TERMS AND CONDITIONS

A. MAINTENANCE AND RECORDS To obtain the benefits provided by this Service Contract, You are required to provide maintenance to Covered Components at a Licensed Repair Facility in accordance with what is recommended by the manufacturer of Your RV. Proper documentation and verifiable receipts for all relevant maintenance and repairs may be required in the event of a claim. Receipts must show Your name, proper RV documentation (i.e. year, make, and model), complete VIN/Serial number, and the current mileage of the RV (when applicable) at the time of repair. Handwritten receipts will not be accepted. Failure to provide proof of required maintenance may result in denial of coverage.

B. WHAT IS COVERED Covered Components are categorized into three sections (EMERALD, DIAMOND, and EMERALD COVERAGE OPTIONS) and sub-categorized by related RV components. Only those items listed within those sections are covered. If a Covered Component Fails during the term of this Contract, then the Administrator will repair or replace the Covered Component subject to the terms and conditions of this Service Contract and in accordance with the coverage, options, and surcharges selected on the first page of this Contract.

EMERALD ITEMS 1-12 APPLY TO MOTOR HOMES ONLY.

1. ENGINE COMPONENTS Intake and Exhaust Manifolds, Engine Mounts and Cushions, Engine Torque Strut, Timing Cover, Valve Cover(s), Oil Pan, Harmonic Balancer, Flywheel (Flex Plate), Flywheel Ring Gear, Vacuum Pump, Dipstick and Tube, Pistons, Piston Pins, Piston Rings, Connecting Rods and Bearings, Crankshaft and Main Bearings, Camshaft Followers and Bearings, Push Rods, Valves, Valve Springs, Valve Guides, Lifters, Rocker Arms, Timing Gear, Timing Chain and Tensioner(s), Retainers, Eccentric Shaft, Oil Pump, and all internal Lubricated Parts of the Engine. Engine Head(s) and Engine Block are covered only if they are damaged by the Failure of an internal Lubricated Part of the Engine.

2. DIESEL ENGINE COMPONENTS Fuel Injectors, Fuel Injection Pump, Fuel Heater, and all internal Lubricated Parts of the Diesel Engine.

3. TURBOCHARGER COMPONENTS All internal Lubricated Parts of the Turbocharger. Turbocharger Housing is covered if damaged by the Failure of an internal Lubricated Part.

4. TRANSMISSION/TRANSFER CASE COMPONENTS Torque Converter, Vacuum Modulator, Internal Linkage, Mounts, Oil Pan, Cooler and Cooler Lines, Filler Tube and Dipstick, and all internal Lubricated Parts of the Transmission and Transfer Case. Transmission Case and Transfer Case Housing are covered if damaged by the Failure of an internal Lubricated Part.

5. DRIVE AXLE COMPONENTS (FRONT AND REAR) Axle Shafts, Constant Velocity Joints, Universal Joints, Drive Shafts, Hub/Wheel Bearings, Supports, Retainers and Bearings, Propeller Shaft, Four-Wheel Drive Hubs and Bearings, and All internal Lubricated Parts contained within the Differential Housing, Transaxle Housing, and Final Drive Housing. The Differential Housing, Transaxle Housing and Final Drive Housing are covered if damaged by the Failure of an internal Lubricated Part.

6. FUEL DELIVERY COMPONENTS Fuel Pump, Fuel Tank(s), Metal Fuel Lines, Fuel Distributor, Fuel Injection Pump, Fuel Injectors, Carburetors, and Auxiliary Tank Switch.

7. STEERING COMPONENTS Rack and Pinion Gear, Power Steering Pump, Main and Intermediate Steering Column Shafts and Couplings, Cooler and Cooler Lines, Power Cylinder, Pitman Arm, Idler Arm, Tie Rod and Tie Rod Ends, Drag Links, Control Valve and Cylinder, and all internal Lubricated Parts of the Steering Gear Box. The Gear Housing is covered if damaged by the Failure of an internal Lubricated Part.

