Enlistment of “Manufacturers/Suppliers for Poly House and

Net House”for the Year 2016-17

Terms and Conditions

1. “Manufacturers/Suppliers for Poly House and Net House” means the providers of all the specified

components/materials along with installation of Polyhouse and net house to the cultivators.

2. The Enlistment of manufacturers/suppliers of Polyhouses and net houses is compulsory for obtaining

subsidy under this scheme.

3. The Enlistment is for the supply of complete Polyhouse and net house to the cultivators and not for

the supply of individual components/materials of the Polyhouse and net house.

4. The Enlistment shall be for the State of Andhra Pradesh.

5. The design of Polyhouses and net houses must confirm to the models approved by Department of

Horticulture, Government of Andhra Pradesh, (Annex-1).

6. The Polyhouse and net house manufacturers/suppliers must use all the components required for the

installation of Polyhouses and net houses confirming to the relevant BIS standards and/or as per

specifications provided by the Department of Horticulture, Government of Andhra Pradesh

(Annex-2).

7. The manufacturers/suppliers must have at least one service center in the State of Andhra Pradesh.

8. The invoices in respect of supply of Polyhouses and net houses including installation shall be raised

by the registered manufacturers/suppliers only. However they may take up the work with local sub-

contractors / suppliers if any, authorized by registered manufacturers / suppliers for civil material &

installation & transport work, for the purpose of construction, but the entire responsibility on billing

and supply of quality material, design, quality of construction, transportation etc. lies with registered

manufacturer only.

9. The manufacturers/suppliers shall under take the responsibility/guarantee of different components of

Polyhouses and net houses supplied to the cultivators (Annex-2).

10. The manufacturer /supplier shall undertake to provide guaranty/ warranty as below.

(a) Cladding material (Polyfilm, all types of Net and Fabric): One year guarantee (i.e., Replacement) against natural wear and tear (excluding the natural calamities, vandalism and any other forced action). Two years warranty (i.e., Repairs) against natural wear and tear (excluding the natural calamities, vandalism and any other forced action).

(b) Structure: Five years warranty (i.e. repairs) against natural wear and tear (excluding the natural calamities, vandalism and any other forced action)The decision of Commissioner of Horticulture, Govt. of Andhra Pradesh shall be final in this regard.

11. The manufacturers/suppliers must undertake to supply the components at the rates equal to or less

than the rates given as per the Annex-3 and/or the rates per unit area of Polyhouse/net house in any

case should not be higher than those prescribed in the Annex-4.

12. If Manufacturers/suppliers not follow the rules and regulations mentioned in the Para No. 9,10 & 11,

then above the entire Bank Guarantee amount will be deposited in government account and such

manufacturers/suppliers will be black listed.

13. Following documents are required for Enlistment of manufacturers/suppliers-

(a) Completely filled in application cum company profile in the prescribed Pro-forma (Annex-5).

(b) Enlistment fee Rs. 10,000.00 (Rupees Ten Thousand only). This Enlistment fee is non-refundable.

The Enlistment fee shall be paid in the form of demand draft only, issued in favour of

“Commissioner of Horticulture, Govt. of Andhra Pradesh” payable at Hyderabad along with

application for Enlistment.

(c) Copy of VAT Enlistment certificate/s.

(d) Copy of SSI Enlistment certificate/Enlistment issued by the Director of Industries.

(e) Latest Sales Tax clearance certificate / VAT return.

(f) The make/brand name/s of different components as per the format given in Annex-6.

(g) List of service centers in Andhra Pradesh. Service centre must be as per description given in the

item No. 15.

(h) Price list of additional components (other than listed in Annex-2 if any) for poly house and net

house system as per the format provided in Annex-7.

(i) Turnover of minimum Rs. 50.00 lakh per year for previous two years which will be counted based

on copies of balance sheet.

(j) Experience of more than two years for installation and supply of polyhouse / nethouse which will

be counted based on the copies of firm orders/bills amounting to minimum Rs.25.00 lakh per year.

14. The performance guarantee of Rs.5,00,000/- (Rupees Five Lakhs only) in the form of bank guarantee

(only of Nationalized bank)in favor of “Commissioner of Horticulture, Govt. of Andhra Pradesh”

according to the format provided in Annex-8 will be required at the time of signing the agreement for

Enlistment. The performance guarantee should be renewed after every year.

15. Service Centre: The service center must be of following description-

(a) The service center should be manned with at least two technical persons; one of them must be

an Agricultural Engineer with minimum qualification of B. Tech (Agricultural Engineering).

(b) The technical person other than Agricultural Engineer, should have completed the training on

Polyhouses/Nethouses from Dr.Y.S.R. Horticultural University, Andhra Pradesh or Regional

Horticultural Training Centers (RHTC) at Srikakulam, Eluru, Ongole, Kadapa & Anantapuram.

In process of time and as per additional requirements, no. of trained technical persons (either

agricultural engineer or trained from SAU/RHTC) should be increased. At least one “service

center” shall be located in the State of Andhra Pradesh.

