Foreword

NTT East has long been promoting the opening of our networks and at the same time facili-

tating the smooth interconnection to our networks by voluntarily establishing rules for inter-

connection. In pursuing smooth interconnection with the facilities of other carriers in particu-

lar, we have been issuing this Guidebook for Interconnection on a regular basis to provide

explanations of the interconnection procedures, etc.

To further develop an overall information and communications market including broadband

services, we recognize the need to improve the value of the networks themselves through a

cooperative relationship among telecommunications carriers in addition to efforts by each in-

dividual carrier to expand its own business activities. In line with these objectives, we intend

to exert every effort to provide network resources that are even more convenient for other

carriers to use. We look forward to your usage of our networks, and hope this guidebook will

serve as a useful reference in promoting smooth and efficient interconnection.

Framework of this GuidebookThis Guidebook consists of three volumes: (1) Common Interconnection Procedures, (2) Specific Procedures for Each Pattern of Interconnection, and (3) Reference Information Concerning Interconnection.Please use each volume of this guidebook for the purposes indicated below.Volume 1: Please confirm the interconnection procedures based on the

Articles of Agreement Concerning Interconnection.Volume 2: The second volume introduces the necessary information for

each pattern of interconnection used by other carriers.Volume 3: The third volume explains the interconnection rules and other

In submitting these applications, please provide information that is as accurate as possible on each application form in order to ensure a prompt response to your interconnection request. Basic Principles of InterconnectionAs NTT East firmly believes that increased competition creates a more vital market and leads to greater diversity in services, we are working to promote network interconnection under the principle of endeavoring to meet all interconnection requests from other carriers. In addition, we are also exerting our best efforts to build networks that are reliable and easy for other carriers to use.

●Meeting all interconnection requests in principle・The charges required for interconnection are specified in the Articles of Agreement Concerning Interconnection.・We may find it necessary to decline interconnection requests only under the following four cases as specified in

Paragraph 1, Article 22 of the Articles of Agreement Concerning Interconnection.① Cases raising any concern that the smooth provision of telecommunications service by NTT East will be hin-

dered.② Cases raising any concern that NTT East's interests will be unduly damaged by the interconnection.③ The applicant for interconnection has failed or is likely to fail to pay any amount due with respect to interconnec-

tion. ④ Cases in which the installation or modification of telecommunications facilities to establish interconnection is ex-

tremely difficult from a technical or economic standpoint.

・Access charges are calculated in accordance with traffic volume, the number of circuits used, etc., on a usage-sensitive basis, and totaled and billed by cal-endar month.

Network modification charges (1.2, Table 1 in the Tables of Charges, the Articles of Agree-ment Concerning Interconnection)・Individual construction costs・Interconnection software development costs

・Usage charges for individual and exclusive functions and facilities in case modifications to NTT East net-works are made to realize such functions at the request of applicant carriers.

Explanation※1 The minimum usage period as stipulated in the Articles of Agreement for Leased Line Service is applied mutatis mu-

tandis.The phrase "the cancellation of a leased line service contract" in the Articles of Agreement for Leased Line Service shall read "the cancellation of a leased line service contract or the suspension of interconnection for the intercon-nection leased line," and the provisions related to the lines for which charges are set by other carriers are excluded.

When NTT East uses the actual cost method for calculating interconnection charges (access charges and network modification charges) for Type 1 telecommunications facilities that are designated by the Minister of Public Management, Home Affairs, Posts and Telecommunications as essential facilities (facilities with few alternatives) in providing services to customers, expenses for the designated Type 1 telecommunications facilities only are used as the costs to calculate interconnection charges in conformity with the Telecommunications Business Law and related government and ministerial ordinances, and specific charges are stipulated in the Articles of Agreement Concerning Interconnection.If the telecommunications services to be offered are new and substantial increases in demand are expected in the future, the calculation period of the costs may be within the five-year period in accordance with the applicable ministerial ordinances.Of the access charges, costs for telephone and ISDN services are calculated in conformity with the Telecommunications Business Law and the applicable government and ministerial ordinances by using the expenses calculated on the assumption of newly re-built networks using the most efficient facilities and technologies now available at the lowest costs as costs by means of the long-run incremental cost (LRIC) method, and specific charges are stipulated in the Articles of Agreement Concerning Interconnection.