8. AIR CONDITIONING COMPONENTS Compressor, Clutch, Clutch Pulley, Clutch Coils, Condenser, Evaporator, POA Valve, Accumulator, Orifice Tube, Temperature Control Programmer, Power Module, Idler Pulley and Bearing, Receiver Drier, Blower Motor, High/Low Pressure Cut Off Switches, Pressure Cycling Switch, P. C. Boards, and Ducts.

9. HEATING/COOLING COMPONENTS Water Pump, Radiator, Heater Core, Fan, Fan Clutch, Fan Motor and Control Module, Coolant Recovery Unit, Fan Shroud, Electric Block Heater, and Heater Ducts.

10. AIR BRAKE COMPONENTS Compressor, Diaphragm, Treadle, Brake Caliper, Compensating Valve, and Slack Adjusters.

DIAMOND If You selected “Diamond” Coverage and selected and paid all applicable surcharges for Your RV, then this Service Contract will cover necessary repairs to all of the mechanical and electrical parts of Your RV except for those items listed under “WHAT IS NOT COVERED.”

EMERALD COVERAGE OPTIONS For any of the following Emerald coverage options to apply, the respective coverage must be selected and paid at the time this Service Contract was sold. 26. DELUXE COMPONENT PACKAGE (NEW RVS ONLY) Rear Monitor System, Ice Maker, Freezer, Dishwasher, Washer/Dryer (EXCLUDING BELTS AND HOSES), Trash Compactor, Central Vacuum Cleaner System, External Barbeque, Tilt/Telescoping Steering Assembly, Horn, Spot Light System, Carbon Monoxide/Smoke Detector, Alarm Sensors, Garbage Disposal, Electronic/Remote Entrance, Thermometer, Compass, Central Locking System, Power Seat System, Awning Mechanism (EXCLUDING COVER), Door Hinges, Hood Hinges, Hood Latches and Springs, Door Handles, Seat Tracks, Interior/Exterior Light Fixtures, Electrical Outlets, Glove Box Door Hinges and Lock, Shift Lever, Thermostat, and Kitchen Center.

27. LEVELING JACK SYSTEM All of the Mechanical, Electrical, and Hydraulic Components of the Leveling Jack System.

28. SLIDE-OUT ROOM(S) All of the Mechanical, Electrical, and Hydraulic Components of the Slide-Out Room(s) and Raised Roof Extension System.

29. AUDIO/VIDEO (NEW RVS ONLY) TV (42” OR LESS), VCR, VCP, DVD Player, and Rear Stereo.

30. SEALS & GASKETS (FOR USED RVS) All Seals, Gaskets, and Sealing Boots for all items listed under Emerald Coverage.

NOTE: Coverage is available only for systems that are Factory installed or Dealer installed and approved by the Factory.

C. ADDITIONAL BENEFITS

The following additional benefits apply to both EMERALD and DIAMOND COVERAGE. These benefits begin on the Contract sale date and are not subject to any deductible:

1. RENTAL CAR REIMBURSEMENT (MOTOR HOMES ONLY) If Your RV sustains a Failure and the coverage cannot be verified by the Selling Company or Licensed Repair Facility in a customary or reasonable length of time, then You qualify for 1 (one) day of rental coverage, not to exceed $50. If Your RV sustains a Failure resulting in a Covered Repair, then You may qualify for additional rental coverage for up to $50 per day, with a 5 (five) day maximum, not to exceed $250 per occurrence (please see “HOW RENTAL COVERAGE IS DETERMINED” and “RENTAL EXCEPTION” sections below).

HOW RENTAL COVERAGE IS DETERMINED: Your rental coverage is contingent on the labor time required to replace/repair Covered Components authorized by the Administrator. The Administrator will use factory labor guides or industry recognized flat-rate manuals to determine the required repair time. However, this repair time specifically excludes the downtime waiting for parts or any other delays beyond the control of the Selling Company, repair facility, or the Administrator (please see “RENTAL EXCEPTION” subsection below). The labor time necessary for rental coverage is as follows: 1 to 8 hours = 1 day, 8.1 to 16 hours = 2 days, 16.1 to 24 hours = 3 days, 24.1 to 32 hours = 4 days, and 32.1 to 40 hours = 5 days. Your rental benefits will not continue beyond the day the repairs are completed and the repair facility notifies You of completion. All vehicles must be rented from the dealer or a licensed rental facility.

