Since, some of the Writ -Pctition s, RFAs in the High Court and Reference,Suits/Execution cases in the District Courts are pending in different stages of hearing,the Govl. Counsels who are dealing with the cases shall continue to deal with thosecases tin it is decided.

The cases to the Govt. Counsels shall be allotted as per roaster maintained inthe Writ Cell and Legal Cell. The cases of Writ Cell shall be allotted as per roasterirrespective of District for equal distribution of cases.

All those cases where the present Govt. Counsels who is dealing with this caseis not on the present Panel shall be assigned to new Govt. Counsels as per Districtallotted to them by the concerned Legal Officers as per. roaster.

In case of advance copy served on Standing Counselor the Govt. Counselaccepted the notice as per direction of the Court who is present in the Court at thattime, shall immediately inform the Writ Celli Legal Cell abou t the notice accepted byhim and the case shall be alloLled to the Counsel as per roaster maintained by theBranch. The Govl. Counsel should ensure that in no case he/she should keep thematter with him/her and appear again and again withou L the assignment from theWrit Cell/Legal Cell.

After receiving such information, the Legal Officer concerned will issue BTF tothe "in turn" Counsel with a copy to the Govt. Counsel who has accepted the notice on'behalf of the Department for information.

The Govt. Counsels shall inform (he concerned Legal Officers of the Departmentof the proceedings of the Court immediately and also inform the action required to betaken by the Department before the next date of hearing.

The Govt. Counsels shall ensure that the certified copy of the order along withtheir fee bills shall be submitted to Writ Cell/Legal Cell immediately after passing of

the order with their legal opinion and action required to be taken by the Departmentimmediately with mentioning the limitation involved in the case.

SPECIAL ASSIGNMENT TO THE COUNSELS ON THE MISC. PANEL:-

The Legal Cell of the Dcptt. shall assign the cases where the legal opinion hasbeen furnished by them to the Land Acquisition Collectors and forward a copy of thelegal opinion to the Panel Counsel of the Misc. work who in turn pursue the caseswhere the SLP/RFA/Appeal has to be filed before the Hon'ble High Court/SupremeCourt on behalf of the Land Acquisition Collectors/ Land &;Building Deptt. and submita report along with photocopy of the filing Memo/No. of the Appeal, to the LAC andLegal Cell along with his/her fee bill for Rs.1000/- as misc. charges per case for t.hismisc. work as per approval of the Hon 'blc Lt. All the cases shall be assigned to the Govt. Counsels as per District/Courtsallotted to them, however, in exceptional cases where the substantial question of law /fact is involved, the case may be assigned to some other Counsels only with priorapproval of the competent authority.

All the ADMs/LACs shall ensure that. they may assign the fresh cases to theCounsels assigned to their respective Districts only. However, they may notwithdraw the cases already assigned to any Govl . Counsels who is still on the Panel inpublic interest as he is well acquainted with the case. In case the Counsel allottedwith the case is not on the present Panel it may be withdrawn Irorn him andtransferred to the Counsel who is on the present Panel and assigned the District.

This issues with the prior approval of Pro Secretary (L&;B).