※1 Limited to cases in which all contracting carriers simultaneously have submitted applications for usage cancellation if multiple contracting carriers are using the relevant functions.

※2 In case of requesting upgrades, an application for new telecommunications facilities or software is re-quired in addition to an application for usage cancellation. After upgrades, moreover, the payment of network modifications charges for the new telecommunications facilities or software is required.

※3 Undepreciated balance = (Fixed asset acquisition value - Residual value) × Ratio of remaining legal life + Residual value

Facilities subject to individual management: Meaning telecommunications facilities or software relating to the functions subject to network modification charges.Residual value: Meaning the fixed asset net value after the expiration of the legal life.Undepreciated balance: Meaning the amount calculated by subtracting the amounts paid as network modification charges from the fixed asset acquisition value. With respect to the provisions relating to the procedures and expenses for canceling the usage of NTT East’s telecommunications facilities or software, the following procedures are applied for canceling the usage of facilities subject to individual management.

・If a POI installation application is cancelled during the period from the date of such application to the completion of the POI installation work, the payment of a penalty equivalent to the equipment usage charges (limited to charges for the power reception/generation equipment) for the period from the POI installation application to the reservation cancellation is required.・Payment of the collocation space fee (housing charges) and the power reception/ generation equipment usage charges is required to extend the resource reservation period.

To meet as many suitable interconnection requests as possible, the procedures to handle cases where credit concerns have arisen with contracting carriers are stipulated in the Articles of Agreement Concerning Interconnection.

※1 Items 1) through 5) and 8) in (4) Acceleration of payment are included in cases where a contracting carrier has failed or is likely to fail to make payment.

※2 It is clearly stipulated that cases in which payment of obligations payable with respect to interconnec-tion is guaranteed are excluded.

※3 NTT may cancel the Agreement without suspending interconnection before such cancellation.

Other related provisions stipulated in the Articles of Agreement Concerning Interconnection include prior consulta-tion for consent to the assignment of accounts receivable (Article 53-2), notification of necessary matters (Article 48), a notification method to a contracting carrier whose whereabouts are unknown (Article 60), expenses in case of Agreement cancellation, termination, etc. (Articles 85, 67 and 68) and reciprocal conditions (Article 101).

It is stipulated that an application for interconnection shall not be accepted if an applicant for interconnection has failed or is likely to fail to make payment.※2

It is stipulated that NTT may decline to accept a request from a contracting carrier for work or procedures, etc.※2

It is stipulated that if any of the reasons listed above becomes applicable, a contracting carrier shall forfeit any grace period with respect to charges and other obligations payable to NTT in relation to interconnection and shall immediately pay such charges and other obligations to NTT.※4

If any of the following items becomes applicable, NTT may suspend inter-connection.①If charges and other obligations of

interconnection have not been paid after the due dates, interconnection is suspended up to payment of such charges or other obligations.②If Article 47 (Confidentiality Obliga-

tion), Article 51 (Responsibility for Maintenance) or other provisions of these Articles of Agreement are vio-lated, interconnection is suspended up to correction of such violation.

NTT may cancel the Agreement if any of the following items becomes applicable.①When a contracting carrier with

whom interconnection was suspen-ded has not yet eliminated the cause for such suspension.②When a contracting carrier falls un-

der Article 60 (Suspension of Inter-connection), and it is deemed that the cause for such suspension will particularly and substantially hinder the implementation of NTT's busi-ness activities.※3

※4 NTT East will accept an application upon confirming that all necessary items have been entered in the Prelim-inary Inquiry Application. NTT East will provide information relating to the relevant inquiry in writing within two weeks (within three weeks for information specified in ※3⑦ with respect to optical subscriber lines) from the date of receipt of a preliminary inquiry application (meaning the date when the application is received by the handling office designated by NTT East; hereinafter the same). ※1 If the applicant carrier applies for an extension by means of documentation indicating the reasons therefor, an extension up to three months is possible.