RENTAL EXCEPTION: You may qualify for 3 additional days of rental coverage, beyond the days described in the paragraphs above, in the event We authorize the replacement, overhaul, or rebuilding of the engine, transmission, or differential assembly.

2. SERVICE CALL REIMBURSEMENT

In the event of a Covered Repair, We will reimburse You for the additional expenses You incur from receiving a service call to Your location, not to exceed $75 per claim. This service call reimbursement only applies if the Selling Company or Licensed Repair Facility sends a service technician to Your location to repair or replace a Covered Component. In addition, the service technician or someone from the Licensed Repair Facility must call Our claims department for instructions before starting repairs (Please see “WHAT TO DO IF YOUR RV SUSTAINS A MECHANICAL BREAKDOWN”).

3. TRIP INTERRUPTION

If You are more than 100 miles from Your place of residence and Your RV is in need of Emergency Repairs, then You may qualify for Trip Interruption benefits, which include lodging and meal reimbursement for up to $100 per day, with a 3 day maximum, not to exceed $300 per occurrence. This benefit applies when a Licensed Repair Facility must keep Your RV overnight to repair Your RV, but it does not extend beyond the day the repairs are completed. For lodging and meal reimbursement, please save all receipts and contact the Administrator for instructions (1-888-888-8888). Receipts must be legible and verifiable. Handwritten receipts will not be accepted. The Trip Interruption benefit is available only where allowed by law.

D. LIMITS OF LIABILITY

Our liability per repair visit will not exceed the NADA “clean trade-in” value of Your RV immediately prior to Breakdown. In addition, the total of all benefits paid or payable under this Contract will not exceed the price paid for the RV by the original purchaser of this Contract, excluding tax, title, and license fees. A copy of the Bill of Sale may be requested for verification. Our liability for incidental and consequential damages including, but not limited to death, personal injury, physical and property damage, loss of RV use, loss of time, inconvenience and commercial loss resulting from the operation, repair, maintenance or use of this RV is expressly excluded.

E. WHAT IS NOT COVERED In accordance with the coverage You selected on the first page of this Service Contract, any part not specifically listed under “WHAT IS COVERED” is not covered. In addition, this Service Contract does not cover the following: 1. Any repair that has not received prior authorization from the Administrator. 2. The repair or replacement of any component that was not properly operating in accordance with manufacturer’s specifications at the time this Service

Contract was sold (i.e. pre-existing conditions). 3. Any RV with a branded title (e.g. salvage, junk, rebuilt, total loss, flood, fire, or gray market). 4. Any RV that has been repurchased by or had its price renegotiated with the manufacturer, or that has had the manufacturer’s warranty revoked or voided. 5. The repair or replacement of engine valves, valve guides, valve seals, and/or piston rings, if the purpose of such repair(s) is simply to raise the compression of the

engine, increase performance, or to reach acceptable oil consumption. 6. The repair, modification, or replacement of any component that has not Failed, as defined by this Contract. 7. Damage due to the alteration, modification, or use of Your RV in a manner not recommended by the manufacturer, including the use of “non-stock” or

modified parts. 8. Any Mechanical Breakdown covered by an insurance entity, the manufacturer’s warranty or recall, or that has a warranty or “repairer’s guarantee” through a

repair facility. Additionally, if an insurance entity, the manufacturer, or repair facility notifies You that they will monetarily participate in a repair that has been authorized and paid by Us, then We will exercise Our right to recover the respective amount.

9. Any RV with an odometer that has been tampered with, altered, disconnected, or not maintained. You may be required to provide an odometer statement at the time of sale of this Service Contract.

10. Any Failure caused by (a) Wear and Tear, as defined herein; (b) Your failure to provide the proper maintenance to the failed part or parts; (c) overheating, regardless of the cause of overheating; (d) incorrect, contaminated or inadequate amounts of coolant, lubricants, or fluids; (e) accidental loss or damage, impact, collision or upset, falling missiles or objects, rust, corrosion, fire, theft, larceny, explosion, lightning, earthquake, wind storm, hail, water, flood, freezing, malicious mischief, vandalism, riot, or civil commotion; or (f) DRIVER NEGLIGENCE OR MISUSE, INCLUDING THE OPERATION OF AN IMPAIRED RV.

