“animal”means anymemberof the animal kingdom (other than a human),whetheraliveordead,including-

(a) anymammal,bird,fish,shellfishorreptile;

(b) any invertebrate declared under paragraph (a) of subsection (2) to be ananimal;

“animalproduct”means-

(a) thecarcassorpartofthecarcassofananimal;

(b) meat,blood,hide,skin,hair,wool,feather,shell,horn,fin,hooforanypartofthevisceraofananimal;

(c) fat,milk,whey,cream,butter,cheese,eggs,orotherfoodorfoodstuffsderivedfromananimal;

(d) thesperm,ovaorembryoofananimal;

(e) anysecretionorexcretionofananimal;

(f) honeyorotherproductsfromhoneybees;and

(g) anyotherthingdeclaredunderparagraph(b)ofsubsection(2)tobeananimalproduct;

“authorisedperson”meansanauthorisedpersonreferredtoinsection5;

“conveyance”meansanyvehicle,vesseloraircraft;

“disease”means-

(a) adiseasethataffectsormayaffectananimalorthatmaybetransmittedbyananimaltoaperson;and

(b) aninfectiousagent;

“healthcertificate”meansahealthcertificateconformingtotheformatoftheappropriatemodelcertificateoftheOffice International des Epizooties;

“import”meanstobringorcausetobringintoNamibiafromaplaceoutsideNamibiabyland,seaorair;

“importer” in relation toany importedanimal, animalproductor restrictedmaterial,meansapersonwho,whetherasowner, consignor, consignee, agentorbroker, is inpossessionofor inanywayentitled to thecustodyorcontrolof thatanimal,animalproductorrestrictedmaterial;

“infected”means-

(a) infectedwithadisease;or

(b) harbouringaninfectiousagent;

“infectiousagent”means-

(a) anybacterium,virus,prion,fungus,parasite,pestorotherorganismorinfectioussubstancewhichmaycauseortransmitdiseaseinanimals;

(b) anyotherthingdeclaredunderparagraph(c)ofsubsection(2)tobeaninfectiousagent;

“intransit”meanstheconveyanceofananimal,animalproductorrestrictedmaterialimportedfromonecountrythroughNamibiatoanothercountry;

Minister”meanstheMinisterresponsibleforagriculture;

“Ministry” means the Ministry responsible for the administration of agriculturalmatters;

“notifiabledisease”meansanydiseasedeclaredunderparagraph(e)ofsubsection(2)tobeanotifiabledisease;

“occupier”means-

(a) apersonwhoresidesinpremises;

(b) ifnopersonresidesinpremises,theownerofthepremises;or

(c) apersonactingonbehalfofapersonreferredtoinparagraph(a)or(b);

“owner,inrelationto-

(a) any animal, animal product or restricted material, conveyance or any othermovable property, includes a person having the possession, charge, custodyorcontrolof thatanimal,animalproduct,restrictedmaterial,conveyanceorproperty;

(b) anyland,meansthepersoninwhosenamethelandisregistered,andincludes-

(i) if thelandhasbeenalienatedinanywaybutnotyet transferred, thepersoninwhosenametransferofthelandisstilltoberegistered;

(ii) inthecaseoflandsubjecttoausufruct,theusufructuary;

(iii) theexecutor,trusteeorotherlegalrepresentativerecognizedbylawofanownerwhoisdeceased,insolvent,aminororsubjecttootherlegaldisability;

(iv) iftheownerisacompanyorclosecorporationunderliquidation,theliquidatorofthecompanyorclosecorporation;

“place”means-

(a) anyland,includinganyriver,damorotherbodyofwateronland;

(b) anypremises;

(c) anybuildingorotherstructureinoronaplace;

(d) anypartofaplace;

“prescribed”meansprescribedbyregulation;

“regulation”meansaregulationmadeunderthisAct;

“restrictedmaterial”means-

(a) aninfectiousagent;or

(b) anythingdeclaredbytheMinisterunderparagraph(d)ofsubsection(2)toberestrictedmaterial;

“staffmember”meansastaffmemberasdefinedinsection1ofthePublicServiceAct,1995(ActNo.13of1995);

“veterinarian”meansapersonregisteredasveterinarianintermsoftheVeterinaryandPara-VeterinaryProclamation,1984(ProclamationAG.No.14of1984);

“veterinaryofficial”meansapersonappointedasveterinaryofficialundersection4andincludestheChiefVeterinaryOfficer;

(2) ForthepurposesofthisAct,theMinistermaydeclarebynoticeintheGazette -

(a) anyinvertebratetobeananimal;

(b) anythingtobeananimalproduct;

(c) anything whichtheMinisterconsidersmaycausediseaseinanimalstobeaninfectiousagent;

(d) anyequipment,materialorotherobjectusedforcontaininganimalsorthehandlingorkeepingofanimalsbymeansofwhichdiseasecanbespreadtoberestrictedmaterial;or

(e) adisease tobeanotifiabledisease in relation toa specifiedclassofanimal.

2. (1) SubjecttothelawsgoverningthePublicService,theMinistermustdesignateastaffmemberemployed in theMinistrywhoisaveterinarian tobeChiefVeterinaryOfficerortoactassuch.

(2) TheChiefVeterinaryOfficer is responsible for theadministrationofthisActandexercisesthepowersandperformsthedutiesconferredorimposedonhimorherbyorunderthisActsubjecttothecontrolanddirectionsoftheMinister.

Veterinary officials

3. (1) TheMinister,ontherecommendationoftheChiefVeterinaryOfficer,mayappointinwritingasveterinaryofficialsforthepurposesofthisAct–

(a) staffmembersemployedintheMinistry;

(b) with theconsentof theMinister responsible foranyotherMinistry,staffmembersemployedinthatMinistry;and

(c) with the consent of the governing body of any institution or bodyestablishedbylaw,employeesofthatinstitutionorbody.

(2) Inadditiontoappointingveterinaryofficialsreferredtoinsubsection(1),theMinister,ontherecommendationoftheChiefVeterinaryOfficer,mayappoint,bynotice in theGazette,membersofaclassofpersonsspecifiedin thenotice tobeveterinary officials if theMinister considers it necessary to do so for controlling anotifiablediseaseoranyotherdiseasespecifiedinthenotice.

(3) AveterinaryofficialmustperformthedutiesandfunctionsconferredonorassignedtoaveterinaryofficialbyorunderthisActsubjecttothecontrolanddirectionsoftheChiefVeterinaryOfficer.

(4) TheMinistermay–

(a) revoke,bynotice inwriting, anappointmentmadeunder subsection(1);or

(b) by notice in theGazette, amend or revoke a notice published undersubsection(2).

(5) TheMinistermust cause to be issued to each veterinary official anidentitycardcontainingaphotographandthesignatureoftheveterinaryofficial.

(6) AveterinaryofficialmustproducehisorheridentitycardforinspectionwhensorequiredbyapersoninrelationtowhomtheveterinaryofficialseekstoperformafunctionorexerciseapowerunderthisAct.

Authorised persons

4. (1) TheMinister,ontherecommendationoftheChiefVeterinaryOfficer,may inwritingauthoriseaperson toperform the functionsandexercise thepowers,ofaveterinaryofficialthatarespecifiedintheauthority.

(2) Anauthorityunder subsection (1)has effect for theperiod specifiedin theauthorityor, ifnoperiod is so specified,until theauthority is revokedby theMinister.

(3) AnauthorisedpersonmustproducehisorherauthorityforinspectionwhensorequiredbyapersoninrelationtowhomtheauthorisedpersonseekstoperformafunctionorexerciseapowerunderthisAct.

delegation

5. (1) TheMinistermaydelegatetothePermanentSecretaryoftheMinistryortheChiefVeterinaryOfficeranyoftheMinister’sfunctionsorpowersunderthisAct,otherthanthepowertomakeregulationsorthepowerofdelegationconferredbythissubsection.

(2) TheChiefVeterinaryOfficermay delegate or assign to a veterinaryofficial any of the powers or functions conferred upon or assigned to the ChiefVeterinaryOfficerbyorunderthisAct.

(3) Adelegationorassignmentundersubsection(1)or(2)-

(a) mustbeinwriting;

(b) does not divest or discharge the Minister or the Chief VeterinaryOfficer,fromthepowerordutydelegatedorassigned;

(c) maybe revokedat any timeby theMinisteror theChiefVeterinaryOfficer.

