A draft plan of management has been prepared for the Berrima River Reserve being the Crown reserves described below, which Wingecarribee Shire Council manages.

of the NSW Department of Primary Industries pursuant to sections 227 and 228 of the Fisheries Management Act 1994 (“the Act”), do by this order:

1. pursuant to section 183 of the Act and section 43(2) of the Interpretation Act 1987, repeal the Quarantine Order titled “Section 183 - Quarantine Order QX Disease” published in New South Wales Government Gazette No. 87 of 11 July 2008, at pages 6996-6997;

2. pursuant to section 183 of the Act: (i) declare each the following estuaries to be a

quarantine area (“the Quarantine Areas”) because of the presence or suspected presence of the declared disease marteiliosis (QX disease):(a) Richmond River(b) Clarence River(c) Macleay River(d) Hawkesbury River(e) Georges River(f) Tweed River(g) Brunswick River

(ii) prohibit the taking of oysters or the movement of cultivation equipment and/or infrastructure from the Quarantine Areas except under the following conditions:(a) oyster cultivation equipment and infrastructure

(eg. oyster sticks, trays, baskets) used in any of the Quarantine Areas must be dried for 30 days before use in any other NSW estuary.

(b) oysters, oyster cultivation equipment and infrastructure may be relocated between the Quarantine Areas but only in accordance with the Oyster Shipment Log Book System for the Movement of Oysters, Oyster Cultivation Equipment and Infrastructure which is detailed below in Schedule 1.

(c) oysters may be taken and culled in or adjacent to the Quarantine Areas or in accordance with a protocol approved by the Deputy Director-General, Agriculture, Biosecurity and Mine Safety.

(iii) exclude sections 185 and 186 of the Fisheries Management Act 1994 with respect to oysters taken from the Quarantine Areas or any part of the Quarantine Areas in accordance with this order (but only in relation to the declared disease marteiliosis (QX disease).

(iv) Require all holders of aquaculture permits within the Quarantine Areas to follow all directions of a fi sheries offi cer made under section 183(4) of the Act.

SCHEDULE 1

Oyster Shipment Logbook System for the Movement of Oysters, Oyster Cultivation Equipment and Infrastructure

(1) All shipment of oysters, oyster cultivation equipment and infrastructure other than those within an estuary or those destined for direct sale for human consumption must be recorded in an Oyster Shipment Log Book prior to shipment.

(2) Not less than 2 days prior to the shipment of a consignment of oysters, oyster cultivation equipment and infrastructure between estuaries, the shipping permit holder must contact the local District Fisheries Offi ce and identify the shipper, the nature of the shipment and its destination and the Oyster Shipment Log Book shipment permit number (top right hand corner of the shipment sheet).

(3) Prior to the shipment of oysters, oyster cultivation equipment and infrastructure, the shipping permit holder must record on all four (4) quadruplicate copies of the Oyster Shipment Log Book sheets, details of the destination (including interstate), quantity (bag equivalents) and form (trays, sticks, etc) of oysters to be shipped.

(4) For each shipment of oysters, oyster cultivation equipment and infrastructure, the completed original white copy (copy 1) of the Oyster Shipment Log Book sheets must accompany the shipment and be retained by the receiving permit holder.

(5) The Oyster Shipment Log Book, or the original white copy (copy 1) of the Oyster Shipment Log Book that has accompanied a shipment, must be made available to a Fisheries Offi cer for inspection on demand.

(6) The holder of an Oyster Shipment Log Book must at the end of each month in which a shipment has occurred, forward all blue copies (copy 3) for those shipments to NSW Department of Primary Industries Aquaculture Management at the address specifi ed below.

Note: Oyster Shipment Log Books are available on application from NSW Department of Primary Industries Aquaculture Administration, Locked Bag 1, Nelson Bay NSW 2315 or by phoning (02) 4982 1232.

In this Schedule, a reference to an estuary in paragraph 3(i) includes a reference to all creeks, rivers, lakes, lagoons and tributaries fl owing into or from that estuary and any jetty, wharf, boat ramp or land used for aquaculture purposes in the immediate vicinity of the water.