11. Cosmetic damage or cosmetic related repairs (e.g. scratches, nicks, dents, or tears). 12. Body components or repairs related to the body of the RV (e.g. awning covers, bumpers, lenses, glass, sky lights, paint, convertible or vinyl tops, sheet metal,

outside ornamentation, frame or structural body parts, air or water leaks, wind noise, weather strips, squeaks or rattles, trim, upholstery, carpet, or mats). 13. Electronic components that were not originally installed by the manufacturer (i.e. non-OEM components) or factory, including the following: audio/video

equipment and accessories, navigational systems, security systems, and electronic transmitting/receiving devices. 14. The following, unless required in conjunction with a Covered Repair: upgrades, adjustments, alignments, oil, fluids, greases, lubricants, or refrigerant. 15. Maintenance services and parts described in the manufacturer’s maintenance schedule for Your RV. NOTE: During the term of this Service Contract, it may

become necessary to (a) replace spark/glow plugs and wires, emission control valves, timing belts, and filters; (b) adjust belts, ignition, transmission bands, or clutch system; (c) clean fuel and cooling systems, or remove sludge or carbon deposits; and (d) maintain or replace items not specifically covered under this Service Contract. These aforementioned services and replacements are required because of normal usage. They are Your responsibility. Costs for these services and parts are not covered by this Service Contract.

16. Any expenses that are associated with shop supplies, materials charges, hazardous waste charges, diagnosis time (where a Covered Mechanical Breakdown has not occurred), freight charges, or storage charges.

17. RVs used as a permanent residence or for any of the following: plowing snow, competitive driving, municipal services, professional emergency services, police services, hire to public (unless the Commercial Use surcharge is selected and paid at the time this Contract is sold), transporting people for hire, or for towing a trailer weighing more than the vehicle manufacturer’s recommendations.

18. Any of the following items: (a) batteries and battery cables; (b) exhaust and emission system components and catalytic converters; (c) tires, wheels/rims, and shock absorbers; (d) fasteners, nuts, bolts, clips, screws, washers; (e) fuses and bulbs; (f) safety restraint systems (including air bags); (g) brake linings, rotors, and drums; (h) sealed beams, LED, and HID headlamp assemblies; (i) wiper blades, hoses, molded rubber, molding, and rubber-like items; (j) clutch disc and linings, clutch pressure plate, clutch throw-out bearings, pilot bearings; (k) bent shift forks, stretched timing chains; and (l) cellular phones.

19. Any of the following repairs or replacements: (a) flooring, carpet, upholstery, bedding; (b) wood framing, carpentry, woodwork, millwork; (c) walls, ceilings, paint, wall coverings; (d) deficiencies in finishes, de-lamination or discoloration of any material; (e) tile or grouting; (f) doors, louvers, vents; (g) sheet metal, siding, trim; (h) roof or roofing materials; (i) weather-strips, seals, caulking, sealants, adhesives; (j) windows, glass or glass treatments, glazing, shades or draperies; (k) cabinets, vanities, racks or shelves, hardware; (l) inside or outside ornamentation, bright metal or chrome; (m) hose washers, loose connections; and (n) filters.

20. Any losses resulting from delays, labor strikes, loss of time, inconvenience, or other causes beyond the control of the Administrator or repair facility. 21. The repair or replacement of any Covered Component that has been damaged by a non-Covered Component or an improper repair. 22. The repair or replacement of any non-Covered Component damaged as a result of the Failure of a Covered Component. 23. RVs registered or needing repairs or replacements outside of the contiguous United States, Alaska, or Hawaii.

F. WHAT TO DO IF YOUR RV SUSTAINS A MECHANICAL BREAKDOWN

1. Take immediate action to prevent further damage to Your RV. Any damage resulting from the continued operation of an impaired RV will constitute the failure to protect Your RV and will not be covered under this Service Contract.