General responsibilities of veterinary officials

6. Theresponsibilitiesofaveterinaryofficialinclude-

(a) thedetectionandinvestigationofdisease; (b) thepreventionofdisease;

(c) thecontrollingofdisease;

(d) thesurveillanceofdisease;

(e) whereappropriate,theeradicationofdisease;

(f) ascertainingwhethertheprovisionsofthisActhavebeenorarebeingcompliedwithanddeterminingwhetherapersonmayhavecontravenedanyprovision;and

(g) otherfunctionsasareassignedtoaveterinaryofficialbyorunderthisAct.

IMPORTATIONOFANIMALS,ANIMALPRODUCTSANDRESTRICTEDMATERIAL

Permit for importation of animals, animal products and restricted material for entry into Namibia

7. (1) ApersonmaynotimportforentryintoNamibia-

(a) anyanimal;

(b) anyanimalproduct;or

(c) anyrestrictedmaterial,

except if the person holds an import permit issued under thisAct authorising theimportation forentry intoNamibia,and the importation iscarriedout inaccordancewiththeconditionsasprescribedandasspecifiedinthepermit.

(2) Despitethatanimportpermitauthorisestheimportationofanyanimal,animal product or restrictedmaterial, a personmay not import such animal, animalproductorrestrictedmaterialif-

(a) the person knows or has reason to believe that the animal, animalproductorrestrictedmaterialisinfected;and

(b) thepermitdoesnotspecificallyauthorisetheimportationoftheanimal,animalproductorrestrictedmaterialininfectedcondition.

(3) Anapplicationforanimportpermitmust–

(a) bemadeintheprescribedmannerandform;and

(b) beaccompaniedbytheprescribedfee.

(4) TheChiefVeterinaryOfficermayrequireanapplicant foran importpermit toprovidefurther informationordocuments that theChiefVeterinaryOfficerconsidersrelevantfordeterminingwhethertoissuethepermit.

(5) An import permit authorises the importation of any animal, animalproductorrestrictedmaterialspecifiedthereinonlywithintheperiodspecifiedinthepermit.

(6) Inadditiontoanypermitconditions,theChiefVeterinaryOfficermayspecifyanyotherconditionswithwhichtheimportermustcomplywhenimportinganyanimal,animalproductorrestrictedmaterialtowhichtheimportpermitrelates.

(7) Withoutlimitingthegeneralityofthepowerconferredbysubsection(6),conditionsspecifiedundersubsection(6)mayincludeconditionsrelatingto-

(a) the identification, inspection, testing or treatment of any animal,animalproductorrestrictedmaterialatanytimebefore,duringorafterimportation;

(b) theisolationofanyanimal,animalproductorrestrictedmaterialatanytimebefore,duringorafterimportation;

(c) the quarantine of any animal, animal product or restricted materialbeforeorafterimportation;

(d) the certification of any aspect of the identity, health status, originorhistoryof anyanimal, animalproductor restrictedmaterial tobeimported.

(8) Anyanimal,animalproductorrestrictedmaterialinrespectofwhichanimportpermithasbeenissued–

(a) maynotbebroughtintoNamibiaataplaceotherthantheplaceofentryspecifiedinthepermit;

(b) mustbemadeavailabletoaveterinaryofficialattheplaceofentryforthepurposeofinspectionorcarryingoutanyfunctionunderthisActortherequirementofaconditiontowhichthepermitissubject;and

(c) maynot be removed from the place of entrywithout the consent inwritingofaveterinaryofficialorcontrarytoanyconditiontowhichthepermitissubject.

(9) Anyimportedanimal,animalproductorrestrictedmaterialwhich,intermsofthisActoraconditiontowhichtheimportpermitissubject,isrequiredtoberemovedforthepurposeofbeing-

(a) testedortreated;or

(b) keptinisolation,

mustberemovedat theowner’sexpensebyorunderthesupervisionofaveterinaryofficialtoaplacedesignatedbytheveterinaryofficialforthatpurpose.

(10) A personmay not remove any animal, animal product or restrictedmaterial fromaplacereferred to insubsection(9)without thewrittenauthorityofaveterinaryofficial or contrary to any condition imposedby theveterinaryofficial ingrantingtheauthority.

(11) A personwho contravenes or fails to complywith any provision ofsubsection(1),(2),(8)or(10)commitsanoffenceandisliabletoafinenotexceedingN$1000000ortoimprisonmentforatermnotexceeding20yearsortobothsuchfineandsuchimprisonment.

Permit for importation of animals, animal products and restricted material for conveyance in transit through Namibia

8. (1) A personmay not import for conveyance in transit throughNamibiatoanothercountry–

(a) anyanimal;

(b) anyanimalproduct;or

(c) anyrestrictedmaterial,

exceptifthepersonholdsanimportandtransitpermitissuedunderthisActauthorisingtheimportationandconveyanceintransit,andtheimportationandconveyancethroughNamibiaarecarriedoutinaccordancewiththeconditionsasprescribedorasspecifiedinthepermit.

(2) Despitethatanimportandtransitpermitauthorisestheimportationofanyanimal,animalproductorrestrictedmaterialfortransitthroughNamibia,apersonmaynotimportsuchanimal,animalproductorrestrictedmaterialif-

(a) the person knows or has reason to believe that the animal, animalproductorrestrictedmaterialisinfected;and

(b) the permit does not specifically authorise the importation andconveyance in transit of the animal, animal product or restrictedmaterialininfectedcondition.

(3) Anapplicationforanimportandtransitpermitmust-

(a) bemadeintheprescribedmannerandform;and

(b) beaccompaniedbytheprescribedfee.

(4) TheChiefVeterinaryOfficermayrequireanapplicant foran importandtransitpermittoprovidefurtherinformationordocumentsthattheChiefVeterinaryOfficerconsidersrelevantfordeterminingwhethertoissuethepermit.

(5) AnimportandtransitpermitauthorisestheimportationandconveyancethroughNamibiaofanyanimal,animalproductorrestrictedmaterialspecifiedthereinonlywithintheperiodandtoanothercountryspecifiedinthepermit.

(6) Inadditiontoanypermitconditions,theChiefVeterinaryOfficermayspecifyotherconditionstobecompliedwithbytheimporterorotherpersoninchargeoftheanimal,animalproductorrestrictedtowhichthepermitrelatesbeforeorduringtheimportationandconveyanceintransit.

(7) Apersonwhocontravenessubsection(1)orapermitconditionspecifiedundersubsection(6)commitsanoffenceandisliabletoafinenotexceedingN$1000000ortoimprisonmentforatermnotexceeding20years,ortobothsuchfineandsuchimprisonment.

Notice to be given and health certificate obtained before import

9. A person who proposes to import any animal, animal product orrestrictedmaterialforentryintoNamibiaorforconveyanceintransitthroughNamibiamust–

(a) give prior notice in the prescribed manner to the Chief VeterinaryOfficeroftheimportationarrangements;and

(b) beforetheanimal,animalproductorrestrictedmaterialentersNamibia,obtainahealthcertificate fromacompetent authorityof thecountryfromwhereitisexported.

Animal, animal product or restricted material imported contrary to Act or presenting risk

10. (1) Ifaveterinaryofficialknowsorhasreasontosuspectthatanyanimal,animalproductorrestrictedarticleisbeingimportedorproposedtobeimportedcontrarytothisActoraconditionofapermit,theveterinaryofficialmaydirectthattheanimal,animalproductorrestrictedmaterial-

(a) maynotbebroughtintoNamibia;or

(b) ifithasenteredNamibia,maynotberemovedfromtheplaceofentry,

except with the written authority of the veterinary official and in accordance withconditionsimposedbytheveterinaryofficialingrantingtheauthority.

(2) If it is ascertained or suspected on reasonable grounds that anyimportedanimal,animalproductorrestrictedmaterialisinfectedorposesahealthrisk,aveterinaryofficialmaydirect the importerorotherpersoninchargeof theanimal,animalproductorrestrictedmaterialtodestroyordisposeoftheanimal,animalproductorrestrictedmaterialinthemannerandwithintheperioddeterminedbytheveterinaryofficial,attheexpenseoftheimporterorthatperson.

(3) If the direction of a veterinary official under subsection (2) is notcarriedout,theveterinaryofficialmaycauseanyactiontobetakenforthedestructionordisposaloftheanimalandtheexpenseconnectedwiththatactionmayberecoveredfromtheimporterasadebtowingtotheState.

(4) Neither the State, nor a veterinary official or a person taking anyactiondirectedbyaveterinaryofficialundersubsection(3)isliableforanydamageorlosssufferedbecauseofthedestructionordisposalofanyanimal,animalproductorrestrictedmaterial.

