. Unit wise AFS Execution Date Reporting

4. Unit wise Allottee Details, type of KYC, e-KYC ID and Mobile number

5. Project Loan and Lenders Reporting

6. Improved RERA Bank Account Details Capturing as per RERA Banking Directions

7. Reporting facility for Unit wise Redevelopment Status in entire lifecycle

8. Auto fetching of Bank Account Details for Project Alteration Applications

9. One time data entry allowed for Redevelopment Projects to enter Estimated Cost & Incurred

and Paid Cost values into Form 3 Certificate

10. Capturing of FRN number of CA firm submitting Form 3

11. Submission of UDIN Number as per ICAI guidelines

12. Project site Physical Progress as certified in Form 1, 2 submissions are in coherence with actual

incurred and paid expenditure considering project specification AND reporting the reasons for

variation, if any.

13. Facility to submit Specific Notes to Certificate.

This document will provide detailed step by step guidance to the process of submitting the new Form

3 to GujRERA authority online. Every practicing CA is hereby advised to refer, adhere and

follow this document for submission of the Form 3 in line with the Regulation framed

by GujRERA Authority.

Important Instructions

A. Submission Process & Cautions:

With the introduction of eSigning facility and digital submission of Form 3 requirement, it will

not be possible to allow any change in data submission after e-Sign and Submission of Form 3.

Moreover, no hardcopy submission or revised submission/ representation would

be acceptable in case of data mismatch. Hence each professional is hereby instructed to

be careful while submission of the compliance.

I. In case of Project Registration, Alteration and Extension application, once CA e-Signs

the Form 3 online, the entire section from Block Entry submission, Form 1A-B, Form 2

to Form 3 Annexure & Certificate submission will be locked and no changes would be

allowed in this collective submission. There is a facility of “Preview” provided in case CA

wants to have a look at the PDF to be submitted to GujRERA before eSigning form 3.

II. In case of Quarterly Return Submission, every step of submitting Form 1A-B, Form 2,

Form 3 Annexure & Certificate is non reversible. For Quarterly Return, facility of

“Preview” is not available as the submissions are non-reversible and CA has

to e-Sign only after submission of Form 3 Certificate.

III. Quarterly Return will not be considered “Submitted” if Form 3 is not e-

Signed Online on GujRERA Portal and submitted.

B. Re-development Projects:

For Project Registration, Alteration, Extension, Quarterly Return Applications, One time

Redevelopment Submission facility is made available for every project in Form 3. CA would be

able to report Unit wise Redevelopment Status in “Form 3 Annexure” in column called

“Redevelopment”. This status is changeable in subsequent submissions for Form 3 Annexure.

As this is one time opportunity given (in the entire project lifecycle), this would enable

Compulsory Reporting of Values in "Estimated” & “Incurred & Paid” column to claim

"Redevelopment" status in Form 3 – Certificate.

As this facility is available one time only for Form 3 Certificate, in subsequent filings. Based on

this, the Redevelopment status will prevail and “Estimated values” will be unchangeable for

entire project lifecycle. Only “Incurred and Paid” values would be allowed to be changed.

C. AFS Reporting:

As per the act and regulation, it is mandatory to execute AFS for the units before receiving

amount more than 10% of the unit consideration amount and report the Date of AFS to

GujRERA. The same needs to be followed carefully while submitting Form 3 Annexure. This

facility is made available for reporting of adherence to the regulatory requirements.

While it is allowed to “Book” any unit with AFS Executed and “Unbook” it later due to change

in decisions, this facility is made available for reporting of “Cancellations” in compliance to the

provisions.

D. UDIN (Unique Document Identification Number – ICAI) Reporting:

UDIN number is unique for each Form 3 being submitted to Gujarat RERA. In line with ICAI

guidelines, CAs are advised to generate UDIN Number from ICAI website for certifying any CA

Certificate and include it in Form 3 - Certificate.

However, in case, if you find notification from GujRERA while submitting Form 3 as "UDIN

number already exist. Please check the UDIN number", it is possible that there is typing error

or your UDIN number is consumed/ already submitted to GujRERA by some other CA

erroneously. In such scenario, CAs are advised to generate new UDIN number and submit the

same on Form 3 - Certificate.

E. Loans and Lenders:

Now, CAs are required to provide Loan and Lenders details to GujRERA as part of reporting

encumbrance on the Project. In section "Loans and Lenders" Form 3 Certificate, Total Number

of Project Units Mortgaged is also to be reported.

F. Joint Allotment for Unit:

In case of joint allotment, only name of the First Allottee should be added as part of submission.

G. Disclosure of coherence among Certificates (Form 1, 2, 3) :

Chartered Accountants are issuing Form 3 considering Form 1 and 2, that is Architect

Certificate and Engineers certificate, as working papers for their certification. They do assess

the reliability of other experts’ work. The prima facie or material difference in certification by

these experts would prompt Chartered Accountants to submit disclosure of the fact that the

Certificates he is relying on are not in coherence. This facility is made available to Chartered

Accountant to report his observations and to enable him to seek and report necessary

clarifications from the promoter.

