    Forward Note

    Equal participation o men and women will ensure the sustainable development o the nation.

    The Royal Government o Cambodia under the wise leadership o Samdech Akkak Moha SenaPadei Techo Hun Sen, Prime Minister o the Kingdom o Cambodia continues to keep gender

    equity enhancement as an important issue in rebuilding the country. The implementationo gender policy is mentioned clearly in corner 3 o the Rectangular Strategy Phase II o the

    Royal Government, which describes women as the backbone o national economic and socialdevelopment. The ull participation o women is a actor that cannot be ignored.

    To achieve the Rectangular Strategy, Phase II the Royal Government is currently paying moreattention to increasing the level o womens participation as much as possible in all levels

    within national institutions, including the central level and local levels.

    As the secretariat o the Royal Government and in order to promote gender equity participation,

    the Ministry o Justice has established the MoJ gender working group to implement all genderactivities in order to reduce inequity o gender within the justice sector.

    At the initial stage, the Ministrys gender working group commenced work by developinggood cooperation with the relevant institutions and development partners in preparing

    or the next phases o work including the policies and the development o the GenderMainstreaming Action Plan (GMAP) or 2009-2013 through support rom the Cambodia

    Criminal Justice Assistance Project (CCJAP).

    To support the ongoing actions required to implement this strategy successully, I would

    like to appeal or active participation rom all leaders and ocers in the justice sector andalso appeal to all development partners and donors to continue the good cooperation to

    promote gender mainstreaming into the justice sector with the goal to achieve the requiredpolicies and the 2009-2013 GMAP o the Ministry o Justice.

    Through the Gender Mainstreaming Action Group (GMAG), I strongly believe that the policyand strategic plans above will be successully implemented and that gender inequity will be

    reduced in the justice sector. In the mean time, I also would like to express my appreciation

    or all the eorts, undertaken with highly responsible spirit o the members o GMAG andthe development partners especially the Cambodia Criminal Justice Assistance Project whocooperated with GMAG in the preparation o this policy and key strategy.

    1 Introduction

    1.1 Government commitment

    Cambodia has signed and ratied the Convention on the Elimination o All Forms oDiscrimination against Women (CEDAW). This refects the commitment o the Royal

    Government o Cambodia in eliminating the disparity o gender and aiming to achievegender equity in all sectors and relevant institutions throughout Cambodia. To achieve this

    goal, the Royal Government o Cambodia has set priorities to promote gender equity throughpreparation o key policies and documents including the National Strategic Development

    Plan (2006-10), the Cambodian Millennium Development Goals (2003), the GovernmentsRectangular Strategy and especially the Constitution o the Kingdom o Cambodia, and

    the supreme law o the state which clearly states that all orms o discrimination against

    women shall be eliminated. In addition, the Royal Government has adopted a legal reormpolicy and a number o laws are being drated with the aim to ensure that men and womenare treated equally.

    1.2 Purpose or the preparation o the Gender Mainstreaming Action Plan (GMAP)

    This Gender Mainstreaming Action Plan has been prepared to be a guide with the aims:

    2 Gender Situation in the Justice Sector

    2.1 Background o the Ministry o Justice

    The Ministry o Justice was established through Royal Decree No NS/RKM/0196 dated 24January 1996 in the rst mandate o the Royal Government o Cambodia. In the rst and

    second mandates o the government, the Ministry o Justice had the structure described insub-decree No. 19 ank.bkdated 7 April 2000. Due to an increase in the scope o work, underthe third mandate the Ministry o Justice reviewed its structure as mentioned in sub-decreeNo 47 ank.bkdated 11 May 2007 with its main tasks and duties revised as ollows:

    < Receive and prepare applications or sentence reduction and amnesty inaccordance with the law;

    < Manage all government oicers working within MoJ;

    < Manage the budget or MoJ, courts, and prosecutions at all levels;

    < Report quarterly on MoJ activities to the RGOC;

    < Implement other activities as required by the RGOC.