Border security in emergency

11. (1) IftheChiefVeterinaryOfficer,oranyotherveterinaryofficial,reasonablysuspectsthatthereisanimmediateriskofadiseasebeingintroducedintoor further spread inNamibia from another country, theChiefVeterinaryOfficer, oranyotherveterinaryofficial actingwith the consentof theChiefVeterinaryOfficer,may issueanemergencyrestrictionnotice thatprohibits,eitherabsolutelyorsubjectto compliancewith conditions specified in the notice, the importation or entry intoNamibiafromthatcountryof-

(a) animals,animalproductsorrestrictedmaterial,eitherofanydescriptionorofaclassspecifiedinthenotice;and

(b) vehiclesofatypeusuallyusedforthetransportationofanimals,animalproductsorrestrictedmaterialasspecifiedinthenotice.

(2) Withoutlimitingthegeneralityofthepowersconferredbysubsection(1),anoticemay–

(a) prohibit or restrict the importation or entry of any description ofanimals, animal products, restricted material or vehicles except atplacesspecifiedinthenotice;and

(b) specifytestsortreatmenttobeappliedtoanydescriptionofanimals,animal products, restricted material or vehicles upon entry intoNamibia.

(3) AnemergencyrestrictionnoticetakeseffectonthedateitisissuedbytheChiefVeterinaryOfficerorotherveterinaryofficialandmustbepublishedintheGazetteassoonaspracticableafterithasbeenissued.

(4) Apersonwhocontravenes,orfailstocomplywith,anyprovisionofanemergencyrestrictionnoticecommitsanoffenceandisliabletoafinenotexceedingN$1000000ortoimprisonmentforatermnotexceeding20years,ortobothsuchfineandsuchimprisonment.

Quarantine stations

12. (1) TheChiefVeterinaryOfficer,withtheapprovaloftheMinister,may establish at any place in Namibia on land owned or controlled by the State aquarantinestationwherefacilitiesareprovidedfor–

(a) the detention or isolation of imported animals, animal products andrestrictedmaterialthatarerequiredintermsofthisActtobedetainedorisolated;

(b) the inspection, examination, testing, observation, disinfection,destructionordisposalofanimals,animalproducts,restrictedmaterial,the carrying out of other procedures, the rendering of services inrelationtoanimals,animalproducts,restrictedmaterialforpreventingtheintroductionorspreadofdiseaseinanimals.

(2) TheChiefVeterinaryOfficermay–

(a) establishrulesforthemanagementanduseoffacilitiesataquarantinestation;

(b) levyfeesandchargesasprescribedforthekeepingandcareofanimals,animalproductsorrestrictedmaterialandforprocedurescarriedoutorservicesrenderedinrelationtoanimals,animalproductsorrestrictedmaterialataquarantinestation.

Health certificate required for exportation of animals, animal products and restricted material

13. (1) Subjecttosubsection(4),apersonmaynotexportanyanimal,animalproductorrestrictedmaterialfromNamibiaexceptifthepersonhasobtainedahealthcertificatefromtheChiefVeterinaryOfficer.

(2) Acertificatereferredtoinsubsection(1),mustcontainspecificinformationrequiredbythecompetentauthorityinthecountryofimportwithregardto–

(a) thehealthstatusoftheanimal,animalproductorrestrictedmaterialtobeexported;

(b) theoccurrenceornon-occurrenceofparticularanimaldiseasesinNamibia and the area of origin of the animal, animal product orrestrictedmaterial;and

(c) anyotherinformationrequiredbythatcompetentauthority.

(3) Anapplicationforahealthcertificatemust–

(a) bemadetotheChiefVeterinaryOfficerintheprescribedmannerandform;and

(b) beaccompaniedbyadocumentissuedbythecompetentauthorityoftheimportingcountryauthorizingtheimportation.

(4) The Chief Veterinary Officer may require an applicant for a healthcertificatetoprovidefurtherinformationordocumentsthattheChiefVeterinaryOfficerconsidersrelevantforthepurposesoftheapplication.

(5) If,uponexaminationoftheanimal,animalproductorrestrictedmaterialtobeexported,theChiefVeterinaryOfficer,withdueregardtotherequirementsoftheimportingcountry–

(a) issatisfiedthattheconditionsforissuingahealthcertificatehavebeenmet,heorshemust issue thehealthcertificate to theapplicantuponpaymentoftheprescribedfee;

(b) is not satisfied that the animal, animalproduct or restrictedmaterialtobeexportedisfreeofanyriskfortheexportationandspreadingofdiseaseordoesnototherwisecomplywithanyrequirementofthisAct,heorshemustrefusethehealthcertificate.

(6) IftheChiefVeterinaryOfficerrefusestoissueahealthcertificate,heorshemaygivedirectionstotheowneroftheanimal,animalproductorrestrictedmaterialinrelationtotheactiontobetakenbytheowner,athisorherownexpensefor–

(a) the appropriate treatmentof the animal, animalproductor restrictedmaterialinordertoremovetherisk;or

(b) thedestructionordisposalotherwiseoftheanimal,animalproductorrestrictedmaterial.

(7) Subsection(1)doesnotapplytotheexportationofanyanimal,animalproductorrestrictedmaterialtoacountryinrespectofwhichthecompetentauthorityinthatcountrydoesnotrequireacertificatereferredtointhatsubsectioniftheexporterprovidestheChiefVeterinaryOfficerwithwrittenproofthereof.

(8) Apersonwhocontravenessubsection (1)commitsanoffenceand isliabletoafinenotexceedingN$1000000ortoimprisonmentforatermnotexceeding20years,ortobothsuchfineandsuchimprisonment.

Export in contravention of Act

14. (1) Ifaveterinaryofficialhasreasontosuspectthatapersonintendstoexport,orcausetobeexported,anyanimal,animalproductorrestrictedmaterialincontraventionofsection14,theveterinaryofficialmaybynoticeinwriting-

(a) direct theperson toceasewithanyactionfor theexportationof thatanimal,animalproductorrestrictedmaterial;and

(b) requirethepersonimmediatelytocausetheanimal,animalproductorrestrictedmaterialtoberemovedtoanddetainedataplacespecifiedin the notice and to take other action in relation to it asmay be sospecified.

(2) If anoticeunder subsection (1) isnot compliedwith, theveterinaryofficialmayseizeorcausetobeseizedanyanimal,animalproductorrestrictedmaterialtowhichthenoticerelatesandarrangefortherequirementsofthenoticetobecompliedwith.

(3) Apersonwhofailstocomplywithadirectionorrequirementofanoticegivenunder subsection (1) commits anoffenceand is liable to afinenot exceedingN$100000ortoimprisonmentforatermnotexceeding5years,ortobothsuchfineandsuchimprisonment.

PARTVDISEASEPREVENTIONANDCONTROL

duties on discovery of incidence of animal disease

15. (1) Anownerofananimalwhoknowsorhasreasontosuspectthattheanimalisinfectedwithadiseasemust–

(a) takeallreasonablesteps–

(i) toisolatetheinfectedanimal;

(ii) topreventthespreadofthedisease;and

(b) iftheownerknowsorhasreasontosuspectthattheanimalisinfectedwithanotifiabledisease,immediatelynotifyaveterinaryofficialofthatincidenceorsuspectedincidence.

(2) Anyveterinarianwhohasreasontosuspectthatananimalisinfectedwithanotifiablediseasemustimmediatelynotifyaveterinaryofficial ofthefactsofthatincidenceorsuspectedincidence.

(3) ApersonwhobecomesawareofthepresenceofadiseasewhichthepersonknowsoronreasonablegroundsbelievesisnotatthetimeknowntooccurinNamibia,mustimmediatelynotifyaveterinaryofficialofthepresenceofthedisease.

(4) An owner of animals who knows or has reason to believe that anunknowndiseaseiscausinganunusuallevelormanifestationofdiseaseornumberofdeathsamongstthoseanimals,oraparticulargroup,must–

(a) engageaveterinariantoinvestigatethediseaseanditscause;or (b) notifyaveterinaryofficialoftheoccurrenceofthediseaseordeaths,

andisolatethoseanimalsorthegroupofanimals.

(5) If,afterdueinvestigation,aveterinarianknowsorhasreasontobelievea disease to be an unknown disease is present, must immediately notify the ChiefVeterinaryOfficerofthefactsinthequickestmannerpracticable.