(c) The service center must provide free after sales service to the farmers for at least five years.

This may exclude the material cost, transportation of material and installation cost.

(d) The service center shall also provide the service as per clause (10) above of these terms and

conditions.

(e) Service center shall have the information board as per the format provided in Annex-9 or as

prescribed by Horticulture Department, Andhra Pradesh State / MIDH, Andhra Pradesh State

from time to time.

(f) Service center shall maintain the list of farmers covered under the scheme.

(g) Service center shall maintain the registers as per the format provided in Annex-10 or as

prescribed by Horticulture Department, Andhra Pradesh State / MIDH, Andhra Pradesh State

from time to time.

(h) It will be the responsibility of the manufacturer/supplier to see that the service center is kept

functional all the year and grievances/complaints of cultivators/farmers are attended to within a

week after receiving written complaints.

(i) The service center must be equipped with the communication facilities such as phone,

internet/email etc.

16. The information furnished for Enlistment should be signed by the competent authority of the

manufacturer/supplier. The true copies should be attested by a Gazzetted officer. The competent

authority means.

(a) For the private and public ltd company: Chairman/CEO/MD or the authorized Person/Director

from the Board of Directors. (Copy of resolution passed by the board for this purpose shall be

submitted).

(b) For Partnership firm/company: One partner duly authorized.(Copy of Authorization signed by

all the partners shall be submitted).

The above mentioned authorities (as stated in (a) and (b)) will have to submit MOU/Partnership

deed in prescribed form.

(c) Proprietorship firm/company: Proprietor.

17. The manufacturer must submit the application in prescribed format with all details to the Office of the

“Commissioner of Horticulture, Govt. of Andhra Pradesh, Public Gardens, Nampally,

Hyderabad”.

18. Horticulture Department, A.P. / MIDH, Andhra Pradesh State, reserve the right to reject the

Enlistment and the decision of Mission Director & Commissioner of Horticulture, Govt. of

Andhra Pradesh, shall be final in this regard.

19. The Enlistment will be subjected to conditions of guidelines issued by Government of India /

Government of Andhra Pradesh / State Horticulture Mission from time to time.

Table No. 1 : General Specifications for OVPH models

1. All members of the structure should be made of Galvanized Iron (GI) with minimum 50

microns thick galvanizing

2.

All members should be of minimum 2 mm thickness which shall be verified by equivalent

minimum weight as follows- 2 ½"-3.75Kgs/mtr.; 2"-2.9Kgs/mtr.; 1 ½”"-2.3Kgs/mtr.;-1 ¼"-

2.1Kgs/mtr.; 1"-1.6Kgs/mtr.; ¾"-1.25Kgs/mtr.; ½"-1Kgs/mtr.

3. Members should not be welded to one another, but fixed with the nut bolts

4. Members should not have any welded joints upto 6.5 mtrs. length

5. The overall slope of the foundation should be between 1.25 % and 2 % so as to keep the Gutter

slope accordingly

6. The shape of the Polyhouse should be according to aerodynamic so as to reduce the impact of

wind & consequent damage of Polyhouse. The structure should also follow aerodynamics along

all four sides with corridors.

7. Grid should be of 4m X 8m

8. Top height should be minimum 6.5 mts in all the districts of Andhra Pradesh.

9. Gutter height should be minimum 4 mtrs.

10. Side curtains should be of minimum 2m height for OVPH of area below 1008 Sq.mtrs. and 3m

for area above 1009 Sq.mtrs.

11. Top Vent should be of minimum 0.8m height

Certificate and Undertaking

Certified that the above said information is true and correct and undersigned is aware that in case of any

discrepancy/false information, the registration is liable to be cancelled and a suitable legal action will be

taken against the company. Undersigned also agrees to execute guarantee and warranty of products and

materials supplied to the cultivators, as per mentioned in Terms & Conditions as well as the Performance

guarantee in the form of bank guarantee in the format(Annex-8) prescribed by the Commissioner of

Horticulture, Andhra Pradesh State.

The all Terms & Conditions are applicable & binding to me/us.

To,

BANK GUARANTEE

WHEREAS the Mission Director & Commissioner of Horticulture, Govt. of A.P., have approved

M/s. ______________________________________________________________ (hereinafter called firm)

for the supplies of Polyhouseand Nethouse (hereinafter called the said goods) under the Polyhouse and

Nethouse Scheme(hereinafter called the said scheme)

AND WHEREAS in pursuance and under the terms of the said approved of the firm, firm has agreed to

furnish in favour of the Commissioner of Horticulture, Govt. of A.P., the Bank Guarantee for a sum of

Rs.5,00,000.00 (Rupees Five lakhs only) for the due performance of his/her its obligation to the

Commissioner of Horticulture, Govt. of A.P., under the terms and conditions of Govt. of Andhra Pradesh,

performance as per the terms and conditions and circular as and when Govt. and Dept. have issued.