※2 In the event installation work is not initiated within six months from the date of the POI survey reply, the contents of the reply will cease to be effective, and the reservation will be cancelled.Similarly, such contents will cease to be effective and the reservation will be cancelled with respect to any portions for which work is not initiated in case work is partially commenced. It is deemed that the POI installation application is cancelled on the date of the reservation cancellation, and the applicant carrier is required to pay a penalty.

※3 In the event of making an application for the installation of a POI at a site other than an NTT East communications building, NTT East will approve such application only when the following three conditions are satisfied.①The interconnection is made in such a way that clearly separates the responsibility for the

provision of telecommunications service to subscribers, and which makes a clear distinction with respect to the fixed assets and maintenance responsibilities.②The POI is installed at a site where security and reliability can be adequately maintained.

③No significant hindrance is otherwise caused to NTT East's business activities.※4 In light of congestion or other usage conditions pertaining to a site, etc., in the relevant communications building,

etc., NTT East may request the applicant carrier to enter into consultations concerning the cancellation of the reserved space.

※5 In the event of canceling an installation application before the completion of the installation work, the applicant carrier is required to pay an amount equivalent to the equipment usage charges (limited to those relating to the power reception and generation equipment) for a period from the date the installation application is received to the date the application is cancelled as a penalty.

※6 In the event the applicant carrier applies for an extension in initiating the work by using a POI Installation Work Initiation Extension Application, an extension of 12 months at the maximum from the date of the POI survey reply will become possible, except for cases in which special circumstances such as those attributable to the applicant carrier necessitate such an extension. In this case, it is deemed that the usage of the space and the power reception and generation equipment is started on the day when six months have passed from the date of the POI survey reply, and the applicant carrier is required to pay the collocation space fee (housing charges) and the equipment usage charges (limited to those relating to the power reception and generation equipment).

NTT East submits a notification of the scheme for providing network functions to the Minister of the Public Management, Home Affairs, Posts and Telecommunications pursuant to the Telecommunications Business Law for functions to be developed for its own and joint usage with other carriers. The outline of these plans is announced in the official gazette and is available at the Information Station, etc. Seminars are also held for interested carriers. We invite you to refer to these services as needed.

In case any requests en-tail plan changes, the re-quired procedures must be completed 60 days or more prior to the start of development. We request your cooperation in the following matters in order to smoothly carry out interconnection.

■Confidentiality obligation・Each party agrees to strictly keep confidential all technical, business or any other information of either party that is not made

publicly available and which either party may come to know in connection with interconnection, and shall not use same for other than the intended purpose. (However, this shall not apply when disclosure is required by law or ordinances and/or when the written consent of the other party is obtained.)

■Notification of necessary matters・Each party agrees to notify the other party in writing of any change in its company name, the suspension or discontinuation of

its business, business licensing and any information concerning interconnection, such as additions, changes or discontinuation of points of interconnection.

■Estimated traffic or estimated number of circuits・An applicant carrier agrees to provide NTT East with estimated traffic volume, the estimated number of lines and other

necessary information as requested by NTT East, such as traffic volume and the number of lines for each POI and each switch, traffic volume for each unit rate area, traffic volume for each local exchange number, information on accommodation status of transmission equipment, etc.

■Maintenance・Each party agrees to exert every effort to avoid causing congestion, trouble or other damage to the other party's

telecommunications facilities.・Each party agrees to maintain its interconnected telecommunications facilities so as to comply with the Business Use

Telecommunications Facilities Regulations and the technical conditions specified by NTT East for each point of interconnection.・Both parties agree to discuss specific matters concerning facility maintenance and to stipulate such matters in the Particulars

on Operations and Maintenance.

■Interconnection among multiple carriers・In the event an applicant carrier establishes interconnection with another carrier via NTT East, or in case another carrier

establishes interconnection with an applicant carrier, there are many cases in which agreements are concluded among all carriers involved.・In the above cases, it is necessary for the carrier that is requesting the interconnection to arrange the interconnection

negotiations among carriers.