(6) Apersonwhocontravenes,orfailstocomplywith,anyoftheprovisionsofthissectioncommitsanoffenceandisliabletoafinenotexceedingN$100000orto imprisonment for a term not exceedingfive years, or to both such fine and suchimprisonment.

Treatment or disposal of infected animal, animal product or restricted material

16. Ifaveterinaryofficialknowsorhasreasontosuspectthatanyanimal,animalproductorrestrictedmaterialisinfectedorhasbeenincontactwithaninfectedanimal,theveterinaryofficialmay-

(a) seizetheanimal,animalproduct,orrestrictedmaterialandanythingwhichmayhavebeenincontacttherewithand,inhisorheropinion,maybeinfected;

(b) givedirectionstotheowneroftheanimal,animalproductorrestrictedmaterialregardingitscleansing,disinfectionortreatmentotherwise;

(c) destroyorotherwisedisposeoftheanimal,animalproduct,restrictedmaterial or give directions to the owner in connection with itsdestructionordisposalotherwise;

(d) givedirectionsthattheanimalbequarantined;

(e) order the cleansing, disinfection or destruction of any premises,conveyance or things that may have become contaminated by thedisease.

17. (1) A veterinary official may in writing declare a place orconveyance to be an infected place if the veterinary official knows or reasonablysuspectsthatadiseaseispresentinthatplaceorconveyanceandconsidersitnecessarytomakethedeclarationforthepurposeofcontrollingthedisease.

(2) Adeclarationofaninfectedplaceorconveyance-

(a) takeseffectwhenitisservedontheowneroftheplaceorconveyance;

(b) maybeamendedinwriting;and

(c) remainsinforcefor theperiodspecifiedor, ifnoperiodisspecified,untilitisrevokedinwritingbyaveterinaryofficial.

(3) Adeclarationofaninfectedplace,oranamendmentortherevocation,mustbeservedontheowneroftheplaceorconveyanceintheprescribedmanner.

(4) Adeclarationofaninfectedplacemayspecifyprohibitions,restrictionsorrequirementswhichtheveterinaryofficialconsidersnecessaryorexpedienttoimposeforthecontrolofadiseaseintheinfectedplace,whichmayrelateto-

(a) theentrytoormovementwithinoroutofaninfectedplaceofpersonsoraspecifiedclassofpersonsorconveyancesoraspecified typeofconveyance;

(b) the introduction into,movementwithinor removal froman infectedplaceofanyanimal,animalproductorotherthingspecifiedinthedeclaration.

(5) Apersonwhocontravenesorfailstocomplywith-

(a) any prohibition, restriction or requirement of a declaration of aninfectedplacewithoutawrittenpermissionissuedinaccordancewiththatdeclaration;or

(b) anyconditionsspecifiedinpermission,

commits an offence and is liable to a fine not exceeding N$100 000 or a term ofimprisonmentnotexceedingfiveyears,ortobothsuchfineandsuchimprisonment.

(2) Anoticeundersubsection(1)maydeclaretheobjectsandnatureofthequarantineimposedandmay-

(a) prohibit, either absolutely or subject to compliance with conditionsspecified in the notice, the introduction into or removal from thequarantineareaofanyanimaloranimalproductoranythingspecifiedinthenotice;

(b) prohibit or regulate the entry to and movement within or fromthe quarantine area of conveyances or conveyances of a specifieddescription;

(c) prohibit or regulate the removalof any animalor animalproductorthingspecifiedinthenoticefromanyplacewithinthequarantineareatoanyotherplacetherein;

(d) requireanowneroroccupieroflandoranyplacewithinthequarantineareatotakemeasuresasareimposedinthenoticeforthepurposeofcontrollingadiseasespecifiedinthenotice;

(e) imposemeasurestobeobservedbypersonswhenenteringormovingfrom a quarantine area, whether by means of a conveyance orotherwise;

(f) authorisetheclosingofanyroadinoradjacenttothequarantineareaortheerectingoffencesorgatesacrossanyroadtoregulateorpreventthemovementofanimals;

(g) impose any other prohibitions, restrictions or requirements as theMinisterconsidersnecessaryorexpedientforachievingtheobjectsofthequarantine.

(3) TheMinister,ontherecommendationoftheChiefVeterinaryOfficer,mayprescriberulesinrelationto–

(a) themanagement,maintenanceoperationandsecurityofaquarantinearea;and

(b) thehandling,keeping,examination,testing,vaccination,identificationandtreatmentofanyanimaloranimalproductoranythingcapableofharbouringortransmittingadiseaseinthequarantinearea.

(4) Apersonwhocontravenesorfailstocomplywith-

(a) anyprohibition, restrictionor requirement of a notice of declarationofaquarantineareawithoutawrittenpermissionissuedinaccordancewiththatnotice;or

(b) anyconditionsspecifiedinapermission,

commits an offence and is liable to a fine not exceedingN$100 000 or a term ofimprisonmentnotexceedingfiveyears,ortobothsuchfineandsuchimprisonment.

19. (1) TheMinister,ontherecommendationoftheChiefVeterinaryOfficer,maydeclare,bynoticeintheGazette,thewholeoraspecifiedpartofNamibiatobeacontrolareaiftheMinisterconsidersitnecessarytodosoforthepurposeofcontrollingadiseasepresent inNamibiaoranothercountry,whether thediseaseisaknowndiseaseoranunknowndisease.

(2) A declaration of a control areamay,with respect to thewhole or aspecifiedpartofthecontrolarea,prohibit,regulateorcontrol-

(a) thepresenceor exposureof specified animals or animal products orclassesofanimalsoranimalproductsatanyplacewhereanimalsoranimalproductsareexposedforsale,exhibition,parade,racemeetingsoranyformofrecreationorcompetition;

(b) thesale,presenceorexposureofspecifiedanimals,animalproducts,classes of animals or animal products, or other things in placeswhereanimalsoranimalproductsarecommonlypreparedforhumanconsumption;

(c) thepurposesforwhichspecifiedanimals,animalproducts,classesofanimalsoranimalproducts,conveyancesorotherthingsmaybeused;

(d) the treatment of animals, animal products, classes of animals oranimalproducts, or other things or any other action of a specifiedkind;

(e) the keeping, transport or management of specified animals, animalproducts,classesofanimalsoranimalproducts,orotherthings;

(f) the identification of specified animals, animal products, classes ofanimalsoranimalproducts,conveyancesorotherthings;

(g) themovementofspecifiedpersons,animals,animalproducts,classesofpersons, animalsor animalproducts, conveyancesorother thingsinto,withinoroutofthecontrolarea;

(h) the cleansing or disinfecting of persons, animals, animal products,clothing,conveyancesorotherthingsthatmayenter,remainin,movewithinorleavethecontrolarea.

(3) A veterinary official may issue a permit authorizing the movementofspecifiedpersons,animals,animalproducts,classesofpersons,animalsoranimalproducts,conveyancesorotherthingsinto,withinoroutofacontrolarea,subjecttoconditionsasmaybespecifiedinthepermit.

(4) Apersonwhocontravenesorfailstocomplywith-

(a) anyprohibition,restrictionorrequirementofanoticeundersubsection(1),exceptasauthorisedbyapermitissuedundersubsection(3);or

(b) anyconditionspecifiedinapermitundersubsection(3),

20. (1) TheMinister,ontherecommendationoftheChiefVeterinaryOfficer,maydeclare,bynotice in theGazette,anareaofNamibia tobeaprotectedarea if theMinister considers it prudent to do so for the purpose of preventing theintroductioninto,orthespreadin,thatareaofadisease.

(2) Adeclarationofaprotectedareamayspecify-

(a) anyclassesofanimals,animalproducts,conveyancesorotherthings-

(i) thatmaynotbebroughtormoved,orpermittedtobebroughtormoved,intoaprotectedarea;or

(ii) thatmay only be brought ormoved into a protected area ifconditionsspecifiedinthedeclarationarecompliedwith;and

(b) any conditionswithwhich every person or a class of personsmustcomplybeforeorwhenenteringtheprotectedarea.

(3) Aveterinaryofficialmayissueapermitauthorisingthemovementintoaprotectedareaofanyanimaloranimalproduct,oranyclassofanimal,animalproduct,conveyanceorotherthing,subjecttoconditionsasmaybespecifiedinthepermit.

(4) Apersonwhocontravenesorfailstocomplywith-

(a) any prohibition, restriction or requirement specified in a declarationof a protected area, except as authorised by a permit issued undersubsection(3);or

(b) anyconditionspecifiedinapermitundersubsection(3),

commitsanoffenceandisliabletoafinenotexceedingN$100000ortoimprisonmentforatermnotexceedingfiveyears,ortobothsuchfineandsuchimprisonment.

