Hugo stated the District will begin paying a $16 million dollar contribution to the RetirementPlan in monthly installments. Once the final mntribution is determined, the Districfscontribution will increase or decrease to cover the change over the remainder of the District'sfiscal year.

K. Discussion of Recent Investment Performance

Hugo reported the performance has been better this year than the past several years. TheS&P is up 11olo; EAFEA is up 9ol0. Jim Callahan reported the Fund was up 11olo for thequarter. All managers, with the exception of Dresdner, exceeded their benchmarks for thequarter, Jim also felt that Dresdner should continue to perform well in light of the staffchanges in the large cap growth team.

Jim Callahan repofted the Plan's asset allocation is tracking the targets fairly closely. Hugostated he will rebalance taking funds from Dodge & Cox and sending them to Siex.

Chris recommended changing the vested table to a sentence $at states the Plan provides ahigher benefit at age 65. Chris also recommended very plain, direct wording for theinformation on the statements. Counsel stated the old table with age/years of service will beimproved in the updated book.

Hugo stated he and Jim plan to go out to the divisions after the statements are mailed out.

tBob McCrory, EFI Actuaries, stated he had reviewed information on future layoffs, overtime,

demographic changes and final average pay, all in an effort to a possible cost savings. Afterreview of this information, Mr. McCrory determined that any cost savings for this year wouldbe very minor, and there are indications from the final average pay issue that costs wouldincrease.

Mr. McCrory stated retirement incentives given to the most senior employees will result inhigher costs to the Plan. He also stated that actuarial estimates on final average pay havebeen approximately 5.3o/o lower than actual figures. Member Zook suggested using the realfigures and load the 5.3olo. Mr. McCrory felt he could look at that data in the experiencestudy. Member Zook also pointed out that it may be incorrect to assume bus operators'salaries for 12 months. She stated senior drivers - those eligible to retire - haveapproximately 6 weeks of vacation pay per year. Vacation pay is substantially less thanregular monthly salary with expected oveftime in the runs and unexpected overtime. Counselagreed that the consequence of dropping lower months of pay results in a calculation basedon the 10 highest months, which tends to show an actuarial loss.

Mr. McCrory recommended the Plan costs as submitted to the Board July 10, 2003.

Discussion of lor Adton on Asset Allocation

Hugo reported the assets are at the upper end of the ranges due to the stock market goingup, He has been moving money from the stock market to the bond market as part of thelong-term re-balancing strategy.

Hugo reported the language on the benefit statements has been simplified, and changes weremade to the Vested section and the table for Projected Retirement Benefits.

Discussion oflor Action on Fall Newsletter

Hugo thanked Jim for his work on the newsletter. These will accompany the benefitstatements which will sent out later in September 2003. As suggested by Member Zook andVice Chair Johnson, changes were made to the calculation and estimate information.

Director Bischofberger requested the District Board receive copies of the newsletter.

Hugo reported he is working with ATU on the second Retirement Workshop scheduled to takeplace, Saturday, November 8, 2003, at the ATU Hall, Hugo will work with staff and Unionrepresentatives on the format for the workshop. He would like to schedule more time in themorning session to discuss how employees can calculate their pensions themselves. Jimadded that staff is available immediately following the workshop to answer any questions,and he added more information should be provided on QDROS. Jim suggested an evaluationform be distributed at the workshop to get feedback from the employees.

J, Discussion oflor Action on Retiree Chapter of Local 192 Participating in Educational Activities

Hugo stated he had been contacted by ATU Local 192 Retireer Nick Norton. Mr. Nortonstated the Retiree Chapter of Local 192 would like to pafticipate in the RetirementDepartment Educational Activities. Hugo stated he has concerns regarding retirees on Districtproperty; if the retirees would be providing information separate and apart from theRetirement Department; and what, if any, responsibility the Retirement Depaftment has forthe retirees passing on incorrect information. Director Piras suggested Hugo may wish tospeak with the General Manager regarding non-employees on the property. Counsel statedthe Retirement Department would have minimal liability regarding incorrect information givenby the Retiree Chapter. The Retirees would have their own table at the educational activities.

K, Discussion of/or Action on Howard Jones Issue

Counsel reported the first decision by the arbitrator appears to grant a pension right topriority employees. However, the plan assets to be transferred by AC Transit to BART werenot transferred to meet the pension obligation for BART. The priority employees then hadred-circled compensation rates. Counsel added there is also mention in the documentationthat Mr, Jones may have signed an agreement with BART for the red-circle compensation ratein lieu of the pension benefit.

Counsel stated she would work with staff on a response letter to Mr. Jones'inquiry regardingpension benefits and theBoard's conclusions in the case.

L. Discussion of/or Action on Retirement Issues Pertaining to Terminated Employee transferredFrom AFSCME to ATU Due to the Reduction in Force

Jim reported issues have arisen in calculating retirement for an employee who transferredback and forth between ATU and AFSCME positions at the District, such as how to determinehis status upon termination, ATU or AFSCME?; if an AFSCME retiree, can he wait to draw hispension at age 60?; and is calculating his pension benefit at the time the benefit was earnedcorrect? Member Zook stated the real question was how the employee was classified in theswitch from AFSCME to ATU. She stated any agreement made was made without the consentor knowledge of ATU, She suggested staff contact the HR Manager to see if the employeewas "re-hired" or "reinstated,"

Staff will talk with the District and discuss the issue at the October meeting with the Board.

TheDistrict is the Plan Sponsor and would be making a decision on pension obligation bonds; theRetirement Board invests the funds.

3) Update on the Retirement Incentive Payments to Terminated Employees

Hugo repofted the Retirement Department has received numerous calls regarding retirementincentive payments that the retirees have not yet received. Hugo contacted the HRDepartment, and separate checks are expected to be mailed out this month.

4) Dates for the October and November Board Meetings

October 13,2003 and November L7,2003.
