1. NOTICE INVITING TENDER (NIT)
Sealed item rate tenders on behalf of the President of India are invited by the Controller
General of Patents, Designs & Trade Marks under two Bid system i.e Technical Bid and
Financial Bid for the work of supply, installation, Testing and Commissioning of Audio
Video system for new conference hall at the office of Trade Marks Registry, IP Bhawan,
Beside Chankyapuri Over Bridge, Near AMC Civic Centre, Ghatlodia, Ahmedabad-
380061.
2. SCOPE OF WORK
2.1 This document constitutes ‘supply, installation, testing and commissioning of audio
video system’ for new conference hall at Trade Marks Registry, Ahmedabad.
2.2 To carry out pre-installation activities related to supply, installation, testing and
commissioning of audio video system for new conference hall at Trade Marks
Registry, Ahmedabad including end points.
2.3 To provide necessary training to the staff in the Trade Marks Registry which will
cover installation, implementation, administration, usage, trouble shooting,
interpretation and other activities related to supply, installation, testing and
commissioning of audio video system for new conference hall.
2.4 To maintain annually audio video system for new conference hall, if asked for the
same, for 2 years without any charges. Further to also quote AMC charges after 2
years of installation and commissioning.
2.5 Vendors are expected to offer solutions covering all the functionability as mentioned
in this tender document. Incomplete responses will not be considered and no
correspondence in this regard will be entertained.
3. QUALIFYING CRITERIA
3.1 The tenderer/bidder should be in profitable business since last 5 years.
3.2 Annual turnover turnover of tenderer/bidder should be at least 1 Crore.
3.3 Copy of balance sheet should be submitted along with tender document
3.4 Copies of balance sheets of last three financial years, duly certified by a Chartered
Accountant shall be submitted in support of the requisite financial turnover.
3.5 The bidder shall have successfully completed works during the last five years as
mentioned below :
a) Three work order each costing not less than 40% of the proposed cost quoted in
the financial bid, or
b) Two work order each costing not less than 50% of the proposed cost quoted in the
financial bid, or
c) One work order costing not less than 80% of the proposed cost quoted in the
financial bid.
3.6 The tenderer shall submit copy of Sales Tax/VAT/Registration Certificate
3.7 The tenders shall be addressed to the Asst. Registrar of Trade Marks, Trade Marks
Registry, IP Bhawan, Beside Chankyapuri Over Bridge, Near AMC Civic Centre,
Ghatlodia, Ahmedabad-380061. Kind Attention : Drawing and Disbursing Officer
alongwith the requisite EMD. The EMD shall be submitted in the form of a DD drawn
in favour of Registrar of Trade Marks from any Nationalized or approved Scheduled
Banks of India and shall be payable at New Delhi. Tenders received without the
requisite EMD shall be summarily rejected.
3.8 CGPDTM or any person authorised by him reserves the right to accept/reject any or
all the tenders in part of full or divided the work among two or more parties without
assigning any reason whatsoever or shorten the quantities mentioned in the price bid
and in such case bidders/intending bidders, shall not have any claim on office of
Controller General of Patents, Designs & Trade Marks.
4. EARNEST MONEY DEPOSIT
The earnest money deposit (EMD) of Rs. 15,000/- ( Rupees Fifteen Thousand Only)
refundable without interest) shall accompany the pre-qualification bid of the bidder. The
EMD shall be submitted in the form of a DD drawn in favour of ‘ The Registrar of Trade
Marks’ from any nationalised or approved Scheduled Bank of India and shall be payable
at Ahmedabad. Tenders received without EMD shall be summarily rejected.
5. SPECIAL TERMS AND CONDITIONS OF CONTRACT
The following special terms and conditions shall be read in conjunction with contract.
5.1 The tenders are to be submitted in two separate sealed envelopes/covers marked as
under :
ENVELOPE -1
The envelope -1 shall contain the followings :
(a) Earnest money deposit (EMD) as per NIT.
(b) Specific authorisation from OEM authorising him to quote for this tender along
with proof of being a regular dealership.
(c) Technical data sheet of all the equipment quoted. Conference equipment, mike,
amplifier and speaker should be of the same brand.
(d) D.D of Rs. 500/- favouring Registrar of Trade Marks is to be submitted as tender
fee at the time of submission of tender, if the tender documents are downloaded
from website.
(e) Affidavit of undertaking to abide by all terms of contract on Stamp paper of Rs.
20/- as per Annexure-B.