Fences

21. (1) TheChiefVeterinaryOfficermaycause a fence,withgates,gridsorotherpassages,tobeconstructed-

(a) onanylandsituatedalongtheinternationalboundariesofNamibiatopreventthestrayingofanimalsintooroutofNamibia;

(b) along the boundaries of any game park or private game reserveestablished by or under the laws relating to nature conservation topreventthemovementofanimalsintooroutofparkorreserve;

(c) along,onoracrosspublicorprivateroads,oralongtheboundariesof,oronoracrossanylandforthepurposeofcontrollinganimaldisease,

and may cause any road, including any bridge, causeway, culvert or drift, to beconstructedover any landasmaybe reasonably required forpurposesof access forerecting,inspectingandmaintainingfence.

(2) TheChiefVeterinaryOfficermustnotify,intheprescribedmanner,theowneroroccupierofthelandinquestionoftheintentiontoexerciseanypowerundersubsection(1).

(3) A veterinary official may enter upon any land with persons,conveyances,tents,materials,toolsorotherthingsasmayreasonablyberequiredforcarryingoutworkreferredtoinsubsection(1),andmay-

(a) temporarily remain on the land for a reasonable period for thatpurpose;

(b) subject to subsection (4), dig out and remove any sand, soil, clay,gravelorstoneanduseanywater,woodorothermaterialonthelandreasonablyrequiredforthatpurpose;and

(c) removeanyvegetation.

(4) Ifmaterialisremovedorusedinaccordancewithsubsection(3)(b),theownerofthelandconcernedisentitledtoreasonablecompensationinrespectthereof,intheamountasagreeduponbetweentheownerandtheChiefVeterinaryOfficeror,failingagreement,asdeterminedbytheChiefVeterinaryOfficer.

(5) TheChiefVeterinaryOfficer–

(a) mustmaintainanyfenceerectedandanygate,gridandotherpassageinstalledintermsofsubsection(1);and

(b) mayfromtimetotimeeffectalterationsorreplacementstheretoasmaybeconsiderednecessary.

(6) Apersonmaynot,withoutthewrittenauthorityoftheChiefVeterinaryOfficer–

(a) remove,alterorimpairtheefficacyofanyfenceorofanygate,gridorpassageerectedorinstalledundersubsection(1);

(b) alter, obstruct or damage any road or associated work constructedunderthatsubsection.

(7) A person who contravenes subsection (6) commits an offence andis liable, on to a fine not exceedingN$100 000 or to imprisonment for a term notexceedingfiveyears,ortobothsuchfineandsuchimprisonment.

Straying animals

22. (1) Anowneroroccupierofanylandwhofindsananimalthathasstrayedontothelandmust-

(a) isolatethatanimal;and

(b) forthwithreportthepresenceoftheanimaltoaveterinaryofficialintheprescribedmanner.

(2) Aveterinaryofficial-

(a) mayseizeastrayanimalreportedto,orfoundby,theveterinaryofficialand cause it to be detained in a manner that the veterinary officialconsidersappropriate;and

(b) mustgivewrittennoticeof theseizure to theownerof theanimal iftheidentityandwhereaboutsofthatownerareknowntotheveterinaryofficial.

(3) Thenoticetotheownerofastrayanimalmuststatethattheanimal–

(a) mustbeclaimedwithin7daysafterthenoticeisgiven;and

(b) ifnotclaimedwithin7daysmaybedisposedofintheprescribedmanner.

(4) Ifapersonclaimstheseizedanimal,theveterinaryofficialmayreleasetheanimaltothepersononlyiftheperson–

(a) satisfiestheveterinaryofficialthatheorsheisentitledtothepossessionoftheanimal;and

(b) pays the prescribed fees and any reasonable expenses incurred inconnectionwiththeseizure,removalanddetentionoftheanimal.

(5) The Chief Veterinary Officer may cause the seized animal to bedestroyedorotherwisedisposedofintheprescribedmannerforthebenefitoftheStateif–

(a) theidentityoftheowneroftheanimalcannotbeascertained;

(b) thewhereaboutsof theownercannotbeestablishedafter reasonableenquiry;or

(c) the owner fails to claim the animalwithin 7 days after havingbeengivennoticeoftheseizureoftheanimal.

(6) Despitethissection,theChiefVeterinaryOfficermaycauseanystrayanimalseizedtobedestroyedatanytime,inawaytheChiefVeterinaryOfficerconsidersappropriate, if the animal is infected and theChiefVeterinaryOfficer considers thedestructionoftheanimalnecessarytopreventthespreadofdisease.

(7) Compensationisnotpayableforananimaldestroyedundersubsection(5)or(6).

definitions for this part

23. Inthispart,unlessthecontextotherwiseindicates-

(a) “prescribedanimal”meansanyanimalbelongingtoaspeciesofanimaltowhichtheMinister,ontherecommendationoftheChiefVeterinaryOfficer, has by regulation prescribed, or by notice in the Gazettedeclared,thattheprovisionsofthisPartareapplicable;and

(b) “registeredestablishment”meansanyplaceregisteredasaregisteredestablishmentundersection24(5).

Obligation to register place on which animals are kept as a registered establishment

24. (1) Anypersonwhoholds,keepsorhandlesanyprescribedanimalonanyplacewhichunder the regulations is required tobe registeredasa registeredestablishmentforthepurposesofthisPart,mustapplytotheChiefVeterinaryOfficerintheprescribedmannerfortheregistrationofthatplaceasaregisteredestablishmentwithinaperiodof90daysasspecifiedintheregulations.

(2) TheMinistermayextend,bynoticeintheGazette,theperiodspecifiedintheregulationscontemplatedinsubsection(1)byfurtherperiodastheMinister,ontherecommendationoftheChiefVeterinaryOfficer,maydetermine.

(3) Regulationscontemplatedinsubsection(1)mayprescriberequirementstobecompliedwithinrespectofanyplaceinordertobeeligibleforregistrationasaregisteredestablishment.

(4) AnapplicationforregistrationofaplaceasaregisteredestablishmentmustbemadetotheChiefVeterinaryOfficerinthemanner,andbeaccompaniedbythedocuments,astheChiefVeterinaryOfficermaydetermine.

(5) The Chief Veterinary Officer must register a place specified in anapplicationforregistrationintermsofsubsection(1)unlesstheChiefVeterinaryOfficerissatisfiedthattheapplicationisnotabonafideapplication,anyrequirementprescribedundersubsection(3)isnotcompliedwith,ortheplaceisnotrequiredtoberegisteredasaregisteredestablishmentundertheregulations.

(6) With effect from the date immediately following the expiry of theperiodspecifiedundersubsection(1),asextended,ifapplicable,undersubsection(2),apersonmaynotkeeporhandleorhaveinhisorherpossessionorunderhisorhercontrolonanyplacerequiredtoberegisteredasaregisteredestablishmentundertheregulationsanyprescribedanimal-

(a) unlesstheplacehasbeenregisteredbytheChiefVeterinaryOfficerasaregisteredestablishment;and

(b) therequirementsprescribedundersubsection(3)arecompliedwithinrespectoftheplace.

(7) Apersonwhocontravenessubsection (6)commitsanoffenceand isliabletoafinenotexceedingN$100000ortoimprisonmentforatermnotexceedingfiveyears,ortobothsuchfineandsuchimprisonment.

Permit required for movement of prescribed animals from registered establishment

25. (1) A person may not remove any prescribed animal from aregisteredestablishmenttoanyotherplacewithinNamibia,unless-

(a) the person holds a movement permit granted under subsection (3)which authorises the movement of the prescribed animal from theregisteredestablishmenttothatotherplace;and

(b) the movement is carried out in accordance with the conditions asprescribedandasspecifiedinthemovementpermit.

(2) Despite that a movement permit authorises the movement of aprescribedanimalspecifiedinthepermit,apersonmaynotmovethatanimalfromitsregisteredestablishmentif-

(a) thepersonknowsorhasreasontobelievethattheanimalisinfected;and

(b) thepermitdoesnotspecificallyauthorisethemovementoftheanimalsoinfected.

(3) Anapplicationforamovementpermitmust–

(a) bemade to a veterinary official in the prescribedmanner in a formapprovedbytheChiefVeterinaryOfficer;and

(b) beaccompaniedbytheprescribedfee.