Note: In addition to complying with the terms of this order, the taking of oysters or the movement of oyster cultivation equipment and/or infrastructure must comply with the terms of any fi shing closure made under section 8 and section 11 of the Fisheries Management Act 1994 including the fi shing closures titled “QX Disease” of 11 July 2008 (New South Wales Government Gazette No. 87 of 11 July 2008, at pages 6994-6996) and of the same date as this order.

Requirements for Design Registration for Gas Detection and Monitoring Plant and Items

I, ROBERT REGAN, Chief Inspector under the Coal Mine Health and Safety Act 2002 (the Act), pursuant to clause 107(2)(ii) of the Occupational Health and Safety Regulation 2001 (the Regulation), by this notice:

1. Revoke the notice titled “Requirements for design registration for gas detection and monitoring plant and items” published in New South Wales Government Gazette No. 24 of 2 February 2007, at pages 672-677, and

2. Specify in the Schedule the standards that must be met for registration of a plant design for portable or hand-held plant or items used to determine or monitor the presence of gases for the purposes of the Act and used in underground mines at a coal workplace.

In this notice, “items used to determine or monitor the presence of gases” include gas detection and monitoring equipment of fi xed installations, installations on mobile or transportable plant and within a mine, excluding tube bundle systems when the analyser is installed on the surface.

SCHEDULE

1. Design and Performance Requirements1.1 The following tests must be carried out prior to design

registration. The design registration will only remain valid for gas detection and monitoring plant and items manufactured during a set period, typically fi ve (5) years, and where there is no change in the design, or change in the location or method of manufacture. Should the manufacture of design registered plant be required beyond the set registration period, a further application will be required and the application is to be accompanied with a further review of the plant with the currency of gazetted requirements and associated compliance standard.

Note: Electrically powered gas detection and monitoring plant and items that are required for use in the hazardous zone must also be of a gazetted type under clause 19(1)(c) of the Coal Mine Health and Safety Regulation 2006 .

1.2 Flammable gas detection and monitoring plant and itemsOnly fl ammable gas detection and monitoring plant and items that conform to the following requirements in respect to construction and performance shall be considered suitable for design registration and permitted for use underground at a coal workplace. Flammable gas detection and monitoring plant must:(a) Conform to AS/NZS 60079.29.1:2008 Electrical

apparatus for the detection and measurement of fl ammable gases Part 1: General requirements and test methods; and

(b) Conform to the requirements of the following additional test criteria:(i) Poisons (additional to AS/NZS 60079.29.1

clause 5.4.24.1)

(1) The apparatus shall be exposed to a volume fraction of 2% methane in air mixture containing a volume fraction of 50ppm hydrogen sulphide for 20 minutes for continuous duty apparatus or 100 tests for spot reading apparatus. The following minimum acceptable performance requirements must be achieved:(A) For apparatus indicating zero to

fi ve percent methane, the variation in indication from the standard test gas concentration shall not exceed a volume fraction ±0.2% methane.

(B) For apparatus indicating zero to one hundred percent methane, the variation in indication from the standard test gas concentration shall not exceed a volume fraction ±0.3% methane.

(ii) Effect of Other Gases (additional to AS/NZS 60079.29.1 clause 5.4.24.2)(1) The apparatus shall be tested separately

with the following gas mixtures:

Carbon monoxide a volume fraction of standard test gas +a volume fraction 0.1% CO in air

Nitric oxide a volume fraction of standard test gas + a volume fraction 25ppm NO in air

Nitrogen dioxide a volume fraction of standard test gas + a volume fraction 10ppm NO2 in air

(2) The standard test gas is as defi ned in AS/NZS 60079.29.1 clause 5.3.3.