    2.2 Structure o the Ministry o Justice

    The Ministry o Justice has its organizational structure as per sub-decree No 47 ank.bkdated 11 May 2007 which consists o a General Inspectorate o Court Aairs, a GeneralDepartment or Administration and Finance, a General Department o Technique and a

    General Department o Research and Judicial Development. Each o the general departments

    2.3 Gender disparity within the justice sector

    The Ministry o Justice supports the implementation o the Royal Government o Cambodiaspolicy to enhance gender equity and also to contribute to the improvement o the role o

    women in Cambodia as well as to provide opportunity or promotion o emale ocers,positions and the participation in training courses and other activities. However, although

    many eorts have been made, we observe that still the number o women standing ascandidates or participation in politics is limited and thereore not meeting the required

    standards. This is because o:

    Seeing such challenges, the Ministry o Justice has made urther eorts through the GMAG toprepare this Gender Mainstreaming Action Plan (GMAP) as a key measure to implement and

    provide solutions aimed to achieving gender equity within the justice sector.

    According to Table A, which shows the number o civil servants at the Ministry o Justicetogether with all judges and prosecutors in provinces and municipalities as o July 2003

    (Second Mandate o the Government), there were only 4 women in leadership positionsand in management positions within the Ministry o Justice ranging rom department head

    to bureau head, as or the provincial and municipal courts there were no emale presidentsexcept the President o the Court o Appeal. The total o number o judges was 133 including

    14 women; as or prosecutors there was only one emale prosecutor out o 64 prosecutorsthroughout the country; out o 797 court clerks there were only 192 emale court clerks.

    There were only 24 emale personnel out o 155 personnel working at the Ministry o Justice,provincial and municipal courts and prosecution departments.

    Table B demonstrates that the number o emale ocers in management positions, the numbero judges, prosecutors, and court clerks and the number o ocials o the Ministry o Justice

    and courts o all levels had increased in the term o the Third Mandate o the Government bycomparison with the rst and second mandates.

    2.4 The Gender Mainstreaming Action Group (GMAG) o the Ministry o Justice

    The Gender Mainstreaming Action Group (GMAG) was rst established in 2002 under Prakas

    No.49 br.k, bbb/ 2002 dated 17 December 2002. It was composed o 7 members. Someo the members o the group retired and a new composition was established through

    review o the old composition and replacement o those who retired in order to meet the

    requirement o the Ministry according to Prakas No. 2 br.bbb/04 dated 14 January 2004.In 2007 ater a request rom the Chair o MoJ Gender Mainstreaming Action Group andwith the aim to expand and improve gender activities, the Ministry o Justice reviewed the

    composition o the GMAG under Prakas No. 82 ky.br.kdated 24 December 2007 with theollowing composition:

    3 Goals, Strategic Objectives and Indicators

    3.1 Goals o the Gender Mainstreaming Action Plan

    All objectives and indicators stated in the GMAP seek to reach the ollowing overall goals:

    3.2 Objectives o the Gender Mainstreaming Action Plan

    1 Strengthening the capacity o the Gender Mainstreaming Action Group

    (GMAG) to lead and coordinate the development and implementation o MoJsgender mainstreaming action plan.

    2 Strengthening the capacity o ocials o the Ministry o Justice and provincial

    and municipal courts; integrate gender initiatives into activities o alldepartments and establish contact ocers in all provincial and municipal courts.

    3 Increasing gender mainstreaming and understanding o relevant laws at locallevels.

    4 Setting up appropriate mechanisms and allocating adequate resources to

    mainstream gender into policy ormulation, organizational planning, drating onew legislations, regulations and capacity development.

    5 Increasing womens representation at all levels and in particular senior positions

    and participation o women in all other activities.