(4) Theveterinaryofficialmayrequireanapplicantforamovementpermitto provide further information or documents that the veterinary official considersrelevantfordeterminingwhethertoissuethepermit.

(5) Amovementpermitauthorisesthemovementofanyspecifiedanimalonlywithintheperiodspecifiedinthepermit.

(6) Inadditiontoanypermitconditionsasmaybeprescribedinrespectofamovementpermit,theveterinaryofficialmayspecifyanyconditionswithwhichtheholderofthemovementpermitmustcomplyinmovinganyanimal.

(7) Conditions specified under subsection (6) may include conditionsrelatingto-

(a) the identification, inspection, testing or treatment of the prescribedanimalatanytimebefore,duringorafterthemovement;

(b) theisolationoftheprescribedanimalatanytimebefore,duringorafterthemovement;

(c) thequarantineoftheprescribedanimalbeforeorafterthemovement;

(d) thecertificationofanyaspectof the identity,health status,originorhistoryoftheprescribedanimaltobemoved.

(8) Anyanimalinrespectofwhichamovementpermithasbeenissued-

(a) may not bemoved through any area infected or suspected of beinginfectedwithanydiseasewhichcanaffecttheanimalbeingmoved;

(b) mustwhen requiredbemadeavailable to aveterinaryofficial at theplaceofdestinationforthepurposeofinspectionorcarryingoutanyfunctionunderthisActortherequirementofaconditiontowhichthepermitissubject.

(9) Apersonwhocontravenes,orfails tocomplywith,anyprovisionofsubsection(1),(2),or(8)commitsanoffenceandisliable,onconviction,toafinenotexceedingN$100000ortoimprisonmentforatermnotexceedingfiveyears,ortobothsuchfineandsuchimprisonment.

Registers and returns in relation to prescribed animals

26. (1) Apersonwhoholds,keepsorhandlesprescribedanimalsonaregisteredestablishmentmust-

(a) keepregisters,andrecordinformation;and

(b) providetheChiefVeterinaryOfficerwithreturns,givinginformation,

inrespectofthebirth,death,lossandmovementofprescribedanimalsonorfromtheregisteredestablishmentasmaybeprescribed.

(2) Apersonmaynotenterinaregisterorprovideinareturnreferredtoinsubsection(1)anyinformationwhichthepersonknowstobefalseordoesnotknowtobetrue,orrecklesslyenterorprovideinformationwhichisfalseorwhichthepersondoesnotknowtobetrue.

(3) Apersonwhocontravenes,orfailstocomplywith,subsection(1)or(2)commitsanoffenceandisliable,onconviction,toafinenotexceedingN$20000or to imprisonmentfora termnotexceedingoneyear,or tobothsuchfineandsuchimprisonment.Animal identification requirements

27. (1) Witheffectfromadateasprescribed,apersonmaynot–

(a) keep,orcauseorpermittobekept,onanyregisteredestablishment;

(b) move,orcauseorpermittobemoved,fromaregisteredestablishment;

(d) bymeansofanyconveyanceorotherwisemove,orcauseorpermittobemoved,alonganyroadoranyotherplacenotbeingontheregisteredestablishment,

any prescribed animal, unless that animal is distinctly identified in the prescribedmannerbymeansofamark,tag,transponderorotherindicatorapprovedbytheChiefVeterinary Officer for the purpose of ascertaining the ownership, origin, location,movementhistoryandfateoftheanimal

(2) A person, other than a veterinary official or a veterinarian,may notremoveorreplaceanapprovedidentificationtag,mark,transponderorotherindicatorattachedorappliedtoaliveanimalforthepurposesofthisAct.

(3) Apersonmust not alter, obliterateor deface the informationon anyidentificationtag,mark,transponderorotherindicatorattachedorappliedtoananimalforthepurposesofthisAct.

(4) Aperson slaughtering a prescribed animalmay,when required by aveterinaryofficial,causeanymeatoroffallderivedfromthecarcassoftheslaughteredanimaltobemarkedorlabelledinamannerapprovedbytheveterinaryofficialsoastoensurealinkbetweenthemeatoroffallandtheindividualanimalorthegroupofanimalsfromwhichtheindividualanimalwastakenandtofacilitatethetracingoftheoriginofanimalorgroupofanimals.

(5) Apersonwhocontravenesorfailstocomplywithsubsection(1),(3)or(4)commitsanoffenceandisliabletoafinenotexceedingN$20000ortoimprisonmentforatermnotexceedingtwoyears,ortobothsuchfineandsuchimprisonment.

PARTVIIENFORCEMENTANDCOMPENSATION

Powers of entry, search and inspection

28. (1) For the purpose of exercising any power or performing anyduty conferred upon or assigned to a veterinary official by thisAct or determiningwhetherthisActisbeingorhasbeencompliedwith,aveterinaryofficialmay,atanyreasonabletime–

(a) subject to subsection (3), enter and search any conveyance or anyplace;

(b) proceedoveranylandinordertoreachanyconveyanceorplacerequiredtobeenteredandsearched;

(c) orderanyconveyancetobestoppedforpurposeofentryandsearchatanyplacewithinNamibiaorintheterritorialwatersofNamibia.

(2) When conducting a search of a conveyance or place, a veterinaryofficialmay-

(a) open,ifnecessarywithforce,anydoororotherstructuregivingaccesstoanyconveyanceorpremisesorpartof anypremisesor anyotherenclosure inoron theplaceoranybox,container,packageorotherreceptacleinorontheconveyanceorplace;

(b) requiretheowneroftheconveyanceorplace,orapersonapparentlyin charge of the conveyance or place, or any other personwho theveterinary official reasonably believes is able to comply with therequirement, to provide, or to take reasonable steps to provide,informationreasonablyrequiredforthepurposeofthesearch;

(c) require a person to produce any document reasonably required forascertainingwhetherthisActisbeingorhasbeencompliedwith,and–

(i) examinethatdocument;

(ii) makecopiesof,ortakeextractsfrom,thedocument;and

(iii) remove thedocument foras longas reasonablynecessary tomakecopiesortakeextracts;

(d) operate,orrequireassistancefromanypersontooperate,anycomputerorotherelectronicequipmentonanypremises todeterminewhetherit or a disk, tapeor other storagedevice that canbeusedwith it oris associatedwith it, containsany information that is relevant to thepurposeofthesearchandcopyorprintanyinformationrelevanttothepurposeofthesearchcontainedinoroncomputer,disk,tapeorotherstoragedevice;

(e) requiretheownerorapersonincontroloforemployedatoronanyplace or conveyance, or of any animals, animal products, restrictedmaterialorotherthings–

(i) to produce or secure, either immediately or at a time andplacespecifiedbytheveterinaryofficial,anyanimals,animalproducts,restrictedmaterialorotherthingsthattheveterinaryofficialrequirestobeinspectedorexamined;

(ii) to give assistance in connection with the inspection orexaminationasmayreasonablyberequiredinthecircumstancesandwhichtheownerorpersoniscapableofgiving;and

(iii) to provide any facilities in the possession or control of thepersonastheveterinaryofficialconsidersreasonabletoallowthesafeandefficienthandlingofanimalsduringinspectionorexamination;

(f) inspect, count, examine, identify by marking, tagging or otherwise,test,vaccinate,treatordisinfectanyanimal,animalproduct,restrictedmaterialorotherthingorreceptacle;

(g) take and remove for analysis or examination samples of or fromor specimens of any animal, animal product, restricted material or

other thing, land, place or conveyancewhich the veterinary officialreasonablybelievesisinfectedwithorcontaminatedbyadisease;

(h) carryoutanyanalysisorexaminationofanyanimal,animalproductorasampleorspecimenoftheanimaloranimalproductandifnecessaryforthatpurpose,destroyorcausethedeathoftheanimal,includingananimalprotectedbyanylaw;

(i) isolate,detainorseizeanyanimal,animalproduct,restrictedmaterialorotherthingreasonablysuspectedofbeinginfectedorcontaminatedbydisease;or

(j) seize anything that is suspected on reasonable grounds of beingconnectedtothecommissionofanoffenceunderthisAct.

(3) A veterinary official may not under subsection (1) or (2) enter anypremisesorpartofpremiseswhichisaresidenceorisbeingusedasaresidence,exceptif-

(a) theoccupierofthepremisesconsentstotheentryandsearch;

(b) awarrant authorising the entry and searchof the premises has beenobtained from a judge of the High Court or a magistrate who hasjurisdictionintheareainwhichthepremisesaresituated;or

(c) theveterinaryofficialonreasonablegroundsbelieves-

(i) thatawarrantofentryandsearchwouldbeissuedtohimorherifheorsheappliedforit;and

(ii) thatthedelayinobtainingthewarrantwoulddefeattheobjectoftheinvestigation.