(3) The following minimum acceptable performance requirements must be achieved:(A) For apparatus indicating zero to

fi ve percent methane, the variation in indication from the standard test gas concentration shall not exceed a volume fraction of: (i) ±0.1% methane for a test gas

concentration less than or equal to 1% methane, or

(ii) ±10% of test gas concentration or ±5% of the full scale measuring range whichever is the least for a test gas concentration greater than 1% methane

(B) For apparatus indicating zero to one hundred percent methane, the variation in indication from the standard test gas concentration shall not exceed a volume fraction of:(i) ±0.3% methane for a test gas

concentration less than or equal to 3% methane, or

1.3 Oxygen detection and monitoring plant and itemsOnly oxygen detection and monitoring plant and items that conform to AS/NZS 4641:2007 Electrical apparatus for detection of oxygen and other gases and vapours at toxic levels in respect to construction and performance shall be considered suitable for design registration and permitted for use underground at a coal workplace.

1.4 Toxic gas detection and monitoring plant and itemsOnly toxic gas detection and monitoring plant and items that conform to AS/NZS 4641:2007 Electrical apparatus for detection of oxygen and other gases and vapours at toxic levels in respect to construction and performance shall be considered suitable for design registration and permitted for use underground at a coal workplace.

2. Testing Requirements2.1 All testing must be carried out by:

(a) A laboratory in Australia that is accredited by the National Association of Testing Authorities Australia (NATA), or

(b) An equivalent organisation acceptable to the Chief Inspector.

3. Registration Assessment3.1 The following documents (or documents containing

the following information) must be provided for assessment with the application under clause 107 of the Regulation for registration of plant design:(a) Testing certifi cate(s), accredited by NATA or by

an otherwise acceptable equivalent, for each test design and performance criteria stipulated in 1.0 above,

(b) All supporting documentation specified in test certificate(s) that was used for product identifi cation and performance evaluation,

(c) Apparatus operating instructions,(d) Apparatus life cycle (within the meaning of the

Coal Mine Health and Safety Regulation 2006) maintenance instructions.

(e) Where the plant is of a type as gazetted under clause 19(1)(c) of the Coal Mine Health and Safety Regulation 2006:(i) A copy of the Certifi cate of Conformity, or

Approval,(ii) A copy of the test report(s) referenced in the

Certifi cate of Conformity or approval, and(iii) A copy of all the drawings referenced in the

test report(s).

1. Name of OrderThis Order is the Occupational Health and Safety Regulation 2001 Exemption Order No. 004/09.

2. CommencementThis Order commences on 12 May 2009 and has effect for a period of fi ve years from that date.

3. Exemption1. The Australian Gas Association, ABN 98004206044

(“AGA”), is hereby exempted from clauses 129 (b), 136 (9) and 140 (2) of the Occupational Health and Safety Regulation 2001 (“Regulation”) to the extent that those clauses (directly or indirectly) require AGA to grant certifi cates of conformity only to gas cylinder test stations in Australia, as required by clause 3.22.1 of AS 2030.1 and clause 1.3.3 of AS 2337.1. This exemption is subject to the conditions in Part A of Schedule 1.

2. A Prescribed Tester is hereby exempted from clauses 129 (b), 136 (9) and 140 (2) of the Regulation to the extent that those clauses (directly or indirectly) require that certifi cates of conformity be granted only to gas cylinder test stations in Australia, as required by clause 3.22.1 of AS 2030.1 and clause 1.3.3 of AS 2337.1. This exemption is subject to the conditions in Part A of Schedule 1.

3. A Prescribed User gas cylinders are exempted from clauses 129(b), 136(9) and 140(2) of the Occupational Health and Safety Regulation 2001 in relation tois hereby exempted from clauses 129 (b), 136 (9) and 140 (2) (as the case may be) of the Regulation to the extent that those clauses (directly or indirectly) require that certifi cates of conformity be granted only to gas cylinder test stations in Australia, as required by clause 3.22.1 of AS 2030.1 and clause 1.3.3 of AS 2337.1. This exemption is subject to the conditions in Part B of Schedule 1. the circumstances specifi ed in Schedule 1, subject to the conditions in Schedule 2.

4. Defi nitionsIn this Order:“Act” means the Occupational Health and Safety Act 2000.

“AS 2030” means Australian Standard AS 2030 – Gas Cylinders.