2. Return Your RV to the Selling Company. If You are within a 50 mile radius of the Selling Company, repairs or replacements under this Service Contract must be performed by the Selling Company or, if approved in advance by the Administrator, at a Licensed Repair Facility. If You are outside a 50 mile radius of the Selling Company and it is not possible or not practical to deliver Your RV to the Selling Company, then call the Administrator for instructions. If the Selling Company does not have a repair facility, then You may deliver Your RV to the Licensed Repair Facility of Your choice. Ensure that any facility You choose is willing to perform repairs according to the terms and conditions of this Service Contract. If necessary, We reserve the right to relocate Your RV to a Licensed Repair Facility of Our choice.

3. Present this Contract to the repair facility. The Administrator may also require you to provide the Licensed Repair Facility with proof of all relevant maintenance as expressed under “MAINTENANCE AND RECORDS”.

4. Make certain the repair facility contacts the Claims Department for instructions prior to any repairs. The Claims Department can be reached at 1-888-888-8888.

5. If Emergency Repairs covered by this Service Contract are required, then deliver Your RV to a Licensed Repair Facility and have the necessary repairs performed at a reasonable and customary charge. On the next business day, report the repairs to the Administrator at 1-888-888-8888.

6. In all instances, if Your repair is a Covered Repair, then You are required to pay the repair facility the deductible amount reflected on the first page of this Contract. In addition, You are also required to pay for anything not authorized by the Administrator.

G. WHAT THE ADMINISTRATOR WILL DO WHEN A CLAIM IS REPORTED The Administrator will determine the extent of coverage, subject to the terms and conditions of this Contract. To that end, the Administrator will work with the Licensed Repair Facility to verify the Failure, verify coverage, determine the Cost of the repair, and authorize the claim for any Covered Repairs (The claim is not approved unless authorization numbers are given to the Licensed Repair Facility). NOTE: (1) At the sole discretion of the Administrator, Failed parts may be replaced with new parts, remanufactured parts, or with used parts of like kind

and quality (LKQ). (2) We reserve the right to inspect Your RV to verify a Failure(s). In addition, if a dispute arises between the repair facility and Us, We reserve the right to relocate Your RV to a repair facility of Our choice. (3) In the event the Administrator determines that a repair in question is not a Covered Repair, then You are responsible for any cost incurred.

H. STATE SALES TAX

The payment of sales tax on Covered Repairs will be made in accordance with the regulations of the Taxing Authority in the state where Your RV has been repaired. I. DEFINITIONS

• ADMINISTRATOR OBLIGOR, ADMINISTRATOR, WE, US, and OUR: • COMMERCIAL USE: The Commercial Use surcharge applies to RVs used for short rentals/leases (12 months or less) or to RVs used for business travel.

COVERAGE DOES NOT INCLUDE TAXI, SHUTTLE DELIVERY SERVICES, HAULING, OR OFF-ROAD USAGE. • COST: The customary and reasonable charges for the parts and labor necessary to repair or replace Covered Components. These charges are subject to the

Administrator’s approval and will not exceed either the manufacturer’s suggested retail (list) price for parts or the labor allowances derived from industry recognized flat-rate manuals. The maximum dollar amount per labor hour will not exceed $100, unless approved in advance by the Administrator.

• COVERED BREAKDOWN or COVERED MECHANICAL BREAKDOWN: A Breakdown that is covered by this Contract. • COVERED PART(S) and COVERED COMPONENT(S): Any part of the RV listed herein as a Covered Part/Component and not excluded from coverage by

this Service Contract. • COVERED REPAIR: The repair of a Covered Part/Component authorized by the Administrator. • EMERGENCY REPAIRS: Repairs which, if not performed, would impair the future operation of Your RV or render it inoperable or unsafe to drive. • FINANCE COMPANY: The financial institution listed on the first page of this Contract who is financing this RV and/or this Service Contract. • LICENSED REPAIR FACILITY: Any automotive repair facility licensed to perform automotive repairs by the state in which it resides. • LUBRICATED PART: A part that requires lubrication to function correctly. • MECHANICAL BREAKDOWN, BREAKDOWN, FAILURE, or FAILED: The inability of any Covered Component(s) that has received proper maintenance, as

prescribed by this Service Contract, to function in the manner for which it was designed. This inability must be the result of defective material or faulty workmanship, not due to Wear and Tear. In addition, a Failed part must be outside the allowable tolerances prescribed by the manufacturer to be deemed a Failure.

