INSTRUCTIONS
1. The application and fee, made payable to the City of Greenville, must be submitted to the planning and development office during normal business hours.
2. The applicant/owner must respond to the 'standards" questions on page 2 of this application (you must answer "why" you believe the application meets the tests for the granting of a conditional use). See also Section 19-2.3.6, Conditional Use Permit, for additional information. You may attach a separate sheet addressing these questions.
3. For conditional use requests for nightclubs/bars, event venues, or businesses operating after midnight, the applicant must also submit the Zoninq Compliance Application for Establishments Servinq Beer, Wine, or Liquor.

4 You must attach a scaled drawing of the property that reflects, at a minimum the following: (a) property lines existing buildings, and other relevant site improvements: (b) the nature (and dimensions) of the proposed development (activity): (C) existing buildings and other relevant site improvements on adjacent properties: and. 6. The administrator will review the application for "sufficiency" pursuant to Section 19-2.2.6, Determination of Sufficiency, prior to routing the application for staff review. If the application is determined to be 'insufficient", the administrator will contact the applicant to request that the applicant resolve the deficiencies. You are encouraged to schedule an application conference with a planner, who will review your application for "sufficiency" at the time it is submitted. Application for Conditional Use Acuarius Nightclub
Applicant Response
1. This existing business complies with the standards and goals of the Land Management ordinance in the following ways:
- It is not near any residential areas. - There are no drive-thru facilities.
Any exterior amplified music is buffered by the building and the hill leading up to the city airport, and since there are no residential areas anywhere near the business, no one is disturbed.
- There is enough parking so that people parking in off-road or other extra legal spots is not an issue.
- The occupancy numbers have already been set by the City.
Note: Most of the requirements in Section 19 of the Land Management Ordinance pertain to new construction, particularly Section 19-6.5, and thus is not applicable to this review.
2. Infrastructure is adequate to serve this existing business. Specifically: - Pleasantburg Drive is six lanes here, which is more than enough to
handle traffic. - The sewer capacity has been reviewed and approved. (See attached.) - Potable water availability has not been an issue, and since the
occupancy is not changing this should not either. - There is no evidence that fire, police and emergency facilities have
been inadequate to the need.

Zoning Compliance Application, Description of "Proposed" Use
Operating Plan.
1. This is a nightclub. 2. It is open on Saturday night from 7 pm until 3 am. 3. There are generally (pre-Covid) 16 employees: 3 waitresses, 4 bar
tenders, 5 security, 2 DJs, the Owner, and a "lighting guy." 4. Kitchen equipment includes a refrigerator, 2 food warmers, 1 toaster
oven, 1 microwave, 1 prep table, a 3-compartment sink, a freezer and a lavatory.
5. The menu includes: corn dogs, wings, small pizzas, quesadillas and hot dogs.
6. There is plenty of parking out in front of the shopping center. 7. The designated smoking area is on the back patio. 8. The DJ plays music for dancing during the hours the club is open. 9. At 1:45 am the DJ announces last call for alcoholic beverages. (Right
now, because of Covid, it is 11:00.)
Security Procedures.
There are generally 5 security people on duty. One is an off-duty Greenville police officer who remains in his squad car in the parking lot.

3. The entry fee is $10.00. 4. Acuarius has a business license. 5. Acuarius has a DHEC permit and has a Grade A rating. 6. Acuarius has an Abl-901 permit with the Department of Revenue. 7. Acuarius already has a liquor license. The SLED requirements were
met when it was obtained.

1. Describe the ways in which the proposed use is consistent with the comprehensive plan.
This business is not inconsistent with any of the principles of the comprehensive plan. On the
positive side, it adds variety to an area that is primarily retail but that also includes business
and restaurants. [Encourage a mixture of uses.'] It certainly respects the heritage and culture
of the Hispanic/Latino part of the community. And the business hires people wtih a good skills mix.
2. Describe the ways in which the request is appropriate for its location and is compatible with the
character of existing and permitted uses of surrounding lands and will not reduce the property values
thereof.
This is an excellent location for this type of business as there are no residential areas anywhere
near it. It is a part of ant existing strip shopping center and it blends in with its surroundings.
3. Describe the ways in which the request will minimize adverse effects on adjacent lands including: visual
impacts; service delivery; parking and loading; odors; noise; glare; and, vibration. Describe the ways in
which the request will not create a nuisance.
The impact of this business on its neighbors is and will be minimal. It is open when all of the
businesses are closed thus any visual, noise or parking issues, if there are any, will not be
noticed. People patronize this business to have a good time: there is enough security to contain any
possible disruptions.
Meet With the Technical Advisory Committee Applications for Zoning Compliance will be reviewed by the Technical Advisory Committee (TAC), a City
Staff committee comprised of representatives from the following City Departments and appointed by
the City Manager:
Building Codes and Inspections Police
Business Licensing Fire
Economic Development Planning
Public Information and Events Legal
The Technical Advisory Committee convenes once-a-month to meet with Applicants and review
Conditional Use Permit applications that may be granted by the Zoning Administrator. This process
promotes a more comprehensive understanding of the Applicant's proposal, which in turn conveys a
more comprehensive understanding of the multiple Departments' operating requirements and
expectations.
The Applicant, Business Owner, and Property Owner (if different) are required to attend a regularly
scheduled TAC meeting prior to granting a Conditional Use Permit. Managers and anyone involved in
operating the business are also encouraged to attend. The meeting date, time, and exact location
within City Hall will be confirmed upon submittal of this application to the Planning and Development
office on the 5th floor of City Hall.