    3.3 Indicators o the Gender Mainstreaming Action Plan

    3.3.1 Objective one

    Strengthening the capacity o the Gender Mainstreaming Action Group to lead and coordinate

    the development and implementation o MoJs Gender Mainstreaming Action Plan.Achievement o the objectives is to be measured using the ollowing seven indicators:

    1 By 2009, the GMAG members will have drated and reviewed the GMAP.

    2 By 2009, the GMAG annual activity plan is implemented with nance allocatedto each activity.

    3 By 2009, the MoJs GMAP is drated, approved, and ocially launched.

    4 By 2009, a capacity development assessment is carried out to determine therequired skill trainings or each individual as well as the group.

    5 By 2009, a series o on-the-job training is supported to enhance the capacity o

    GMAG members.

    6 By 2010, the MoJs gender mainstreaming annual activity plan is integrated as

    part o MoJ overall annual plan and nanced.

    7 By 2010, GMAG members are competent and skillul to lead the developmento a gender mainstreaming annual activity plan and coordinate its

    implementation.

    Annex 1 Gender Terminology

    Gender:Gender reers to ideas and opinion absorbed culturally and socially which include the value,

    behavior, roles and responsibilities something that women or men can change rom time totime and makes a dierence between cultures. In most societies, eminism or masculinity is a

    challenge o dierent expectations depending on the roles determined by society accordingto what we have learnt when growing up.

    Gender equality:Gender equality reers to equal participation o women and men or boys or girls in the

    implementation o rights, employment opportunities, services, and resources. These needto have at the time that men and women or boys or girls have equal conditions through

    understanding o their own rights and potential to engage in social, economic and politicaldevelopment and equal distribution o benets is made through results. Equality means

    women and men or boys and girls shall be treated the same; however, their rights andemployment opportunities around are not limited even though a person is borne as a male

    or a emale.

    Note: Women may have the same access to opportunity as men but i women donthave access to opportunity as men then the conditions are not sucient.

    Gender equity:

    Gender equity reers to the way to reach gender equality. Equity contributes to the equality. To

    ensure equality, usually there are interventions to response to the loss o society and hindranceo traditions that separates men and women rom being treated equally.

    Gender balance:

    Gender balance reers to the number o women in comparison with the number o men whoequally work in any institution in the sector and in various areas. It can be said that achieving a

    balance or normally the greater the number o women as representatives does not create any

    issue to gender program nor all men dont want to know about gender. Moreover, the balancebetween men and women in all workplaces and meeting or a o communities creates the

    incorporation o all voices.

    MISSION, ROLE, DUTY, AND STRUCTURE

    Article 2

    The Ministry o Justice shall direct and manage the administration o justice o the Kingdom

    o Cambodia.

    Article 3The Ministry o Justice shall be responsible or:

    Protect the independence o judges in perorming their unctions; Ensure justice or all according to the law; Establish and monitor the administration o all courts and prosecution oces; Ensure the unctioning o all levels o court and prosecutions oces; Ensure the implementation o laws and all court and prosecution decisions; Monitor and oversee the implementation o laws, judgments and all decisions ocourts and prosecutors; Inspect cases where there are complaints rom any individuals or legal persons

    about courts or prosecutors;

    Monitor the legal and operational perormance o the prisons and correctionalcentres;

    Develop drat laws within the justice sector; Receive and give recommendations on drat laws rom other ministries and

    relevant institutions;

    Prepare and implement recommendations within the legal ramework o thejustice sector;

    Research, educate and disseminate the laws in the justice sector; Develop cooperation with the Royal School or Judges and Prosecutors in

    relation to the training o bailis and judicial ocers;

    Cooperate with the Royal School or Judges and Prosecutors in judge, prosecutorand clerk training;

    Monitor education and dissemination o all law relevant to the justice sector; Develop relationships with international agencies within the justice sector toassist in the development o relevant laws; Create and manage the production o extracts o criminal records; Receive and prepare applications or sentence reduction and amnesty in

    accordance with the law;

    Article 4

    The Ministry o Justice shall be endowed with the ollowing organizational structure:

    CHAPTER III

    CABINET OF THE MINISTER

    Article 5

    The Cabinet o the Minister shall be responsible or all missions dened by the provisions oSub-Decree No. 20/ANK/BKdated April 30, 1996 on Organization and Functioning o theMinistries and State Secretariats.