”AS 2337” means Australian Standard AS 2337 – Gas Cylinder Test Stations.

”Gas cylinder” has the same meaning as in the Regulation.

“Gas cylinder test station” means a facility which performs inspection and testing of gas cylinders according to the requirements of AS 2337, and includes an integrated gas cylinder test station.

“Integrated gas cylinder test station” means a test station located within a gas cylinder manufacturing facility, which is also accredited to perform inspection of the manufacturing process.

“MP 48” means the document of that title published by Standards Australia Limited from time to time.

“Prescribed Tester” means a person who has received a certifi cate of conformity from AGA in relation to a gas cylinder test station that is located outside Australia and is operated by that person.

“Prescribed User” means a person who:(a) hires or leases a gas cylinder to another person (within

the meaning of clause 129 (b) of the Regulation),(b) owns a gas cylinder affecting public safety (within

the meaning of clause 136 (9) of the Regulation, or(c) is an employer (within the meaning of clause 140

(2) of the Regulation) who must ensure that a gas cylinder complies with AS 2030 Parts 1, 2 and 4 and is inspected and maintained as required by AS 2030 Parts 1, 2 and 4.

“Regulation” means the Occupational Health and Safety Regulation 2001.

“WorkCover NSW” means the WorkCover Authority of New South Wales.

5. Other laws not affectedNothing in this Order affects any other applicable requirement imposed by the Regulation, the Act or any other law in relation to the matters connected with this Order.

6. Status of certain previous exemption ordersFor the avoidance of doubt, exemption orders 021/007 and 005/08 are not affected by this Order.

SCHEDULE 1Part A

Conditions applicable to AGA and Prescribed Testers

The exemption applying to AGA and a Prescribed Tester under this Order is subject to the following conditions:

1. The design of a gas cylinder which is tested by the Prescribed Tester has been registered in accordance with clause 107 of the Regulation.

2. The Prescribed Tester has received a current certifi cate of conformity granted by AGA.

3. The Prescribed Tester’s identifi cation stamp mark has been advised to Standards Australia Limited for listing in the next publication of MP48.

4. AGA must: (a) maintain a current register of all Prescribed Testers and (b) make available, on request, details contained in the register to a regulatory authority (including WorkCover NSW).

5. The gas cylinders tested by a Prescribed Tester must be acceptable for sale in the country of manufacture as well as in Australia.

6. Documentation, in the English language, required by AS 2030.1 must be available in Australia in relation to the gas cylinders tested by the Prescribed Tester.

7. The Prescribed Tester must remain compliant with Appendix E of AS 2337.1.

8. AGA must continue to be permitted by a recognized body (within the meaning of AS 2337.1) to grant certificates of conformity to gas cylinder test stations.

Part BConditions applicable to Prescribed Users

The exemption applying to a Prescribed User under this Order is subject to the condition that the Prescribed User ensures that any gas cylinder to which the exemption applies bears an identifi cation stamp mark which indicates that the gas cylinder has been tested by a Prescribed Tester.

PRACTICE NOTE DC (CIVIL) NO. 7Court Approval of Settlements

THIS Practice Note applies to actions commenced in the Sydney Registry of the Court only.

1. In general, applications for approval under the Civil Procedure Act will be listed for hearing on Fridays. However alternative arrangements will be made for urgent applications or where there are special circumstances.

2. A party may list a matter for approval either by fi ling copies of the proposed Terms of Settlement and the relevant Affi davit(s) in the Registry or by contacting the List Offi ce.

3. Where an approval is listed by contacting the List Offi ce, the parties are required to fi le all Affi davit evidence upon which they will rely at the hearing at least three (3) clear working days prior to the listing of the application before the Court.

4. A matter should not be listed unless the application will be ready to proceed. If the plaintiff’s disability requires orders to be made by the Supreme Court or Guardianship Board, application for orders should, wherever possible, be made prior to the matter being listed.

5. Unless there are exceptional circumstances, the plaintiff and the tutor will be required to attend at the hearing of the application.