We, (hereafter called the bank) hereby irrevocably and

un-conditionally undertake and guarantee payment to the Mission Director, State Horticulture Mission, A.P.,

forthwith on demand being made by the Commissioner of Horticulture, Govt. of A.P., in writing without

demur any and all monies anywise payable by firm, as may be specified in the notice of the demand made

by the the Commissioner of Horticulture, Govt. of A.P., to the bank upto an aggregate a sum of

Rs.5,00,000/- (Rupees Five lakhs only) and the bank hereby agree and undertake to the Mission Director,

State Horticulture Mission, A.P., that :

1. The firm will have to give complete material to the farmers as mentioned in the bill of materials

(invoice) in quantity and quality as per specification. (with prescribed guarantee of materials),

along with installation of Polyhouse and /or shadenet house work .

2. In consideration interalia of the firm paying to the guarantor the guarantee charges and executing

requisites documents in favour of the bank and which have been done prior to the execution

hereof and the request of the firm, the Bank hereby agree with the Commissioner of Horticulture,

Govt. of A.P., THAT in the event of any default and / or defaults being committed by the firm in

payment to the firm of the said Rs. 5,00,000/- (Rupees five lakhs only) and or any part thereof

the Bank hereby irrevocably unconditionally and or without any demur and not withstanding any

intimation and or direction by the firm to the contrary guarantee and covenants to pay to the

Commissioner of Horticulture, Govt. of A.P., the said sum of Rs. 5,00,000/- (Rupees Five lakhs

only) and or any part thereof as the case may be.

3. The Commissioner of Horticulture, Govt. of A.P., shall be entitle to act under the terms hereof as if

the Bank was the Principal Debtor to the Commissioner of Horticulture, Govt. of A.P., for payment

of any amount upto the said sum of Rs.5,00,000/- (Rupees five lakhs only) guarantee by the

Bank aforesaid to the Commissioner of Horticulture, Govt. of A.P.

4. The guarantee is additional and without prejudice to any security of obligations which the

Commissioner of Horticulture, Govt. of A.P., may now of hereafter have from the firm and or any

other person in respect of the said indebtedness and or liabilities and or obligations hereby

guaranteed and all rights and remedies in respect thereof are hereby reserved by the Commissioner

of Horticulture, Govt. of A.P., in its favour.

5. The guarantee contained herein is irrevocable and unconditional shall be continuing guarantee

and shall remain in force for a period of 36 months with effect from the date of guarantee. On the

CAO serving on the bank notice of claim under this guarantee before the expiry of the said

period, the same shall be enforceable against the bank notwithstanding the fact that the same is

payable after expiry of the said period.

6. The guarantee shall be continuing guarantee and shall not be considered as wholly or partially

satisfies or exhaust by any payments from time to time made by the Bank or the distributor or

any settlements of the accounts between the Commissioner of Horticulture, Govt. of A.P., and the

firm.

7. The bank shall make the payment to the firm at the time or from time to time a sum not

exceeding in aggregate the said sum of Rs. 5,00,000/- (Rupees five lakhs only) unconditionally

and without any demur and irrespective of any instructions or directions given by the firm to the

bank to without payment thereof or any ground whatsoever. The bank obligations of the bank in

terms hereof shall not be anywise affected or suspended by reason of dispute (if any) having been

raised by the firm (whether of not pending before any Arbitrator Office, Tribunal or Court) or

any denial of liability by the firm stopping or preventing or purporting to stop or prevent any

payment by the Bank of the Commissioner of Horticulture, Govt. of A.P., in terms thereof.

8. The bank hereby further agrees with declares and undertake to the Commissioner of Horticulture,

Govt. of A.P., that his guarantee is and shall always be unconditional irrevocable and absolute till

guaranteed amount hereunder have been paid in full to the Commissioner of Horticulture, Govt. of

A.P., irrespective of any dispute of difference as to any liability of the firm or invalidity,

enforceability, illegality or otherwise of any terms, conditions or provision between the firm and

the Commissioner of Horticulture, Govt. of A.P., or otherwise.

9. This guarantee shall be determined of affected by the liquidation or winding up, dissolution of

change of constitution or insolvency of the firm or change in the constitution of either the firm or

bank but shall in respect and for all purposes be binding and operative until satisfactory

performance of all the obligations by the firm towards the Commissioner of Horticulture, Govt. of

A.P.

10. Notwithstanding anything contained herein :

a) Our liability under this guarantee shall not exceed Rs. 5,00,000/- (Rupees five lakhs only).

b) The guarantee shall be valid up to .

c) We are liable to pay the guaranteed amount or any part thereof under this guarantee only and

only if you serve upon us a written claim of demand on or before (inclusive

of claim period of three months).

Format of information board to be provided at each Service Center

Specifications: Information board should be of size 5’ x 4’. The board should be preferably made from the

iron/steel sheet with iron/steel angle of sufficient strength for mounting and fixed in foundation.

Place: The board should be installed at each Service Station of Supplies/Manufacturer at the eye level for

the height of normal person.