(4) Totheextentthatsubsections(1),(2)and(3)authorisetheinterferencewith a person’s fundamental right to privacy by authorising the entry and search ofpremises,thoseprovisionsareenactedontheauthorityofArticle13oftheNamibianConstitutionfortheprotectionofhealth,thepreventionofcrimeandtheprotectionoftherightsorfreedomsofothers.

(5) Awarrantmaybe issuedunder subsection (3)(b) if it appears to thejudge or magistrate from information on oath that there are reasonable grounds tobelievethatanyanimal,animalproduct,restrictedmaterial,substanceorthingoranybook, statement or document thatmay relate to a contravention of thisAct ormaypresentahealthrisk,isuponorinthepremises.

(6) Aveterinaryofficial,inperformingafunctionunderthisAct,maybeassistedbypersonsreasonablyrequiredtoperformthefunction.

(7) If a person refuses or fails to comply with a requirement of theveterinaryofficialunderthissection,theveterinaryofficialmaytaketheactionrequiredtobetakenorcauseittobetaken.

(8) Costsandexpensesreasonablyincurredbyaveterinaryofficialundersubsection(7)mayberecoveredasadebtowingtotheStatefromthepersonforwhomtherequirementwasmade.

disposal of isolated, detained or seized animal or thing

29. (1) Anyanimal,animalproduct,restrictedmaterialorotherthingisolated,detainedorseizedintermsofsection28(2)(i) may–

(a) beplacedinthecareoftheowneroroccupieroftheplaceconcernedortheowneroftheanimal,animalproduct,restrictedmaterialorotherthing on conditions agreed upon by the veterinary official and thepersoniftheveterinaryofficialconsidersthatthepersonhasadequatemeansavailablefortheisolationordetentionandcareoftheanimal,animal product, restricted material or other thing in a manner thatpreventsthespreadofdisease;

(b) beremovedtoaplacethattheveterinaryofficialconsiderssuitableforthekeepingandtreatment;

(c) in the case of an animal, be slaughtered if the veterinary officialconsidersapost-mortemexaminationoftheanimalnecessary;

(d) bedestroyedorotherwisedisposedofiftheveterinaryofficialconsidersthat–

(i) itisnotpracticaltoisolateortreatitadequately;

(ii) thecalculatedcostofitsisolationandtreatmentwouldexceedtheestimatedvalue;or

(iii) no means, remedy or equipment is available for effectivelyisolatingortreatingit,

andtheveterinaryofficialmaycauseittobedestroyedordisposedofordirecttheownerconcernedtodestroyordisposeofitinthemannerdeterminedbytheveterinaryofficial;or

(e) inthecaseofanoutbreakorsuspectedoutbreakofadiseasethatisnotknowntobeestablishedinNamibiaand–

(i) isafastspreadingdisease;

(ii) iscapableofcausingaseriousriskforhumanoranimalhealth;or

(iii) poses a potential risk of becoming established or furtherspreadinginNamibia,

bedestroyedorotherwisedisposedofby,orwiththeapprovalof,theChiefVeterinaryOfficer.

(2) Aveterinaryofficial,ifsatisfiedthattheisolationordetentionofanyanimal,animalproduct,restrictedmaterialorotherthingseizedundersection28(2)(i)isnolongernecessary,mustreleasethatanimal,animalproduct,restrictedmaterialorotherthingtotheowneroranyotherpersonwhosatisfiestheveterinaryofficialthatheorsheisentitledtopossessit.

(3) Iftheidentityofneithertheownernorapersonentitledtothepossessionofanyanimal,animalproduct,restrictedmaterialorotherthingtobereleasedisknown,ortheownerorthatpersoncannotbelocated,theveterinaryofficialmaydisposeoftheanimalorthinginamannerbeneficialtotheState.

(4) Anownerofanyanimal,animalproduct,restrictedmaterialorotherthing seized under 28(2)(i), must reimburse the State for any reasonable expensesincurred in terms of this section for the removal, keeping, care treatment or otherservicesrenderedinrelationtotheanimal,animalproduct,restrictedmaterialorotherthingandexpensesmayberecoveredfromthatownerasadebtowingtotheState.

Compensation

30. (1) Anownerofanyanimal,animalproduct,restrictedmaterialorotherthingisentitledtocompensationif-

(a) the animal, animal product, restricted material or other thing isdestroyedbyoratthedirectionofaveterinaryofficialforthepurposeofcontrollingadisease;and

(b) theownerhassufferedlossasaresultofthedestruction.

(2) Despitesubsection(1),apersonisnotentitledtocompensationforthedestructionofanyanimal,animalproduct,restrictedmaterialorotherthingif–

(a) itwasdestroyedasaconsequenceofacontraventionofthisAct;

(b) itwasinfectedatthetimeitwasimportedintoNamibia;or

(c) itwasdestroyedwhilebeingconveyedintransitthroughNamibia.

(3) Theamountofcompensationpayableintermsofsubsection(1)maynotexceedthefairmarketvalueoftheanimal,animalproduct,restrictedmaterialorotherthingatthetimeofitsdestruction,asdeterminedbytheChiefVeterinaryOfficer,less, in the case of an animal, the value of the carcass as determined by the ChiefVeterinaryOfficer.

(4) Compensationpayableunderthissectionmaynotincludeanyamountforlossofprofitorproductionorotherconsequentialloss.

(5) Intheeventofanydoubtordisputearisingastotheentitlementofaperson to receivecompensationunder this section, theChiefVeterinaryOfficermaycausethewholeorpartof thecompensationpayabletoberetaineduntil therightofthepersontoreceivecompensationhasbeenestablishedtothesatisfactionoftheChiefVeterinaryOfficer.

Appeals

31. (1) ApersonwhoisunhappywithadecisionoractiontakenbytheChiefVeterinaryOfficerorotherveterinaryofficialmay,withintheperiodandinthemannerprescribed,andonpaymentoftheprescribedfee,appealagainstthedecisionoractiontotheMinisterfordeterminationbyanappealboardtobeappointedbytheMinister.

(2) TheMinistermustappointtheappealboardwithin30daysfromthedateof the receiptof theappeal,whichmust consistof a chairperson,beinga legalpractitioner with at least five years standing, and one or more persons with expertknowledgeinthefieldofanimaldiseasesandrelatedfields.

(3) Amemberoftheappealboardmustwithdrawasamemberifheorshehasanydirectorindirectinterestinthesubjectmatteroftheappealorif,foranyotherreason,thereislikelytobeaconflictofinterestsasaresultofhisorhermembershipoftheappealboard.

(4) Anappealboardmaymakeordersasitthinksfit,confirming,varyingorsettingasidethedecisionoractionappealedagainstorreferringthematterbackforreconsiderationbytheChiefVeterinaryOfficerorotherveterinaryofficial.

(5) Iftheappealboardmakesanorder–

(a) settingasidethedecisionoractionappealedagainst,theprescribedfeepaidfortheappealmustberefundedtotheappellant;or

(b) varying the decision or action appealed against, a portion of thatprescribedfeeastheappealboarddeterminesmustberefundedtotheappellant.

(6) Thechairpersonoftheappealboardmustcausecopiesofthedecisionoftheappealboard,andthereasonsforthedecisiontobefurnishedtotheMinister,theappellantandtheChiefVeterinaryOfficerwithin14daysafterthedateonwhichthefinaldecisionistaken.