6. The Affi davit evidence should, where relevant, include the following matters:A. Whether the settlement reflects a compromise

on liability and if so, copies of any relevant documents;

B. Up to date medical report/s dealing with all relevant medical issues;

C. A statement by the tutor as to the plaintiff’s current disabilities, if any;

D. A statement of the net amount to be invested on behalf of the plaintiff or which will be payable in accordance with a Court order, which should include all accounts (including legal costs and claims by the tutor or family members for reimbursement), both paid and unpaid;

E. Details of the past out-of-pocket expenses both paid and unpaid;

F. Details of any other deductions to be made from the settlement e.g. Centrelink;

G. A statement by the tutor to the effect that the amount allowed for past out-of-pocket expenses in the settlement includes all accounts, both paid and unpaid, of which the tutor is aware having made all relevant enquiries;

7. A copy of counsel’s advice or in its absence the advice of the solicitor with carriage of the matter, dealing with both the question of liability and the consideration of each of the applicable heads of damage in the proceedings should generally be provided for the assistance of the presiding Judge considering approval of the settlement three (3) clear working days prior to the listing of the application before the Court. Such advice may be provided to the Court in a sealed envelope and will be returned.

8. In cases where an undertaking is required from a legal representative in relation to either the payment of out of pocket expenses or the reimbursement of payments made, the undertaking should, unless the court otherwise orders, be in the following form:

Undertaking(Insert name) undertakes to the Court to hold any amount received pursuant to this settlement, other than for legal costs and disbursements, on trust and to only apply those trust funds in accordance with the Orders made and the evidence fi led in support of the application for approval.

9. If an application for approval pursuant to section 76 of the Civil Procedure Act is either refused or not ready to proceed the action will be returned for management. If the action has already been allocated an arbitration or trial date, that arbitration or trial will, unless the Court otherwise orders, proceed.

Early Return of Subpoenas

THIS Practice Note supersedes and replaces the previous Practices Notes referable to early return of subpoenas.1. INTRODUCTION

1.1 The issuing of subpoenas and the inspection of documents is vital to the proper preparation of cases. The Court provides a system for the early production of documents so that parties can meet the standards imposed by Practice Notes.

1.2 The power to deal with subpoenas is delegated to the registrar by a direction under section 13 of the Civil Procedure Act 2005.

2. SYSTEM FOR EARLY RETURN OF SUBPOENAS2.1 The Court aims to allocate a return date within 6

weeks of the issue of a subpoena for production.

2.2 The Court has adopted the following system for the early return of subpoenas and access to documents to give effect to the powers in rule 33.9 of the Uniform Civil Procedure Rules 2005: (a) The issuing party will obtain a return date from

the registry and endorse it on the subpoena. In Sydney, the return date will be on a Monday at 11am before the registrar.

(b) The issuing party must attach to the service copies of the subpoena a notice in the form specifi ed in the Practice Note. The issuing party is required to endorse a proposed access order and the producer is required to complete the attached declaration as to whether the material produced is copied material, original material or a mix of copied and original material. Unless an alternative order is sought the proposed access order will be “Plaintiff to have fi rst access for 7 days; thereafter, in the absence of further application, access to all parties.” Where a different proposed access order is sought the issuing party must state his or her reasons in the notice. If there is a dispute over the proposed access, the parties must appear on the return date.

(c) The issuing party must serve a copy of the subpoena and notice on all other parties who have an address for service within 7 days of issue. If the return date is less than 2 weeks away, the copy and notice must be served within 24 hours.

(d) The issuing party must appear on the return date if it has not notifi ed all parties of the issue of the subpoena. All other parties must attend on the return date unless the issuing party has obtained consent to mention the matter for all parties. The Court may make costs orders against parties who have not complied with the rules and this practice note.

(e) Any party or the producer, may object to the issuing party about the proposed access order. The issuing party must notify all other parties of the objection. Parties who wish to contest the proposed access order must appear on the return date and argue the question before the registrar.