    CHAPTER IV

    INTERNAL AUDIT DEPARTMENT

    Article 6The Internal Audit Department shall be directly supervised by the justice minister and shall

    be responsible or duties dened by the Sub-Decree No. 40/ANK/BKdated February 15,2005 on Organization and Functioning o the Internal Audit Departments o the Institutions,

    Ministries, and Public Enterprises.

    The Internal Audit Department shall be managed by a director assisted by a number o

    deputy directors as necessary.

    CHAPTER V

    GENERAL INSPECTORATE

    Article 7The General Inspectorate shall be responsible or:

    Conducting regular inspections o institutions subjected to the jurisdiction othe Ministry o Justice.

    Conducting permanent inspections o administrative process and lawsimplementation o all levels o court and prosecution department.

    Conducting inspections at the courts and prosecution department in casewhere there are the complaints rom the person against the courts and

    prosecution departments and report to the justice minister and the SupremeCouncil o Magistracy and deend such report at the Discipline Council o the

    Preparing reports to the justice minister on the administrative process and thelaws implementation o all levels o court and prosecution department and

    institutions under supervision o the Ministry o Justice, which has been

    inspected and providing suggestion or their improvement.

    Reviewing and disposing the evidences kept by the courts and prosecutionsdepartments.

    Reviewing and mediating administrative disputes related to the competence ocivil servants and agents o the Ministry.

    Perorming duties as provided by the justice minister.The General Inspectorate shall assist the justice minister in coordination the aairs with theSupreme Council o Magistracy and shall assist the Supreme Council o Magistracy and shall

    be responsible or: Contacting and coordinating the aairs o the Ministry o Justice with the

    Supreme Council o Magistracy with the purpose to better and uniorm the

    process o judiciary system.

    Receiving complaints led against judges and prosecutors and submittingdocuments related to complaints to the Discipline Council o the SupremeCouncil o Magistracy.

    Obtaining responsibility to process the administrative aairs, made reports andminutes o meetings o the Supreme Council o Magistracy and its Discipline

    Council, and keep these reports and minutes and other documents.The General Inspectorate shall be managed by a general inspector assisted by one deputy

    general inspector and a number o inspectors as necessary.

    CHAPTER VI

    GENERAL DEPARTMENT OF ADMINISTRATION AND FINANCE

    Article 8

    The General Department o Administration and Finance shall be responsible or coordinationand management on administrative aairs, ocials, plans, statistics and nances o the

    Ministry and the Supreme Council o Magistracy.

    The General Department o Administration and Finance shall be endowed with theollowing three Departments:

    Department o Administrative Aairs Department o Financial Aairs Department o Personnel Aairs

    The General Department o Administrative and Finance shall be managed by a generaldirector assisted by a number o deputy general inspectors as necessary.

    Studying, researching and compiling national and international criminology datasystem.

    Preparing monthly, trimester, semester, nine months and annual reports to leaders. Perorming other duties as provided by justice minister.

    Article 14The Department o Prosecutorial Aairs shall be responsible or:

    Participating in preparation o drat laws and regulations related to prosecutorialaairs.

    Participating in review and consultations o the drat laws o the Ministries andInstitutions related to prosecutorial aairs. Monitoring the laws implementation at the penal institutions. Monitoring the statistic lists and activities o all levels o prosecution department. Following up and monitoring the execution o judgments and rulings o all

    levels o court and prosecution department.

    Reviewing and proceeding complaints related to prosecution departments. Making relationship with local and oreign organizations related to prosecution

    and human right aairs.

    Reviewing and providing consultations o the problems related to prosecutorialaairs.

    Following up the laws implementations activities o the prosecutiondepartments.

    Preparing prosecutorial aairs statistics and reports. Preparing monthly, trimester, semester, nine month, and annual reports to leaders. Perorming other duties as provided by the justice minister.