(f) Details of balance work in hand as on date of submission of tenders.
(g) Credentials/documents in support of meeting the pre-qualifying criteria as
prescribed in the NIT.
(h) Acceptance letter for unconditional acceptance of the tender documents as per the
Performa given in the instructions to Tenderers as per profroma in Annexure-C.
(i) This envelope shall be marked as :
Envelope1 “ EMD, Acceptance letter, Technical Specifications, List of Approved
Makes and Tender drawings and Corrigendum/Addendum, if any.

5.2 ENVELOPE-2 : PRICE BID for supply, installation and commissioning of
Audio/Viedo System for conference room at Trade Marks Registry,
Ahmedabad.
This envelope shall contain the following :
Price Bid duly filled in signed and stamped on each page by the
tenderer/authorised representative of the tenderer. No cutting or
overwriting shall be allowed. In such cases the bid shall be treated as
CANCELLED AND TENDERER SHALL BE TREATED AS
DISQUALIFIED. All proforma forming part of tender documents shall be
filled in, signed and stamped by the tenderer.
(a) Any other information as required to be submitted alongwith the tender.
(b) This envelope shall be marked as :
ENVELOPE -2 : PRICE BID for supply, installation and commissioning of
Audio video system in the conference room at Trade Marks Registry,
Ahmedabad.

6. LIABILITY OF THE TENDERER
6.1 The contractor shall be responsible to obtain all the necessary approvals from the
respective statutory authorities before during and after completion of work as and
when required. CGPDTM shall not assist the contractor for liaising to obtain the
approval from the concerned authorities.
6.2 From the commencement to the completion of the works, contractor shall take full
responsibility for the care of works thereof and of all temporary works and in case any
damage, loss or injury happens to the works or any part thereof or to any temporary
works due to lack of precaution or negligence on the part of contractor, it shall be
made good as its own cost.
6.3 The Controller General of Patents, Designs & Trade Marks and its officials shall not
be responsible for any loss and damage. However, without limiting its obligations and
responsibilities as above, contractor shall insure directly in the joint names of
CGPDTM and Contractor against.
(j) All loss or damage from whatever cause during the period of execution of work
(ii) All loss and damage arising from a cause occurring prior to the commencement of
the period of maintenance and
(iii) For any loss or damage occasioned by contractor in the course of any operation
carried out for the purpose of complying with its obligation of maintenance as follows
(a) The work and the temporary work to the full values of such works executed from
time to time.
(b) The materials, constructional items and other things brought on to the site by
CGPDTM/ Contractor to the full value of such materials, constructional items and
other things.
(c) Sufficient insurance cover for the workers and personnel at site provided that such
insurance shall be effected with any Nationalised Insurance company and
contractor shall, whenever required produce to the CGPDTM IPO/Client policy on
the policies of insurance and the receipts for payments of the current premium
thereof.
7. PAYMENTS
The General Financial Regulations of the Government of India preclude any advance
payments and payments by letter of credit. Such provisions in a proposal will be
prejudicial to its evaluation by the CGPDTM. The normal terms of payments are 45 days
after satisfactory completion of work. The payments will be made after evaluation by a
technical committee and acceptance thereof by Trade Marks Registry.
8. PERFORMANCE BANK GUARANTEE
The applicant who has been awarded the contract (successful bidder) shall furnish a
performance bank guarantee to the tune of 10% of the value of the contract or minimum
EMD of Rs. 15,000/- whichever is higher in the form of account payee demand draft or
bank guarantee which should be valid for a period of one hundred and eighty days beyond
the completion of all contractual obligation of the applicant including warranty.
Performance security/EMD shall be forfeited and credited to the Government account in
the event of breach of contractual obligation by the applicant.
9. JURISDICTION
The disputes, if any, arising between the successful applicant and CGPDTM shall be
resolved amicably, failing which shall be referred to an Arbitrator, mutually acceptable to
both parties, appointed by the CGPDTM as per the Arbitration and Conciliation Act,
1996. Alternatively, this shall be subject to the exclusive jurisdiction of courts at
Ahmedabad.
10. TENDER FEE
In addition to the documents as listed in the Notice Inviting Tender (NIT), the bidders
downloading the tender documents from the website are required to deposit tender fee of
Rs. 500/- (Non refundable) by way of a DD in favour of “The Registrar of Trade Marks”
payable at Ahmedabad and same shall be enclosed in Envelope-1 alongwith other
documents.