(f) If there is No. appearance on the return date, the Court will generally make the proposed access order. There is No. need for the parties to appear on the return date if all parties consent to the order sought.

(g) If the subpoena has not been served, the issuing party should appear on the return date and ask the registrar for a new return date.

(h) If documents have not been produced, any party may obtain a further return date from the registry. That party must inform all other parties of the new return date.

3. ACCESS TO DOCUMENTS3.1 When the proposed access order takes effect, parties

may inspect documents in the registry in accordance with that order. The other parties may inspect the documents produced as soon as the fi rst access order has expired.

3.2 Practitioners should be aware that, if the party with fi rst access does not inspect documents in accordance with the proposed access order, other parties may inspect privileged documents and the privilege may be lost.

3.3 The Court has broad discretionary powers under rule 33.8 of the Uniform Civil Procedure Rules 2005 with respect to access to and copying of documents.

PRACTICE NOTE SC Eq 7 – Family Provision

Commencement 1. This Practice Note commences on 1 June 2009. Application 2. This Practice Note applies to all applications under the Family Provision Act 1982

or Chapter 3 of the Succession Act 2006. Definitions 3. In this Practice Note:

CPA means the Civil Procedure Act 2005 Family provision application means an application under the Family Provision Act 1982 or Chapter 3 of the Succession Act 2006 Online hearing means a hearing conducted pursuant to s 71 of the Civil Procedure Act 2005 and Part 3.9 of the Uniform Civil Procedure Rules 2005 and in accordance with Practice Note SC Gen 12 UCPR means the Uniform Civil Procedure Rules 2005.

Plaintiff’s documents 4. The plaintiff must serve the following documents with the Summons:

• An affidavit adapted from the form in Annexure 1 to this Practice Note • Notice of eligible persons • Draft consent orders for the first return date of the Summons that:

o Set out a timetable for the future conduct of the proceedings including the service of affidavits and the disclosure of any documents

o Refer the proceedings to mediation at the conclusion of that timetable. 5. If a limitation period is about to expire and proceedings are being commenced to

preserve rights, the plaintiff must serve the following documents with the Summons: • An affidavit setting out the reasons why the service of evidence should be

Mediation 8. Unless ordered otherwise, all proceedings involving Family provision applications

necessary adaptations, if expert evidence is to be called. Consent Orders finalising proceedings 20. Consent Orders finalising proceedings must include provisions that the parties

agree that: • The application was made within time • The plaintiff is an eligible person • The plaintiff has served a notice identifying all other eligible persons on the

administrator at the time of serving the summons • The administrator has filed a copy of the affidavit required by SCR Schedule J • The administrator has served notices of the plaintiff's claim on any person

who, in the administrator's opinion, may be an eligible person • The administrator has filed a notice of appearance.

21. Consent orders requiring the approval of an associate judge will be referred to

the duty associate judge on a Friday. Listing for hearing 22. If the proceedings fail to settle at mediation, the Registrar will set the proceedings

down for hearing and make the Usual Order for Hearing in Annexure 4 to this Practice Note.

USUAL ORDER FOR MEDIATION

1. The executor or administrator of the deceased estate must file and serve an

updated affidavit listing the estate’s assets and an up to date valuation of those assets by no later than 6 working days prior to the mediation.

2. All other parties must file and serve a statement listing the parties’ assets and up

to date valuation of those assets by no later than 6 working days prior to the mediation.

3. Not less than 3 working days prior to the mediation, the plaintiff is to deliver a

bundle of documents to the Mediator containing: 3.1 copies of all affidavits served in the proceedings; 3.2 copies of any other documents relied on by the plaintiff; 3.3 the statement containing up to date valuations of the plaintiff’s assets; 3.4 the statement as to the plaintiff’s estimated costs to the date of mediation.

4. Not less than 3 working days prior to the mediation the defendant is to deliver a

bundle of documents to the Mediator containing: 4.1 copies of any documents that will be relied upon by the defendant other

than affidavits that have already been served on the plaintiff; 4.2 a statement as to the defendant’s estimated costs to the conclusion of the