32. (1) TheMinistermaymakeregulationsrelatingto-

(a) anymatterwhich in termsof thisAct is requiredorpermitted tobeprescribed;

(b) themannerinandperiodswithinwhichspecifiedapplicationsmustbesubmittedandthedocumentstoaccompanytheapplications;

(c) thefeespayableinrespectofanymatterunderthisAct;

(d) theclassificationofveterinaryofficialsandthedutiesofvariousclassesofveterinaryofficials;

(e) conditions onwhich animals, animal products or restrictedmaterialmaybeintroducedintoNamibiaoraspecifiedpartofNamibia;

(f) the testing, vaccination and inoculation of animals and the use,manufacture, testing, distribution storage, sale or display for sale ofanyvaccine,serum,diagnosticagentorotherbiologicalsubstanceusedfortesting,vaccinatingorinoculatinganimals;

(g) the treatment tobe applied to animals, animalproductsor restrictedmaterialfoundtobeinfectedorsuspectedofbeinginfected;

(h) the examination, testing and treatment of any animals or class ofanimalswithinaquarantinearea,controlareaorprotectedarea;

(i) themannerofisolation,careandtreatmentofanyanimalrequiredtobeisolated;

(j) themannerofdealingwithanimalproductsderivedfromaninfectedanimal;

(k) themannerofdisposalofanycarcassofananimal;

(l) impositionofobligationsontheownersoroccupiersofland,ownersof animals or other persons engaged in business or other operationsinvolvingtheimportation,sale,handling,conveyance,manufacturingorprocessingof,oranyotherdealingwith,animals,animalproductsor restrictedmaterial in relation to the keeping of registers or otherrecordsandthegivingofnoticesorthefurnishingofreturnsinrespectofanymatterasprescribed;

(m) thesale,transport,deliveryforslaughterataplaceorfacilityfortheslaughteringofanimalsordisposalinanyotherspecifiedmannerofanyprescribedanimalnotbearingtheprescribedmeansofidentificationinaccordancewiththerequirementsofthisAct;

(n) theholdingofmarkets,fairs,exhibitions,publicsales,paradesorracemeetings of animals or any other event where animals are broughttogetherforanypurpose;

(o) theinspectionorexaminationofanyanimalofaspecifiedclassreferredto in paragraph (m) by any veterinarian or other persons handlinganimals,therecordingoftheresultsoftheinspectionorexaminationtogetherwithanyidentificationcodesornumbersrequiredtobetagged,markedorbrandedontheanimalandtheforwardingofthoseresultsandcodesornumberstotheChiefVeterinaryOfficer;

(p) thecarryingoutofartificialbreeding,artificialbreedingproceduresandanymatterconnectedwithartificialbreeding,including–

(i) sanitary and health measures for establishments in whichanimalsemen,embryosandovaarecollected,stored,frozenorsoldorotherwisedistributed;

(ii) theregistrationofestablishmentsreferredtoinsubparagraph(i);

(iii) thelicensingorapprovalofpersonstocollect,processanimalsemen,embryos,ovaortoconducttrainingcoursesonartificialbreeding;

(q) anyothermatteroractionthattheMinisterconsidersnecessaryforthepurposeofprotectinghumanandanimalhealth.

(2) Regulationsmadeundersubsection(1)–

(a) maybeofgeneralorlimitedapplication;

(b) maydifferaccordingtodifferencesintime,placeorcircumstances;

(c) mayauthoriseanymattertobeapprovedordeterminedbyaveterinaryofficial;

(d) mayconferpowersorimposedutiesonanyperson;

(e) mayprovidethatacontraventionof,orafailuretocomplywithanyoftheprovisionsthereofisanoffenceandprovideinrespectthereoffortheimpositionofafinenotexceedingN$100000orimprisonmentfor a term not exceeding five years, or to both such fine and suchimprisonment,andinthecaseofacontinuingoffenceafurtherfinenotexceedingN$1000foreachdayduringwhichtheoffencecontinues.

Immunity from personal liability

33. TheMinister,aveterinaryofficial,oranauthorisedpersonoranyotherpersonengagedintheadministrationorenforcementofthisActisnotpersonallyliableinrespectofanyactdoneoromittedingoodfaithintheexerciseorperformance,orthepurportedexerciseorperformanceofanypowerorfunctionunderthisAct.

General offences and penalties

34. (1) Apersonwho–

(a) removes from isolation or detention any animal, animal product,restricted material or other thing that has been isolated or is beingdetainedunderanyprovisionofthisAct,withoutthewrittenauthorityof the Chief Veterinary Officer or contrary to any condition ofauthority;

(b) obstructs or hinders a veterinary official or an authorised person toperformanyfunctionunderthisAct;

(c) refusesorfailstocomplywithanyprohibition,restrictionorobligation,oranyconditionrelatingthereto,containedinaprescribedmeasurethatappliestopersonoranyanimal,animalproductrestrictedmaterialorotherthingbelongingtoorinthecontroloftheperson;

(d) refusesorfails tocomplywithaconditionorrequirementsubject towhichapermit,certificate,authority,consentorotherproofofassentorapprovalhasbeenissuedunderthisAct;

(e) refusesorfailstocomplywithadirectionofaveterinaryofficialundersection28(1)(c)tostopanyconveyance;

(f) refusesorfailstocomplywitharequestofaveterinaryofficialundersection28(1)torenderreasonableassistanceforthepurposeofcarryingoutaninspection;

(g) refuses or fails to provide information or give an explanation or ananswer to a question lawfully required in terms of section 24, orfurnishes information that is false ormisleading, knowing that it isfalseormisleading;

(h) damages,destroysorotherwisetamperswithanysampletakenoranyobjectseizedunderthisAct;

(i) damages, removes or otherwise tampers with any conveyance,appliance, instrument, tool, equipment, remedy or any other objectbelongingtoorunderthesupervisionorcustodyofaveterinaryofficialoranyotherpersontoperformanyfunctionintermsofthisActwithorinconnectionwithanyobjector,inthecaseofanyanimal,injuresit,orremovesitwithouttheconsentofanyperson,orotherwiseinterfereswithit;

(j) alters or forges in anyway any permit, certificate, consent or otherproofofassentorapprovalthatisissuedorrenderedunderthisAct,orobtainsdocumentoranyotherdecisionthatisrequiredorpermittedtobegiven,fromaveterinaryofficialunderfalsepretences;

(k) withtheintenttoevadeanyprovisionofthisAct,usesadocumentthathasbeenalteredorforgedascontemplatedinparagraph(j);

(l) damages,destroys,moves,removes,erases,altersorotherwisetamperswithanybeacon,markorsealthathas,underanyprovisionofthisAct,beeninstalledoraffixedon,orinconnectionwith,anyland,animal,animalproduct,restrictedmaterialoranyotherthing;

(m) performs any act for which a permit, consent or authority or otherdocumentisrequiredunderthisAct,withoutpermit,consent,authorityor document having been issued, granted or given to him or her inrespectthereof;

(n) obtains,oraidsandabetsanyotherpersontoobtain,bymeansoffalserepresentations,anycompensationunderthisAct;

(o) contravenesanyprovisionofaprescribedmeasure,orfailstocomplytherewith,

commitsanoffence.

(2) Apersonconvictedofanoffenceundersubsection(1)isliable–

(a) to a fine not exceeding N$8 000 or to a term of imprisonment notexceedingtwoyears,ortobothsuchfineandsuchimprisonment;or

(b) inthecaseofasecondorsubsequentconviction,whetherthesameoranyotheroffencereferredtoinsubsection(1),toafinenotexceedingN$20000ortoatermofimprisonmentnotexceedingfouryears,ortobothsuchfineandsuchimprisonment.

Presumptions and evidence

35. InanyprosecutionforanyoffenceunderthisAct-

(a) itispresumed,intheabsenceofevidencetothecontrary,thatanysampletakenfromananimalorthingintermsofthisActisrepresentativeofthat animalor thing fromwhich itwas takenand that theanimalorthinghasthesamepropertiesasthatsample;

(b) any document purporting to be certified by the Chief VeterinaryOfficer,totheeffectthatitisatruecopyofthedocumenttowhichtheproceedings relate, is admissible as evidence in a courtwithout anyfurtherproofortheproductionoftheoriginaldocument;

(c) anydeclarationorotherdocumentthatpurportstohavebeenissuedbythegovernmentof,oranycompetentauthorityin,anyforeignStateisprimafacie evidenceofdeclarationoroftheevent,actionorfactsstatedthereinandis,intheabsenceofevidencetothecontrary,admissibleasevidenceinanycourt.

Act binds State

36. ThisActbindstheState,exceptaprovisionrelatingto–

(a) thepaymentoffeesorcharges;or

(b) thecommissionofanoffence.

Repeal of laws and savings provisions

37. (1) ThelawsspecifiedintheSchedulearerepealedtotheextentindicatedintheSchedule.

(2) Anyregulationmadeoranythingdoneunderanyprovisionofa lawrepealedbysubsection(1)whichisinforceatthecommencementofthisActandwhichcouldbemadeordoneunderacorrespondingprovisionofthisAct,isdeemedtohavebeenmadeordoneunderthatcorrespondingprovision.

Short title and commencement

38. (1) ThisActiscalledtheAnimalHealthAct,2011,andcomesintooperationonadatedeterminedbytheMinisterbynoticeintheGazette.