Form 3 Filling Process

Part 1:

FORM 3 (Annexure)

[Status of each inventory and amount]

- After ensuring Correct Block Entry, Form 1 and Form 2 submitted successfully, CA will be

shown the Form 3 (Annexure) as the first part of submission.

a) As per the GUJRERA requirement, CA has to provide all inventories available in the project

with respect to Unique Block/ Type/ Wing/ Bungalow/ Category. The CA has to ensure that No

inventory remains out of the submission irrespective of its booking status.

- System will not accept duplicate entries having same combination of Unique Block/ Type/

Wing/ Bungalow/ Category, Flat/Bungalow/Office Number and Usage (i.e. First 3 columns)

b) Process:

- First time Form 3 Annexure Submission in entire Project Life Cycle [i.e. in case

of Project Application, First Quarter (Q-1 or Only one Q-E) in case annexure not

submitted in Project Application, Project Alteration (For Applications submitted

before April-2018)]:

o CA has to download the sample excel template sheet from this section, fill in the details

offline in this excel sheet and upload the same using “Select and Upload file” function.

o If successful, CA will be able to see the successfully uploaded annexure. Please verify the

details uploaded before pressing Submit button on the Annexure page.

- Form 3 Annexure Submission (in case if the Digital Form 3 Data is available in

system or Project Extension):

o CA has to export the previously submitted annexure data from this web page, fill in the

details offline in this excel sheet for columns namely “STATUS”, “UNIT AMOUNT”,

“RECEIVED AMOUNT”, “DATE OF AGREEMENT OF SALE”, “ENCUMBRANCE

STATUS”, “ALLOTTEE NAME”, “TYPE OF KYC”, “KYC UNIQUE ID” AND “MOBILE

NO. OF ALLOTTEE” and upload the same using “Select and Upload file” function.

o The following 7 columns have been introduced in Form-3 Annexure :

1) DATE OF AGREEMENT OF SALE Date of Agreement of Sale executed in DD/MM/YYYY format

o Columns such as “BLOCK TYPE”, “FLAT/BUNGLOW/OFFICE -USAGE”,“CARPET

AREA”, “AREA OF EXCLUSIVE BALCONY” will not be available for changing as any change

in these is considered as project alteration.

o If successful, CA will be able to see the successfully submitted annexure. Please verify the

details uploaded before pressing Submit button on the Annexure page.

- For any help, CA can refer the excel file “Help” after downloading it from the Form-3 Annexure

page on the web portal.

- For various errors, you may refer “Common Mistakes” section in “Help” sheet

- After filling Annexure and Filling No. of garages, No. of Covered Parking, No. of Open Parking,

CA can finally submit the Form 3 (Annexure) Section.

No Common Mistakes (Which will lead to Form 3 Annexure getting submitted to GujRERA)

1 IMPORT will give error if blocks entered are not same as declared on Block Entry Stage in Portal

2 IMPORT will give error if USAGE or STATUS or DATE OF AGREEMENT OF SALE or ENCUMBRANCE STATUS is not entered as per the Allowed Values as they are case sensitive values

3 IMPORT will give error if RECEIVED AMOUNT is greater than UNIT AMOUNT for particular Unit

4 IMPORT will give error if STATUS is UNBOOKED and RECEIVED AMOUNT is written for particular Unit

UDIN number is unique for each Form 3 being submitted to Gujarat RERA. In line with ICAI guidelines, CA are advised to generate UDIN Number from ICAI website for certifying any CA Certificate and report to Gujarat RERA Form 3 - Certificate. Hence, in case, if your find notification from GujRERA while submitting Form 3 as "UDIN number already exist. Please check the UDIN number", it is suspected that your UDIN number is consumed/ already submitted to GujRERA by some other CA/ User due to typing error etc. In such scenario, CA is advised to generate new UDIN number and submit the same on Form 3 - Certificate. Such situation must also be reported to GujRERA

3 For Project Registration, Alteration, Extension, Quarterly Return only One time opportunity would be given (in entire lifecycle) to report values in "Estimated column to claim "Redevelopment" status in Form 3 - Certificate for reporting "Estimated" column values by submitting "Yes" in REDEVELOPMENT column for any unit the eSigning of the Form - 3 is not performed.

4 In section "Loans and Lenders", Total Number of Project Units Mortgaged if found more than total units reported in Annexure, then it shall be considered as flagging to authority

In case of Project registration, alteration and extension applications, for submitting Form 3 using e-Sign, Promoters would be required to allow access of the Application on GujRERA Portal to their CA for eSigning. In Case of Quarterly Return Submissions, Promoters are advised to share credentials (User id, Passwords of GujRERA Project) with CA for their login to Submit the Return after submitting form 1 and 2. Every promoter is advised to change credentials after submission of their Quarterly Return by the respective CA

signature enabled.

2.3. E-sign and submit feature

Before proceeding for “e-Sign and Submit” please ensure that the pki component utility is installed in

the system and a valid class 2 token containing the digital signature of the assigned Chartered

Accountant (CA) is ready.

Failing which the system shall not allow the Chartered Accountant to proceed with the e-signing

process

Once the digital token has been inserted into the system with the installed e-signing client utility, a

popup window for selecting the certificate will appear on the screen. Click on OK to continue. Enter the PIN for e-signing in the popup window as indicated below and click OK to proceed. Once the document has been successfully signed, a confirmation message page shall appear.