• RV: The Motor Home, Fifth Wheel, Travel Trailer, Slide-in Camper, or Pop-up Camper identified on the first page of this Contract. • SELLING COMPANY: The entity identified on the first page of this Contract from which You purchased Your RV and this Service Contract. • SERVICE CONTRACT or CONTRACT: This document in its entirety. • WEAR AND TEAR: The gradual reduction in component performance through normal or excessive usage. • YOU, YOUR, CONTRACT HOLDER, MY, and I: The person(s) whose name is listed as the purchaser(s) of this Service Contract.

J. CANCELLATION AND RENEWAL

CANCELLATION BY THE FINANCE COMPANY: You hereby authorize the Finance Company to cancel this Contract on Your behalf in the event: (1) Your RV is repossessed, (2) Your RV is declared a total loss, or (3) You default in Your obligations to the Finance Company. In addition, You authorize the Finance Company to be listed as a joint payee and to receive any refund in the event this Contract is cancelled.

CANCELLATION BY THE ADMINISTRATOR: The Administrator may cancel this Contract for material misrepresentation or substantial breaches of contractual duties, conditions, or warranties, or for non-payment of the Service Contract price.

CANCELLATION BY THE CONTRACT HOLDER: You may cancel this Service Contract at any time by notifying the Selling Dealer or Administrator in writing. This notification must include this Service Contract. A notarized statement indicating the actual mileage of Your RV on the date of the cancellation request may also be required. The odometer reading applies to motor homes only.

CANCELLATION PROVISIONS: If this Contract is cancelled within the first thirty (30) days from the Contract sale date and no claims have been filed, then You will receive a full refund. If this Contract is cancelled after thirty (30) days past the Contract sale date or after a claim has been filed, then You will receive a pro rata refund, and any claims paid under this Contract will be deducted. Pro rata refunds are determined by multiplying the amount You paid for this Service Contract by the number of covered days remaining on the Service Contract divided by the original number of covered days. A cancellation fee of $50 or 10% of the Service Contract price, whichever is less, will apply to all pro rata cancellations made by the Contract Holder. In all instances, if there is no Finance Company, the refundable amount will be paid to You. If there is a Finance Company, the refundable amount will be paid to the Finance Company.

NOTE: Transferred Service Contracts are not eligible for cancellation refunds. This Contract is non-renewable.

K. TRANSFER OF RV OWNERSHIP

If You sell Your RV or if there is any change in the ownership of Your RV, this Contract will terminate. However, You may request to transfer the remaining coverage of this Contract to the new owner within fifteen (15) days of the change in RV ownership. You must notify the Administrator in writing and include the following: a transfer fee of $50, name and address of the new owner, a copy of the bill of sale or sales contract showing the date and mileage of Your RV at the time of sale (when applicable), and proof that You transferred the remaining manufacturer’s warranty (when available) to the new owner of Your RV. Copies of all maintenance records must be submitted to the Administrator. No handwritten receipts will be accepted. The new owner must retain these records and the RV will still be subject to the maintenance requirements as specified in this Contract and by the RV manufacturer. This Contract may not be transferred more than once, may not be assigned to another RV, and may not be transferred to a new or used RV dealer or anyone other than an individual purchasing Your RV for personal use. The Administrator has the discretion to approve or reject your request. If You sell Your RV, or if there is any change in the ownership of Your RV without notifying the Administrator as outlined in this section, this Contract will terminate. To transfer this Contract, fill in the information below, cut along the dotted line, and mail the portion below along with a copy of the first page of this Contract to Dealers Alliance Corporation. Transfer will be valid when the new owner receives a confirmation letter from Dealers Alliance Corporation.