    Collecting judgments and decisions related to criminal case rom all levels o court.

    Article 16The Department o Civil Aairs shall be responsible or:

    Participating in preparation o drat laws and regulations related to civil aairs. Reviewing and providing consultations o the drat laws and regulations o the

    other Ministries and Institutions related to civil aairs.

    Participating in discussion on, negotiation o and entering into the internationalagreement related to private law, commercial law, social law, and patent andintellectual property.

    Reviewing, disposing, and orwarding complaints related to civil case. Ensuring the proper unctioning o the cooperation o international court o civiljurisdiction and ensuring o the execution o ruling order to investigate in the

    manner o internationally in civil case.

    Collecting judgments and decisions related to civil case rom all levels o court. Examining books o court ees o the courts and books o civil case statistic. Reviewing and providing consultations o the problems related to civil aairs. Preparing statistics and achievement reports o civil aairs. Preparing monthly, trimester, semester, nine month, and annual reports to leaders.

    Article 18

    The Department o International Aairs shall be responsible or:

    Coordinating oreign aairs related to the Ministry o Justice. Coordinating international justice und. Making relationship with other countries on justice domain. Collaborating with other oreign countries, ministries, and institutions on

    terrorism, the ghting against illegal drugs, money laundering, tracking inperson, and cross-border crime.

    Obtaining responsible or working related to ASEAN aairs, justice aairs. Developing cooperation programs, memoranda, and agreements on justice

    domain with other countries and international organizations.

    Coordinating and arranging missions at oversea or leaders and delegations othe Ministry.

    Preparing statistics and achievement reports o international aairs. Making monthly, trimester, semester, nine month, and annual report to leaders. Perorming other duties as provided by the justice minister.

    Article 19The Department o Research and Training shall be responsible or:

    Gathering visions or promotion and development o the Ministry. Researching and evaluating requirements or organizing training courses and

    Article 20The Department o Legal Education and Laws Dissemination shall be responsible or:

    Educating and disseminating o laws related to justice domain. Monitoring educations and disseminations o laws related to justice domain.

    Compiling and publishing all regulation in orce related to justice domain. Preparing and administrating library o the Ministry. Installing and administrating inormation technology system and website o the

    Ministry.

    Preparing inormation strategy project. Preparing monthly, trimester, semester, nine month, and annual reports to leaders. Perorming other duties as provided by the justice minister.

    The Department o Legal Education and Laws Dissemination shall be managed by a director

    assisted by a number o deputy directors as necessary.

    CHAPTER IX

    FINANCIAL CONTROL UNIT

    Article 21The Financial Control Unit shall be established by the Ministry o Economy and Finance

    pursuant to the conditions provided in Sub-Decree No. 81/ANK/BKdated November 16,

    1995 on the Financial Control o Budgeted Expenditures within Ministries.

    CHAPTER IX

    FINAL PROVISIONS

    Article 22

    The organization and unctioning o the Ministry at the central administration levels lower

    that the department level shall be declared by a Prakas o the Ministry o Justice.

    Article 23For duties related to the competence o other institutions, the chies o those institutions

    and the Minister o Justice shall collaborate to allocate responsibilities and implement themthrough a joint Prakas o both institutions concerned.

    Article 24

    Sub-Decree No. 19/ANK/BKdated April 07, 2000 on organization and unctioning o theMinistry o Justice, Decision No. 03/SSRdated March 01, 2006 on Creation o Working Groupo the Ministry o Justice to the Supreme Council o Magistracy and any provisions contraryto this Sub-Decree shall be null and void.

    Article 25The Minister in charge o the Oce o the Council o Minister, the Minister o the Ministry

    o Economy and Finance, the Minister o the Ministry o Justice, the Secretary o State othe State Secretariat o Civil Services, ministers and secretaries o state o relevant ministries

    and institutions shall be responsible or implementing this Sub-Decree rom the date o its

    signature.
